>> I DON'T HAVE ANYTHING FURTHER, MA'AM.

>> OKAY. >> ANYTHING FURTHER FROM ANYBODY? IS ANYONE HERE ON BEHALF OF JOSEPH SCOTT OF STILL WATER HOMES?

>> NO, MA'AM. >> I'M SORRY ABOUT WHAT HAPPENED

[00:10:07]

TO YOU. >> THANK YOU.

>> YEAH. >> UNFORTUNATELY, IT HAPPENS A LOT, ESPECIALLY NOWADAYS. WE SEE IT ALMOST EVERY MONTH.

THESE PEOPLE HOLD THEMSELVES OUT TO BE LICENSED.

THEY ARE NOT. AND PARTIES END UP IN THE SAME POSITION YOU'RE IN RIGHT NOW. SO I THINK THE CITY TRIES TO CRACK DOWN ON THEM. AND THANK YOU FOR COMING

FORWARD. >> THANK YOU.

>> IT'LL PROBABLY PREVENT SOMEBODY ELSE FROM GOING THROUGH THE SAME THING YOU'VE GONE THROUGH.

>> THAT'S WHAT WE'RE HOPING. THANK YOU.

>> THANK YOU FOR COMING. ALL RIGHT, BASED ON THE TESTIMONY AND EVIDENCE ADMITTED, I FIND THE VIOLATION EXISTS AND JOSEPH SCOTT AND/OR STILL WATER HOMES IS RESPONSIBLE FOR THE VIOLATION, NEVERTHELESS. HE WILL BE ASSESSED A FINE IN THE AMOUNT OF $500 FOR BEING AN UNLICENSED CONTRACTOR IN FORT PIERCE, ST. LUCIE COUNTY, WHEREVER HE PRACTICES.

THE CITATION IS BEING FORWARDED TO THE COUNTY COURT SYSTEM WHERE HE COULD INCUR ADDITIONAL COSTS AND HE HAS 30 DAYS TO APPEAL.

THANK YOU, GOOD LUCK. >> THANK YOU, THANK YOU.

[G. 20-888 1004 Texas Court Saeed, Ghazanfar Afzal, Mohammad Cris Bossano ]

>> THE NEXT CASE IS 5G 20-888, 1004 TEXAS COURT, GHAZANFAR SAEED AND MOHAMMAD AFZAL ARE THE OWNERS.

>> GOOD MORNING. >> GOOD MORNING.

>> GOOD MORNING.

>> JUST TO SAVE TIME, I SPOKE TO HIM ABOUT THE CASE JUST TO SAVE TIME BECAUSE MY MOTHER IS SICK. SHE IS 90 YEARS OLD.

SHE'S ON OXYGEN. HE HAS GRACIOUSLY AGREED TO GIVE ME TIME BECAUSE AND I HAVE SOME LIMITATIONS. FIRST IT WAS THEN IT WAS EVICTION BAN. YES, MA'AM.

>> STATE YOUR NAME FOR THE RECORD.

>> GHAZANFAR SAEED. >> THANK YOU.

GO AHEAD. >> SOME KIND OF COMPLY WITH ON MY BEHALF BECAUSE TENANT WHO WAS THINKING HE WAS THE TENANT OWNED OCCUPIED SITUATION, AS A STEADY HOME FOR HIS SON BECAUSE THEY WERE STAYING HOME.

BUT I WILL TAKE CARE OF THAT. I SPOKE TO THE CONTRACTOR AND HE JUST LIT IT BACK UP. I'M REQUESTING THE SPECIAL MAGISTRATE GIVE ME TIME SO WE CAN REALLY GET IT RESOLVED.

>> MR. COSS. >> MISS MAGISTRATE, STAFF WOULD RESPECTFULLY REQUEST WE READ THIS CASE INTO THE RECORD TO DETERMINE IF A VIOLATION EXISTS. OUR CASELOAD IS QUICKLY GROWING SO I DON'T WANT TO POSTPONE ANY CASES THAT THERE'S NO NEED TO DO

SO. >> OKAY.

MR. BOSSANO. >> APRIL 1, 2020, THE OWNER IS

-- >> GHAZANFAR SAEED, GHAZANFAR

SAEED. >> GHAZANFAR SAEED.

THE SECTION IS TO BEGIN BUILDING INCLUDE BUILDING ANY PLUMBING, MECHANICAL OR ELECTRIC WORK THEY'VE DONE.

>> AND AT THIS MOMENT, THERE'S NO PLUMBING INVOLVED, THERE'S NO KIND OF MECHANICAL ISSUE INVOLVED, AND THE STRUCTURE JUST

[00:15:02]

NEEDS A LITTLE AND THE CONTRACTOR IS WORKING ON THAT BECAUSE EVERYTHING IS BACKED UP BECAUSE OF THE COVID-19.

AND I'M WELL AWARE OF THAT. I'VE DONE ACCORDINGLY.

I'M ON THE CASE BECAUSE I'M NOT TRUSTING THE RENT TO OWN TENANT BECAUSE I WAS UNDER THE IMPRESSION HE WAS WORKING ON, THAT GET IT RESOLVED, BUT NO, I HAD TO PICK IT UP MYSELF.

THAT'S WHY I'M REQUESTING HONORABLE GIVE ME TIME TO GET THE PERMIT AND GET IT OVER WITH.

>> OKAY.

ANYTHING FURTHER? ANYTHING FURTHER?

>> YES. I HAD A QUESTION, THE SAME THING. HE HAS GRACIOUSLY GIVEN ME 60 DAYS BECAUSE EVERYTHING IS BACKED UP.

EVERYBODY IS HAS TO COME AND A THEY HAVE TO REALLY DRAW THE PLAN AND JUST STAMP IT, THEN GO THROUGH THE CONTRACTOR AND YOU PLEASE, GIVE ME THAT 60 DAYS.

IT'LL BE DONE WITH, YES, MA'AM. >> OKAY, ALL RIGHT.

THEN BASED ON THE TESTIMONY OF THE PARTIES, I FIND THAT A VIOLATION EXISTS AT 1004 TEXAS COURT AND THAT GHAZANFAR SAEED IS RESPONSIBLE, IS ONE OF THE RESPONSIBLE PARTIES.

I WILL GIVE YOU 60 DAYS TO OBTAIN A PERMIT.

>> THANK YOU. >> ONCE YOU PULL THAT PERMIT, YOU HAVE 180 DAYS TO COMPLETE THE JOB.

NOW, IF YOU RUN INTO ANY DIFFICULTIES OR PROBLEMS DURING THAT 180-DAY PERIOD, PLEASE GET IN TOUCH WITH MR. BOSSANO.

>> DEFINITELY I WILL. >> AND THEY CAN HELP YOU OUT

WITH THAT. >> THANK YOU SO MUCH.

>> BUT YOU'VE GOT TO PULL THE PERMIT, OBTAIN THE PERMIT FOR ALL REQUIRED INSPECTIONS AT LEAST 180 DAYS AND CURE ALL OVER INVITATIONS DESCRIBED IN THE ORDER NOT REQUIRING A PERMIT OR A FINE OF $100 PER DAY WILL BE ASSESSED.

YOU HAVE 180 DAYS. >> IT WILL BE DONE WAY BEFORE

THAT, I ASSURE THAT. >> YOU'VE GOT TO PULL THE PERMIT

IN 60 DAYS. >> IT'S A TEDIOUS PROCESS BECAUSE EVERYBODY IS BACKED UP. THEY'RE WORKING FROM HOME.

THEY HESITATE TO COME OUT BECAUSE OF COVID-19.

AND HE WILL COME OUT WITH THOSE PROTECTIONS AND WE'LL

>> MAKE SURE HE OR SHE IS LICENSED.

>> DEFINITELY. THANK YOU SO MUCH AND IT WILL BE DONE WITHIN THE TIMEFRAME, REALLY SHORT PERIOD OF TIME.

>> OKAY, THANK YOU. >> THANK YOU SO MUCH.

>> GOOD LUCK. >> THANKS.

>> ARE WE READY, MA'AM CLERK? >> NEXT CASE IS 1109 AVENUE E.

[L. 20-1111 1109 Avenue E Vaner, Mosne Frank Remling]

MOSNE VANER IS THE OWNER. >> WHEN YOU'RE READY.

>> YES, MA'AM. MY NAME IS FRANK REMLING.

I'M A BUILDING INSPECTOR FOR THE CITY OF FORT PIERCE.

THIS IS CASE 20-1111, 1109 AVENUE E VANER MOSNE.

AND THE CASE INITIATED MAY 5TH, 2020.

THE OWNER IS MOSNE VANER, PO BOX 6211, MIAMI BEACH, FLORIDA 33141. THE VIOLATIONS ARE 504.3 PLUMBING SYSTEM HADS, 506.2 SANITARY DRAIN SYSTEM MAINTENANCE, 304.7 ROOF AND DRAINAGE.

305.3 INTERIOR SURFACE. THE ACTIONS ARE MAKE NECESSARY PLUMBING REPAIRS TO SEWER SYSTEM THAT IS CLOGGED AND CAUSING SEWAGE TO BACK UP. REPAIR/REPLACE ROOF THAT IS LEAKING. RARE WALLS AND CEILING THAT IS DAMAGED BY WATER INTRUSION IN THE LIVING ROOM.

I HAVE PICTURES. >> DID YOU TAKE THE PICTURES?

>> YES, MA'AM. >> THANK YOU.

WHILE HE'S DOING THAT, DO THE PICTURES FAIRLY AND ACCURATELY

[00:20:04]

DEPICT WHAT YOU SAW? >> YES.

>> OKAY. SO AT THIS TIME WE WOULD MOVE THE PHOTOS IN AS CITY'S 1 COMPOSITE.

>> IT WILL B ADMITTED AS CITY'S COMPOSITE 1.

DO YOU HAVE ANY QUESTIONS, COUNSELOR?

>> IS THERE ANYTHING THAT YOU WANT TO SAY ABOUT THE PHOTOGRAPHS? NO?

>> NO. PRETTY BAD STUFF.

>> MR. REMLING, HOW DID THIS COME TO THE ATTENTION OF CODE,

BUILDING DEPARTMENT? >> I WAS CALLED AND ISSUED THE

CASE. >> WAS ANYBODY --

>> FROM A COMPLAINT FROM A PERSON THAT WAS OCCUPYING THIS.

>> THERE WAS SOMEBODY LIVING HERE?

>> YES. >> WERE THERE CHILDREN, DO YOU

KNOW? >> I THINK THERE WAS, YES, MA'AM. I BELIEVE THEY COULDN'T TAKE A BATH IN THE BATHTUB IS WHAT THEY WERE TELLING ME WHEN I WAS

THERE. >> OKAY, THANK YOU.

SIR, WOULD YOU RAISE YOUR RIGHT HAND? I'M SORRY. YOU WERE ALREADY SWORN, WEREN'T YOU? OKAY, STATE YOUR NAME.

>>

-- >> PROPERTY MANAGER.

>> AND HOW DO YOU RESPOND TO THESE ALLEGATIONS?

>> WE GOT A CALL FROM THE TENANT AND WE RESOLVED THE ISSUE.

WE CALLED A PLUMBING COMPANY. THERE WAS A CLOG IN THE SEWER LINE. IT WAS CLEANED.

WE CLEANED THE HOUSE. AND I THINK THE NEXT -- LAST WEEK WE CALLED THE INSPECTOR TO INSPECT THE HOUSE.

AND THEY WENT BY TO INSPECT IT. THE PLUMBING HAS BEEN FIXED FOR A FEW MONTHS ALREADY. AND THE ROOF -- THE SECOND ITEM WAS THE ROOF. AND THAT HAS BEEN REPAIRED.

AS A MATTER OF FACT, WE FINISHED YESTERDAY.

YEAH. THIS PARTICULAR PICTURE HAS BEEN REPAIRED AND THE INSIDE AS WELL. I'VE BEEN TALKING TO ELIZABETH

IN RESPECT TO THIS MATTER. >> IS THERE STILL A TENANT IN

THE BUILDING? >> YEAH.

>> HOW LONG HAS THAT TENANT LIVED THERE?

>> TWO YEARS. >> AND THERE ARE CHILDREN AT THIS RESIDENCE? YOU DON'T GO OUT PERIODICALLY AS

PART OF YOUR RESPONSIBILITY? >> YES, I DO.

>> AND YOU NEVER SAW THIS SITUATION?

>> YES, I DID. I SPOKE WITH THEM.

AS A MATTER OF FACT, WE HAD THE BIGGEST PROBLEM IS THAT WE CLEANED THE LINE SEVERAL TIMES. AND WE FIND TOYS, THINGS IN THE LINE THAT CLOGGED UP THE SYSTEM. BUT WE DID CLEAN THE LINE LAST TIME AND WE ASKED THEM TO TRY NOT TO THROW TOYS INSIDE THE TOILET. BUT THE SITUATION HAS BEEN CORR CORRECTED.

>> EXCUSE ME. IT GOT CORRECTED AFTER THEY COMPLAINED TO BUILDING. THAT'S HOW IT GOT CORRECTED.

I DON'T SEE WHERE YOU GUYS DID ANYTHING TO CORRECT THIS SITUATION. AND WHAT I FIND TROUBLESOME IN CASES LIKE THIS WITH THESE TYPE OF PHOTOGRAPHS, I ALWAYS ASK, WOULD YOU LIVE THERE? WOULD YOU LET YOUR CHILDREN AND GRANDCHILDREN LIVE IN A PLACE LIKE THIS?

>> I AGREE 100%. >> I DON'T UNDERSTAND THAT.

AND YOU COLLECT RENT. >> YEAH.

>> ANYTHING FURTHER? >> CAN I JUST INQUIRE, IF THERE

HAVE BEEN ANY REINSPECTIONS? >> I DID GO THERE LAST WEEK AND THE TENANT WAS SATISFIED WITH THE PLUMBING ISSUE.

IT WAS JUST THE ROOF THAT WAS STILL LEAKING.

>> OKAY. SO THE RESPONDENT HAS INDICATED THAT SOME ADDITIONAL REPAIRS WERE MADE TO THE ROOF.

HAVE YOU BEEN ABLE TO VERIFY THAT? OKAY. SO AS FAR AS THE CORRECTIVE ACTIONS THAT YOU'RE REQUESTING, CAN YOU BE SPECIFIC AS TO WHAT

YOU'RE ASKING FOR THIS MORNING? >> THE PLUMBING IS GOOD.

I REINSPECTED THAT. I WOULD LIKE TO GO OUT AND LOOK AT THE ROOF AND MAKE SURE IT'S NOT COMING IN THE HOUSE AND IT'S

PROPERLY REPAIRED. >> IT IS, YEAH.

>> THAT'S ITEMS 2 AND 3 BECAUSE I PRESUME THE WALLS ARE RELATED

TO THE REPAIRS TO THE ROOF. >> YES.

>> OKAY. >> AND YOU SAID THAT THE ROOF

WAS DONE YESTERDAY? >> IT WAS FINISHED YESTERDAY, YES, MA'AM. I TRIED TO DO IT LAST WEEK, BUT

[00:25:06]

WE COULDN'T DO BETWEEN THE TENANT AND THE WORKERS.

THEY COULDN'T AGREE TO A TIME. SO THEY FINISHED YESTERDAY.

>> AND THE OWNER HERE LIVES ON MIAMI BEACH, ACCORDING TO --

>> I'M SORRY? >> THE OWNER LIVES IN MIAMI,

MIAMI BEACH? >> OH, THE OWNER LIVES OUT OF THE COUNTRY. I HAPPEN TO LIVE IN MIAMI BEACH.

>> OKAY. ANYTHING FURTHER?

>> NO, MA'AM. >> ALL RIGHT.

BASED ON THE EVIDENCE AND TESTIMONY PRESENTED, I FIND THAT AS TO THE CORRECTIVE ACTIONS AND REGARDING THE VIOLATIONS, THE PLUMBING SYSTEM HAS BEEN CURED AS OF TODAY'S DATE.

YOU SAID YOU DID THE ROOF YESTERDAY.

>> YES, MA'AM. >> THE DAY BEFORE THIS HEARING.

>> MM-HM. >> SO I DO FIND THAT A VIOLATION EXISTS REGARDING THE ROOF THAT'S LEAKING AND THE WALLS AND CEILINGS DAMAGED BY THE WATER INTRUSION IN THE LIVING ROOM AND CARPET. I'LL GIVE YOU 60 DAYS TO OBTAIN A PERMIT AND DO WHATEVER YOU NEED TO DO, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED AND COMPLY WITH OTHER PERMIT.

YOU HAVE 30 DAYS TO APPEAL. >> I COULD REQUEST FOR PERMIT

TOMORROW IF -- >> THEY WILL HELP YOU.

>> OKAY. THANK YOU VERY MUCH.

>> YOU'RE WELCOME.

[O. 20-1370 702 N 15th Street (Front Unit) B & B Business Mgmt Services Inc Frank Remling]

>> THE NEXT CASE IS 5020-1370, THE ADDRESS IS 702 15TH STREET FRONT UNIT. B & B BUSINESS MANAGEMENT

SERVICES INC. IS THE OWNER. >> GOOD MORNING.

>> HELLO, GOOD MORNING. WHEN YOU'RE READY, MR. REMLING.

>> THIS IS CASE NUMBER 20. MY NAME IS FRANK REMLING.

THE CASE NUMBER IS 201370, 702 NORTH 15TH STREET, B & B BUSINESS MANAGEMENT SERVICES. THE CASE INITIATED IN JUNE 10, 2020. THE OWNER IS B & B BUSINESS MANAGEMENT SERVICES INCORPORATED, PO BOX 4205 FORT PIERCE, FLORIDA 34948. THE VIOLATIONS ARE 309.1 INFESTATION, 304.13 WITNESS STANDS, DOORS, AND FRAMES, 304.7 ROOFS AND DRAINAGE, 305.3 INTERIOR SURFACES.

AND CORRECTIVE ACTIONS WERE TREAT PROPERLY FOR INFESTATION OF RATS AND ANY OTHER PESTS, REPAIR/REPLACE WINDOWS THAT ARE NOT WORKING AND ROOF THAT IS LEAKING, MAKE REPAIRS TO CEILING WHERE THERE WAS WATER INTRUSION. AND I DO HAVE SOME PICTURES.

>> WILL YOU GO AHEAD AND SHOW THEM TO THE RESPONDENT FIRST PLEASE? DID YOU TAKE THE PICTURES? AND DID THEY FAIRLY AND ACCURATELY DEPICT WHAT YOU SAW?

>> YES, MA'AM. >> OKAY, THANK YOU.

AT THIS TIME WE WOULD MOVE THE PHOTOS IN AS CITY'S 1 COMPOSITE.

>> THEY WILL BE ADMITTED AS SUCH.

>> IS TH WANT TO SAY ABOUT THE PHOTOS?

>> NO. IT PRETTY MUCH SHOWS THE LEAK AND THE RAT INFESTATION AND STUFF ON THE PICTURES.

AND THAT IS IT. >> ALL RIGHT, THANK YOU.

>> YES, MA'AM. >> ALL RIGHT.

AND JUST STATE YOUR NAME. >> RANDOLPH WALTON.

>> AND HOW DO YOU RESPOND TO THIS?

>> THAT THE TENANT DELIBERATELY DID THESE THINGS.

[00:30:01]

I DO HAVE MY RESPONSE FROM THE PEST CONTROL LICENSE GUY.

>> I'M SORRY, SPECIAL MAGISTRATE.

I BELIEVE MS. WALTON CAME IN LATE AND SHE WAS NOT SWORN IN.

>> OH, OKAY. >> CAN YOU RAISE YOUR RIGHT HAND AND STATE YOUR NAME FOR THE RECORD?

>> BRENDA WALTON. >> TO YOU SWEAR THE TESTIMONY YOU'RE ABOUT TO GIVE WILL BE THE TRUTH?

>> I HAD A TENANT THAT POKED THE HOLE IN THE CEILING AND HE DID THE DAMAGE BUT I HAD THE HOUSE TREATED BY A LICENSED PEST CONTROL GUY. I'VE HAD ALL THOSE THINGS CORRECTED. I WAS SUPPOSED TO GET BACK TO GET AN INSPECTION BUT MY BROTHER'S SON WAS KILLED YESTERDAY, SO I WASN'T ABLE TO GET BACK IN TOUCH WITH FRANK TO SEE THE PLACE YESTERDAY. SO I JUST SHOWED UP TODAY.

BUT EVERYTHING HAS BEEN CORRECTED.

I HAVE THE PEST CONTROL LICENSE GUY STUFF.

ALL THE OTHER STUFF HAS BEEN TAKEN CARE OF.

I HAVE INDICATION TO SHOW DURING THAT PERIOD THAT THE TENANT DID NOT HAVE THE I'VE GOT IT ALL, 13 BOUNCED CHECKS AS A RESULT OF IT.

BUT THE REPAIRS ITSELF HAS BEEN TAKEN CARE OF NOW AND THE TENANT

HAS BEEN EVICTED. >> ANYTHING FURTHER FROM EITHER

PARTY? >> NO, MA'AM.

>> HOW DID THIS COME TO BUILDING?

>> COMPLAINT. >> FROM THE TENANT?

>> YES. >> AND I HAVE BEEN IN TOUCH WITH MS. BRENDA AND IT JUST DIDN'T WORK OUT WHEN I COULD GET OUT THERE. WE TALKED ABOUT GETTING AN INSPECTION BUT WE NEVER COULD GET TOGETHER AND I COULDN'T LOOK

AT ANYTHING. >> I'M JUST HAVING PROBLEMS WITH PEOPLE CALLING FOR INSPECTIONS THE DAY BEFORE THE HEARING.

>> YES, MA'AM. >> I UNDERSTAND LIFE HAPPENS, BUT THIS WAS INITIATED JUNE 10TH.

WE'RE TALKING FIFVE MONTHS. >> MM-HM.

>> AND I'M NOT TRYING TO TELL YOU HOW TO RUN YOUR BUSINESS, BUT IF SOMEBODY WROTE ME TWO BAD CHECKS, I WOULDN'T BE TRYING TO EVICT THEM. I WOULDN'T WAIT ON 13 BAD

CHECKS. >> IT WASN'T 13.

HE DID IT TWICE WITHIN THE SAME MONTH.

AND I TRIED TO CALL AND I LEFT MESSAGES BUT I THINK IT WAS DURING THE COVID AND SO THEY MESSAGES FOR BOTH OF THESE TWO. SO IT WASN'T JUST THE DAY BEFORE. SO I REALIZED IT WAS TIME FOR THE INSPECTION AND THAT'S WHEN I CALLED.

AND I CALLED LAST WEEK, TOO. SO I WAS JUST ABLE TO GET TO HIM. AND YESTERDAY WAS THE PROBLEM.

>> AND I'M SORRY FOR YOUR LOSS. BUT ALL I HEAR IS COVID, COVID, COVID. I WORK EVERY DAY WITH COVID.

WE LIVE EVERY DAY WITH COVID. COVID IS HERE UNTIL PEOPLE START DOING WHAT THEY NEED TO DO TO PROTECT THEMSELVES AND OTHERS.

COVID IS GOING TO BE HERE.

I AM JUST APPALLED WHEN I SEE PICTURES LIKE THIS WITH PEOPLE LIVING IN THESE KINDS OF CONDITIONS.

I DON'T CARE, YOU CAN BE THE WORST PERSON IN THE WORLD, BUT NOBODY SHOULD PAY RENT TO ANYBODY AND HAVE TO DEAL WITH

THIS BECAUSE WE DON'T. >> BUT THEY WEREN'T LIVING HERE WHEN HE DID THAT. THEY JUST LEFT THEIR STUFF THERE AND CALLED CODE. THEY WEREN'T LIVING IN THERE.

>> BUT YOU'RE RESPONSIBLE FOR THE PROPERTY.

>> YES, I AM. >> ULTIMATELY.

AND I'VE SAID A HUNDRED TIMES WHEN PEOPLE COME IN HERE, IT'S THE TENANT, IT'S THE TENANT. BUT YOUR NAME IS ON THE

PROPERTY. >> MM-HM.

>> AND A LOT OF PLACES BEFORE THEY EVEN RENT TO YOU, THEY WANT REFERENCES. LET ME TALK TO YOUR PREVIOUS LANDLORD. TELL ME WHERE YOU'VE LIVED.

THERE ARE THINGS THAT SHOULD BE DONE TO AVOID THIS.

>> IT'S TRUE. >> ANYTHING FURTHER,

MR. REMLING? >> NO, MA'AM.

>> MS. WALTON. >> YES.

>> ALL RIGHT.

ALL RIGHT. BASED ON THE EVIDENCE AND TESTIMONY PRESENTED, YOU HAD THE PLACE TREATED FOR THE RATS AND

[00:35:02]

OTHER PESTS. >> MM-HM.

>> THAT VIOLATION EXISTED BUT HAS BEEN CURED AS OF THIS DATE ACCORDING TO THE TESTIMONY OF MS. BRENDA WALTON.

BUT REGARDING THE OTHER VIOLATIONS, I FIND THAT THE VIOLATION EXISTS. YOU'LL BE GIVEN 60 DAYS TO OBTAIN A PERMIT, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED, COMPLY .

YOU HAVE 30 DAYS TO APPEAL. >> OKAY.

>> NEXT CASE, MADAME CLERK. >> NEXT CASE IS 7A 18, CASE

[A. 18-2622 602 N 22nd Street CJBR N 22nd St LLC Shaun Coss]

NUMBER 18-2622. ADDRESS 602 NORTH 22ND STREET, CJBR NORTH 22ND LLC IS THE OW

OWNER. >> THIS IS CASE 18-2422, 602 NORTH 22ND STREET, 4977 NORTH STATE ROAD 7, LAUDERHILL, FLORIDA 3319. ANDRE BEIRUT.

VIOLATIONS ARE SECTION 5-1.105.1.

THIS ORDER CAME BEFORE YOU ON MARCH 20TH 2019.

ON MAY 20TH 2019 AN EX EXTENSION WAS GRANTED.

THIS MATTER WAS BROUGHT IN COMPLIANCE ON DECEMBER 10, 2019 AND THIS MATTER CAME BEFORE YOU DECEMBER 18TH FOR A REQUEST FOR A REDUCTION OF LIEN. I'M SORRY.

THAT WAS A REQUEST FOR A REDUCTION OF FINE AT THAT TIME.

AFTER NON-PAYMENT AFTER 180 DAYS FOR THE REDUCTION, THE FINE REVERTED BACK TO THE ORIGINAL AMOUNT OF $4,360 AND A LIEN WAS RECORDED ON AUGUST 4TH, 2020. AT THIS TIME, THE RESPONDENT HAS REQUESTED THE LIEN REDUCTION. THERE ARE SEVEN CRITERIA IN CONSIDERING THE REDUCTION. THE GRAVITY OR SERIOUSNESS OF THE VIOLATION IS MODERATE. ANY AND ALL ACTIONS TAKEN BY THE VIOLATOR TO CORRECT THE VIOLATIONS.

THE OWNER OBTAINED THE NECESSARY PERMITS AND RECEIVED THE NECESSARY INSPECTIONS BRINGING THE PROPERTY INTO COMPLIANCE.

THREE, THE LENGTH AND TIME NECESSARY TO BRING THE PROPERTY INTO COMPLIANCE WAS ONE YEAR, ONE MONTH.

FOUR, FIVE, THE NUMBER OF VIOLATION NOTICES THE VIOLATOR HAS RECEIVED IN THE PAST AS WELL AS THEIR NATURE AND FINAL DISPOSITION. TWO, BOTH CASES ARE NOW COMPLIANT. NUMBER 6, THERE SHALL EXTENUATING FACTORS SUCH AS UNAVOIDABLE PERSONAL HARDSHIP.

THE OWNER WAS UNAWARE THE FINAL INSPECTIONS WERE NOT OBTAINED BY THE CONTRACTOR. ONCE THE OWNER WAS AWARE, THEY WERE RENEWENED AND OBTAINED. ANY OTHER PROPERTY OWNED, THERE ARE NOT. THE ADMINISTRATIVE COST IS $1,651.22. STAFF LAST AGREED TO REDUCE THE FINES TO $575. HOWEVER, SINCE THIS IS NOW A LIEN, THERE IS A $250 FEE FOR THE CITY COMMISSION FROM THE LIEN REDUCTION AND ALSO THE ADDITIONAL HEARING WITH YOU THIS MORNING. STAFF'S RECOMMENDATION AT THIS TIME IS TO REDUCE THE FINE TO $925 TO COVER THOSE ADDITIONAL CO COSTS.

>> OKAY, ANYTHING FURTHER? >> NOT AT THIS TIME, THANK YOU.

>> AND, SIR, STATE YOUR NAME. >> ANDRE BARRETT.

>> AND YOUR RESPONSE TO THE REPRESENTATIONS MADE BY

MR. COSS? >> HE'S CORRECT IN EVERYTHING HE SAID. UNFORTUNATELY, DUE TO

[00:40:01]

CIRCUMSTANCES, WE LET THIS ONE SLIP BETWEEN THE CRACKS, ESPECIALLY WITH THE PANDEMIC. AND UNFORTUNATELY, IT IS WHAT IT IS AT THIS PARTICULAR POINT IN TIME.

>> WELL, THE QUESTION IS, ARE YOU AGREEING TO THE REDUCTION OFFERED BY THE CITY IN THE AMOUNT OF $925?

>> I WOULD LOVE TO AGREE TO THE ORIGINAL REDUCTION, IF THAT'S AT ALL POSSIBLE OR SOME DOLLAR AMOUNT BETWEEN THE PROPOSED AMOUNT AND WHAT WAS ORIGINALLY GRANTED.

>> WELL -- >> AND IT WAS UNFORTUNATE, AGAIN, DUE TO THE CIRCUMSTANCES. I KNOW YOU JUST SAID PREVIOUSLY THAT ALL YOU'RE HEARING IS COVID, COVID, COVID, BUT WITH THIS EXTENDED SHUTDOWN AND EVERYTHING THAT WAS GOING ON AROUND US, IT'S UNFORTUNATE THAT THIS HAD TO SLIP BETWEEN THE CRACKS FOR US. WE HAD EVERY INTENTION TO PAY AND PAY TIMELY AND AGAIN, UNFORTUNATELY, THAT DID NOT HAPPEN. THAT'S WHY WE'RE HERE AGAIN TODAY. SO I DO APOLOGIZE FOR THE TIME WASTED AND HOPEFULLY WE CAN, YOU KNOW, COME TO SOME DOLLAR AMOUNT THAT IS AGREEABLE BY ALL PAR

PARTIES. >> ALL RIGHT.

ANYTHING FURTHER?

>> NOT FROM ME. >> OKAY.

YOU KNOW, WHAT'S PUZZLING HERE IS THAT I REDUCED THE FINE OR SOMEBODY DID ON DECEMBER 17TH, 2019, LESS THAN A YEAR AGO, TO $575 TO BE PAID IN SIX MONTHS. AND ONE OF THE THINGS THAT I TELL PEOPLE IS THAT YOU HAVE TO COMPLY WITH THAT AGREEMENT.

IF NOT, THAT FINE WILL REVERT BACK TO THE ORIGINAL AMOUNT.

AND THAT'S WHAT HAPPENED HERE. NOW YOU'RE HERE AGAIN.

THE CITY HAS SAID, "OKAY, WE'LL AGREE TO $925." AND YOU WANT LESS THAT THAT. DURING THE SIX MONTHS THAT YOU WERE GIVEN TO PAY THIS $575, DID YOU EVER MAKE ANY ATTEMPTS TO CONTACT THE BUILDING DEPARTMENT TO TELL THEM SOMETHING WAS GOING

ON? >> NO, MA'AM.

AGAIN, WE DID HAVE EVERY SINGLE INTENTION TO PAY THE FINE.

I WAS VERY HAPPY WITH THE REDUCTION THAT YOU GUYS GRANTED WHEN WE WERE HERE BEFORE. AND UNFORTUNATELY, THIS ONE SLIPPED BETWEEN THE CRACKS. IT WOULD HAVE BEEN SOMETHING VERY SIMPLE FOR US TO DO. I TAKE FULL RESPONSIBILITY FOR THE PAYMENT NOT BEING MADE IN A TIMELY FASHION.

IT WAS OUR INTENTION TO PAY IT AND IT WAS A SIMPLE MISTAKE ON OUR PART. AND I DO TAKE RESPONSIBILITY FOR

EVERYTHING THAT TOOK PLACE. >> ALL RIGHT.

ANYTHING ELSE? >> NO, MA'AM, THANK YOU.

>> ALL RIGHT. THEN BASED ON THE TESTIMONY PRESENTED, I WILL REDUCE THIS FINE AGAIN, OKAY, TO $975.

NOW, $250 OF THAT AMOUNT GOES TOWARD ADMINISTRATIVE FEES.

>> THAT'S TO THE CITY COMMISSION FOR HEARING THE LIEN REDUCTION.

>> AND SO WHAT I DO HERE TODAY IN REDUCING IT TO $925, AND YOU NEED TO UNDERSTAND, IF YOU DON'T PAY IT -- WHATEVER I DO HERE, THERE'S A TWO-STEP PROCESS HERE. NUMBER ONE, MINE IS JUST A RECOMMENDATION TO THE CITY COMMISSION ONLY.

THEY HAVE FINAL SAY-SO IN THIS MATTER.

THAT'S WHERE THE $250 COME IN. THAT'S WHAT THE FEE IS TO GET IT UP TO THE CITY COMMISSION. AND THEY WILL DO WHATEVER.

YOU CAN APPEAR AND SOMEONE HERE WILL TELL YOU HOW THAT PROCEDURE WORKS WHEN WE'RE DONE HERE. BUT IT WILL GO TO THE CITY COMMISSION. AND THAT'S IT BECAUSE IT'S OVER $3,000, IT HAS TO GO BEFORE THE CITY AND THEY HAVE THE FINAL

[00:45:03]

SAY SAY-SO.

>> OKAY. SO JUST SO I'M CLEAR, THIS HAS A SECOND STEP TO GO THROUGH BEFORE THAT REDUCTION IS GRANTED?

>> YES. >> OKAY.

>> ANYTHING FURTHER? >> DOES YOUR ORDER HAVE THE REVERTING CLAUSE IF IT'S NOT PAID WITHIN A CERTAIN TIMEFRAME?

>> WE CAN DO THAT. WE'VE BEEN RELUCTANT TO DO IT SOMETIMES BECAUSE WE DON'T KNOW WHAT THE CITY WILL DO.

BUT WHATEVER THE CITY AGREES UPON, IF YOU DON'T PAY THAT MONEY WITHIN A CERTAIN PERIOD OF TIME OF TIME, IT WILL REVERT BACK TO THE ORIGINAL AMOUNT, WHICH HAS ALREADY HAPPENED IN THIS CASE. YOU UNDERSTAND THAT?

>> TOTALLY UNDERSTAND. AS SOON AS I RECEIVE A NOTIFICATION AS TO WHAT THE VICTORY IS, I'LL DEFINITELY MAKE SURE TO GET A PAYMENT IN THE MAIL ASAP.

>> WELL, THERE'S A PROCEDURE IF YOU WANT TO APPEAR BEFORE THE CITY COUNCIL TO ASK THEM FOR A FURTHER REDUCTION, YOU CAN DO

THAT. >> WHAT IF I WOULD JUST BE INTERESTED IN PAYING THE $900 THAT THE GENTLEMAN HAS PROPOSED AND GET THIS THING DONE WITH AND DON'T WASTE ANY ADDITIONAL TIME

ON IT? >> UNFORTUNATELY, THAT CAN'T BE DONE. THE FINAL DECISION HAS TO BE MADE BY THE CITY COMMISSION. THAT MEETING WILL BE HELD ON MONDAY, DECEMBER 21ST. AND THEY'LL MAKE THE FINAL

REDUCTION. >> IS THAT IF -- IS THAT SOMETHING THAT I WOULD HAVE TO APPEAR FOR OR IS IT --

>> UNLESS YOU WANT TO REQUEST A FURTHER REDUCTION AND THEN YOU WOULD NEED TO COME SPEAK DURING PUBLIC COMMENT.

>> OKAY. BUT IF NO NEED TO PERSONALLY

APPEAR FOR THAT? >> RIGHT.

YOU'RE NOT REQUIRED TO. >> WOULD IT BE IN MY BEST BREAST

TO APPEAR? >> THE ITEM IS SCHEDULED ON THE CONSENT AGENDA, SO TYPICALLY THOSE ITEMS ARE NOT PULLED UNLESS A COMMISSIONER HAS A PARTICULAR INTEREST IN THAT ITEM. SO IT MAY GET PASSED AS IT'S ON THE AGENDA OR IT MAY GET PULLED FOR DISCUSSION.

AND CERTAINLY, IF IT WAS PULLED FOR DISCUSSION, IT WOULD BE IN

YOUR BEST INTEREST TO BE HERE. >> WOULD I BE NOTIFIED IN ADVANCE OF IT BEING PULLED OR IS THAT SOMETHING THAT HAPPENS ON

THE DAY OF? >> CORRECT.

>> OKAY. AND YOU GUYS WILL SEND OUT A NOTIFICATION ON THIS MEETING AND THE DATE AND TIME?

>> YES. >> OKAY.

THANK YOU VERY MUCH. >> GOOD LUCK TO YOU.

>> HAVE A GREAT DAY. >> THANK YOU.

[A. 19-1181 1401 N 22nd Street Boston, Homer Shaun Coss]

>> AND THE NEXT CASE IS UNIQUE IN THAT WE HAVE TO CALL SOMEBODY

AND WE HAVE SOMEBODY PRESENT. >> OKAY.

>> FOR THE CASE. >> DO YOU WANT TO CALL THE PERSON FIRST OR DEAL WITH THE PERSON PRESENT?

>> THE PERSON I HAVE TO CALL WOULD LIKE TO HEAR THE WHOLE CASE. SO I'M GOING TO CALL HER FIRST.

IT'S CASE 6A, CASE 19-1181 S. I'LL BE CALLING MS. CORINTHA

PIERCE. >> GOOD MORNING.

>> HELLO. >> HI, MS. PIERCE.

>> HI. >> THIS IS ELIZABETH WITH THE CITY OF FORT PIERCE BUILDING DEPARTMENT.

>> MM-HM. >> YOU'RE ON AUDIO OF THIS SPECIAL MAGISTRATE HEARING AND THE NEXT VOICE YOU HEAR WILL BE

THE SPECIAL MAGISTRATE. >> OKAY, THANK YOU

>> GOOD MORNING. >> GOOD MORNING.

>> RAISE YOUR RIGHT HAND AND BE SWORN PLEASE.

>> YES. >> STATE YOUR NAME FOR THE

RECORD PLEASE. >> CORINTHIA PIERCE.

>> DO YOU SWEAR OR AFFIRM THAT THE TESTIMONY YOU'RE ABOUT TO

GIVE WILL BE THE TRUTH? >> YES.

>> AND THERE'S A GENTLEMAN HERE. WOULD YOU STATE YOUR NAME.

>> YES, MA'AM. I'M SEAN MORGAN OF JOHN GEORGE

[00:50:03]

AND ASSOCIATE CONTRACTORS. >> OKAY.

WHO WANTS TO DO THE PRESENTATION?

>> SPECIAL MAGISTRATE, AS YOU MAY RECALL, THE CASE ORIGINALLY CAME BEFORE YOU AS A MASSEY HEARING.

THE CASE IS 19-1181. THE PROPERTY IS OWNED BY HOMER BO BOSTON.

THIS MATTER CAME BEFORE YOU SEPTEMBER 17TH, 2019 IN AN ORDER DETERMINING VIOLATION WAS PROVIDED.

ON JANUARY 6TH, 2020 A 90 DAY EXTENSION WAS GRANTED AND ON APRIL 8TH, 2020, AFTER NO PERMITS OBTAINED, NO REINSPECTION BY THE OWNER, AN AFFIDAVIT OF NON-COMPLIANCE WAS ORDERED. WHEN THIS CASE FIRST CAME BEFORE YOU THE FINES TOTALLING $3,220 INCLUDING $30 OF RECORDING FEES STOPPED BY YOU AT THAT TIME. AS YOU MAY RECALL, MR. BOSTON HAS UNFORTUNATELY PASSED AWAY. MS. PIERCE HAS BEEN WORKING TO BRING THIS MATTER IN COMPLIANCE. TODAY IT'S HERE FOR A STATUS UPDATE. SO I WOULD LIKE TO HEAR A STATUS BEFORE STAFF MAKES A RECOMMENDATION.

>> OKAY. DO YOU WANT TO SPEAK, MS. PIERCE

OR MR. MORGAN? >> YES, MA'AM

>> WHO WANTS TO GO FIRST? >> HOW ABOUT IF I GO FIRST AND

MR. MORRIS CAN TAKE OVER? >> THAT'S FINE.

>> THANK YOU. LET ME THANK YOU, MAGISTRATE, AND THANK THE BUILDING DEPARTMENT AT FORT PIERCE FOR YOUR PATIENCE AND UNDERSTANDING DUE TO THE DEATH OF MY FATHER.

AND AS STATED, IT IS MY DESIRE TO COME IN TO COMPLIANCE.

SO THE LAST HEARING I HAD INDICATED THAT I WAS LOOKING FOR A CONTRACTOR AND HAD REACHED OUT TO MR. SEAN MORGAN WHO I ALSO WOULD LIKE TO THANK HIM FOR TAKING TIME OUT OF HIS BUSY SCHEDULE TO BE HERE. SO MR. MORGAN, I WILL TURN IT OVER TO YOU. AND THEN IF THERE ARE QUESTIONS,

I CAN ALSO ANSWER OR ADDRESS. >> ALL RIGHT, MR. MORGAN.

>> THANK YOU, MS. PIERCE. SPECIAL MAGISTRATE, WE WERE HIRED BY MS. PIERCE TO CORRECT THE LISTED VIOLATIONS ON THE PROPERTY. AS STATED, I SPOKE WITH MS. BECK AND ALSO MR. COSS. THERE WERE SOME WALLS AND WINDOWS AND DOORS ADDED AND WE AGREED TO RETURNING IT BACK TO A SINGLE-FAMILY HOME, BUT WE DON'T HAVE THE INITIAL PLANS OF WHAT WAS INITIALLY THERE. SO I SPOKE WITH MR. COSS AND WE MAY HAVE TO HIRE AN ARCHITECT TO COME IN AND DRAW UP NEW PLANS TO TRY TO GET MOST OF THESE WALLS TAKEN OUT OF VIOLATION.

I RECEIVED SOME OF THE DOCUMENTS OF THE WALLS, BUT WE DON'T KNOW THE INITIAL, WAS IT A 3.1, 3/2. WE DON'T KNOW WHICH ROOMS OR WHAT SIZE. ALL THE STRUCTURES HAVE TO BE INSIDE. WE JUST DON'T KNOW WHAT THEY DID INSIDE TO ADD ALL THESE ADDITIONAL ROOMS.

>> AND THAT'S WHERE YOU ARE RIGHT NOW WITH TRYING TO BRING

THIS PROPERTY INTO COMPLIANCE? >> YES, INTO COMPLIANCE.

>> YES. >> SO NOT IN COMPLIANCE.

HAVE WE -- HAVE YOU TALKED WITH MR. COSS LATELY TO TELL HIM ABOUT YOUR PROBLEMS OR SOMETHING FROM BUILDING?

>> I SPOKE WITH HIM BECAUSE I ASKED HIM ABOUT WHAT WAS THE ORIGINAL PLANS ON THE HOME. BUT HE SAID HE DIDN'T HAVE ANYTHING, REALLY, NO, IT'S ACTUALLY SEVEN ROOMS ON THE HOUSE NOW. SO WE DON'T KNOW IF IT WAS A 3/2, 3/1 BECAUSE WE DON'T HAVE THE ORIGINAL PLANS TO GET IT BACK TO THE ORIGINAL STRUCTURE, WHAT IT WAS DESIGNED.

SO THAT'S WHERE WE'RE GOING. WE ACTUALLY SPOKE TO AN ARCHITECT AND HE'S GOING TO GO WITH THE SQUARE FOOTAGE AND JUST TRY TO GET SOMETHING OUT AS FAR AS SQUARE FOOTAGE AND -- BECAUSE WE REALLY DON'T KNOW WHAT SIZE IT WAS.

[00:55:01]

WE DON'T KNOW IF IT WAS A THREE BEDROOM, FOUR BEDROOM.

WE DON'T REALLY KNOW. I HAVE NO EVIDENCE.

AND I'VE ASKED THE UPSTAIRS AND THEY DON'T HAVE THE -- ANY DRAWINGS OF WHAT THE SIZE WAS. IT JUST SAYS 3/1 ON THE COUNTY

COURT RECORDS, SO -- >> WELL, OKAY.

SO MR. COSS, WHERE ARE WE? >> SPECIAL MAGISTRATE, THE PURPOSE OF TODAY'S MEETING IS TO DETERMINE IF THE FINES SHOULD CONTINUE TO REMAIN STAYED AND ALLOW THEM ADDITIONAL TIME TO COMPLY. STAFF'S RECOMMENDATION WOULD BE TO CONTINUE THE STAY OF THE FINES FOR AN ADDITIONAL -- INSTEAD OF SAYING A NUMBER OF DAYS, LET ME LOOK AT THE CALENDAR FOR JANUARY. STAFF WOULD REQUEST THAT THIS MATTER COME BACK BEFORE YOU JANUARY 19TH, 2021.

IF THIS MATTER IS NOT IN COMPLIANCE PRIOR TO THAT DATE.

>> OKAY. AND MS. PIERCE.

>> YES. >> I KNOW YOU WERE TRYING TO GET THE PROBATE STARTED. WERE YOU ABLE TO DO THAT?

>> ACTUALLY, THE ATTORNEY, SHE DID OPEN UP THE ESTATE.

SO THERE IS NOW THE ESTATE OF HOMER BOSTON.

>> ALL RIGHT, THAT'S GOOD, OKAY. SO WE ARE MAKING SOME HEADWAY HERE. ALL RIGHT, MR. MORGAN, ARE YOU IN AGREEMENT AS STAY THE FINES UNTIL YOU CAN FIND OUT WHAT THE

3/1 REALLY IS ALL ABOUT? >> YES, MA'AM.

>> OKAY. THAT'S WHAT WE WILL DO.

>> OKAY. >> AND THANK YOU FOR COMING.

AND I WILL SEE YOU JANUARY 19TH, 2021, LORD WILLING.

>> THANK YOU. >> YOU'RE WELCOME.

>> THANK YOU, STAFF. >> THANK YOU.

>> GOOD LUCK. >> THANK YOU.

>> YOU'RE WELCOME. BYE.

>> BYE-BYE. >> OKAY.

[C. 20-826 1570 Thumb Point Dr Galloway, Alison Bridge, Brian Cris Bossano ]

OUR NEXT CASE IS ALSO A CALL-IN CASE.

IT'S CASE NUMBER 20-826, 1570 THUMB POINT DRIVE, ALISON GALLOWAY AND BRIAN BRIDGE ARE THE OWNERS.

>> HELLO, THIS IS BRIAN. >> HI, BRIAN, THIS IS ELIZABETH WITH THE CITY OF FORT PIERCE BUILDING DEPARTMENT.

>> HI, HOW ARE YOU, ELIZABETH? GOOD MORNING.

>> GOOD MORNING. YOU'RE IN AUDIO ATTENDANCE FOR THE SPECIAL MAGISTRATE HEARING FOR YOUR PROPERTY AT 1570 THUMB POINT DRIVE AND THE NEXT VOICE YOU HEAR WILL BE THE SPECIAL

MAGISTRATE. >> GOOD MORNING, MR. BRIDGE.

>> GOOD MORNING. >> WOULD YOU RAISE YOUR RIGHT HAND, STATE YOUR NAME AND BE SWORN.

>> >> BRIAN BRIDGE.

>> DO YOU SWEAR THE TESTIMONY YOU'RE ABOUT TO GIVE WILL BE THE

TRUTH? >> YES.

>> THANK YOU. >> OKAY, MR. BOSSANO.

>> GOOD MORNING. >> HEY, GOOD MORNING.

>> MY NAME IS CRIS BOSSANO. I'M THE BUILDING INSPECTOR FOR THE CITY OF FORT PIERCE. THE CASE IS 20-826, 1570 THUMB POINT DRIVE. THE OWNER IS ALISON GALLOWAY AND BRIAN BRIDGE. VIOLATION SECTION 5-1.105.1 PERMIT REQUIRED. CORRECTIVE ACTION, OBTAIN A PERMIT FOR THE ENCLOSING OF THE FIRST FLOOR AND THE ADDITION OF AN UPPER DECK AND TO THE SECOND FLOOR OVER THE POOL.

>> MR. BOSSANO, DID YOU TAKE ANY PICTURES?

>> YEAH, I TAKE A LOT OF PICTURES FROM THE JOB.

IT WAS BUILDING A ROOM IN THE SECOND FLOOR AND THEY'RE ENCLOSING SOMETHING IN THE FIRST FLOOR DOWN THE

>> OKAY. WERE THE RESPONDENTS PROVIDED A COPY OF THE PHOTOS IN ADVANCE OF THE HEARING?

>> NO. >> I HAVE NOT GOTTEN ANY PHOTOS.

>> SO SPECIAL MAGISTRATE, WE WOULD BE ASKED TO BE ABLE TO LAY

[01:00:02]

THE FOUNDATION NOW AND PERHAPS SUPPLEMENT THE RECORD AT A LATER

DATE IF NECESSARY. >> OKAY.

>> MR. BOSSANO, WE'RE NOT GOING TO PUT THE PHOTOS IN EVIDENCE AT THIS TIME. I'M GOING TO ASK WHETHER YOU

TOOK THE PHOTOS PERSONALLY. >> YES.

>> DID IT FAIRLY AND ACCURATELY DEPICT WHAT YOU SAW?

>> YES. >> OKAY.

CAN YOU HOLD ON TO THOSE? AFTER THE HEARING WE'LL SEND A COPY TO HAVE THE RESPONDENT AND IF NECESSARY WE'LL SUPPLEMENT THE RECORD. IS THERE ANYTHING ELSE YOU WANT TO TELL US ABOUT WHAT YOU OBSERVED?

>> I SPOKE TO HIM. HE SAID HE WAS GOING TO GET A PERMIT. SO I DON'T KNOW WHAT'S GOING ON.

>> OKAY. SO AT THIS TIME WE WOULD ASK THE RESPONDENTS TO TELL US WHERE THEY ARE IN THAT PROCESS.

>> YES. THIS ALL HAPPENED DURING THE BEGINNING STAGES OF THE -- A PANDEMIC.

AND I WAS PLANNING ON DOING A LITTLE SUNROOM THERE FOR THE WIFE OFF THE UPPER DECK. AND I'M NOT GOING TO BE ABLE TO DO IT NOW. SO WHAT I WANT TO DO WAS OBTAIN A DEMO PERMIT, A DEMOLITION PERMIT FOR THAT SUNROOM.

I WOULD REQUEST MAYBE 90 DAYS FOR ME TO OBTAIN THE PROPER PERMITS TO DEMO. THE PROBLEM THAT I'M RUNNING INTO IS FINANCIALLY RIGHT NOW AT THIS POINT.

SO I'M NOT GOING TO BE ABLE TO CONTINUE WITH ANY TYPE OF PROJECT. IS THAT POSSIBLE TO GET THE -- LIKE A CONTINUANCE ON IT FOR 90 DAYS SO I CAN GET THE PROPER

PERMIT? >> IS THAT WHAT YOU'RE

REQUESTING? >> YEAH, PLEASE.

AND I'LL GET IT RECONCILED. I DIDN'T WANT TO -- I DON'T WANT TO HAVE ANY PROBLEMS OR ISSUES WITH THE ESPECIALLY PERMIT-WISE. I DIDN'T REALIZE I NEEDED TO OBTAIN A PERMIT FOR THAT WHEN I DID IT.

AND I TOLD CRIS THAT I WAS GOING TO GET A PERMIT.

I'VE BEEN GOING BACK AND FORTH WITH THE BUILDERS THAT THE COSTS ARE JUST SO MUCH. I DID GET SOME ARCHITECTURAL DRAWINGS DONE FOR IT AND THAT'S ABOUT AS FAR AS I'VE GONE.

AND THAT IN ITSELF TOOK ALMOST THREE MONTHS TO GET.

SO I KNEW I NEEDED SOME ENGINEERING PLANS AND I DID HAVE THOSE DONE AND THEY WERE EXPENSIVE.

BUT I'M JUST NOT GOING TO CONTINUE.

THERE'S JUST NO WAY. WE'RE JUST BARELY HANGING ON NOW AND ABLE TO -- I'M IN THE FINANCE INDUSTRY AND I DO AUTO FINANCE AND IT'S -- WE'RE JUST HAVING SOME DEEP PROBLEMS NOW

FINANCIALLY. >> ALL RIGHT.

ANYTHING FURTHER? >> SPECIAL MAGISTRATE, STAFF WOULD REQUEST THAT IF YOU FIND THAT A VIOLATION EXISTS, THAT THE PROPERTY OWNER BE PROVIDED 90 DAYS TO OBTAIN THE PERMIT OR

FINED $100 PER DAY BE ASSESSED. >> OKAY.

DID YOU HEAR THAT MR. BRIDGE? >> YES, I DID.

THANK YOU VERY MUCH FOR THE LEEWAY THERE.

>> OKAY. >> CAN I GET THOSE DOCUMENTS THOUGH, THE PICTURES AND STUFF LIKE THAT, IF POSSIBLE?

>> YES. >> OKAY.

>> ANYTHING FURTHER? >> NO.

THANK YOU GUYS VERY MUCH. I APPRECIATE YOU ALLOWING ME TO

DO THIS VIA TELEPHONE. >> OH, YOU'RE WELCOME.

ALL RIGHT. BASED ON THE RECOMMENDATION OF THE CITY, I FIND THAT THE VIOLATION EXISTS AND THE TESTIMONY ALSO OF MR. BRIAN BRIDGE, I FIND THAT A VIOLATION EXISTS AND THAT ALISON GALLOWAY AND BRIAN BRIDGE ARE THE RESPONSIBLE PARTIES. YOU WILL BE GIVEN 90 DAYS TO OBTAIN WHATEVER PERMIT IT IS YOU'RE GOING TO PULL TO CORRECT THIS SITUATION, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED, CAN COMPLY WITH ALL OTHER PERMIT CONDITIONS AND CURE ALL OTHER VIOLATIONS DESCRIBED IN THE ORDER NOT REQUIRING A PERMIT OR A FINE OF $100 PER DAY WILL BE ASSESSED.

YOU HAVE 30 DAYS TO APPEAL THIS DECISION.

GOOD LUCK. >> OKAY, THANK YOU GUYS VERY

MUCH. >> YOU'RE WELCOME.

>> OKAY, THANKS. >> OKAY.

SO SINCE WE HAVE CRIS SITTING THERE STILL, WE'RE GOING TO DO

[D. 20-829 512 N 17th Street DSV SPV3 LLC Cris Bossano]

HIS RECALLED CASES FROM LAST MONTH.

THE FIRST ONE THERE IS 5D 20-829, 512 NORTH 17TH STREET

[01:05:08]

DSV SPV3 LLC IS THE OWNER. >> SO SPECIAL MAGISTRATE, THESE RECALLED CASES WERE CASES THAT WERE CALLED AT PREVIOUS HEARINGS DATES. NOTICE WAS GIVEN TO THE RESPONDENT. THE RESPONDENT FAILED TO APPEAR.

WE GAVE SOME LEEWAY BECAUSE OF THE ONGOING SITUATION WITH THE PANDEMIC. AND THESE CASES ARE NOW BEING RECALLED TODAY AGAIN. AND IT'S MY UNDERSTANDING THAT NOTICE HAS BEEN GIVEN AGAIN AND THAT WE HAVE NO RESPONDENTS PRESENT. WITH THAT SAID, WOULD IT BE OKAY IF I QUESTION THE WITNESS, THAT WAY WE GET ELEMENTS ON THE

RECORD? >> YES.

>> OKAY, THANK YOU. MR. BOSSANO, YOU WERE PREVIOUSLY

SWORN, CORRECT? >> YES.

>> WERE YOU SENT TO 20-829 AS THE INSPECTOR ON MARCH 24TH,

2020? >> YES.

>> AND IS THE ADDRESS 512 NORTH 17TH STREET?

>> YES. >> CAN YOU TELL US THE VIOLATION OF THE NATURE YOU OBSERVED WHEN YOU WENT TO INSPECT THE

PROPERTY? >> I WAS INSPECTING THE OTHER PROPERTY NEXT TO THE -- THIS ONE WHEN WE SAW THEY WAS WORKING ON THE ROOF WHEN THE ROOF

>> SO YOU SAW PEOPLE WORKING ON THE ROOF AND YOU DISCOVERED THAT THEY HAD NOT OBTAINED A PERMIT TO DO SO?

>> YES. >> OKAY.

AND THE VIOLATIONS LISTED ON THE AGENDA FOR THIS MORNING, ARE THOSE STILL THE VIOLATIONS THAT YOU'RE PROCEEDING WITH AT THIS

TIME? >> YEAH, THEY'RE STILL.

>> AND THE RECOMMENDATION ON THE AGENDA, IS THAT THE RECOMMENDATION THAT YOU'RE MAKING AT THIS TIME?

>> YES. >> DID YOU TAKE ANY PARAGHOTOGR?

>> YES. >> DO THEY ACCURATELY DEPICT

WHAT YOU SAW? >> YES.

>> DO YOU HAVE ANYTHING TO ADD TO THE PHOTOGRAPHS?

>> NO. >> NO FURTHER QUESTIONS.

>> OKAY. THERE'S NOT A -- I FIND THAT THERE'S NOT A REPRESENTATIVE HERE FOR DSV SPV3 LLC.

BASED ON THE TESTIMONY AND EVIDENCE PRESENTED, I FIND THAT A VIOLATION EXISTS, THAT THEY GET 60 DAYS TO OBTAIN A PERMIT, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED, COMPLY WITH ALL OTHER PERMIT CONDITIONS AND CURE OTHER VIOLATIONS DESCRIBED IN THE ORDER OR A FINE OF $100 PER DAY BE ASSESSED.

THEY HAVE 30 DAYS TO APPEAL. >> OKAY.

ANOTHER RECALLED CASE FOR CRIS, CASE NUMBER 20-830, 427 NORTH

[E. 20-830 427 N 15th Street Valsant, Zakari Cris Bossano]

15TH STREET. ZAKARI VALSANT IS THE OWNER.

>> OKAY, MR. BOSSANO, WERE YOU THE BUILDING INSPECTOR TO CASE

20-830? >> YES.

>> WERE YOU PREVIOUSLY SWORN THIS MORNING?

>> YES. >> WAS THAT ADDRESS 427 NORTH

15TH STREET? >> YES.

>> WAS THE CASE INITIATED ON MARCH 24TH, 2020?

>> CAN YOU TELL US THE NATURE OF THE VIOLATIONS?

>> THERE WAS A CALL FOR SOMEBODY WORKING.

I WAS TO CHECK THE HOUSE WHEN I SEE THEY WAS DOING SOME KIND OF WORK, THE CONSTRUCTION WORK INSIDE THEIR HOUSE WAS AND IN THE BACK OF THE HOUSE WAS NO OTHER CONDITION, THEY TOOK

THEIR CONDITION. >> OKAY.

SO YOU OBSERVED EVIDENCE OF SOMEONE DOING FRAMING WORK, ELECTRICAL WORK, REPLACING WINDOWS, PARTIAL INFILL AND

MECHANICAL WORK? >>

>> OKAY. DID YOU TAKE PHOTOGRAPHS OF WHAT

YOU SAW? >> I TOOK SOME.

>> OKAY. AND DO THE PHOTOGRAPHS FAIRLY AND ACCURATELY DEPICT WHAT YOU SAW THAT DAY?

>> YEAH. >> OKAY.

AND THEY SHOWED THE VIOLATIONS AS YOU OBSERVED THEM?

>> MM-HM. > OKAY.

AT THIS TIME, WE WOULD MOVE THE PHOTOGRAPHS IN AS CITY'S 1

COMPOSITE. >> THEY WILL BE ADMITTED AS SU SUCH.

>> IS THERE ANYTHING YOU WANT TO SAY ABOUT THE PHOTOGRAPHS?

[01:10:01]

>> NO. >> OKAY.

AND THE VIOLATIONS THAT ARE LISTED ON THE AGENDA THIS MORNING, ARE THEY STILL THE CORRECT ONES?

>> YES. >> AND THE RECOMMENDATIONS LISTED ON THE AGENDA THIS MORNING ARE THE RECOMMENDATIONS

YOU'RE MAKING? >> NEVER THE -- THEY'RE THE

SAME. >> MAGISTRATE, WE ASK THAT YOU WOULD FOLLOW THE RECOMMENDATIONS AS STATED ON THE AGENDA.

>> OKAY. I FIND THAT BASED ON THE EVIDENCE AND TESTIMONY PRESENTED, THAT A VIOLATION EXISTS AT 427 NORTH 15TH STREET AND THAT ZAKARI VALSANT IS THE PARTY RESPONSIBLE FOR THE VIOLATION.

I FIND THAT NEITHER MR. VALSANT NOR ANY REPRESENTATIVE IS HERE THIS MORNING. I WILL GIVE THE VIOLATOR 60 DAYS TO OBTAIN A PERMIT, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 UNTIL THE PERMIT IS CLOSED, COMPLY WITH OTHER PERMIT CONDITIONS AND CURE OTHER VIOLATIONS DESCRIBED IN THE ORDER NOT REQUIRING A PERMIT OR FINE OF $100 PER DAY BE ASSESSED.

THEY HAVE 30 DAYS TO APPEAL. THANK YOU.

>> TAKE YOUR TIME. OKAY.

THE NEXT CASE WE HAVE IS FOR MR. SMITH.

[A. 20-273 505 N 17th St Realty Analysis LLC Ed Smith]

IT IS 5A CASE NUMBER 20-273. THE ADDRESS IS 505 NORTH 17TH STREET, REALTY ANALYSIS LLC IS THE OWNER.

IT'S A RECALLED CASE, BY THE WAY.

>> THANK YOU. GOOD MORNING, MR. SMITH.

WERE YOU PREVIOUSLY SWORN? >> YES.

>> WERE YOU THE INSPECTOR? >> YES.

AND IS THAT ADDRESS 505 NORTH 17TH STREET?

>> YES IT IS. >> WAS IT INITIATED ON JANUARY

22ND, 2020? >> YES.

>> THERE WAS INITIALLY A COMPLAINT FROM A TENANT AND WHEN I WENT BY, I FOUND THAT THERE WAS BAD LIVING CONDITIONS.

THERE WAS A HOLE IN THE ROOF OF THE CARPORT.

THERE WAS UNPERMITTED WORK AS FAR AS PLUMBING WAS CONCERNED.

THERE WAS SOME, YOU KNOW, INFESTATION.

THE WALL WAS SEPARATING AND WAS QUITE A BIT OF STUFF.

IT HAD RATS AND, YOU KNOW, INSECTS.

>> HOLD ON. I'M GOING TO RUDELY INTERRUPT YOU. SORRY.

>> ALL RIGHT. >> SO THE VIOLATION SET FORTH ON THE AGENDA THIS MORNING IS FOR A PERMIT REQUIRED SECTION --

>> OKAY. >> SO THAT STILL -- IS THAT

STILL CORRECT AND ACCURATE? >> YES.

OF COURSE AFTER THEIR VIOLATION, THE INITIAL VIOLATION WENT BACK AND SAW THAT THEY WERE ATTEMPTING TO TRY TO REPAIR, MAKE REPAIRS TO THE VIOLATION WITHOUT ACQUIRING A PERMIT.

AND I SAW THAT THEY HAD REDONE THE ROOF OR THAT THE CARPORT, THEY WERE ATTEMPTING TO REDO THE CARPORT WITH -- I SAW NEW WOOD THAT HAD BEEN PAINTED, WHICH OF COURSE WOULD LOOK TOTALLY DIFFERENT THAN THE WOOD THAT I HAD ON THE PREVIOUS PICTURE.

SO THAT'S HOW I WAS ABLE TO DISTINGUISH THE DIFFERENCE.

>> OKAY. AND HAVE YOU -- DID YOU TAKE ANY PHOTOGRAPHS WITH REGARD TO THE UNPERMITTED WORK?

>> YES. >> OKAY.

AND HAVE YOU BEEN ABLE TO CONFIRM WHETHER OR NOT ANY

PERMITS WERE OBTAINED SINCE? >> NOT FOR THE ACTUAL VIOLATIONS. THERE WAS SOME PERMITTING -- PERMITS THAT WERE ISSUED BUT I DON'T BELIEVE IT WAS FOR THE --

>> WERE OTHER ITEMS NOT COVERED BY THE ALLEGATIONS ON THE AGENDA

THIS MORNING? >> RIGHT.

>> OKAY. CAN YOU -- I CAN'T REMEMBER IF I ASKED YOU ABOUT THE PICTURES? I'M SORRY.

DO THEY FAIRLY AND ACCURATELY DEPICT WHAT YOU SAW?

>> YES, THEY DO. >> AT THIS TIME WE WOULD MOVE THE PICTURES IN AS CITY'S 1 COMPOSITE AND THE RECOMMENDATION THAT'S SET FORTH ON THE AGENDA THIS MORNING, IS THAT STILL YOUR

RECOMMENDATION? >> YES.

>> THANK YOU.

>> THANK YOU. >> IS THERE ANYTHING YOU WANT TO SAY ABOUT THE PHOTOS OR ANYTHING ELSE THAT YOU WANT TO ADD ABOUT

THIS CASE? >> I DID HAVE A MEETING WITH SOMEBODY OVER THERE BECAUSE APPARENTLY THEY THOUGHT THEY HAD CLEARED UP THE VIOLATIONS, BUT LIKE I SAID, THEY DIDN'T PULL THE PERMITS THAT WERE REQUIRED AS FAR AS THE VIOLATION WAS

[01:15:04]

CONCERNED. >> OKAY.

SO AT THIS TIME, ARE YOU STILL MAKING THE SAME RECOMMENDATION

THAT APPEARS ON THE AGENDA? >> YES.

>> SO SPECIAL MAGISTRATE, WE ASK THAT YOU FOLLOW THE

RECOMMENDATIONS AS SET FORTH. >> ALL RIGHT, THANK YOU.

AND THESE WILL BE ADMITTED AS COMPOSITE 1.

I FIND THAT NO ONE HERE IS -- NO ONE IS HERE ON BEHALF OF REALTY ANALYSIS LLC. AND BASED ON THE EVIDENCE PRESENTED, I FIND THAT A VIOLATION DOES EXIST AT 505 NORTH 17TH STREET AND THEY ARE THE RESPONSIBLE PARTY.

I'LL GIVE THEM 60 DAYS TO OBTAIN A PERMIT.

HAVE YOU EVER SPOKEN WITH ANYBODY FROM THIS REALTY

ANALYSIS LLC? >> YEAH.

THEY'RE ACTUALLY -- THEY ACQUIRED IT FROM THE ORIGINAL OWNER. I BELIEVE IT WAS A CHANGE OF OWNERSHIP. SO I DID MEET WITH THE REALTOR COMPANY AND I ACTUALLY WALKED THROUGH WITH HIM AND SHOWED HIM WHAT VIOLATIONS I SAW AND WHAT NEEDED TO BE DONE.

HE SAID THAT HE WAS GOING TO OF COURSE OBTAIN THE PROPER PERMITS TO DO SO WHEN I MET HIM. AND THAT WAS ABOUT THREE MONTHS AGO, THREE TO FOUR MONTHS AGO, I BELIEVE.

>> SPECIAL MAGISTRATE. >> YES, MR. COSS.

>> JUST FOR CLARITY, THERE IS A SEPARATE VIOLATION CASE HERE AS WELL, WHICH IS ADDRESSING THE OTHER CONCERNS THAT MR. SMITH HAS PREVIOUSLY MENTIONED. THE APPLICANT HAS APPLIED FOR A PERMIT FOR WINDOWS AND DOORS WHICH DOES NOT ADDRESS THE FULL SCOPE OF WORK FOR THIS VIOLATION CASE OR THE OTHER VIOLATION CASE. THAT PERMIT WAS REJECTED ON OCTOBER 28TH WITH A NOTE THAT THEY NEED TO SPECIFY WHICH PRODUCTS ARE BEING USED SO THAT COMPLIANCE CAN BE DETERMINED AND ALSO WITH A NOTE THAT THIS PERMIT IF ISSUED, WOULD THAT SATISFY THE VIOLATION CASES PREVIOUSLY MENTIONED.

>> OKAY.

ALL RIGHT. ANYTHING FURTHER?

>> NO. >> MR. SMITH, I GENERALLY FOLLOW THE RECOMMENDATIONS MADE BY THE OFFICERS BECAUSE YOU GUYS ARE OUT THERE IN THE FIELD AND YOU KNOW WHAT'S GOING ON.

BUT I'M GOING TO DEVIATE FROM YOUR RECOMMENDATION JUST A LITTLE BIT BASED ON WHAT MR. COSS HAS JUST STATED FOR THE RECORD. I'M GOING TO FIND THAT THE VIOLATION EXISTS, BUT I'M GIVING THEM ONLY 45 DAYS TO OBTAIN A PERMIT. IT'S A REALTY COMPANY, OKAY? NO OFFENSE TO YOU, MR. SMITH. I'LL GIVE THEM 45 DAYS TO OBTAIN A PERMIT, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED, COMPLY WITH ALL OTHER PERMIT CONDITIONS AND CURE ALL OTHER VIOLATIONS DESCRIBED IN THE ORDER IF NOT A FINE OF $100 DAYS WILL BE ASSESSED. THEY HAVE 30 DAYS TO APPEAL.

I THINK YOU ALL HAVE BENT OVER BACKWARDS A LITTLE BIT, WHICH YOU DO A LOT OF TIMES. I'M IN HERE EVERY MONTH.

BUT IT JUST DOESN'T SEEM LIKE THEY'RE TAKING THIS VERY SERIOUSLY. AND A REALTY COMPANY MORE THAN ANYBODY ELSE, SHOULD KNOW HOW AND WHEN TO OBTAIN PERMITS.

THANK YOU. NEXT CASE, MADAME CLERK.

>> ALL RIGHTY. >> THANK YOU, MR. SMITH.

[B. 19-1470 428 N 20th Street Randolph, Curtis Shaun Coss]

>> THE NEXT CASE WE HAVE IS A CALL-IN CASE IT IS 6B, CASE NUMBER 19-1470, 428 NORTH 20TH STREET.

CURTIS RANDOLPH IS THE OWNER >> MADAME CLERK, YOU CAN GET MR. RANDOLPH ON THE PHONE, BUT I'M GOING TO HAVE TO RECUSE MYSELF FROM THAT CASE. I AM NOW WORKING A CASE WITH

MR. RANDOLPH AS CO-COUNSEL. >> OKAY.

>> SO THAT WOULD NOT BE PROPER FOR ME TO DECIDE THIS PARTICULAR

CASE. >> OKAY, THOSE ARE OUR NEXT TWO

CASES. >> GIVEN THOSE CIRCUMSTANCES.

AND THIS JUST HAPPENED THIS MONTH.

SO I JUST WANT EVERYBODY TO BE AWARE OF THIS.

SO HIS CASES WILL HAVE TO GO TO THE OTHER SPECIAL MAGISTRATE.

>> OKAY. >> OKAY.

>> WOULD YOU AGREE WITH ME, COUNSELOR?

>> I AGREE. >> OKAY.

[01:20:01]

OH, WE HAVE A RECALLED CASE. I'M SORRY.

WE HAVE A RECALLED CASE TOO. >> SO SHOULD WE JUST CONTINUE THESE UNTIL THE NEXT SPECIAL MAGISTRATE FOR THE OTHER SPECIAL MAGISTRATE INSTEAD OF CALLING OR --

>> I THINK THAT WOULD BE OKAY. IT'S NOT GOING TO -- IF WE CONTINUE THEM AT THIS POINT, THERE'S NOTHING THAT'S GOING TO NEGATIVELY IMPACT THE RESPONDENT.

OKAY. >> WE'LL CONTACT ATTORNEY RANDOLPH FOLLOWING THIS HEARING AND LET HIM KNOW.

>> OKAY, THANK YOU. THANK YOU.

>> ALL RIGHT. SO WE HAVE ONE LAST RECALLED

[K. 20-1072 2303 Avenue N Hall, Christopher Paul Julin]

CASE. IT IS 5K, 20-1072, 2303 AVENUE N. CHRISTOPHER HALL IS THE OWNER.

PAUL JULIN IS OUR INSPECTINSPEC. >> GOOD MORNING, MR. JULIN, WERE

YOU PREVIOUSLY SWORN? >> YES.

>> AND WERE YOU THE INSPECTOR? >> YES, MA'AM.

>> AND IS THAT ADDRESS 2303 AVENUE N?

>> IT IS, YES >> AND WAS THE CASE INITIATED ON

APRIL 27TH, 2020? >> YES, MA'AM.

>> OKAY. CAN YOU TELL US THE NATURE OF

THE VIOLATIONS YOU OBSERVED? >> SURE.

WE HAVE VIOLATIONS THAT WE SAW THAT THERE WAS SOME -- AN AREA OF ELECTRICAL THAT COULD BE A HAZARD WITH SOFFITS IN THE -- ON THE HOUSE. THERE'S MULTIPLE OPENINGS THAT COULD ALLOW VERMIN, BATS, THINGS LIKE THAT.

AND THOSE WOULD MAKE THE WHOLE -- THAT WAS THE WHOLE THING THERE. WOULD YOU LIKE ME TO READ THEM OFF? THERE'S FOUR ITEMS.

>> THE FOUR ITEMS THAT ARE ON THE AGENDA THIS MORNING, DO THEY CORRECTLY REPRESENT THE CORRECTIVE ACTIONS THAT YOU'RE

ASKING FOR? >> YES, MA'AM.

>> OKAY. DID YOU TAKE ANY PHOTOGRAPHS OF

THE CONDITIONS OF THE PROPERTY? >> YES, MA'AM, I DID.

>> DO THEY FAIRLY AND ACCURATELY DEPICT WHAT YOU SAW?

>> YES. >> OKAY.

AT THIS TIME WE MOVE THE PHOTOS IN AS CITY'S 1 COMPOSITE.

>> IT WILL BE ADMITTED AS SUCH. >> THANK YOU.

IS THERE ANYTHING THAT YOU WANT TO SAY ABOUT THE PHOTOGRAPHS?

>> NO, I THINK THEY DEPICT EVERYTHING THAT WE KNOW ABOUT OF

THIS CASE. >> WAS THIS CASE INITIATED VIA A

TENANT COMPLAINT? >> THAT'S A GOOD QUESTION.

I'M TRYING TO THINK. I WOULD SAY YES BECAUSE THIS HAS BEEN A WHILE AND, YOU KNOW, I DON'T GO THERE BY MYSELF.

SOMEBODY INITIATED THAT WITHIN THE DEPARTMENT.

SO I WENT OUT THERE AND LOOKED AND FACTOR PHOTOS.

>> OKAY. THE RECOMMENDATION THAT APPEARS ON THE AGENDA THIS MORNING, IS THAT STILL YOUR RECOMMENDATION?

>> YES, MA'AM. >> OKAY.

IS THERE ANYTHING ELSE THAT YOU WANT TO ADD OR LET THE SPECIAL MAGISTRATE KNOW REGARDNG THIS CASE?

>> NO, I THINK I'M OKAY. >> SPECIAL MAGISTRATE, WE ASK THAT YOU FOLLOW THE RECOMMENDATION AS SET FORTH ON

THE AGENDA. >> I HAVE JUST ONE QUESTION.

YOU SAID THERE'S AN INFESTATION OF BATS ALONG WITH OTHER PESTS?

>> YES. >> BATS?

>> YES. >> OKAY.

ALL RIGHT. I JUST WANTED TO BE SURE.

>> ALL RIGHT. ANYTHING FURTHER?

>> NO, MA'AM. >> BATS, OKAY.

BASED ON THE EVIDENCE AND TESTIMONY PRESENTED I FIND THAT A VIOLATION EXISTS AND CHRISTOPHER HALL IS RESPONSIBLE FOR THE VIOLATION. I'LL GIVE 60 DAYS TO FIND A PERMIT, COMPLY WITH ALL OTHER PERMIT CONDITIONS AND CURE ALL OTHER VIOLATIONS DESCRIBED IN THE ORDER, EXCUSE ME, NOT REQUIRING A PERMIT. OR A FINE OF $100 A DAY BE ASSESSED. 30 DAYS TO APPEAL.

OKAY, MADAME CLERK. >> OKAY.

SO THERE ARE CASES THAT WERE NOT PRESENT TODAY AND THEY ARE 5B, CASE NUMBER 20-186 -- 816. SORRY.

CASE NUMBER 5J 20-1014, 417 NORTH 9TH STREET, 417 NORTH 9TH

AND THOSE WERE NOT PRESENT TODAY?

>> AND THESE ARE THE ONLY CASES WE DIDN'T HAVE ANYBODY PRESENT?

>> YES, MA'AM. >> HOW WERE THEY NOTIFIED?

>> NOTICE OF HEARING SENT TO THE VIOLATOR CERTIFIED MAIL.

IF THE GREEN CARD IS SIGNED, IT'S PLACED IN THE FILE, IF IT'S RETURNED UNSIGNED A NOTICE THE MAILED TO THE VIOLATOR.

TEN DAYS BEFORE THE HEARING A NOTICE OF HEARING SENT REGULAR U.S. MAIL WITH AN AFFIDAVIT OF MAILING ATTACHED TO IT.

A COPY WAS PLACED IN THE BUILDING DEPARTMENT FILE.

ANYTHING ELSE? THEN WE ARE ADJOURNED.
