[E. 20-1183 CE 1123 S 7th Street Morales, TJesus J Isaac Saucedo]

MOVE ON TO OLD BUSY TEM NUMBER 10E, 20-1183.

1123 SOUTH MORALES. >> GOOD MORNING..

>> AND THIS IS CASE 20-83 -- 20-83 SOUTH 7TH STREET, OWNER IS JOSE J MORALES. THE CASE ISSUED ON MAY 19TH, 2020. THE VIOLATIONS IS DAMAGE TO PUBLIC PROPERTY. THIS IS A SECOND TIME IT'S ACTUALLY BEEN IN FRONT OF A SPECIAL MAGISTRATE.

THE FIRST HEARING WAS OCTOBER 21ST, 2020, WHICH NO ONE SHOWED UP. I HAVE PHOTOS TO PRESENT, IF YOU WANT TO TAKE A LOOK AT THEM. AND

>> THE RESPONDENT HAD A CHANCE TO VIEW THE PHOTOS?

>> NO. >> THE CONTRACTOR ALSO IS HERE TODAY, WHICH HE JUST SPOKE TO ENGINEERING AND OBTAINED THE APPLICATION TO OBTAIN THIS PERMIT.

ORIGINALLY, WE HAD RECOMMENDED OF A BE GIVEN TEN DAYS TO OBTAIN A PERMIT, WHERE A FINE OF $250 A DAY WOULD BE ASSESSED.

>> MR. GEORGE, I THINK YOU WERE NOT SWORN IN.

I THINK YOU WERE OUT OF THE ROOM.

>> PLEASE STATE YOUR NAME FOR THE RECORD.

>> JOHN GEORGE. >> AND DO YOU SWEAR OR AFFIRM TESTIMONY YOU ARE ABOUT TO GIVE WILL BE THE TRUTH?

>> I DO. >> THANK YOU.

>> SPECIAL MAGISTRATE, THIS IS FOR DAMAGE TO A CITY RIGHT OF WAY DUE TO A REPAIR OF A DRIVEWAY.

OKAY. WHICH IS WHY TRACY TELLY IS HERE FOR ENGINEERING.

IF YOU HAVE ANY QUESTIONS ABOUT WHAT REPAIRS WILL BE DONE, SHE IS AVAILABLE. I WOULD LIKE TO TURN IT IN TO MR. GEORGE SO WE CAN UNDERSTAND BETTER.

>> I THINK THE PHOTOS FORMALLY SHOULD BE ENTERED INTO EVIDENCE.

I APOLOGIZE. >> OKAY, THE EIGHT PHOTOS WILL BE ENTERED AS COMPOSITE 1 FOR THE CITY.

>> THANK YOU, MA'AM. >> GOOD MORNING.

>> MORNING. >> MORNING, MAGISTRATE.

AND I'M THE ENGINEER JUST STEPPING IN AND WE WILL HAVE AN

[00:10:06]

APPLICATION TO THE ROAD DIVISION, THE RIGHT OF WAY BY NEXT WEEK. I SPOKE WITH SOMEONE.

WE GOT A PERMIT AND I SPOKE TO THEM OVER THE PHONE.

I DON'T KNOW WHO IT WAS AND RIGHT OF WAY.

I THOUGHT IT WAS HER BUT SHE SAID IT WASN'T.

THEY TOLD ME TO GO TO WORK BUT BECAUSE OF THE WATER FIELD AND ALL OF THAT RAIN, WE WERE NOT ABLE TO DO THAT.

SO WE WILL HAVE THIS IN FOR APPROVAL FOR NEXT WEEK AND HOPEFULLY, YOU KNOW, WITHIN TEN DAYS, EVERYTHING WITH THAT

DEPARTMENT WILL BE COMPLETED. >> I HAVE A QUESTION FOR TRACY.

TRACY YOU COULD COME UP REAL QUICK? I THINK YOU NEED TO BE SWORN AS WELL OR WERE YOU HERE.

>> SWEAR YOU REAL QUICK. >> I WANT TO SAY SOMETHING.

KEEP IN MIND NEXT WEEK IS A SHORT WEEK SO YOU MAY WANT TO TAKE THAT INTO CONSIDERATION WHEN YOU SUBMIT THE OPERATION.

>> PLEASE STATE YOUR NAME FOR THE RECORD?

>> TRACY TALLY. >> DO YOU AFFIRM THE TESTIMONY YOU ARE ABOUT TO GIVE WILL BE THE TRUTH?

>> YES. >> THANK YOU.

>> SURE. >> TRACY, BECAUSE YOUR DEPARTMENT IS KEY IN APPROVING THESE TYPES OF PERMITS, I WAS WONDERING, WHAT IS THE REASONABLE TIME FOR THE PERMIT APPLICATION TO BE SUBMITTED AND APPROVED?

>> A RIGHT WAY PERMIT APPLICATION IS SUBMITTED DIRECTLY TO ENGINEERING. THERE'S NO FEE INVOLVED.

IT'S REVIEWED IN HOUSE. SO TYPICALLY, WE CAN TURN THOSE AROUND WITHIN A COUPLE OF DAYS. IF IT IS COMPLETE WITH COMMENTS

AND APPROVAL. >> GIVEN NEXT WEEK IS A SHORT

WEEK. >> I'M WORKING ALL WEEK.

>> SO NUMBER ONE WOULD BE A REASONABLE --

>> SO IF YOU HAVE SOMETHING SUBMITTED BY -- I'M SORRY, WHAT'S THE TIME FRAME? WHAT ARE YOU GOING TO SUBMIT?

>> LET'S TRY TO SUBMIT HOPEFULLY BY THE END OF THE WEEK BUT FIRST

OF NEXT WEEK FOR SURE. >> I'LL HAVE IT REVIEWED AND COMMENTS OR APPROVAL SENT BACK NEXT WEEK.

IF HE HAS IT TO ME BY MONDAY, I'LL HAVE IT TO YOU BACK BY

WEDNESDAY. >> SPECIAL MAGISTRATE, STAFF IS ASKING IF A VIOLATION DOES EXIST, THAT THEY HAVE UNTIL DECEMBER 1 TO OBTAIN THE NECESSARY PERMITS AND THEN COMPLY WITH ALL PERMIT CONDITIONS.

>> OKAY. DOES ANYONE HAVE ANYTHING TO ADD -- OKAY.

I WILL FIND THAT THE VIOLATION DOES EXIST IN THAT -- WE ARE RECOMMENDING TEN DAYS BUT I THINK DECEMBER 1ST IS A DATE CERTAIN BY WHICH YOU NEED TO COMPLY OR A FINE WILL BEGIN TO BE ASSESSED FROM THAT POINT. IF YOU HAVE ANY QUESTIONS ABOUT THAT, PLEASE ASK NOW BECAUSE DECEMBER 1ST, I'M NOT SURE HOW

MANY DAYS. >> IT'S SLIGHTLY MORE THAN TEN

DAYS WITHOUT THE HOLIDAYS. >> AND IF THE VIOLATION IS NOT, IF THE PERMIT IS NOT APPROVED BY THEN, A FINE WILL BEGIN TO BE

ASSESSED AT $250 A DAY. >> COULD I SAY ONE THING?

>> SURE. >> IF SHE KEEPS COMMENTING AND TURNING IT DOWN, I DON'T WANT YOU TO SAY APPROVED AND AT LEAST IF WE GET THE APPLICATION IN THE PROCESS IS STARTED.

>> SPECIAL MAGISTRATE, IT'S ALL DEPENDENT ON THE APPLICANT, WHETHER IT'S APPROVED OR NOT. WE SPOKE ON WHAT WE ARE LOOKING FOR. YOU HAVE TO PUT IN A DETAILED SKETCH ON HOW TO REPAIR THE ROADWAY THAT'S UNDERMINED.

YOU WON'T BE ABLE TO USE SOME STANDARD BASE MATERIAL.

YOU HAVE TO USE AN OVERFLOW, WHILE I GO OUT AND TAKE PHOTOS AND IT CONTINUES, THE ASPHALT CONTINUES TO EAT AWAY.

YOU HAVE OUR STANDARD DETAILS FOR DRIVEWAY FOR CURBING.

AND THE LAYMENTS OF THE OVERLAY. THAT WAS A BRAND-NEW ROAD, BEFORE IT WAS DESTROYED AND THE CITY PAID A LOT OF MONEY TO IMPROVE THAT AREA. THE DRAINAGE HAS BEEN IMPACTED BECAUSE THE CURB AND GUTTER IS GONE.

IT'S ALL UP TO YOU. IF YOUR APPLICATION IS COMPLETE AND EVERYTHING IS DONE CORRECTLY, THEN YES, IT WILL BE

[00:15:01]

APPROVED. >> THAT'S THE PART I'M TALKING

ABOUT, THE CORRECT PART. >> MR. GEORGE, YOU MAY REMEMBER FROM YOUR PAST HISTORY, TAF DOES HAVE THE AUTHORITY TO DO A STAFF ADMINISTRATION IF IT'S WARRANTED AND NECESSARY.

>> YES. >> I THINK THAT ADDRESS IS YOUR CONCERN, THAT IF THERE'S SOMETHING THE STAFF COULD DO,

THEY WILL EXTEND IT. >> THANK YOU.

>> THANK YOU VERY MUCH. >> I WANT YOU TO PAST THAT PAST HISTORY WITH THE -- WITH THE BAD.

>> MR. GEORGE USED TO BE A MEMBER OF THE CODE ENFORCEMENT

BOARD. >> OKAY.

>> MAY I ASK ONE MORE QUESTION. I UNDERSTAND THEY HAVE UNTIL DECEMBER 1ST TO GET THEIR APPROVAL.

IS THERE A TIME FRAME WHEN THEY HAVE TO HAVE THE WORK COMPLETED.

>> IT'S COMPLIED WITH ALL THE CONDITIONS OF THE PERMIT.

THE PERMIT HAS AN EXPIRATION DATE.

>> AND CAUSEWAY PERMITS DO NOT. I DON'T WANT THEM TO ISSUE ANOTHER PERMITS. I WANT THEM TO GO THERE AND DO

THE WORK. >> THE STIPULATION, ONCE THE PERMIT IS APPROVED, THEY HAVE SO MANY DAYS TO COMMENCE THE WORK.

>> MR. GEORGE, HOW LONG WILL IT TAKE FOR THE WORK TO BE

COMPLETED? >> I DON'T KNOW ABOUT COMPLETED, BUT TO GET STARTED. AND RIGHT AFTERWARDS, BECAUSE SHE WANTS SPECIAL STUFF. I REALLY WANT TO MAKE SURE WE

GET HER WHAT SHE'S LOOKING. >> IS IT REASONABLE TO SAY, WITHIN 60 DAYS, THE WORK WILL BE COMPLETED.

>> TRACY, WITHIN 30 DAYS. >> EXTREMELY REASONABLE.

HE HAS EVERYTHING EXCAVATED OUT THERE.

THEY SHOULD HAVE EVERYTHING DONE.

30 DAYS IS AMPLE TIME. >> SPECIAL MAGISTRATE, ONCE THE 10 DAYS TO OBTAIN THE PERMIT. 30 DAYS TO COMPLETE THE WORK.

>> AND THE DAMAGE WAS IN THE ROAD, BECAUSE WHEN I PULLED THE PERMIT, I WAS ON THE HOUSE AND I PULLED THE PERMIT FOR THE FIRST TIME. THEY GIVE THE PERMIT TO ME.

I DON'T KNOW IF I HAD TO APPROVE THE PERMIT FOR A RIGHT OF WAY.

I TALKED TO HER. SHE TOLD ME ON THE PHONE, I NEED TO REMOVE THE SIDEWALK. I REMOVED THE SIDEWALK.

IT WAS 4 INCHES OF CONCRETE AND IT WAS SUPPOSED TO BE 6 INCHES.

THEN I CAUSED A CURVE, I DON'T WANT TO REMOVE THE CURVE, BECAUSE I KNOW THE ROAD WOULD BE DAMAGE.

IT WAS BRAND-NEW. SHE TOLD ME OVER THE PHONE, TO REMOVE THE PHONE. SINCE I REMOVED THE CURVE, THE DAMAGE CAME OUT IN THE ASPHALT. I WAS TRYING TO FIX IT RIGHT AWAY, BUT THEY CANCELLED MY PERMIT.

SHE TOLD ME THE GENERAL CONTRACTOR, I GOT A GENERAL CONTRACTOR. SHE TOLD ME I HAVE TO HAVE THIS MAN RIGHT HERE AND I HIRED THIS GUY TO DO THE JOB.

I'M THE FIRST ONE, TO DO THE JOB CORRECTLY, YOU KNOW.

I WAITED FOR 19 YEARS TO -- FOR THE ROAD TO GET FIXED.

FINALLY THE ROAD GETS FIXED AND THE DAMAGE IS NOW

>> THANK YOU. >> WOULD YOU LIKE TO RESPOND?

IT'S NOT NECESSARY? >> I JUST WANT TO CONE FIRM THE PERMIT YOU'RE TALKING ABOUT IS A DRIVEWAY PERMIT.

>> WE'RE ALL CLEAR. >> WE'RE ALL CLEAR.

WE'RE GOOD NOW. >> THERE'S NOTHING ELSE.

>> THANK YOU >> THANK YOU ALL.

>> COLLEEN, IF YOU JUST WANT TO READ, FROM MY COUNT, IT LOOKS LIKE THERE'S THREE VIOLATION CASES UNDER 5A THAT FAILED TO APPEAR. WE'RE AGAIN UNDER THE EMERGENCY ORDER, SO WE'RE ALLOWING A RECALL FOR ALL NO SHOWS.

IF YOU WANT TO READ THOSE THREE IN.

[A. 20-1961 CE 5280 S US Highway 1 HAR - BAR - FTP LLC Heather Debevec]

>> YES, MA'AM. CASE 5-A, 201961, HAR-BAR.

[L. 20-2044 CE 1312 Atlantic Avenue Smith (TR), Wiliiam H Isaac Saucedo]

CASE 5L, 1312 ATLANTIC AVENUE SM

[M. 20-905 CE 6737 Darter Court Steak N Shake Operation INC & Ryan LLC Chad Dawson]

SMITH. >> WE'RE DOING A TELEPHONE CALL.

>> WE'RE GOING TO CALL MR. MR. JONES.

YOU WANT TO DO THAT NOW? >> DO THAT NOW.

[00:21:25]

>> GOOD MORNING. IT'S JACK JONES, STEAK N SHAKE.

>> THIS IS, CODE ENFORCEMENT. YOU ARE ON SPEAKER PHONE AND IN FRONT OF SPECIAL MAGISTRATE AND SHE'S READY TO HEAR THIS MATTER.

OKAY. . >> YES, MA'AM.

>> BEFORE WE CAN GET STARTED, IF WE CAN HAVE YOU SWORN IN?

>> NOT A PROBLEM. >> PLEASE STATE YOUR NAME AGAIN?

>> JACK JONES. >> AND DO YOU SWEAR OR AFFIRM TESTIMONY YOU ARE ABOUT TO GIVE WILL BE THE TRUTH?

>> YES. >> MR. JONES, OFFICER DAWSON WILL START OUT BY READING THE FACTS IN THE CASE AND PRESENTING INFORMATION TO THE SPECIAL MAGISTRATE.

I WANT TO CONFIRM YOU RECEIVED THE PHOTOS FROM EARLIER TODAY?

>> YES, MA'AM. >> GOOD MORNING, SPECIAL

MAGISTRATE. >> GOOD MORNING.

>> THIS IS CASE 20-905, 6737 DARTER COURT OWNED BY STEAK N SHAKE. THE CASE WAS INITIATED APRIL 14TH, 2020. PROPERTY CITED 302.3 SIDEWALK AND DRIVEWAYS. THEY FOUND THE VIOLATION HAS BEEN GIVEN TEN DAYS TO COMPLY OR A FINE OF $200 PER DAY TO BE ASSESSED. I HAVE PHOTOS TO COMMIT TO -- SUBMIT AS COMPOSITE 1. THANK YOU.

>> THANK YOU. >> PHOTOS SUBMITTED AS COMPOSITE 1. OKAY. THERE APPEARS TO BE FOUR PHOTOS IN THERE, THAT THEY ARE BEING ADMITTED AS THE CITY'S

COMPOSITE EXINT 1. >> SPESHING MANL STRAIGHT, I WANT TO COMPLY MORE INFORMATION. MR. JONES HAS BEEN COMMUNICATING WITH MR. DAWSON. I DID GET INVOLVED BRIEFLY YESTERDAY AND THIS MORNING. I'M GOING TO LET MR. JONES TESTIFY ON HIS BEHALF. I WANT TO SAY, I DID CONFIRM, A PERMIT WAS NOT COMPLIED WITH THE CITY OF FORT PIERCE.

>> OKAY. >> OKAY.

>> MR. JONES? >> YES, MA'AM.

>> THIS IS YOUR OPPORTUNITY TO SPEAK WITH THE SPECIAL MAGISTRATE AND EXPLAIN STEAK N SHAKE'S POSITION IN THIS MATTER?

>> YES, MA'AM. GOOD MORNING.

>> GOOD MORNING.. >> I STARTED THE STEAK N SHAKE LESS THAN TWO MONTHS AGO. I LEARNED ABOUT THE ISSUES THAT HAD BEEN IN THE SITE. I'VE BEEN WORKING DILIGENTLY TO CREDIT CARD THESE ISSUES. YOU KNOW, I DON'T UNDERSTAND OR KNOW WHAT HAPPENED PRIOR TO ME COMING ON BOARD WITH STEAK N SHAKE. AS MR. DAWSON COULD SEE, I HAVE BEEN WORKING STEADILY TRYING TO GET THE ISSUES AT HAND.

THE PROBLEM I HAVE IS THAT THE PHOTOS ARE SHOWING A GRAVEL ACCESS. IT'S NOT EVEN A ROAD.

THE ASPHALT DOES NOT APPROVE INTO THE STREET.

AND I DON'T HAVE A PROBLEM WITH PUTTING SOME ASPHALT DOWN, OKAY,

[00:25:05]

SO IT MAKES THE ATRIUM NICER, BUT THE FACT IS, IT'S NOT A ROAD. IT'S A GRAVEL DRIVEWAY.

IT'S PUT IN THE BACK OF THE PROPERTY.

AND LIKE I SAID, I DON'T MIND DOING THIS, WHATSOEVER, AND I COULD HAVE IT DONE WITHIN TWO WEEKS.

NOW I'M LEARNING, I HAVE TO HAVE ENGINEERED STAMP PLANS TO PUT IN SOME ASPHALT. AND I GUESS I'M NOT UNDERSTANDING BECAUSE WE CLEANED THE BUILDING UP, REMOVED ALL THE SIGNS, DONE ALL THE PAINTING, FIXED THE DUMPSTER.

TO BE HONEST, I ORDERED CAMERAS FOR THE SITE, THAT WILL GO TO MY CELL PHONE, BECAUSE WE HAD EVERYTHING CLEANED UP ON FRIDAY.

MY GUY WAS ON MONDAY AND SOMEBODY DROPPED TARS ON THE PROPERTY. I SPOKE TO A LOCAL POLICE DEPARTMENT AND THEY WILL TRY TO HELP ME CURB THE HOMELESS AND PEOPLE FROM DUMPING ON OUR PROPERTY.

BUT THIS BACK AREA, MA'AM, I DON'T UNDERSTAND -- LIKE I SAID, IF IT WAS A NORMAL ROAD, ACCESS ROAD, YES, I SEE WHERE IT COULD BE A PROBLEM. AND WE DON'T MIND, AGAIN, HIRING LOCAL ASPHALT COMPANY TO COME IN AND PUT ASPHALT DOWN.

NOT A PROBLEM. >> DID MR. DAWSON --

>> I JUST WANT TO SAY SOMETHING ABOUT THE DUMPING.

I KNOW THE CASE IS STAMPED BEFORE YOU, THERE'S A SEPARATE CASE ON THE PROPERTY. WE GOT THE COMPLAINT FROM THE PUBLIC WORKS DEPARTMENT, PEOPLE ARE DUMPING THERE.

I TOLD MR. JONES IN THE E-MAIL, THE REASON PEOPLE ARE DUMPING BECAUSE THEY DON'T MAINTAIN HALF THE PROPERTY.

I MET WITH A CONTRACTOR, MET WITH MR. PARKER, THE REASON WHY PEOPLE ARE DUMPING, BY BEING OVERGROWN, IT'S JUST A MAGNET FOR PEOPLE TO DUMP BECAUSE THEY KNOW IT'S NOT MAINTAINED.

BY NOT B MAINTAINED, IT GIVES PEOPLE FREE WILL TO DO WHAT THEY DO. AND --

>> IT'S ANOTHER CASE. >> IT'S ANOTHER CASE.

>> YOU COULD -- HE'S SAYING THIS IS NOT A ROAD.

>> WHAT WE'RE ADDRESSING IS THE DAMAGED DRIVEWAY.

WHEN I GOT INVOLVED WITH THIS, MORE THIS MORNING, THAN ANYTHING ELSE, THE CONTRACTOR HAS APPLIED TO THE CITY FOR THE COMPETENCY CARD AND BUSINESS RECEIPT IN ORDER TO DO BUSINESS WITH THE CITY. HE WILL HOPEFULLY HAVE THAT ON HAND BY THE END OF THE WEEK IF NOT TODAY.

ONCE THAT'S DONE, HE HAS TO HAVE A PERMIT FOR THE CITY DRIVEWAY.

THE BUILDING DEPARTMENT WILL TELL HIM EXACTLY WHAT IS PLANNED, WHAT'S NEEDED TO SUBMIT THE BUILDING PERMIT APPLICATION BUT THAT'S THROUGH THE BUILDING DEPARTMENT.

AS I EXPLAINED TO THE CONTRACTOR THIS MORNING, HE NEEDS TO CONTACT THE BUILDING DEPARTMENT AND GET THE INFORMATION ON SUBMITTING A BUILDING PERMIT APPLICATION TO REPAIR THE DRIVEWAY. BECAUSE WHATEVER NEEDS TO BE DONE, IT'S GOING TO BE DONE THROUGH THE BUILDING DEPARTMENT AND ENGINEERING, WHO IS JUST HERE.

THEY ARE THE ONES THAT APPROVED THAT.

THIS ENTIRE AREA IS BEING ADDRESSED.

NOT JUST THIS PROPERTY, BUT THE NEIGHBORING PROPERTIES IS BEING ADDRESSED AS WELL.PTHIS ENTIRE ADDRESSED.

SO IT'S A -- IT'S NOT A MAIN ROAD, BUT IT'S AN ACCESS ROAD THAT COMES INTO MULTIPLE COMMERCIAL PROPERTIES THAT ARE BACK HERE. THERE'S HOTELS AND RESTAURANTS AND SOME ARE VACANT AND SOME ARE OCCUPIED.

WE'RE REFERRING TO THE DRIVEWAY ITSELF, THAT NEEDS TO BE REPAIRED. NOT THE ROAD.

>> SO I HAVE A QUESTION. IF I'M -- IF I HAVE SOME ASPHALT, POTHOLES IN MY PARKING LOT, TYPICALLY SPEAKING YOU DON'T CONTACT THE BUILDING DEPARTMENT.

I ASKED, COULD YOU FIX SOME POTHOLES.

>> I'M SORRY. IT DIDN'T COME THROUGH CLEARLY.

YOU COULD RESTATE THAT? >> YES, MA'AM.

TYPICALLY SPEAKING IN THE STATE FLORIDA, IF I HAVE POTHOLES IN THE DRIVEWAY, TYPICALLY SPEAKING COME TO A BUILDING DEPARTMENT IN A PARKWAY. THERE'S NO MEANS, THAT COMES TO

[00:30:01]

EFFECT IN THE ROAD. THIS IS NO DIFFERENT.

YOU KNOW, LIKE I SAID, THIS IS AN ACCESS POINT THAT WAS MADE NOT A ROAD. MY RECOMMENDATION IS TO PUT BALLERS ACROSS AND PATCH IT WITH ASPHALT AND NOBODY CAN USE IT.

BECAUSE IT'S NOT A ROAD. >> IT'S A DRIVEWAY IN AN ACCESS ROAD. SPECIAL MAGISTRATE, MR. JONES, I PUT UP THE PHOTO, WHICH I BELIEVE IT WILL BE MARKED 1A.

AS YOU COULD SEE, SPECIAL MAGISTRATE, THIS IS NOT A POTHOLE. THIS REQUIRES MAJOR WORK TO BE DONE. SO THIS IS GOING TO REQUIRE A PERMIT. A POTHOLE, NO, WE DON'T REQUIRE PERMITS TO REPAIR POTHOLES. THIS TYPE OF DAMAGE AND REPAIR

REQUIRES A PERMIT >> OKAY.

>> OKAY. THAT'S FINE. WHAT WE'RE ARGUING IS THIS.

IT'S NOT A ROAD. IT'S NOT A DRIVEWAY.

THIS IS A GRAVEL AREA. WHY NOT PUT GRAVEL BACK IN IT? WE'LL BE FINE. WATER DOESN'T COME FROM THIS ACCESS POINT BACK ON TO THE MAIN STREET.

>> ISN'T -- YOU KNOW, IT'S IMPER VUS -- YOU HAVE A -- THAT'S

ASPHALT. >> THE CITY IS REQUESTING THAT HE GET A PERMIT WITHIN THE TEN DAYS, CORRECT?

>> YES, MA'AM. >> SO WHEN HE DOES THAT, WON'T THE BUILDING DEPARTMENT OR ENGINEERING DEPARTMENT TELL HIM

WHAT NEEDS TO BE DONE? >> WE'RE REQUESTING THE PERMIT BE OBTAINED WITH THE 10 DAYS. WITH THE HOLIDAY, WE HAVE TO EXTEND IT A LITTLE BIT TO DECEMBER 1ST.

THE CONTRACTOR SHOULD BE AWARE OF WHAT'S NEEDED IF NOT HE SHOULD CONTACT THE BUILDING DEPARTMENT TO SUBMIT AN APPLICATION, TO FIND OUT WHAT'S NEEDED.

>> MR. JONES, DID YOU UNDERSTAND THAT? YOU HAVE, I FIND THE VIOLATION EXIST AND YOU HAVE UNTIL DECEMBER 1ST TO OBTAIN THE PERMIT.

NOT TO FINISH THE WORK, BUT TO GET THE PERMIT.

>> YES, MA'AM. >> DO YOU HAVE ANY QUESTIONS

ABOUT THAT? >> NO, MA'AM, I DO NOT.

>> THEN THAT'S -- >> AND THEN, YOU KNOW, WE ARE REQUESTING THAT THEY COMPLY WITH ANY CONDITIONS OF THE PERMIT.

>> RIGHT. >> THE CONDITIONS OF THE PERMIT, YOUR TIME FRAMES AND REQUIREMENTS, YOU KNOW, WHATEVER CONDITIONS, WE ASK THAT THEY HAVE TEN DAYS TO OBTAIN THE PERMIT AND COMPLY 30 DAYS O TO COMPLY WITH THE PERMIT.

>> I'M FINDING THE VIOLATIONS EXIST.

AND THEY WERE REQUESTING TEN DAYS, BUT BECAUSE OF THE HOLIDAY, WE ARE SAYING DECEMBER 1ST.

AND THEN YOU NEED TO COMPLY WITH WAFR THE TERMS OF THE PERMIT ARE

AT THAT POINT. >> SO LET ME ASK THIS QUESTION.

>> OKAY. >> I GO IN.

I GO TO A PARK WITH A PERMIT. AND THEY TELL ME, THEY CAN'T GIVE IT TO ME. I HAVE TO HAVE ENGINEERS STAMP IN. AND DUE TO THE HOLIDAYS, THERE'S NO WAY I CAN GET ENGINEER. COULD WE PLEASE PERSIST AT LEAST THE 15TH TO GIVE ME THE TIME. A LOT OF PEOPLE TAKE OFF ALL

NEXT WEEK. >> DECEMBER 15TH.

>> SO DECEMBER 15TH, YOU COULD DO IT BY THEN?

>> THAT'S MY TRUE GUESS, YES, MA'AM.

I WILL DEFINITELY, GO TO THE BUILDING DEPARTMENT PERSONALLY

MYSELF. >> DECEMBER 15TH, TO OBTAIN THE

PERMIT? >> YES, MA'AM.

>> SPECIAL MAGISTRATE, FAILURE TO COMPLY WITH YOUR ORDER WOULD

RESULT IN WHAT? >> IF YOU FAIL TO DO IT BY THEN, YOU WILL BE ASSESSED A FINE OF $200 A DAY, SO THAT WOULD BE AFTER THAT DATE IF YOU HAVE NOT COMPLIED?

[00:35:01]

>> YES, MA'AM. >> MR. JONES, I'M JUST GOING TO ASK THAT YOU CONTINUE TO BE IN COMMUNICATION WITH OFFICER DAWSON, PROVIDING HIM WITH WHATEVER UPDATE YOU HAVE SO WE CAN MONITOR WHAT'S GOING ON AND KEEP OUR CASE UP-TO-DATE WITH WHATEVER IS GOING ON WITH THE BUILDING DEPARTMENT.

>> NOT A PROBLEM. >> OKAY. .

>> THANK YOU, SIR >> THANK YOU.

>> THANK YOU FOR YOUR TIME. >> WE WANT TO DO THE OTHER

[A. 20-0970 CE 2608 S US Highway 1 Kelly (TR), Mary TELEPHONE Heather Debevec]

TELEPHONE? >> YES, MA'AM.

>> OKAY. >> I THINK THIS IS LOW.

>> GOOD MORNING.. >> GOOD MORNING, MS. KELLY.

THIS IS PEGGY WITH THE CITY CODE ENFORCEMENT?

>> YEAH, HOW ARE YOU? >> I'M DOING FINE.

YOU ARE ON SPEAKER PHONE WITH THE SPECIAL MAGISTRATE.

SHE'S READY TO HEAR YOUR CASE. WE WILL START WITH HAVING YOU

SWORN IN? >> YES.

>> PLEASE STATE YOUR NAME FOR THE RECORD.

>> MARY KELLY. >> DO YOU SWEAR OR AFFIRM TESTIMONY YOU ARE ABOUT TO GIVE WILL BE THE TRUTH?

>> YES. >> THANK YOU.

>> MS. KELLY OFFICER DEBEBBIC, WILL READ THE CASE AND PROVIDE UPDATES ON FROM OUR LAST HEARING.

>> GOOD MORNING, SPECIAL MAGISTRATE, THIS IS CASE 79 O 8 OWNED BY MARY KELLY. CASE WAS INITIATED OF APRIL 24TH OF THIS YEAR, 15-3 SUBSECTION 3, REMOVAL OF SIGNS.

RPMC, PROTECTIVE TREATMENT. WAS REQUESTED THEY REMOVE SIGNAGE, TO VACATE THE BUSINESS, PRESSURE WASH THE PARKWAY, FRONT LAMP ON THE ROAD AND BACK OF THE BUILDING.

THE CITY WAS REQUESTING THE SPECIAL VIOLATION DOES EXIST.

AND THE PAINTING HAS BEEN DONE. I DID GO BY THE PROPERTY THIS MORNING. THE WALKWAY HAS ALSO BEEN DONE.

THE ONLY THING PERTAINED TO THIS CASE WOULD BE THE SIGN IN THE FRONT THAT'S UP IN THE AIR. SHE'S TAKEN THE SIGN DOWN BUT NOT LEAVING THE BEAR BARS, SO JUST A PLAIN PEEK NEEDS TO BE REPLACED FOR THAT. I DO HAVE PHOTOS.

>> HAS SHE BEEN TOLD THAT? >> I DIDN'T KNOW -- I JUST TOOK THE SIGN DOWN. I JUST PAID SOMEBODY TO TAKE THE SIGN DOWN. I DIDN'T KNOW I HAD TO REPLACE ANYTHING. THEY JUST SAID TO TAKE THE SIGNAGE DOWN DEALING WITH THE BUSINESS.

SO YOU WANT TO PUT SOMETHING UP NOW?

>> YOU COULD -- >> I'M SORRY, MS. KELLY, GIVE ME ONE SECOND TO CONFER WITH OFFICER DEBEVIC.

>> THE PHOTOS -- THE PHOTOS SUBMITTED BY THE CITY ARE BEING INTRODUCED AS EXHIBIT, COMPOSITE EXHIBIT 1 FOR THE CITY.

>> THANK YOU. >> OKAY.

>> MS. KELLY, THE -- BECAUSE THE FRAME OF THE SIGN IS ALL STILL THERE, WHAT YOU NEED TO DO IS REPLACE IT WITH BLANK SIGNS, WITH A BLANK COVER. BECAUSE THE FRAME IS STILL THERE, IT'S NOT IN COMPLIANCE UNTIL -- YOU COULD CHECK WITH -- I WOULD ACTUALLY CHECK WITH THE BUILDING DEPARTMENT ON WHAT THEY APPROVED WITHOUT PERMITS. THERE'S SOME BLANK SIGN FACES THAT YOU COULD GET THAT COULD JUST GO IN THERE TO FILL THE

SPACE. >> OKAY.

>> I WOULD TALK TO THE BUILDING DEPARTMENT ON WHAT COULD GET IN THERE WITHOUT A PERMIT. I'M SURE YOU COULD GET BLANK

SPACES STICK IT IN THERE. >>IVE TO TALK TO THEM BEFORE I

COULD DO THAT >> I WOULD TALK TO THE BUILDING

DEPARTMENT FIRST, YES >> YOU HAVE ANY QUESTIONS?

>> NO, MA'AM. >> AND THEN I WILL FIND THAT THE

[00:40:03]

VIOLATION JUST, THAT STILL EXISTS, BUT YOU HAVE 30 DAYS TO COMPLY. AND IF NOT, A FINE OF $50 A DAY

WILL BE ASSESSED. >> OKAY.

>> SO YOU WANT ME TO PUT A SIGN BACK UP, A BLANK SIGN?

>> CORRECT. >> MS. KELLY, I WILL GIVE YOU A

PHONE NUMBER TO CALL? >> YEP.

>> 772-467-3187. AND YOU'RE GOING TO SPEAK TO A GENTLEMAN BY THE NAME OF SEAN. AND HE COULD ADVISE YOU ON WHAT'S PROPER TO PUT IN THERE AND -- BECAUSE I DON'T WANT YOU TO HAVE TO GO THROUGH AND -- HE'LL BE ABLE TO HAD DIRECT YOU

IN A PROPER WAY TO ADDRESS THIS. >> OKAY.

>> ALL RIGHT, I GOT IT. >> ONE MORE CASE.

>> SORRY. >> WHAT IS THAT?

>> THERE'S ONE MORE MATTER? >> OKAY. .

[B. 20-0883 CE 2608 S US Highway 1 Kelly (TR), Mary TELEPHONE Heather Debevec]

>> THIS IS CASE NUMBER 20-883, 2608, SOUTH U.S. 1, OWNED BY MARY KELLY. THIS CASE WAS ALSO INITIATED ON APRIL 24TH, FOR SECTION 22-187 SUBSECTION 13, LANDSCAPE MAINTENANCE. SECTION 1646, 1647, FOR OUTSIDE STORAGE. WAS REQUESTED TO TERMINATE WEEDS, REMOVE DEAD DEBRIS FROM THE LOT.

REMOVE OR BRING IN TIRES, BUCKETS, OTHER ITEMS THAT WERE LOOSE OUTSIDE OF THE PROPERTY, WHICH THE OUTSIDE STORAGE HAS BEEN TAKEN CARE OF. THE LANDSCAPING IN THE BACK.

THE VACANT LOT THAT'S ATTACHED TO THE PROPERTY, THERE'S STILL A PILE OF DEAD DEBRIS APP. REQUESTING TEN DAYS TO COMPLY OR CON FINED, $50 FINE BE ASSESSED. AND I DO HAVE PHOTOS.

>> DID YOU SAY PHOTOS TODAY, BY ANY CHANCE.

YESTERDAY? >> I TOOK PHOTOS THIS MORNING,

YES, MA'AM. >> AND GENTLEMEN, HIRED THEM TO CUT EVERY MONTH FOR ME. HE SAID HE TOOK THE PILE AWAY.

HE JUST DIDN'T HAVE ROOM WHEN HE CUT LAST WEEK.

I TOLD HIM I WANTED IT DONE BEFORE TODAY BECAUSE I KNEW I WAS COMING. I WAS HOPING HE WOULD GET IT

DONE. >> THE PROPERTY WAS DEFINITELY

MOWED. >> AND MS. KELLY, IS THIS THE ONLY THING THAT REMAINS, THE DEBRIS PILE.

>> SPECIAL MAGISTRATE, WE WILL ASK TO CONTINUE THIS FOR 30 DAYS. SHE'S MAKING AN EFFORT.

WE ASK FOR 30 DAYS TO FINISH IT UP.

>> YOU SAID THE PILES OF DEBRIS, THE PILES WHATEVER IT IS?

>> YES, MA'AM. >> MS. KELLY, IF YOU COULD HAVE YOUR CONTRACTOR CONTACT HEATHER DIRECTLY, I'M SURE THEY CAN MEET

OUT THERE AND GET THIS RESOLVED. >> MY CONTRACTOR?

>> WHOEVER YOUR VENDOR IS. >> THE LAWN GUY?

>> OH, YES IF HE COULD CONTACT HEATHER DIRECTLY, THEY CAN GET THAT RESOLVED PRETTY QUICKLY, I'M

SURE. >> YEAH, I'LL MAKE SURE HE GOES UP AND I'LL CALL HIM TODAY AND TELL HIM.

>> AND THIS CASE WILL BE CONTINUED FOR 30 DAYS, FOR YOU

TO GET THAT DONE, OKAY? >> OKAY.

I'LL MAKE SURE IT'S DONE WITHIN A WEEK.

AND I'LL WORK ON THAT SIGN DEAL >> OKAY. .

>> THANK YOU. >> ALL RIGHT.

THANK YOU. >> OKAY, LOOKS LIKE WE'VE GOT FOUR MORE CASES WE NEED TO GO OV

[C. 20-1545 PK 1826 Orange Avenue Willie's Car Care Isaac Saucedo]

OVER. >> OKAY, YOU WANT TO CALL THE

FIRST ONE, COLLEEN. >> THIS IS CASE 20-1545, 1826

ORANGE AVENUE, WILLY'S CAR CARE. >> THIS IS A PARKING CITATION.

TANYA WILL -- >> GOOD MORNING..

>> YOU'RE PREVIOUSLY SWORN, CORRECT?

>> CORRECT. >> YOU COULD PUT YOUR NAME AND

JOB TITLE ON THE RECORD. >> ISAAC SAUCEDO.

[00:45:05]

>> AND YOU WERE ASSIGNED TO 20-2045?

>> I WAS. >> DID YOU ISSUE THE CITATION

RELATED TO THE CASE? >> RIGHT.

>> IS THAT FOR A VIOLATION THAT YOU HAVE OBSERVED WITHIN THE

CITY LIMITS OF FORT PIERCE? >> YES.

>> WHERE PRECISELY IS THE VIOLATION?

>> THE VIOLATION WAS VEHICLE PARKED IN THE CITY RIGHT OF WAY.

>> OKAY. SO THAT WAS THE NATURE OF THE VIOLATION.

WAS THE VIOLATION OBSERVED AT 1826 ORANGE AVENUE?

>> ON THE SIDEWALK, ACROSS THE STREET IS 1826 ORANGE AVENUE, WHICH THIS VEHICLE BELONGS TO THE OWNER OF THE PROPERTY OVER HERE, WHICH IS WILLIE'S CAR CARE.

>> IN THE VICINITY THEN? >> CORRECT.

>> I'M ASSUMING YOU TOOK PHOTOGRAPHS?

>> I DID. >> THEY FAIRLY AND DEPICT WHAT

YOU SAW? >> THEY DO.

>> WE MOVE TO THE PHOTOGRAPHS IN CITY ONE COMPOSITE.

AND I'LL NOTE FOR THE RECORD, THERE'S NONE THIS MORNING.

THANK YOU. IS THERE ANYTHING YOU WANT TO

SAY ABOUT THE PHOTOGRAPHS? >> NO, NOT AT THIS MOMENT.
