[A. 17-2775 1708 N 19th St Morgan, Shawn Paul Julin]

MR. JULIN? >> THE CLERK: FIRST CASE IS 5-A, CASE 17-2775, ADDRESS 1708 NORTH 19TH STREET, SHAWN MORGAN IS

THE OWNER. >> I'LL TAKE THIS DOWN.

>> MAGISTRATE, THIS CASE IS CASE 17-2775.

ADDRESS IS 1708 NORTH 19TH STREET.

OWNER IS SHAWN MORGAN. THE CASE INITIATED BACK IN AUGUST - 9TH OF AUGUST, 2018. THE ADDRESS IS 2407 NORTH 43RD STREET, FORT PIERCE, FLORIDA. AND THE VIOLATION IS SECTION 5-1.105.1, PERMIT REQUIRED. TO OBTAIN A PERMIT FOR THE RESIDENTIAL REPAIRS, INCLUDING BUT NOT LIMITED TO AN ADDITION.

REPAIRS AND/OR REPLACEMENTS FOR THE ROOF TRUSSES, SIDING, ABOVE CEILING PLUMBING, ABOVE-SEERLG ELECTRICAL, SEWER LINE ENTRY DOOR AND 4 BY 4 POSTS. RECOMMENDATION IS THE CITY REQUESTED -- THE ASK REQUESTS THAT THE SPECIAL MAGISTRATE FIND THE VIOLATIONS EXIST. THE VIOLENTER BEING 60 DAYS TO OBTAIN A PERMIT, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED.

COME PLY WITH ALL -- COMPLY WITH OTHER CONDITIONS AND CURE OTHER CONDITIONS DESCRIBED IN THE ORDER, NOT REQUIRED A PERMIT FOR

[00:05:01]

A FINE OF $100 PER DAY TO BE ASSESSED.

>> SPECIAL MAGISTRATE: ANYTHING FURTHER?

>> NOM. >> SPECIAL MAGISTRATE: YOU HAVE BEEN SWORN. HOW DO YOU RESPOND TO THE

ALLEGATIONS? >> MA'AM, THIS ISSUE HAD ALREADY BEEN TAKEN CARE OF OVER A YEAR AGO.

I HAVE ALREADY SPOKEN -- I HAD ALREADY PULLED THE PERMIT TO DO THE DEMO. I PULLED THAT IT MYSELF BACK IN -- IT'S BEEN A COUPLE OF YEARS.

THE SECOND VIOLATION IS I SPOKE WITH MR. JULIN.

HE WAS ALSO WITH ME IN THE INSPECTED HOUSE.

AS FAR AS THE HOLES AND OUTSIDE, THE SCREENING, ALL OF THAT STUFF HAS BEEN TAKEN CARE OF. IT'S BEEN DONE OVER A YEAR.

>> SPECIAL MAGISTRATE -- I'M SORRY, YOU CAN FINISH.

>> THEY DIDN'T COME LAST YEAR TO CLOSE THIS THING OUT.

>> SPECIAL MAGISTRATE: ANYTHING FURTHER?

>> NOM. >> FOR THE RECORD, THERE ARE TWO CASES. THE FIRST IS 17-2775 WHICH IS STRICTLY PERMITTING IRNZ. THE OTHER, I HAVEN'T HAD A CHANCE TO RESPOND TO THAT FOR THE MAINTENANCE ISSUES.

THIS CASE, I DO HAVE -- I'M FAMILIAR WITH THE CASE.

I INITIATED THIS CASE IN 2017. PRIOR TO MR. MORGAN OWNING THE PROPERTY. WHEN THE PROPERTY CHANGED OWNERSHIP, MR. MORGAN WAS CITED AT THAT TIME BY MR. JULIN.

MR. MORGAN DID OBTAIN DEMOLITION PERMITS IN 2014.

FOR AN ADDITION THAT WAS BUILT. HOWEVER, THAT IS NOT THE ADDITION THAT WE WERE SPEAKING OF IN REGARDS TO THIS CASE.

THIS WAS A FRONT PORCH ADDITION OR BACK PORCH.

I'LL PULL THE PICTURES UP ON THE SCREEN SO WE CAN BE CERTAIN WHAT WE ARE TALKING ABOUT. I BELIEVE THIS ADDITION HAS BEEN DEMOLISHED AS WELL. HOWEVER, WE HAVE NOT HAD ANY DEMOLITION PERMITS FOR THIS WORK.

ALSO, MR. MORGAN DID APPLY FOR A PERMIT BACK IN 2019.

PERMIT 19-3250. THAT PERMIT WAS TO CURE SOME OF THE MAINTENANCE ISSUES. THAT PERMIT WAS NEVER ISSUED.

THAT PERMIT WAS REJECTED BECAUSE IT DID NOT INCLUDE THE FULL SCOPE OF WORK. WE ARE STILL PENDING REVISIONS FOR THAT PERMIT. MR. MORGAN, THE PICTURE THEY HAVE SHOWN ON THE SCREEN HERE IS THE AREA WHERE THE ADDITION IN QUESTION, WHERE THERE IS NEW FASCIA BOARDS.

IT SHOWS THERE IS REFRACTORS THAT WERE REPLACED, SOME NEW SIGHING, SOME NEW ELECTRIC WORK. ADDITIONAL AFTERS, ROOF DECKING, 4 BY 4 POSTS. 4 BY 4 POSTS AGAIN FOR THIS OVERHANG. THERE IS WATER PIPING, SOME ADDITIONAL -- THIS IS ANOTHER VIEW OF THE FASCIA BOARDS AS WELL AS THE REFRACTORS, SIDING, NEW DOOR.

MR. MORGAN, ARE YOU SAYING THAT THAT WORK HAS BEEN DEMOLISHED AS

WELL? >> YES.

THERE ARE PICTURES I E-MAILED TO YOU.

>> DO WE HAVE THOSE PRINTED OUT? I DON'T KNOW IF YOU WANT TO CALL IN THE RESPONDENT OR THE CITY EXHIBIT.

>> SPECIAL MAGISTRATE: WE'LL CALL IT RESPONDENT'S EXHIBIT,

PROVIDED BY MR. MORGAN. >> THESE PICTURES ARE CITY'S EXHIBITS. THEN I DO HAVE MR. MORGAN'S PICTURES AS WELL THAT HAVE NOT BEEN SHOWN ON SCREEN THAT CAN BE

ENTERED AS RESPONDENT'S EXHIBIT. >> THE PICTURES THAT HAVE ALREADY BEEN PUBLISHED WERE TAKEN BY CITY STAFF?

>> THAT'S CORRECT. THOSE PICTURES WERE TAKEN BY ME.

>> THEY FAIRLY AND ACCURATELY DEPICT WHAT YOU SAW?

>> YES. THIS IS THE E-MAIL YOU SENT TO

[00:10:10]

ME OF THE THREE PICTURES THAT WE SAW.

>> UH-HUH. THESE HAVE BEEN REPLACED.

THERE IS SOME HOLES. >> SPECIAL MAGISTRATE: THESE WILL BE ADMIT THE AS CITY'S COMPOST ONE AND COMPOSITE 6.

>> I WANT TO REITERATE, EVEN IN IF THE WORK IS REMOVED, DEMOLITION PERMITS ARE REQUIRED. SINCE THERE IS ANOTHER PERMIT PENDING, IF HE WANTS TO PUT THE DEMOLITION IN THAT SCOPE OF PERMIT OR OBTAIN A SEPARATE PERMIT.

I WOULD SUGGEST THAT IT WOULD BE WITH THE PENDING 1950 TO INCLUDE THE ENTIRE SCOPE OF WORK FOR THIS CASE.

IN ADDITION TO THE MAINTENANCE CASE THAT HAS NOT BEEN APPROVED

YET. >> SPECIAL MAGISTRATE: ARE YOU IN AGREEMENT WITH THAT, MR. MORGAN?

>> YES, MA'AM. >> SPECIAL MAGISTRATE: WOULD YOU LIKE ME TO CONTINUE THIS UNTIL -- HE'S PULLED PERMITS ALREADY. I'M NOT SURE WHICH ONES ARE

ACTIVE. >> HE'S APPLIED FOR PERMITS BUT THEY ARE NO ACTIVE PERMITS AT THIS TIME.

>> SPECIAL MAGISTRATE: OKAY. DO YOU INTEND TO PULL A PERMIT FOR THIS, MR. MORGAN? YOU DON'T HAVE A CHOICE.

>> YES, MA'AM, I CAN RESUBMIT THEM TODAY.

I DO IT ALL THE TIME. I JUST THOUGHT THIS ISSUE WOULD BE GONE. IT'S BEEN A COUPLE OF YEARS AGO.

LIKE I SAY, I HAD SPOKEN WITH THE INSPECTOR AND DIRECTED EVERY COMMENT ON THE PAGE AND TOOK CARE OF IT, EVEN THE DOOR SWEEPS, AND ALSO CLOSING OFF THE OUTSIDE FOR RODENTS AND ALL OF THAT STUFF HAS BEEN TAKEN CARE OF.

>> SPECIAL MAGISTRATE: IS ANYBODY LIVING IN THE HOUSE?

>> I HAVE A TENANT IN THERE NOW. >> SPECIAL MAGISTRATE: THAT CONCERNS ME, BASED ON THESE PHOTOS.

>> IT'S NOTHING THAT'S -- ALL OF THAT HAS BEEN TAKEN CARE OF.

I DON'T UNDERSTAND. IT'S DEFINITELY IN LIVABLE CONDITION FROM WHEN I INITIALLY PURCHASED IT.

I HAD TO TEAR OFF ABOUT 1700 SQUARE FEET OF HOUSE THAT THEY

BUILT DOWN. >> SPECIAL MAGISTRATE: I UNDERSTAND THAT. AGAIN, I REALLY AM CONCERNED ABOUT PEOPLE LIVING HERE. I SEE TWO PEOPLE IN THE BACK.

>> THAT'S THE ISSUES, MA'AM. >> SPECIAL MAGISTRATE: I SAID I'M CONCERNED SOMEONE WOULD BE LIVING IN THIS HOUSE.

UNLESS YOU HAVE SOME BETTER PICTURES.

>> YES, MA'AM. >> SPECIAL MAGISTRATE: SHOW ME, IF YOU HAVE MORE RECENT ONES. THIS DOESN'T DO YOU ANY FAVOR HERE. IN THE PAST AND NOT QUITE COMPLETED. YOU ARE RENTING THE PROPERTY OUT. I TRULY HAVE PROBLEMS WITH LANDLORDS WHO RENT PROPERTY THAT IS NOT UP TO CODE.

THEY COLLECT RENT AND THE PEOPLE LIVE IN DEPLORABLE CONDITIONS.

THAT'S WHY THE CITY HAS BUILDING CODES.

I'M NOT GOING TO DEBATE WHETHER OR NOT THEY SHOULD OR SHOULD NOT HAVE THEM. BUT I JUST -- I HAVE A HARD TIME ACCEPTING LANDLORDS WHO COLLECT RENT AND SOMETIMES THESE HOUSES

ARE REALLY NOT UP TO CODE. >> MA'AM, ONE OF THE BIGGEST ISSUES WAS THE ELECTRICAL. IT WAS PULLED BY STONEY ELECTRIC. THEIR THE ONES WHO CAME OUT --

>> SPECIAL MAGISTRATE: THAT IS NOT BEFORE ME THIS MORNING.

THAT MIGHT BE COMING UP ON THE NEXT ONE.

THAT'S THE NEXT MATTER BEFORE THE COURT.

ANYTHING FURTHER WITH REGARDS TO THIS CASE?

>> NO, MA'AM. >> SPECIAL MAGISTRATE: DO YOU ALL WANT TO SPEAK? ONE EVER YOU OR BOTH OF YOU?

COME FORWARD, PLEASE. >> THE CLERK: CAN YOU HAVE A

SEAT IN THE FRONT ROW. >> I'M CRYSTAL.

[00:15:01]

>> I'M HARRY COOPER JR. >> SPECIAL MAGISTRATE: WHO WANTS

TO SPEAK FIRST? >> WE RENTED THE HOUSE FROM MR. MORGAN, SIGNED THE LEASE MARCH 23RD.

WE MOVED GAVE HIM THE FIRST MONTH, LAST MONTH, AND DEPOSIT.

WE MOVED IN, AS MONTHS GO ON PROBLEMS START SHOWING UP.

ELECTRICAL OUTLETS NOT WORKING. NO COVERS OVER -- WE HAVE NO COVERS OVER THE AC VENTS. RATS, TERMITES, RIGHT NOW NO AC.

THAT'S THE SECOND TIME IT'S WENT OUT TOTALLY.

IT'S GONE LIKE THREE WEEKS. THERE IS MOLD.

>> RATS. >> UNDERNEATH THE KITCHEN SINK AND BATHROOM SINK, THERE IS MOLD.

>> MA'AM, I'VE GOT A VIDEO. >> SPECIAL MAGISTRATE: FOR THE RECORD, YOUR NAME IS. LET'S DO ONE PERSON AT A TIME.

ONLY BECAUSE IT'S BEING RECORDED.

IT HAS TO BE TRANSCRIBED AND BOTH OF YOU ARE TALKING SOMETIMES THE TRANSCRIPTIONIST WON'T PICK IT UP.

THAT GOES FOR YOU, TOO, LITTLE FELLA.

YOU'VE BEEN QUIET, BUT YOU WERE BUSY BACK THERE.

YEAH, HE'S READY TO TALK. >> HE CAME TO FIX THE SINK IN THE MASTER BEDROOM. BUT IT'S BROKEN.

WITH THE MOLD THAT WAS UNDERNEATH IT, ALL HE DID WAS PUT A PIECE OF WOOD ON TOP OF THE MOLD.

THERE IS JUST -- IN MY BATHROOM WE NOTICED LAST NIGHT FROM SO MUCH WATER LEAKING, THE SIDE OF THE WALL NOW HAS A BIG HOLE IN IT NEXT TO MY SINK. THE TOILET IN MY BATHROOM, EVERY TIME IT FLUSHES, IT LEAKS. HE IS AWARE OF ALL OF THIS.

I PAID THE PEOPLE TO COME FIX IT, I DON'T KNOW WHY THEY ARE NOT SHOWING UP." WE HAVE NOT PAID FOR IT BECAUSE IT'S -- I MEAN, THERE IS -- IT'S BAD.

IT'S REALLY BAD. HE JUST SERVED US WITH AN EVICTION NOTICE ON SATURDAY. THE HOUSE IS JUST -- THE OUTSIDE IS BAD. WE DIDN'T NOTICE WHEN WE FIRST MOVED IN. WHEN YOU FIRST MOVE IN, ROACHES GALORE. OUR DAUGHTERS WON'T USE THE FRONT BATHROOM. WE HAVE VIDEOS, PICTURES.

SOME OF THE PICTURES ARE UPDATED THAN THOSE, LIKE THE SIDE SEWER IS JUST A BOARD OVER THE WALL, OVER IT.

IN ONE OF THE PICTURES. WE HAVE VIDEOS, PICTURES OF ALL

>> SPECIAL MAGISTRATE: MR. CARTE R?

>> COOPER. >> SPECIAL MAGISTRATE: GO AHEAD,

YOU FINISH. >> THERE IS I TRY TO LIKE KEEP STUFF DOWN. SOME STUFF -- LIKE THE WALL.

HE TELL US THAT HE GONNA DO SOMETHING, AND CHRISTMAS START, HE NEVER COME DO IT. YOU GOT A PIECE OF WIRE HANGING OFF THE SIDE OF THE HOUSE WHERE KIDS CANNOT PLAY.

THE AC, HOUGH YOU GOT IT RIGGED, I DON'T KNOW, BUT IT JUST LOOK CRAZY. HE TRY TO SAY WE DON'T COMMUNICATE. HE DON'T WANT TO COME SEE ME.

HE'LL COME WHEN I LEAVE, WHEN I GO TO WORK.

I WORK HARD. I WORK SIX DAYS A WEEK.

TEN HOURS A DAY. VIP THREE DAUGHTERS.

CRYSTAL GOT TWO KIDS HERSELF AND ONE ON THE WAY, HERSELF.

IT JUST LIKE -- HE DON'T DO NOTHING.

HE WON'T DO NOTHING TO THE HOUSE.

I HAVE UPDATED PICTURES, VIDEOS GOING AROUND THE WHOLE HOUSE.

WHAT IT IS, I JUST FEEL LIKE HE SHOULD HAVE GONE ON HIS WAY AND NOT RENTED THE HOUSE. JUST LIKE I TOLD HIM HIMSELF.

>> AND IT'S BEEN -- I SIGNED THE LEASE ON MARCH.

I HAVE ACCOUNT OF MY ELECTRIC BILLS, $450.

BECAUSE WHEN THE AC DID WORK, IT RAN ALL DAY LONG.

IF I HAD ITSET AT 73 T RAN ALL DAY LONG AND NEVER SHUT OFF AND THE TEMPERATURE WOULD BE UP TO 89.

RIGHT NOW IT'S GONE ON TWO WEEKS, IT'S COMPLETELY OFF AND THAT'S THE SECOND TIME. IT'S FLORIDA, AND I'M FIVE MONTHS. PREGNANT AND IT'S HOT.

I MAY PASS OUT. IT'S VERY UP LIVEABLE AND UNSAFE. IT'S BAD.

>> AS WELL I SAID WOULD YOU PUT YOURSELF IN OUR KIND OF SITUATION, WOULD YOU DO YOUR FAMILY LIKE THAT? WOULD YOU? I'VE BEEN HERE 35 YEARS, I'M A LIFE-LONG RESIDENTS OF FORT PIERCE, FLORIDA.

I SAID WOULD YOU DO YOUR FAMILY LIKE THAT?

>> SPECIAL MAGISTRATE: MR. JULIN , DID YOU SEE ANY OF THEIR

[00:20:04]

VIDEOS? >> THE CASE THAT WE'RE TALKING ABOUT NOW, THIS IS AN OLD CASE. I WASN'T -- I WASN'T ON THIS

CASE. >> SPECIAL MAGISTRATE: OKAY.

>> IT WAS GIVEN TO ME. NEITHER HERE NOR THERE, BUT SOME OF IT IS STILL -- I THINK THERE IS ANOTHER CASE COMING.

>> SPECIAL MAGISTRATE: THERE IS A CASE THAT DEALS WITH THE

ELECTRICAL. >> I JUST WANT TO MAKE SURE WE ARE KEEPING THE RECORD CLEAR AS TO WHAT EVIDENCE GOES TO WHAT CASE, IF I MAY. THIS PARTICULAR CASE, I BELIEVE IS JUST FOR UNPERMITTED WORK THAT HAS BEEN DONE OR STARTED IN THE PAST. IS THAT CORRECT?

>> THAT'S CORRECT. >> THAT'S JUST WHAT WE HAVE FOR NOW. BUT TO AVOID ANY -- TO THE EXTENT IT'S RELEVANT TO THE NEXT CASE.

I THINK THE ONLY -- THE PHOTOGRAPHS THAT WE RECEIVED ARE IN EVIDENCE. THEY SHOW THE FACT THERE WAS UNPERMITTED WORK DONE AT THE TIME THE PHOTOS WERE TAKEN.

AND THEN LET'S MOVE ON TO THE NEXT CASE F THAT'S OKAY WITH

YOU. >> SPECIAL MAGISTRATE: IT'S OKAY WITH ME. ANYTHING ELSE IN THIS CASE?

>> I HAVE NOTHING FURTHER. >> STAFF DOESN'T HAVE ANYTHING FURTHER. THANK YOU.

>> SPECIAL MAGISTRATE: YOU ALL CAN HAVE A SEAT.

AND THANK YOU FOR COMING. YOU'RE WELCOME.

MR. MORGAN? >> YES.

>> SO, YOU PULLED A DEMO PERMIT FOR THIS PROPERTY.

>> CORRECT. >> SPECIAL MAGISTRATE: YOU

DIDN'T DEMO THE PROPERTY. >> I DID.

>> YOU DID. >> YES, MA'AM.

>> WHERE ARE WE AT NOW WITH THIS PROPERTY AS FAR AS YOU ARE

CONCERNED? >> AS FAR AS THE DEMO, IT SHOULD HAVE BEEN DONE AND CLOSED OFF BECAUSE WHERE THE INITIAL PICTURES WERE, ALL OF THAT IS GONE.

I HIRED A COMPANY TO COME DEMO. I PULLED THE PERMIT BECAUSE INITIALLY I WAS GOING TO MOVE IN.

I HAD HEALTH HAZARDED IN NOVEMBER.

I HAD A DEMO COMPANY PULL THAT OUT.

IT WAS DONE. >> SPECIAL MAGISTRATE: THERE IS STILL A STRUCTURE BECAUSE THESE PEOPLE ARE RENTING.

>> THAT IS THE ADDITION. EVEN WITH WHAT THE CITY SHOWED ME -- THEY TOLD ME WHAT I NEEDED TO TEAR OUT, WHAT WAS THE ADDITION. WHAT IS THERE NOW IS THE ORIGINAL STRUCTURE OF THE HOUSE. ALL THE OTHER -- THERE WAS SIX MORE ROOMS ON THE BACK OF THE HOUSE THAT I HAD TORN OFF AND DEMOED. THAT'S ALREADY GONE.

>> SPECIAL MAGISTRATE F I MAY. >> SPECIAL MAGISTRATE: YES.

>> THE DEMOLITION PERMIT WAS ISSUED IN 2014.

THAT WAS A PARTIAL DEMO FOR THE ADDITION WITHIN THE HOUSE.

THAT WORK WAS COMPLETED. STAFF IS NOT ARGUING THAT POINT.

THE UNPERMITTED WORK THAT'S BEEN CITED IN THIS CASE, 17-2775, IS AS IT RELATES TO THE COMPOSITE EXHIBIT IS FOR THE OVERHANG, THE TRUSS, ROOF RAFTER, ABOVE-CEILING PLUMBING, ABOVE-SEALING ELECTRICAL AND AND THE 4 BY 4 POST.

IF THAT WORK HAS BEEN DEMOLISHED, OR IF ANY PORTION OF IT STILL REMAINS, THAT NEEDS TO BE PERMITTED.

THAT WOULD BE A SEPARATE DEMOLITION PERMIT FROM THE ONE

ISSUED IN 2014. >> YES, I HAVEN'T DENIAL ANY PLUMBING. THE ELECTRIC WAS DONE BY STONEY ELECTRIC. THEY PULLED THE PERMIT TO DO THE METER CHANGE. HAD TO DIG THE POWER UNDERGROUND. I HAVEN'T DONE ANY ELECTRICAL IN THE HOUSE. THEY PUT THE NEW ELECTRICAL BOX IN THERE. THERE IS NO -- POSSIBLY IF IN THE NEXT CASE BUT THERE IS NOTHING DONE AS FAR AS WIRES HANGING. ELECTRIC COMPANY DID THAT.

I HIRED A COMPANY TO COME DO THAT.

THEY HE DID THAT. I HAVEN'T DONE ANY OF THAT.

THE STRUCTURE IS JUST LIKE IT IS.

THE ONLY LITTLE THINGS I'VE DONE IS CLOSE UP THE HOLE ON THE OUTSIDE. EVERYTHING ELSE IS ALREADY DONE.

I DIDN'T REALLY DO NOTHING IN THE HOUSE.

INSTALLED KITCHEN CABINETS. >> YOU HAVE TENANTS LIVING

THERE. >> THAT WAS PROVIDER.

ALL OF THAT WAS DONE PRIOR. BUT NOW I HAVE TENANTS.

[00:25:01]

I HAVE PICTURES OF MY HOUSE BEFORE THEY MOVED IN THERE.

THEY CAN'T TELL ME -- AND I HAVE RECEIPTS FROM THE EX-TERMINATION COMPANY. I RESENT THE WAY THEY COME IN

HERE TRYING TO MAKE ME LOOK. >> SPECIAL MAGISTRATE: WE WON'T GET INTO A LANDLORD-TENANT DISPUTE.

THAT'S NOT WHAT WE DO HERE. I HAVE SAID HOW I FEEL ABOUT PEOPLE RENTING PLACES LIKE THIS. WHAT IS YOUR NEXT STEP TO

CORRECT THIS PERMIT REQUIRED. >> ALL THE PERMITS I NEED AND I WILL UPDATE THE PERMIT AND ADD THE DEMO AGAIN.

>> SPECIAL MAGISTRATE: YOU JUST NEED TO GET WITH THE CITY TO FIND OUT WHAT YOU NEED TO DO. ANYTHING FURTHER ON THIS CASE? BASED ON THE EVIDENCE AND TESTIMONY PRESENTED I FIND THAT A VIOLATION EXISTS AT 1708 NORTH 19TH STREET AND SHAWN MORGAN IS RESPONSIBLE FOR THE VIOLATION.

I WILL GIVE YOU 30 DAYS TO OBTAIN WHATEVER PERMIT IS NECESSARY, OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS, AT LEAST EVERY 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED.

GOOD MORNING AGAIN. >> SPECIAL MAGISTRATE?

>> SPECIAL MAGISTRATE: YES, SIR. GOOD MORNING.

HOW DO YOU RESPOND. >> WELL, I GOT SEVERAL THINGS TO

SAY F I MAY. >> SPECIAL MAGISTRATE: YOU MAY.

>> I WANT TO FIRST TELL YOU ABOUT WHAT WE DO.

I HAVE AFFORDABLE HOUSING IN FORT PIERCE.

I HAVE A MISSION STATEMENT, ONE SENTENCE I WOULD LIKE TO READ TO YOU. IT SAYS AFFORDABLE HOUSING FLORIDA LC CONCERNING THE CITY OF FORT PIERCE AND CITIZENS BY BUYING AND REHABBING, EYESORE, UNSAFE, SINGLE-FAMILY HOUSE AND RENTS THEM TO VETERANS, THE RETIRED AND WORKING POOR FOR 195 A MONTH OR LESS. I HAVE SOME PICTURES, IF I MAY

DOING. >> SPECIAL MAGISTRATE: WE'LL TAKE ONE CASE AT A TIME. LET'S TALK --

>> I HAVE ALL THREE OF THEM. >> SPECIAL MAGISTRATE: OKAY.

>> BUYING RUNDOWN HOUSES -- FIRST OF ALL, WHAT YOU SAID TO MR. MORGAN, I WANT TO AGREE WITH YOU.

THIS IS A HARD BUSINESS TO BE IN.

IT'S NOT EASY BUYING RUNDOWN HOUSES.

IT'S VERY CAPITAL INTENSIVE. THERE IS NEVER ENOUGH MOYNAN SO A FEW MONTHS AGO I BORROWED ALMOST $1 MILLION FROM VERO BEACH BANK SO I COULD CONTINUE BUYING RAGGEDY HOUSES HERE.

I DON'T HAVE A BUILDING OR AIRPLANE ANYMORE.

I SPENT ALL OF MY TIME AND ALL OF MY MONEY WITH THE AFOREMENTIONED MISSION STATEMENT, OF WHICH YOU ARE LOOKING AT. I'M HERE EVERY DAY, MY WORK DAY IS 14 HOURS. I WORK SEVEN DAYS A WEEK.

I DON'T REALLY DO ANYTHING OTHER THAN THIS BUSINESS.

REHABBING THESE OLD HOUSES. I SUBMIT THAT MISSION STATEMENT WHICH YOU ARE LOOKING AT NOW. I CONSIDER IT A CHARACTER FLAW, OR A WEAKNESS TO BRING PROBLEMS ON SOMEONE ELSE.

ACCORDINGLY, I'M THE CAPTAIN OF A SHIP.

I ACCEPT 100% RESPONSIBILITY FOR BEING WITH YOU HERE TODAY.

I'M SORRY THAT IT'S REQUIRED. I'VE HAD A CONFLUENCE OF

[00:45:03]

NEGATIVE EVENTS IN MY LIFE. A PERFECT STORM F YOU WILL.

HERE IS A SHORT LIST. I READ FAST.

YOU CAN LOOK AT THESE AS REASONS OR EXCUSES, IF YOU LIKE.

THE MOST IMPORTANT AND PROBABLY IS GOVERNOR DESANTIS PUT A MORATORIUM ON EVICTIONS. HE TOLD MY TENANTS THE LAST FIVE MONTHS I COULDN'T EVICT THEM. A LOT OF THEM QUIT PAYING RENT.

PLEASE LET ME SHOW TO YOU THIS >> SPECIAL MAGISTRATE: MR. HATFI ELD, I'M FAMILIAR WITH THE WORK YOU DO IN THE CITY.

I'VE BEEN HERE A LONG TIME AS WELL.

I APPRECIATE WHAT YOU DO. I WANT TO STAY FOCUSED ON THIS PARTICULAR CASE, WHICH HAS TO DEAL WITH OBTAIN A PERMIT FOR

THE INSTALLATION OF THE AC UNIT. >> I'LL MOVE QUITE QUICKLY, THEN. THERE ARE 51 PEOPLE NOT PAYING RENT F THEY ALL PAY 1,000 A MONTH, THAT'S 5100 A MONTH, SO IT'S SIGNIFICANT TO HAVE THAT HAPPEN.

MY MAIN MAINTENANCE MAN, STEVE, DEVELOPED SOME KIND OF NEUROLOGICAL PROBLEM AND CAN NOW ONLY WORK PERMIT.

LAST FRIDAY MY COLLEGE ROOMMATE TRANSFERRED FROM THE HOSPITAL TO HOSPICE. THE PROPERTY MANAGER I HAD FOR 24 YEARS, JENNY, I DON'T KNOW IF YOU MET HER OR NOT, BURNED OUT FROM THE PRESSURE AND QUIT. THE REPLACEMENT WHO WAS RESPONSIBLE FOR CORRECTING THESE VIOLATIONS, IT WAS HER RESPONSIBILITY TO DO ALL OF THIS, TOOK ME OUT FOR MY LOCKED MAIL BOX AND I TOLD HER IT WAS A FELONY, SHE QUIT.

SHE WAS REALLY THE PERSON THAT RAN THIS BUSINESS.

THAT LEFT ME WITH ONE FULL-TIME OFFICE MANAGEMENT EMPLOYEE WHO WAS INCREDIBLY UNRELIABLE. I HAVEN'T HEARD FROM HER SINCE A WEEK BEFORE LAST. THIS IS A WONDERFUL SINGLE WORKING MOM BUT SHE IS PERMIT PE BECAUSE SHE HAS -- I WAS OPERATED ON FOR SCHOOL SKIN CANCER.

I LOST 25 POUNDS BEFORE I FOUND I HAD INTESTINAL PARASITES.

BECAUSE I DIDN'T FORESEE ALL OF THE ABOVE PROBLEMS. WE ARE EXPERIENCING GROWING PAINS, WE ARE TRYING TO MAKE A DIFFERENCE IN FORT PIERCE. WE HAVE A FULL-TIME MAINTENANCE GUY WHO DID A WHOLE LIST OF THINGS WRONG, SO I FIRED HIM.

IN RETRIBUTION, HE CONTACTED THE CITY, TOLD ABOUT WHAT HE DID WRONG, AND USED THE CITY TO HURT ME.

VERY VINDICTIVE. THAT'S WHY I'M HERE BECAUSE OF THAT GENTLEMAN. LAST THING, MY CONSTANT COMPANION, PRINCESS, DIED LAST JANUARY THAT'S MISSION OF TIME IS THE THING THAT STOPS EVERYTHING FROM GOING WRONG ALL AT THE SAME TIME.

THAT'S KIND OF WHAT HAPPENED TO ME.

I HAD ALL OF THOSE THINGS IN THE LAST SIX MONTHS OR SO.

DON'T BE A VICTIM, BE A VICTOR AND I AM.

I DIDN'T TELL ALL OF THIS TO YOU FOR YOU TO FEEL SORRY BUT, RATHER, YOU WOULD UNDERSTAND THAT THIS PROBLEM YOU HAVE WITH ME IS NOT INTENTIONAL. DIDN'T NEVER MEAN TO BE HERE LIKE THIS. NOT EVERYTHING IS WRONGEN MY COMPUTER HASN'T CRASHED, MY HOUSE HASN'T BURNED AND I HAVEN'T HAD A HEART ATTACK YET. EVERY YEAR I INVITE CODE ENFORCEMENT TO SPEAK AT LANDLORD MEETINGS AND THEY USED MY COMPANY AS AN EXAMPLE OF DOING IT RIGHT, RATHER THAN A CERTIFIED LETTER, THEY WOULD CALL ME ABOUT THE PAINT, THE JUNK IN THE YARD OR GRASS AND WE WOULD FIX IT AND CALL THEM BACK THE SAME DAY. I HAVEN'T BEEN BEFORE THE MAGISTRATE FOR 50 YEARS. I WAS HERE ONE TIME LAST YEAR BUT FOR 50 YEARS I'VE NEVER DONE.

THIS WE COULD HAVE JUMPED ON THESE PROBLEMS AND RESOLVED THEM, BUT WE HAVE DOZENS OF OTHER PROBLEMS, TOO.

THE OFFICE WORK IS OVERWHELMING, THERE IS NO ONE DOING ANY OF IT EXCEPT LIZZY HERE. WE HAVEN'T FINISHED OR INCOME TAX YET. THE DEADLINE WAS LAST WEEK.

I AM TOLD WE NEED TO GET PERMITS FOR THESE VIOLATIONS.

I THINK WE HAVE PERMITS AND MR. COSS, BEYOND WHAT WE ARE DOING WRONG. WE ARE WRONG A LOT.

I DON'T THINK WE CAN FIX ALL OF THIS IN 30 DAYS.

WE CAN PROBABLY FIX ONE EVERY THREE OR FOUR WEEKS.

>> SPECIAL MAGISTRATE: HERE IS HOW IT WORKS.

>> MORE SPECIFICALLY -- EXCUSE ME?

>> SPECIAL MAGISTRATE: ONCE YOU PULL THE PERMIT, YOU HAVE 180 DAYS TO COMPLY WITH ALL THE CONDITIONS.

>> MAYBE THAT'S WHAT WE DID WRONG.

MOST OF WHAT WE ARE DOING HERE IS WE HAD AIR CONDITIONING CENTRAL SYSTEMS THAT WENT BAD. THERE IS THREE OF THEM.

THEY WENT BAD. WE USED PARTS THAT WE ALREADY HAD AND REPLACED THE PART THAT WENT BAD.

THEY ARE ALL THREE WORKING FINE. THE PROBLEM EXISTS IS THAT WE DIDN'T GET PERMITS. IS THAT CORRECT?

[00:50:03]

>> SPECIAL MAGISTRATE? MR. HATFIELD, THE ONLY PERMIT THAT'S BEEN ISSUED IS FOR -- WE DO NOT HAVE ANY PERMITS FOR 928, 930, OR 703. IT APPEARS THESE ARE NEW UNITS THAT HAVE BEEN INSTALLED. AS THE SPECIAL MAGISTRATE REFERRED BEFORE. WE ARE DEALING WITH 928 SKYLARK DRIVE. MR. BOSSANO HAS PICTURES OF THAT UNITS THAT WAS REPLACED WITHOUT A PERMIT.

TO CURE THIS VIOLATION, WE SIMPLY NEED TO HAVE A PERMIT.

ONCE THE WORK HAS BEEN COMPLETED, WHICH IT HAS, YOUR CONTRACTOR WOULD SCHEDULE AN INSPECTION AND WE'LL VERIFY THAT

THE WORK HAS BEEN DONE TO CODE. >> IS THAT ALL THAT'S REQUIRED? CAN I GET THE PERMIT AND THAT'S IT?

>> THAT'S IT. >> WE CAN DO THAT.

IT WON'T TAKE VERY LONG. >> SPECIAL MAGISTRATE: OKAY.

I CAN SEE THE PHOTOGRAPHS. IF YOU WANT TO ADMIT THEM.

IT'S UP TO YOU. >> YES, PLEASE.

>> SPECIAL MAGISTRATE: DID THEY SEE? SHOW IT TO THEM.

>> SPECIAL MAGISTRATE: DO YOU WANT TO ADMIT THOSE?

>> THE CLERK: WE'LL MOVE TO ADMIT THOSE.

SHOW THEM TO THE MAGISTRATE, PLEASE.

>> I DON'T MEAN TO TAKE SO LONG. I WANTED YOU TO KNOW WHERE WE

ARE AND WHAT WE ARE DOING. >> SPECIAL MAGISTRATE: THOSE WILL BE ADMITTED AS CITY COMPOSITE 1.

ANYTHING FURTHER ON THIS CASE? THERE BEING NOTHING FURTHER IN IN PARTICULAR CASE, I FIND THAT WITH REGARDS TO 19-3088, 928 SKYLARK DRIVE, THAT THERE IS A VIOLATION, THAT JAMES HATFIELD IS RESPONSIBLE FOR THE VIOLATION.

YOU WILL BE GIVEN 60 DAYS TO OBTAIN A PERMIT.

OBTAIN APPROVAL FOR ALL REQUIRED INSPECTIONS AT LEAST 180 DAYS UNTIL THE PERMIT HAS BEEN CLOSED.

COMPLY WITH OTHER CONDITIONS AND CURE ALL OTHER VIOLATIONS DESCRIBED IN THE ORDER NOT REQUIRING A PERMIT, OR FINE OF $100 PER DAY WILL BE ASSESSED. YOU HAVE 30 DAYS TO APPEAL.

>> SPECIAL MAGISTRATE: NO, THAT'S FINE.

>> SPECIAL MAGISTRATE: YOU KNOW AS THE LANDLORD, YOU HAVE A RIGHT OF INSPECTION. I THINK YOU LISTENED THIS MORNING. MY PROBLEM IS WHEN I SEE THESE KIND OF PHOTOGRAPHS, I GET CONCERNED BECAUSE MOST OF THESE PLACES HAVE TENANTS. MOST TENANTS HAVE CHILDREN.

AND SO MY CONCERN IS NOT ONLY ABOUT THE CONDITION OF THE PLACE, BUT ALSO ABOUT THE LIVES TA LIVE IN THAT PLACE EVERY DAY.

SOMETIMES IT'S JUST A HEALTH HAZARD.

AND I OFTEN TIME ASK FOLK, WOULD YOU LIVE IN IT? WILL YOUR CHILDREN AND GRANDCHILDREN LIVE THERE? SO THAT IS HOW I VIEW IT. I KNOW SOMETIMES TENANTS CAN BE

YOU DO IT WHEN IT'S CONVENIENT FOR THE TENANTS AND FOR YOURSELF AS WELL. SOME OF THESE PROBLEMS COULD BE ELIMINATED. THE PROBLEM IS I DON'T KNOW IF THE PROBLEM EXISTED WHEN THEY MOVED IN THERE OR IF THEY CREATED THE PROBLEM. SO YOU JUST HAVE TO STAY ON TOP OF IT TO PROTECT YOURSELF AND THEM, TOO.

I WILL ALLOW THE WITHDRAWAL OF THE PERMIT REGARDING THE AC.

NOW WITH WINDOWS AND SCREENS AND ELECTRICAL, HOW MUCH TIME DO YOU

NEED TO CORRECT THAT? >> THE PART SHOULD BE IN ANY DAY. IF YOU COULD GIVE ME ANOTHER 30

I DID NOT GET AN UNDELIVERABLE MESSAGE ON THE SECOND E-MAIL.

>> I WOULD ASK THE RESPONDENT IF HE WOULD HAVE ANY OBJECTIONS TO

THE PHOTOGRAPHS COMING IN. >> SPECIAL MAGISTRATE: ON COULD WE GET A DESCRIPTION? WHAT ARE THE PHOTOGRAPHS

DESCRIBING? >> THE DEMOLITION, THE SIDEWALK, AND BREAK EVERYTHING, DAMAGE THE NEIGHBOR PROPERTY.

>> SPECIAL MAGISTRATE: OKAY. YOU DIDN'T GET ANY PHOTOGRAPHS,

MR. SPALDING? >> NO, I HAVEN'T GOT ANYTHING.

>> SPECIAL MAGISTRATE: BUT YOU ARE AWARE OF HOWEVER THE AREA THERE LOOKS NEAR THE RIVER, RIGHT?

WITH THE SEAWALL. >> YES, I KNOW.

WHAT HAPPENED IS -- CAN I EXPLAIN WHAT HAPPENED?

>> SPECIAL MAGISTRATE: SURE. >> FIRST OFF, I HAD TO COME HOME EARLY THIS YEAR BECAUSE THE GAL I HAD WITH HIM WAS FROM CANADA, LONDON, ONTARIO. I HAD TO COME HOME 15TH OF APRIL. I HAD TO COME HOME ABOUT THE 15TH OF FEBRUARY. BECAUSE SHE HAD TO BE BACK IN HER HOME COUNTRY. THEY INSISTED OF HER COMING BACK. DY HIRE SOMEBODY.

I PAID THEM $2,000 UP FRONT TO DO IT.

AND THEN THAT'S WHEN WE GOT DONE.

WELL, HE BUILT IT ALL UP WITH AN ELECTRIC JACK, PLUGGED IT IN AT THE BOATHOUSE. HE GOT IT ALL BROKE UP AND TOOK THE JACK HAMMER BACK TO PARKS. I GET HE GOT IT FROM PARKS.

[01:35:03]

HE CAME BACK THE NEXT DAY AND EVERYTHING WAS GOING -- NOW HE HAD TO GET BACK UP HERE BECAUSE SHE HAD TO GET BACK IN HER COUNTRY. I LEFT AND NEXT THING I KNOW -- BY THE WAY, I GAVE HIM THE 2,000 IN THE MORNING.

THE DAY BEFORE. THEN I GIVE HIM THE REST OF IT BECAUSE HE DID SUCH A GOOD JOB, I GOT THE AMOUNT RIGHT HERE.

LET'S SEE HERE. HERE IT IS.

I HAD TO GIVE HIM -- I GAVE HIM A SECOND CHECK, $4,254 ON IT, $2,000 THE DAY BEFORE. THE CHECKS ARE ONE RIGHT AFTER THE OTHER. I THOUGHT HE WOULD DO A GOOD JOB. I NEVER THOUGHT ANYTHING WAS WRONG, EXCEPT WHEN THEY ENDED ON IT, CALLED ME AND SAID THE GUY DIDN'T COME BACK. I CALLED AND HE DIDN'T ANSWER ME ONE TIME. HE WON'T ANSWER ME NO MORE.

HE SAID THE NEIGHBOR GOT IN HIS FACE ABOUT SOMETHING.

THE NEIGHBORS GOT THE SAME PROBLEM I HAD.

IT'S ALL WASHED OUT FROM UNDERNEATH.

I WAS GOING TO PUT GRAVEL IN THERE.

I WASN'T GOING TO PUT CEMENT THERE, I WAS GOING TO PUT GRAVEL IN THERE. THEN EVERYTHING CAME TO A SCREECHING HALT. NOBODY WOULD LET ME DO ANYTHING.

I GOT IT HERE SOMEWHERE. LET'S SEE WHAT DATE WAS IT.

IT WAS 7TH JULY ELIZABETH CALLED ME.

I SAID WHAT CAN I DO? SHE SAID YOU CAN'T DO ANYTHING.

IT'S BEFORE THE COURT, YOU HAVE TO WAIT UNTIL WE GET BACK WITH YOU. WHAT I'M DOING NOW, I'M JUST NOW HEARING FROM YOU THAT SOMETHING HAS TO BE DONE.

I WAS WILLING TO DO SOMETHING BACK IN THE BEGINNING.

I DIDN'T REALIZE THIS GUY WOULD PULL ALL OF THIS.

I'M OUT, I DON'T KNOW, 6, $7,00. WHICH I'LL HAVE TO PAY AGAIN.

ALL I WANT TO DO IS GET THE PROBLEM FIXED AND SOLVED, RESOLVED, AND GET IT DONE. AND NOT HAVE ALL OF THIS PROBLEM. IT SEEMS LIKE YOU AIN'T GONNA GO ANYWHERE WITH IT UNTIL WE GET IT THROUGH THE COURTS.

NOW IT'S AN ISSUE FOR THE COURTS.

THIS IS WHERE I STAND RIGHT NOW. I DON'T LIKE IT LIKE THAT.

YOU I NEVER LEAVE ANYTHING UNFISH FINISHED -- UNFINISHED LIKE THAT IN MY LIFE. I'D LIKE TO COME DOWN THERE, BUT I DON'T WANT TO COME TO FLORIDA WITH THAT VIRUS DOWN THERE, I'M

OVER 80 YEARS OF AGE. >> SPECIAL MAGISTRATE: BASICALLY YOU'RE HERE TODAY BECAUSE YOU SIMPLY NEED TO PULL A PERMIT.

THIS GUY THAT STARTED THE WORK FOR YOU, THEN ABANDONED YOU, DID HE PULL A PERMIT? DID HE TRY TO PULL A PERMIT?

>> HE SAID HE WAS GOING TO BUT THE CITY SAID HE DIDN'T.

>> SPECIAL MAGISTRATE, MR. SPALDING, THIS IS SHAUN COSS, BUILDING COORDINATOR. I SPOKE WITH MR. SPALDING A WEEK AGO RARTDING THIS ISSUE. THE CONTRACTOR IS AN UNLICENSED CONTRACTOR. HE IS NOT ABLE TO PULL A PERMIT% NOR DID HE ATTEMPT TO PULL A PERMIT.

AT THIS TIME THERE IS NO PERMIT >> SPECIAL MAGISTRATE: MR. SPALD ING YOU ARE IN A SITUATION WHERE YOU ARE RIGHT BACK AT SQUARE

ONE. >> I SEE THAT.

I HADN'T STARTED THIS THING AT ALL THIS YEAR, THE PROBLEM WOULD HAVE BEEN CONTINUING DOWN THERE, IT WOULD HAVE BEEN DONE SOMETIMES. THE WATER WAS COMING UNDER THE SEAWALL AND WASHING THE DIRT OUT.

SO THEY COULDN'T PUT THE GRAVEL OR CEMENT THERE, SO I HAD TO BREAK THE CONCRETE OUT. HE WAS SUPPOSED TO -- I WENT THROUGH THAT. 6 YARDS OF DIRT OR GRAVEL THERE, I GUESS. I HAVE ALL THE PAPERWORK FROM HIM. NOW THAT I TRY TO LOOK HIM UP ON THE COMPUTER, HIS NAME IS -- LET'S SEE HERE.

[01:40:01]

>> SPECIAL MAGISTRATE: SIR, YOU REALIZE -- I FEEL BAD ABOUT YOUR HARDSHIP WITH THIS CONTRACTOR, BUT YOU HAVE TO HAVE A PERMIT FOR THE DEMOLITION OF THAT CONCRETE AT THE SEAWALL.

>> OKAY. >> HAVE YOU FOUND SOMEONE ELSE

TO DO THE JOB? >> I'M NOT DOWN THERE.

DO YOU HAVE SUGGESTIONS HOW I CAN FIND SOMEBODY? I WANT TO GET THE JOB DONE. I WANT THIS THING OUT OF MY HAIR. I'M TOO OLD FOR THIS.

I DIDN'T SLEEP ALL NIGHT BECAUSE THIS THING CAME UP.

I REALLY DON'T WANT TO COME DOWN THERE WITH THAT CORONAVIRUS DOWN THERE. I'M OVER 80 YEARS OF AGE.

>> SPECIAL MAGISTRATE: HOLD ON A SECOND.

MR. COSS? >> SPECIAL MAGISTRATE, SINCE WE DO HANDLE THE ENFORCEMENT ACTIVITY OF CONTRACTORS THAT AREN'T DOING THINGS APPROPRIATELY, WE CANNOT MAKE RECOMMENDATIONS ON CONTRACTORS. I WOULD REFER HIM TO THE TREASURE BUILDERS ASSOCIATION, THEY CAN MAKE A REMDESIVIR.

>> I CAN HARDLY HEAR WHAT HE IS SAYING.

I CAN BARELY HEAR WHAT HE WAS TALKING ABOUT.

>> MR. SPALDING SINCE THE BUILDING DEPARTMENT HANDLES ENFORCEMENT ACTIVITY OF CONTRACTORS THAT ARE DOING THINGS INAPPROPRIATELY, WE ENFORCE LICENSE CONTRACTING, WE CANNOT MAKE A REGS FOR CONTRACTORS.

IF YOU CONTACT THE TREASURY COAST BUILDERS ASSOCIATION, THEY CAN CERTAILY MAKE A RECOMMENDATION FOR YOU.

>> OKAY. I CAN GO TO THE KITCHEN TO WRITE THAT DOWN. IS THERE SOMEBODY CAN YOU RECOMMEND, I CAN TRY AND CONTACT.

AT MY AGE, I CAN'T HEAR. I HAVE A HARD TIME SEEING WITHOUT MIGHT HAVE GLASSES. I WILL WRITE THIS DOWN.

I CAN CONTACT SOMEBODY BUT I DON'T HAVE MY GLASSES ON.

OKAY. I'LL TRY TO WRITE IT DOWN.

WHO DO YOU WANT ME TO CONTACT DOWN THERE.

>> THE TREASURE COAST BUILDERS ASSOCIATION.

>> JUST A MINUTE. TREASURE.

TREASURE COAST BUILDERS. >> ASSOCIATION.

>> ASSOCIATION. >> THE PHOBE NUMBER 772464.

8222. 772-464-8222.

>> YES, SIR. MY NAME IS SHAUN COSS.

I SPOKE TO YOU LAST WEEK. >> DID I TALK TO YOU AT THE

HOUSE, TOO? >> YES, SIR, YEARS AGO.

>> WHAT WAS THAT REGARDS TO? >> SPECIAL MAGISTRATE: EXCUSE ME. WE HAVE SOME OTHER MATTERS BEFORE THE SPECIAL MAGISTRATE THAT I HAVE TO GET IN TO.

YOU ARE FREE TO CALL MR. COSS AND YOU ALL CAN DISCUSS.

>> CAN I HAVE THE NUMBER, PLEASE?

>> 772-467-3189. >> OKAY.

I WILL CALL HIM RIGHT BACK. >> SPECIAL MAGISTRATE BEFORE YOU MAKE A RULING, STAFF WANT TO POINT OUT THE COMPLAINANT AND NEIGHBORS ARE HERE. THEY DID WISH TO TESTIFY THIS MORNING, IF YOU WOULD LIKE TO ENTERTAIN THAT.

>> SPECIAL MAGISTRATE: I WILL. MR. SPALDING STAY ON THE LINE.

WE HAVE PEOPLE HERE WANTING TO SPEAK REGARDING THIS SITUATION AT 303 FERNADINA STREET. IS THAT WHERE IT IS?

>> THAT'S MY HOUSE. >> SPECIAL MAGISTRATE: GOOD

MORNING. >> GOOD MORNING, 241 FERNADINA STREET. I'M GLAD TO HEAR THAT IT SOUNDS LIKE YOU ARE GOING TO HIRE SOMEBODY TO TAKE CARE OF IT.

WE WERE UNDER THE IMPRESSION NOTHING TO BE DONE UNTIL YOU CAME BACK IN OCTOBER FROM THE CONVERSATION HE HAD WITH KIRK.

I HAVE PICTURES FROM THE SEAWALL AND THE WHOLE AREA LOOKED LIKE BEFORE HE DID THE CONSTRUCTION. I THINK YOU CAN SEEP IN THE PICTURES, OUR PROPERTY IS RIGHT NEXT TO IT, THAT OUR CEMENT IS CACAVING IN AS A RESULT OF IT. EVERY TIME IT RAINS.

EVERY TIME THERE IS A BAD STORM T FALLS IN FURTHER AND FURTHER.

WE ARE LOSING OUR PROPERTY AS WELL AS A RESULT OF THE UNLICENSED CONTRACTOR NOT FINISHING THE WORK.

WE ARE VERY CONCERNED BECAUSE WE DIDN'T DO ANYTHING AND WE JUST

WANT TO GET IT FIXED. >> IT'S ALL WASHED OUT LIKE MINE

WAS. >> IT WASN'T FALLING IN, IT WASN'T CAVING IN. IT MAY BE WOULD HAVE DONE THAT

[01:45:02]

EVENTUALLY, BUT THIS IS WHAT -- >> I WAS STANDING THERE WITH KIRK AND IT WAS CAVED IN PROBABLY A FOOT, 18 INCHES DOWN TO IT THE BOTTOM OF THE SEAWALL. IT DIDN'T DO ANY GOOD.

>> I HAVE PICTURES THAT SHOWED WHAT IT LOOKED LIKE.

>> CAN YOU HAVE THE PICTURES. I GOT TO GET A HOLD OF THIS GUY AND GIVE AND STRAIGHTEN THE MESS OUT, I GUESS.

>> SPECIAL MAGISTRATE: DO YOU HAVE PHOTOS YOU WANT TO ADMIT?

>> DO YOU WANT ME TO GIVE THEM TO --

>> SPECIAL MAGISTRATE: TO THE ATTORNEY.

>> THANK YOU. >> I JUST HAD DATES ON THE PHOTOS SO CAN YOU SEE. ONE OF THEM WAS MORE THAN A YEAR AGO. AND THIS IS RECENT.

ALL WE REALLY -- >> ARE THEY DATED WHEN THEY WERE

TAKEN? >> YES, THEY WERE ALL DATED AND THEY SHOW THE SEAWALL LOOKED CONSISTENT FOR A YEAR UNTIL THIS WORK WAS DONE. NOT THE SEAWALL BUT THE ACTUAL CEMENT BEHIND THE SEAWALL, THAT NOTHING WAS CHANGING.

>> THE SEAWALL HASN'T CHANGED HAS IT?

>> I DON'T BELIEVE SO. SO I THINK IT COULD HAVE HAVE LASTED FOR QUITE A LONG TIME. WE BOUGHT THE HOUSE A YEAR AGO.

>> SPECIAL MAGISTRATE: MR. SPALD ING, I WILL NOT BE ENGAGING IN CONVERSATION HERE. THIS IS RECORDED.

>> SORRY, I GOT TO GET A HOLD OF SHAUN COSS AND TALK TO HIM AND IT HAS TO BE DONE, I GUESS. AND I GOT THIS TREASURE COAST BUILDERS ASSOCIATION. YOU SEEM TO THINK THEY CAN HELP

ME SOMEHOW? >> MR. SPALDING, THIS IS SHAUN AGAIN. THEY WOULD BE ABLE TO REFER A CONTRACTOR TO YOU. THEY WOULD NOT BE ABLE TO PROVIDE ANY ADDITIONAL ASSISTANCE OTHER THAN THAT, TO

MY KNOWLEDGE. >> OKAY.

I NEED TO GET THIS RIGHT. THIS ISN'T STALLING, I'M TRYING IN MY OWN MIND TO GET IT TAKEN CARE OF.

I'M GOING TO CALL TREASURE COAST BUILDERS TO SEE IF THEY CAN GIVE ME A CONTRACTOR TO GO OUT THERE. AND TAKE A LOOK AT IT.

IT'S BEEN ONE THING RIGHT AFTER ANOTHER IN THIS THING TRYING TO GET IT DONE. I WAS SAYING, I TRIED TO DID THIS TWO WEEKS AGO AND THEY SAID YOU CAN'T DO ANYTHING WITH IT

BECAUSE IT'S GOING TO COURT. >> SPECIAL MAGISTRATE: HERE'S WHAT -- ANY FURTHER TESTIMONY? DO YOU HAVE ANY? THANK YOU FOR COMING HERE. I WANT TO CONTINUE THIS AND GIVE HIM A CHANCE -- YOU THINK 30 DAYS WOULD BE SUFFICIENT? MAYBE 60? I DON'T WANT IT LINGERING TOO

LONG. >> I WOULD LIKE TO COME DOWN THERE, BUT WITH THIS VIRUS OUT THERE, I CERTAINLY DON'T WANT TO COME DOWN THERE AND GET IT. FLORIDA AND ARIZONA AND CALIFORNIA ARE THE WORST STATES IT SAID THIS MORNING.

THERE ARE A HELL OF A LOT MORE >> SPECIAL MAGISTRATE: MR. SPALD ING, WE WANT YOU TO STAY SAFE, CAN YOU APPEAR BY PHONE.

>> SPECIAL MAGISTRATE, I WOULD RECOMMEND 30 DAYS.

I'M HESITANT -- >> SPECIAL MAGISTRATE: THAT'S

WHAT I'M THINKING. >> SPECIAL MAGISTRATE: I HESITATE TO TAKE LONGER AND THIS SEAWALL BE JEOPARDIZED.

I DON'T KNOW IF IT'S POSSIBLE TO HAVE IT IN 30 DAYS BUT I MATE TO

PROLONG IT LONGER THAN THAT. >> SPECIAL MAGISTRATE: I'M LEANING THAT WAY MYSELF. MR. SPALDING --

>> HOW DO I GO ABOUT GETTING A >> SPECIAL MAGISTRATE: MR. SPALD ING, I WILL GO AHEAD AND CONTINUE THIS FOR 30 DAYS SO CAN YOU TRY TO CONTACT THE TREASURE COAST BUILDERS ASSOCIATION AND LOCATE A CONTRACTOR, WHO CAN ASSIST YOU IN THAT MATTER.

HOPEFULLY YOU WILL HAVE SOMETHING DONE IN A 30 DAY PERIOD. IT WILL BE ON MY CALENDAR FOR

THE NEXT DOCKET. >> I WILL TRY MY BEST.

THINGS DO NOT MOVE FAST IN FLORIDA.
