>> I THINK WE HAVE ANOTHER ONE COMING UP. SO I WANT EVERYBODY TO PAY

ATTENTION TO MR. SWEENEY. >> THANK YOU, MA'AM. >> THE CITY COMMISSION SERVES BOTH A LEGISLATIVE AND QUASI-ROLE. THE COMMISSION ENGAGES IN LAW MAKING ACTIVITY BY PASSING LAWMAKERS AND ESTABLISHING POLICIES.

WHEN ACTING AS A QUASI-JUDICIAL BODY THE COMMISSION APPLIES THOSE LAWS AND POLICIES IS HELD TO STRICTER PROCEDURAL REQUIREMENTS.

QUASI-JUDICIAL PROCEEDINGS ARE LESS FORMAL THAN PROCEEDINGS BEFORE A CIRCUIT COURT BUT ARE MORE FORMAL THAN THE NORMAL COMMISSION MEETING.

QUASI-JUDICIAL PROCEEDINGS MUST FOLLOW BASIC STANDARDS OF NOTICE AND DUE PROCESS AND DECISIONS MUST BE MADE BASED ON COMPETENT SUBSTANTIAL EVIDENCE.

THEREFORE, COMMISSIONERS HAVE A DUTY TO CONDUCT THE QUASI-JUDICIAL PROCEEDINGS MORE LIKE JUDGES THAN LEGISLATORS. THAT IS WHY THE COMMISSION HAS ESTABLISHED THE UNIFORM PROCEDURES FOR QUASI-JUDICIAL HEARINGS THAT

WILL BE FOLLOWED THIS EVENING. >> THANK YOU.

MADAM CLERK HAVE WE MET THE ADVERTISING REQUIREMENTS FOR THIS ITEM?

>> YES, MA'AM, WE HAVE MET THE ADVERTISING REQUIREMENTS.

COMMUNICATIONS ON THIS MATTER? >> NO, MA'AM.

>> COMMISSIONER PERONA. >> NO, MA'AM. >> COMMISSIONER SESSIONS.

NOW IT IS TIME TO SWEAR IN ANY WITNESSES WHO PLAN TO SPEAK ON THIS ITEM.

WILL ANYONE WISHING TO SPEAK ON THIS ITEM PLEASE STAND AND RAISE YOUR RIGHT HAND.

ANYONE OFFERING PUBLIC COMMENT. DO YOU SWEAR OR AFFIRM TO TELL THE TRUTH AND WHOLE TRUTH AND NOTHING BUT THE TRUTH.

>> YES. >> THANK YOU VERY MUCH. >> ALL RIGHTY.

IT IS TIME FOR THE STAFF TO MAKE ITS PRESENTATION. THANK YOU AND WELCOME.

>> GOOD EVENING, MADAM MAYOR, CITY COMMISSIONERS. THIS IS A DEVELOPMENT REVIEW DESIGN REVIEW AND CONDITIONAL USE APPLICATION FOR THE SUBJECT PROPERTY AT 3,000 OKEECHOBEE ROAD. SUBJECT PROPERTY IS LOCATED AT THE NORTHEAST CORNER OF SOUTH 31ST STREET IN OKEECHOBEE ROAD. THERE'S APPROXIMATELY 6.796 ON ACRES. SUBJECT PROPERTY CURRENTLY HAS A FUTURE LAND USE OF G.C. BUT JUST A SECOND READING TO CHANGE IT TO R.M. AND IT CURRENTLY HAS A ZONING OF C-3 WHICH IS GENERAL COMMERCIAL WHICH YOU ALSO JUST SAW REZONING FROM G.C. TO R.M. WHICH IS MEDIUM DENSITY RESIDENTIAL. STAFF RECOMMENDS APPROVAL BECAUSE IT'S IT DOES NOT ADVERSITY AFFECT THE PUBLIC HEALTH IT'S WITHIN PROXIMITY TO KEY COMMERCIAL AMENITIES. THE SITE PLAN BEFORE YOU HAS THE FOLLOWING AMENITIES WHICH ARE SEVERAL TO CONSIDER THERE WILL BE FIVE APARTMENT BUILDINGS, TWO AND THREE STORY BUILDINGS. 112 UNITS, MAXIMUM HEIGHT OF 39 FEET.

[00:10:01]

CLUBHOUSE WITH SWIMMING POOL, TOT LOT WITH PLAYGROUND, BENCHES.

A WALK AROUND A LAKE WITH PICNIC TABLES AND BENCHES, A FENCED OFF PARK.

SOME OF THE REQUIRED PARKING SPACES WOULD BE 168 THE APPLICANTS PROVIDING 172.

SEVEN OF THOSE BEING HANDICAPPED. REQUIRED BICYCLE SPACES ARE 12 THE APPLICANTS PROVIDING 14. FOR THE INNOVATIVE RESIDENTIAL DEVELOPMENT THE CITY CODE SECTION REQUIRES THAT YOU PROVIDE A MAGNITUDE OR CREATIVE HOUSING DEVELOPMENT OF SOME SORT AND THE APPLICANT EXCEEDS THIS THROUGH ITS LANDSCAPING, AND DESIGN. THROUGH THE LANDSCAPING THE REQUIRED LANDSCAPE AREA REQUIRE 168 TREES BUT THE APPLICANT IS PROVIDING 303.

WHICH EXCEEDS BY 80.4%. THE SITE PLAN CREATED PLACEMENT OF THE BUILDINGS FOCAL POINTS VIEW AND WIND ORIENTATION AND VARIATION IN BUILDING AND SETBACKS IN BUILDINGS. SUCH AS THE TWO STORY AND THREE STORY BUILDINGS FOR THIS DESIGN THE APPLICANT USES IMAGINATIVE DESIGN FEATURES HARMONIOUS USE OF THE MATERIAL BUILDINGS AND NEOMODERN ARCHITECTURE WITH BALCONY, WINDOW CANOPIES AND OPEN AIR STAIR SPACES. THIS WAS THE FIRST SUBMITAL FOR THE ELEVATION WHICH IS BASICALLY WHITE AND GRAYS. ONE OF OUR CONDITIONS FOR THE APPLICANT WAS TO ADD SOME COLOR. THE APPLICANT HAS SINCE SUBMITTED THIS

ELEVATION WITH LIKE A LIGHT GREEN, LIKE BLUISH COLOR. >> THERE'S A FORT PIERCE

GREEN. >> EXACTLY. WITH 12 UNITS WE RECOMMEND APPROVAL THAT'S CONSISTENT AND DOES NOT AFFECT ADVERSITY AFFECT THE PUBLIC HEALTH IS WITHIN ONE FOURTH OF A MILE OF A TRANSIT STOP. IS ELIGIBILITY FOR DENSITY BONUS PURSUANT TO THE COMP PLAN POLICIES 1.1 6A AND 7. APPROVAL OF THE REQUEST A LANDSCAPE BOND WILL BE NEEDED TO PROVIDED AT THE TIME OF THE CERTIFICATE OF OCCUPANCY FOR EACH BUILDING PURSUANT TO CITY CODE SECTION THE LANDSCAPE BOND FOR THE COMMON AREAS, CLUBHOUSE, LAKES AND PARKING AREAS SHALL BE SUBMITTED BEFORE THE CERTIFICATE OF OCCUPANCY IS ISSUED FOR THE FIRST BUILDING IN EACH PHASE. TWO AT THE TIME OF THE BUILDING PERMIT SUBMIT A SIGN AND SEALED BOUNDARY TO THE ENGINEERNG DEPARTMENT IN ACCORDANCE WITH CITY CODE SECTION 119- A 7 THREE REMOVE THE LIGHT GRAY FROM THE COLOR SCHEME AND USE COLORS OF BLUE, VIOLET OR BLUE GREEN COLLAR PALETTE WHICH THE APPLICANT HAS DONE. -- COLOR PALETTE WHICH THE APPLICANT HAS DONE.

AND A MINIMUM DISTANCE OF THREE FEET IN ALL DIRECTIONS.

SUCH LANDSCAPE AREAS SHALL COMPLETELY COVERED BY GROUND COVER AND SHRUBS VEGETATION IN THE AREAS SHALL BE MAINTAINED AT A HEIGHT OF LESS THAN 12 INCHES.

THERE WAS ALSO AN ADVISORY COMMENT CONSIDER A GATED ENTRANCE FOR THE HEALTH, SAFETY AND WELFARE OF THE FUTURE TENANTS OF THE PROPOSED DEVELOPMENT.

DETAILS NEED TO BE WORKED OUT BETWEEN THE DESIGN APPLE AND THE PLANNING DEPARTMENT.

HOWEVER WE HAVE SPOKEN WITH THE APPLICANT AND THEY WOULD NOT LIKE TO DO THE GATED

ENTRANCE WHICH WE DON'T HAVE A PROBLEM WITH. >> RIGHT, I REMEMBER THAT

WAS IN THE T.R.C. THAT WAS ONE THE ONE, RIGHT? >> IT WAS REALLY COST PROHIBITIVE AND THE APPLICANT IS HERE IF YOU WANT TO TALK FURTHER.

I KNOW YOU HAD MENTIONED THAT AT THE LAST COMMISSIONER MEETING.

>> THANK YOU. IS THAT THE END OF YOUR PRESENTATION.

ARE THERE ANY QUESTIONS OF STAFF. >> I HAVE A FEW QUESTIONS.

BACK ON THE SITE PLAN. LOOKING IT LOOKS LIKE THE PROJECT DOES NOT CONNECT TO

SOUTH 31ST STREET, DO I HAVE THAT ACCURATE? >> IT DOESN'T CONNECT TO IT,

NO. >> WHICH IS TO THE WEST OF THE PROPERTY.

>> CORRECT. THE BOTTOM LEFT-HAND CORNER THERE.

WHY THERE IS A PEDESTRIAN CONNECTION THERE? BECAUSE I BELIEVE -- IS THERE A PEDESTRIAN CONNECTION THERE? I BELIEVE THERE'S AN EAST WEST ROAD NEBRASKA THAT DOES CONNECT WITH 33RD WHICH IS ONE OF OUR MAJOR NORTH SOUTH CONNECTERS. CAN YOU TALK TO ME ABOUT THAT.

>> I DO REMEMBER WE HAD REQUIRED SIDEWALKS AND THERE WAS DISCUSSION BETWEEN THE ENGINEERING DEPARTMENT THAT THEY RECOMMENDED THAT THEY NOT DO SIDEWALKS BECAUSE THERE WAS LIKE A HUGE SWELL OR SOMETHING LOCATED ON THAT STREET.

DRAINAGE. >> ON THE NORTH SIDE. >> ON THE WESTSIDE.

[00:15:01]

>> ON THE WESTSIDE. OKAY. HOW ABOUT THE INTENSITY OF THE LANDSCAPE AND THE FRONTAGE. OBVIOUSLY IT'S AN IMPORTANT FACTOR THAT WE INCLUDE THE LANDSCAPE BUT I WANT TO BE ABLE TO NOT, I GUESS, IMPACT A DRIVERS VISION WHEN THEY COME UP TO THE STOP BAR TO EXIT ON TO MERGE ONTO OKEECHOBEE ROAD. WHAT DOES THE LANDSCAPE PLAN LOOK LIKE AT THE ENTRANCE?

>> I HAVE A LANDSCAPE SLIDE. >> THE REASON I BRING THIS UP WE'VE HAD PROBLEMS ON OKEECHOBEE ROAD AND VIRGINIA AVENUE. THIS IS PROBABLY ONE OF OUR PARTNERSHIPS WITH THE DEPARTMENT OF TRANSPORTATION.

WE HAVE A LANDSCAPE MEDIAN. WHEN YOU ARE MAKING THOSE LAND HAND TURN MOVEMENTS AND GOING AGAINST THE GRAIN SOMETIMES IT BECOMES AN IMPEDIMENT WITH THE

LANDSCAPING OR TREES. >> TOTALLY. >> MR. JOHNSON THAT IS PART OF OUR T.R.C. REVIEW. WE DO HAVE DOT AS PART OF OUR T.R.C. REVIEW COMMITTEE.

WE ALSO HAVE ENGINEERING AND OUR TREE ARBORIST WHO REVIEWS THESE LANDSCAPE PLANS FOR THAT VERY REASON. SO THAT THERE ISN'T A SITE YOU KNOW BLOCK IN THAT CROSS SECTION WHEN YOU'RE COMING UP AGAINST THE INTERSECTION. IF THAT IS SOMETHING YOU WOULD LIKE AT FURTHER WE CAN DO THAT. WE CAN DO THAT TO MAKE SURE THERE ISN'T SOMETHING THAT WOULD IMIMMEDIATE THE DRIVER FROM TAKING A TURN SAFELY.

>> SO I THINK MY WORRY WOULD BE MOSTLY MAYBE AN EASTBOUND TRAVEL WANTING TO TURN INTO IN COMMUNITY OFF OF OKEECHOBEE ROAD INTO THE COMMUNITY AND THEY HAVE TO GET INTO THE MIDDLE SECTION OF OKEECHOBEE ROAD. IF I REMEMBER CORRECTLY, THERE ARE OAK TREES ALONG THAT CORRIDOR OF OKEECHOBEE ROAD.

I JUST DON'T WANT TO CREATE AN ENVIRONMENT WHERE THEY ARE MAKING THAT TURN AND CAN'T SEE THE TRAFFIC. IF THERE'S AN ADJUSTMENT THAT NEED TO BE MADE THEN

LET'S DO THAT. >> ABSOLUTELY. COMMISSIONERS, WE ACTUALLY OUR REQUIREMENTS FOR LANDSCAPE PLANS ARE THE FORMAL SUBMITAL FOR THE LANDSCAPE PLANET IT OF PLANNING PERMIT. THEY WILL HAVE ANOTHER

OPPORTUNITY. WE CAN MAKE A NOTE OF THAT. >> THAT'S OUT IN THE RIGHT OF WAY. THIS IS AN IMPROVEMENT THAT THEY'RE REQUESTING.

SO I WOULDN'T BE OPPOSED TO YOU ASKING THEM TO MAKE ADJUSTMENTS IF THE OAK TREES NEED TO BE ADJUSTED OR WHATEVER LANDSCAPING IS IN THE MEDIAN BECOMES AN ISSUE.

>> ANYTHING ELSE? ANY OTHER QUESTIONS? >> YES.

>> COMMISSIONER ALEXANDER. WE ARE ON ITEM NUMBER 12 D, D AS IN DOG.

>> OKAY, THANK YOU. THE STAFF HAS JUST MADE ITS PRESENTATION AND I'M GETTING

READY TO OPEN THE PUBLIC HEARING. >> OKAY.

THANK YOU. >> YOU'RE WELCOME. SO I WOULD LIKE TO NOW ASK THE APPLICANT TO COME FORWARD IF THE APPLICANT IS HERE.

ARE WE SIGNING IN TONIGHT? WE'RE NOT SIGNING IN. DO HAVE YOU ANY QUESTIONS OF

THE STAFF? >> I DON'T. THANK YOU.

>> SO YOU MAY BE EXCUSED. THANK YOU VERY MUCH. SO STATE YOUR NAME.

>> THANK YOU ADDRESS FOR THE RECORD. >> MAYOR MY NAME IS MICHAEL SANCHEZ I'M A MANAGED LAND ENTITLEMENTS REPRESENTING THE PROPERTY OWNER.

IT'S A PLEASURE TO BE HERE AGAIN WITH YOU TONIGHT. I WANT TO THANK STAFF THEY

HAVE BEEN GREAT TO WORK WITH ON THIS PROJECT. >> GOOD.

>> I LIKE TO HEAR THAT. >> THANK YOU. I WILL ADDRESS SOME OF THE QUESTIONS MADAM MAYOR. I JUST WANT TO SAY OUR INTENTION ON THIS PROJECT WAS TO PUT FORTH A HIGH QUALITY PROJECT THAT WE HOPE RAISES THE BAR FOR OTHER MULTIFAMILY DEVELOPMENT IN THE CITY. WE PAID SPECIAL ATTENTION TO SITE DESIGN, LANDSCAPING, BUILDING ARCHITECTURE AND SITE AMENITIES JUST TO BE ABLE TO COMPLY WITH THAT INNOVATIVE DESIGN CRITERIA AND REALLY PUT FORTH A NICE PROJECT SO WE FEEL LIKE WE HAVE GONE ABOVE AND BEYOND IN ALL THOSE AREAS.

THE RESIDENTIAL USE WILL A COMPLEMENT TO THE NEIGHBORHOOD COMMERCIAL USES UP AND DOWN THAT CORRIDOR. WE ARE EXCITED TO DEVELOP IN THE CITY OF FORT PIERCE.

WITH RESPECT TO THE QUESTIONS COUNCILMEMBER JOHNSON THE WESTSIDE OF THE PROPERTY HAS A DITCH RUNNING ALONG THERE THAT WE'RE RECONFIGURING A LITTLE BIT IT AND RUNS PROBABLY THREE-QUARTERS OF THE WAY UP THE PROPERTY.

SO I SIDE FROM BUILDING A BRIDGE WE WOULDN'T BE ABLE TO CROSS.

THAT BUT THERE IS A SIDEWALK UP ALONG OBVIOUSLY OKEECHOBEE ROAD.

AS FAR AS THE LANDSCAPE PLAN IF YOU LOOK WE HAD THERE'S WHAT THEY CALL THE SAFE SITE TRIANGLE THAT'S WE HAVE SHOWN AND THE LANDSCAPING IS SET BACK.

WE KIND OF CURVE THE HEDGING AROUND THERE. SO I THINK THERE WILL BE PLENTY OF VISIBILITY AT THE DRIVEWAY. THEN WE'RE ACTUALLY REQUIRED TO PUT A LEFT TURN, LET'S SEE YOU KNOW A LEFT TURN LANE AS YOU'RE GOING KIND OF

[00:20:03]

NORTHEAST. SO YOU WILL BE A LITTLE BIT OVER YOU DON'T HAVE TO GO INTO THE MEDIAN OPENINGMENT YOU WILL BE SITTING IN TURN LANE WHICH PUTS YOU A LITTLE FARTHER OVER AND I THINK YOU WILL HAVE A NICE LINE OF SIGHT.

BUT WE WILL CERTAINLY WORK WITH STAFF AND I THINK THAT'S A COUNTY ROAD TO MAKE

SURE RELEASE NO CONFLICTS THERE. >> YOU ARE ACTUALLY

CONSTRUCTING AN EASTBOUND WE'LL JUST CALL IT EASTBOUND >> WE ARE.

THAT'S A REQUIREMENT SO IT GETS PEOPLE OUT OF THE DRIVE ISLAND NOT JUST SITTING

THERE IN THE DEAD ZONE. >> YEAH. ANYTHING ELSE YOU WOULD LIKE

TO ADD? >> NO THANK YOU. >> ANY QUESTIONS OF THE

APPLICANT? >> THANK YOU VERY MUCH. IS THERE ANYONE ELSE IN THE AUD ENCE WHO WOULD LIKE TO ADDRESS THIS ISSUE -- AUDIENCE WHO WOULD LIKE TO ADDRESS THIS ISSUE. YOU WERE SWORN IN RIGHT MR. SANCHEZ.

OKAY, THANK YOU. I CLOSE THE PUBLIC HEARING. ENTERTAIN A MOTION OR

DISCUSSION. >> MOVE TO APPROVE WITH THOSE CONDITIONS.

>> SECOND. THERE'S A MOTION IS WILL A SECOND?

>> SECOND. >> SECOND. ALL RIGHT.

CALL THE ROLL PLEASE. >> COMMISSIONER ALEXANDER. >> YES.

>> COMMISSIONER JOHNSON. >> YES, MA'AM. >> COMMISSIONER PERONA.

>> YES, MA'AM. >> COMMISSIONER SESSIONS. >> YES, MA'AM, MAYOR HUDSON.

>> YES, MA'AM. >> MADAM MAYOR BEFORE WE MOVE ON I WANT TO CLARIFY THERE WAS MULTIPLE ITEMS INCLUDED WITHIN THAT SINGLE READING.

TO CLARIFY FOR THE RECORD THAT WAS TO ENCOMPASS ALL OF THE SITE PLAN, DESIGN REVIEW AND CONDITIONAL USE, IS THAT CORRECT FOR CLARIFICATION BY THE MOTION MAKER?

>> YES IT WORKS MOTIONS. SO ONE FOR THE SITE PLAN AND DESIGN REVIEW AND ONE FOR THE CONDITIONAL USE. THE CONDITIONAL USE IS FOR INNOVATION DEVELOPMENT.

>> YOU NEED AN ADDITIONAL RESOLUTION? MOTION? ALL RIGHTY. SO THE -- MADAM MAYOR MAY WE TREAT THE FIRST ONE AS

APPROVING WITH STAFF'S RECOMMENDATIONS. >> YES, SIR.

>> SO MOVED. >> THEN WE'LL NEED A SECOND MOTION.

>> NEW MOTION FOR THE CONDITIONAL USE. >> MOTION FOR CONDITIONAL

USE? >> MOTION TO APPROVE THE CONDITIONAL USE.

>> IS THERE A SECOND. >> WITH CHANGES. CALL ROLL.

>> CONDITIONAL USE HAVE CONDITIONS ON IT AS WELL? >> YES.

SAME. SAME CONDITIONS. >> THE FOUR SAME.

>> COMMISSIONER ALEXANDER. >> YES. >> COMMISSIONER JOHNSON.

>> YES, MA'AM. >> COMMISSIONERT PERONA, YES.

>> COMMISSIONER SESSIONS. >> YES. >> MAYOR HUDSON.

YES, MA'AM. >>> OKAY NEXT WE HAVE ANOTHER QUASI-JUDICIAL

[e. Resolution No. 20-R47 and Quasi-Judicial Hearing – A hearing to allow the owners and/or parties of interest in the property identified as 1311 Avenue E to show cause why the structure located on the premises should not be condemned and demolished.]

HEARING ON RESOLUTION 20-447 FOR RESOLUTION TO DETERMINING THAT A BUILDING CERTAIN BUILDING OR STRUCTURE IS LOCATED IS UNSAFE AND A NUISANCE THAT CONSTITUTES A MENACE TO THE BUSINESS HEALTH AND SAFETY AND THAT SAID OR STRUCTURE SHALL BE DEMONTHLY ISHED THEY WERE PROVIDED THE OPPORTUNITY TO BE HEARD AND ARE RESPONSIBLE FOR THE REMOVAL OF THE BUILDING OR STRUCTURE AND ORDERING THE CITY OF FORT PIERCE TO PROCEED WITH SUCH REMOVAL AND PLACE A LIEN UPON THE PROPERTY IDENTIFIED IF COMPLETED BY THE CITY OF FORT PIERCE, PROVIDING FOR APPEAL, PROVIDING FOR NOTICE TO ALL PARTIES AND PROVIDING FOR AN EFFECTIVE DATE.

>> MADAM CLERK, HAVE WE MET THE ADVERTISING REQUIREMENTS?

>> WE HAVE MET THE ADVERTISING REQUIREMENTS FOR THIS ITEM.

>> CAN YOU ASK THE COMMISSIONERS ABOUT EX PARTE COMMUNICATIONS.

>> YES, MA'AM. COMMISSIONER ALEXANDER HAVE HAD YOU EX PARTE COMMUNICATIONS REGARDING 1311 AVENUE E? COMMISSIONER ALEXANDER.

>> NO. >> THANK YOU. COMMISSIONER JOHNSON.

>> NO, MA'AM. >> COMMISSIONER PERONA. >> NO.

>> COMMISSIONER SESSIONS. >> NO, MA'AM. >> MAYOR HUDSON.

>> NO, MA'AM. NOW WILL YOU SWEAR IN ANY WITNESSES THAT MIGHT WANT TO

SPEAK ON THIS ISSUE. >> WILL ANYONE WISHING TO SPEAK ON THIS IDEA PLEASE STAND AND RAISE YOUR RIGHT HAND. DO YOU SWEAR OR AFFIRM TO TELL THE TRUTH, THE WHOLE TRUTH AND NOTHING BUT THE TRUTH.

THANK YOU. PLEASE PROCEED. >> GOOD EVENING MADAM MAYOR, COMMISSIONERS. WE'RE HERE TO DISCUSS THE REQUEST FOR CONDEMNATION WITH DEMOLITION OF 1311 AVENUE E. THIS PROPERTY ACTUALLY HAS A LONG HISTORY I WILL ANSWER ONE OF THE QUESTIONS THAT COMMISSIONER ALEXANDER HAD AT THE LAST HEARING. THERE WERE TWO STRUCTURES ON THIS PROPERTY THAT WERE ORIGINALLY CONDEMNED BY THE CITY COMMISSION BACK IN THE YEAR 2000.

IN 2005 THE STRUCTURE WITH THE ADDRESS OF 526 NORTH 14TH STREET WAS REPAIRED AND BECAME OCCUPIED. BUT THE ADDRESS OF 1311 AVENUE E ACTUALLY IT GOT DEMOLISHED BY THE CITY IN 2012. I CHECKED WITH THE UTILITY

[00:25:01]

AUTHORITY BOTH STRUCTURES, THE UTILITIES ARE TURNED OFF IN 2008.

SO 2008 BOTH SURE LOST THEIR UTILITIES. 2012, THE ADDRESS 1311 AVENUE E WAS DEMONTHLY ISHED. 526 NORTH 14TH STREET IS STILL THERE JUST TO BE CLEAR 1311 AVENUE E IS THE OFFICIAL ADDRESS AND ALL OF OUR HISTORY IS UNDER THAT ADDRESS. BECAUSE THAT'S WHAT THE PARCEL I.D. IS CONNECTED TO. WE'VE HAD MULTIPLE CASES AT THIS LOCATION.

IN MAY, 2018 THE PROPERTY WAS SOLD AT TAX AUCTION TO THE CURRENT OWNER.

OVER THE YEARS INCLUDING THAT TIME SINCE THE TITLE CHANGE WE HAVE INITIATED FOR LOT CLEARINGS DUE TO COMPLAINTS FROM THE NEIGHBORHOOD.

WE DID BOARD 526 IN 2019. THE CURRENT OWNER HAS BEEN NONRESPONSIVE TO ALL OF OUR REQUESTS FOR ACTION. THERE IS MULTIPLE LIENS ON THIS PROPERTY RIGHT NOW.

THE DEMOLITION OF THE 1311 AVENUE E STRUCTURE IS 23,613 WE SPENT $1900 TO BOARD IT UP AND WE SPENT OVER $1,000 IN CUTTING THE GRASS. THERE'S ANOTHER LOT CLEARING THERE RIGHT NOW. THE PROPERTY MAINTENANCE INSPECTOR'S PROPERTY WAS COMPLETED BY ED SMITH AND THEY RECOMMENDED DEMOLITION OF THE STRUCTURE DUE TO THE CONTINUED DETERIORATION OF THE STRUCTURE. THE UTILITIES AS I MENTION HAVE HAD BEEN DISCONNECTED SINCE 2018 SO IT HAS BEEN SITTING WITHOUT ANY UTILITIES VACANT FOR 12 YEARS. WE DID SECURE THE STRUCTURE BECAUSE THERE WAS SOME UNLAWFUL ACTIVITY GOING ON IN THE FACILITIES THE NEIGHBORS WERE COMPLAINING ABOUT IT. THERE WAS A TAX CERTIFICATE ISSUED IN JUNE OF THEY YEAR BECAUSE, AGAIN THE TAXES ARE NOT PAID.

WE SENT THE NOTICE OF UNSAFE BUILDING TO THE OWNER IT WAS RETURNED UNCLAIMED.

WE DID POST THE STRUCTURE AND WE SENT THE NOTICE REGULAR U.S. POSTAL SERVICE THAT NOTICE NOT RETURNED. THEN FOLLOWING THE TITLE SEARCH WE NOTIFIED A LIEN HOLDER AND CERTIFICATE HOLDER WE HAVE NOT RECEIVED ANY CONTACT FROM THEM EITHER. WE'VE HAD NO RESPONSE AT ALL. QUICK REVIEW OF THE STATUS IT IS NOT HOMESTEADED WE CONFIRMED THAT WITH THE TAX COLLECTOR AND PROPERTY APPRAISERS. IT'S NOT OCCUPIED. THERE HAS BEEN NO ATTEMPT FOR ANY CORRECTIVE ACTIVITY AT THIS LOCATION. WE DO HAVE AN ACTIVE LOT CLEARING CASE. IT IS A HISTORIC PROPERTY. SO WE DID TAKE THIS TO THE HISTORIC BOARD ALREADY THEY DID APPROVE THE DEMOLITION. THERE ARE NO UTILITIES, THERE ARE NO BUILDING PERMITS WE DID COMPLETE THE TITLE SEARCH.

EARLIEST PHOTO I COULD FIND WAS 2016 EVEN THOUGH IT HAS BEEN SITTING IN THIS CONDITION FOR MANY MORE YEARS THAN THAT. IN THIS PHOTO YOU CAN SEE YOU HAVE YOUR BROKEN WINDOWS. THE BUILDING HAS BEEN ACCESSED THERE WAS AN ATTEMPT TO BOARD IT UP AT ONE TIME BUT IT DIDN'T SUCCEED WITH TOO WELL WITH THE WINDOWS UP TOP. THIS WAS IN 2017.

THIS IS 2019 AS YOU CAN SEE AT THIS TIME THE DOOR WAS KICKED OPEN THAT'S WHEN PEOPLE WERE USING THE OUTSIDE OF THE BUILDING FOR ILLEGAL ACTIVITIS.

THIS IS THE BUILDING AFTER THIS IS THE PHOTO I TOOK JUST ANOTHER DAY.

THE ROOF IS STARTING TO DETERIORATE PRETTY BADLY. YOU CAN ACTUALLY SEE RIGHT THROUGH THE ROOF. THE STUCCO IS FALLING OFF. IN THIS LAST PHOTO YOU CAN SEE RIGHT THROUGH THE ROOF. YOU CAN SEE THE SKY ON THE OTHER SIDE OF IT.

SO THERE HAS BEEN A LOT OF DETERIORATION ON THE BUILDING WHICH IS BECAUSE IT SAT EMPTY FOR THE LAST 12 YEARS. THIS IS A QUICK OVERHEAD OF THE 1311 AVENUE E PROPERTY. THIS EMPTY SPOT HERE IS WHERE THE FIRST STRUCTURE USED TO STAND THAT WAS DEMOLISHED. THEN OUR NEIGHBORING PROPERTIES HERE. IF THE COMMISSION FINDS SUFFICIENT EVIDENCE WAS PRESENTED WE HAVE THE ACTION TO ADOPT THE RESOLUTION TO ORDER ITS DEMOLITION.

IT CAN BE AMENDED OR DENIED AT THE RULE OF THE COMMISSION.

OUR NEXT STEPS WE WOULD PROVIDE 30 DAYS THERE'S A 30 DAY RIGHT TO APPEAL.

AS I MENTION WE ALREADY DID GO TO THE HISTORIC PRESERVATION BOARD SO WE JUMP STARTED THAT STEP ALREADY. WITH A FINAL NOTICE IF NO ACTION IS TAKEN BY THE OWNER THEN THE CITY WILL HAVE THIS DEMOLITION AS PART OF OUR

C.S.I. PROGRAM. >> ANY QUESTIONS? >> ONE QUICK ONE.

>> I NOTICE ON THE PROPERTY APPRAISER CARD THE LAND SIZE IS 0.11 ACRES IS THAT THETAL PAH BOTH STRUCTURES OR ONLY ONE STRUCTURE THERE NOW, BUT DO WE KNOW?

>> I WOULD GO BY WHATEVER THEY HAVE ON THERE. >> I'M JUST THINKING AHEAD WHAT THE NEXT STEPS ARE IN THE PROGRAMS IF WE DECIDE TO DO THIS WE'LL HAVE ADDITIONAL LIENS ON THE PROPERTY. OKAY.

THANK YOU. >> YES, SIR. >> NORMALLY OUR DEMOLITION

[00:30:02]

PICTURESHAN THIS.T WORSE THIS BUILDING LOOKS LIKE IT WAS WELL BUILT AT ONE TIME. I'M LOOKING AT IT GOING YOU KNOW IT'S GOT A LITTLE BIT OF AN UNUSUAL ARCHITECTURE EVEN THOUGH IT'S JUST A SQUARE THIS TWO STORY.

IT'S GOT SOME UNUSUAL ARCHITECTURE ON IT AND STUFF LIKE THAT.

SOMEHOW FEEL A LITTLE BIT SAD WE'RE GOING TO BE KNOCKING DOWN SOMETHING LIKE THIS. SOMEBODY PROBABLY HAD A VISION AND SAID HEY, BE COOL IF WE PUT THESE ROCK ENDS ON IT AND DID AROUND THE WINDOWS AND STUFF LIKE THAT.

NORMALLY WHEN WE SEE SOMETHING THAT HAS BEEN LEFT FOR MANY, MANY YEARS IT'S A LOT WORSE THAN THIS. BUT HAVING SAID THAT YOU KNOW THE NEIGHBORS HAVE PUT UP WITH THIS FOR A LONG PERIOD OF TIME. OBVIOUSLY, NOBODY HAS COME FORWARD TO REHAB THE UNIT. IF WE WERE YOUNGER MY PARTNER SITTING OUT THERE.

IF WE WERE YOUNGER MR. ROSLIN DO YOU THINK WE WOULD TACKLE SOMETHING LIKE

THIS? >> I KNOW. COMMISSIONER PERONA, THAT IS NOT SOMETHING THAT HASN'T BEEN LOOKED AT. IT WENT TO HISTORIC PRESERVATION BOARD FIRST. AT THE FIRST HEARING IT WAS POSTPONED BECAUSE SOMEONE AT THE HEARING WANTED THE OPPORTUNITY TO TRY AND GET WITH THE OWNER AND DO A TITLE TRANSFER. WE GAVE THE TIME FOR THAT TO WORK OUT AND IT DIDN'T WORK OUT. WE DID MAKE THAT ATTEMPT TO HAVE SOMEONE ELSE TAKE

POSSESSION OF THE PROPERTY. THAT EFFORT WAS MADE. >> AND THE INSIDE WE THE

INSIDE IS PRETTY NASTY, TOO. >> MY COURT OFFICER WOULDN'T GO UP THE STAIRS.

THEY WOULD NOT ENTER. >> I DON'T THINK I WOULD EITHER.

COMMISSIONER SESSIONS. >> TO SOME DEGREE YOU ARE RIGHT IT HAS A WHOLE LOT OF POTENTIAL. BUT WHEN YOU LOOK AT THE ULTRA HAZARDOUS AND CRIME THAT HAS BEEN GOING ON IN THAT BUILDING IT'S KNOWN FOR BEDROCK HOTEL, A PLACE WHERE IT'S BEEN SO MUCH DRUG ACTIVITY TAKING THIS BUILDING OFF THE FACE OF THAT BLOCK IS GOING TO BE A GREAT CONTRIBUTOR TOWARDS ERADICATING CRIME IN THAT AREA. WITH THAT BEING SAID I'M NOT SYMPATHETIC TOWARDS THE OWNER LETTING IT STAY IN THE STATE IT HAS BEEN IN FOR AS LONG AS IT HAS BEEN BECAUSE IT'S BEEN A MAJOR PROBLEM FOR THE NEIGHBORHOOD. SO TO SEE IT GO DOWN AS QUICK AS POSSIBLE WOULD BE DOING THE CITY OF FORT PIERCE A GREAT DEAL.

>> I BELIEVE -- HAS HAD TO PUT UP QUITE A BIT OF PROBLEM WITH THIS STRUCTURE.

>> ANY OTHER QUESTIONS OF STAFF? THIS IS A PUBLIC HEARING.

ANYONE WISHING TO ADDRESS THIS ISSUE PLEASE COME FORWARD? SEE NO ONE I WILL CLOSE THE PUBLIC HEARING. ENTERTAIN A MOTION.

>> SO MOVED. >> SECOND. >> THERE'S A MOTION AND A

SECOND. CALL ROLL PLEASE. >> COMMISSIONER ALEXANDER.

>> YES. >> COMMISSIONER JOHNSON. >> YES.

>> COMMISSIONER PERONA. >> YES. >> COMMISSIONER SESSIONS

YES. >> MAYOR HUDSON, YES, MA'AM. THANK YOU, MA'AM.

NEXT WE HAVE WE GO BACK TO A LEGISLATIVE HEARING ON ORDINANCE 20-028 AN ORDINANCE BY THE CITY COMMISSION AMENDING CHAPTER 38 ARTICLE 3 DIVISION 2 OF THE CODE OF ORDINANCES AND ENTITLED NO WAKE AND MINIMUM WAKE ZONES ATTENDING SECTION 38 -- TO MODIFY LANGUAGE TO ALLOW FOR IDLE SPEED NO WAKE ZONE WITHIN 300 FEET OF JAYCEE PARK BOAT RAMPS AS PROVIDED BY THIS CHAPTER OR ADMINISTRATIVE RULE PROVIDING FOR SEVRABILITY CLAUSE AND PROVIDING FOR -- THIS IS THE FIRST READING.

>> GOOD EVENING MADAM MAYOR, COMMISSIONERS. >> GOOD EVENING.

SOME TIME AGO THE COMMISSION PASSED THE PARKS ADVISORY COMMITTEE WITH ASSESSING SOME SAFETY CONCERNS AT JAYCEE PARK. AS THEY ALWAYS DO THEY TOOK THAT TASK SERIOUSLY AND AS A RESULT WERE INSTRUMENTAL IN HELPING DRAFT THE ORDINANCE THAT WAS PRESENTED TO COMMISSION IN DECEMBER OF 2019 AND ULTIMATELY APPROVED PROVIDING FOR A 500 FOOT NO WAKE ZONE FROM THE BOAT RAMP.

AFTER APPROVAL THAT WAS THE PERMIT PROCESS WENT THROUGH CLEARLY THE SIGNS WERE INSTALLED THE BOOTHS REPLACED AT SOME POINT STAFF WAS DIRECTED TO DRAFT AN ORDINANCE OF 300 FOOT DISTANCE FROM THAT BOAT RAMP.

SO ESSENTIALLY, SHORTENING THE DISTANCE BY 200 FEET AND THAT IS WHAT WE HAVE BEFORE YOU THIS OOENK EVENING. I AM HERE TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE.

>> HOW LONG IS THE 500 FEET ACTUALLY BEEN IN EFFECT? >> THE SIGNS WERE INSTALLED

[00:35:01]

IN EARLY JUNE OF THIS YEAR. 2020. SOLY MONTHS, FOUR MONTHS?

-- SO THREE MONTHS, FOUR MONTHS. >> WHAT WAS THE COST

ASSOCIATED WITH THE INSTALLATION. >> THE TOTAL COST ASSOCIATED WITH THAT INSTALLATION INCLUDING THE PERMIT FEE, THE PILINGS BEING IN PLACE THE SIGNAGE AND AT THAT TIME WE ALSO ADDED SOME MISSING BOWIES THAT HAD BEEN MISSING FOR SOMETIME BOWIES THAT HAD BEEN MISSING FOR SOMETIME. HOW MANY OF THE CHANNEL MARKERS OR DESIGNATED NO WAKE ZONE MARKERS DO WE HAVE INSTALLED AND WE OWN THEM,

CORRECT? >> CORRECT. THERE ARE FOUR 500 FEET OFFSHORE IN THE WATER THERE IS ONE ADJACENT TO THE NORTHERNMOST BOAT RAMP.

>> AND THAT IS IN THE COST OF THE $ 15,000. >> YES, MA'AM.

>> MAYOR. >> YES, SIR. >> THE QUESTION MR. REALS I THOUGHT I RECALLED READING AN E-MAIL THAT WE HAVE ALL THE AGENCIES AS FAR AS, YOU KNOW, THE MARINE PATROL AND THE SHERIFF DEPARTMENT ARE THEY GETTING ON BOARD WITH THIS? I UNDERSTAND THAT THEY WERE DOING A LITTLE YOU KNOW

SURVEILLANCE THEMSELVES. SO IS THAT TRUE? >> COMMISSIONER ALEXANDER I HAVE NOT HEARD FROM THOSE AGENCIES BUT I DO UNDERSTAND THAT SINCE THIS HAS PASSED AND THE SIGNS HAVE BEEN PLACED THAT THERE HAVE BEEN ENFORCEMENT EFFORTS AT

JAYCEE PARK. >> OKAY. >> COMMISSIONER PERONA.

>> SO WE ORIGINALLY TALKED ABOUT THIS ABOUT A YEAR AGO. >> YES, SIR.

>> AND IT TOOK ALL THE WAY TO JUNE TO GET THAT COMPLETED. CAN YOU KIND OF GIVE US AN

IDEA OF WHAT THAT PROCESS WAS? >> WELL, THE PARKS ADVISORY COMMITTEE IN THEIR EFFORTS IN DRAFTING THE ORIGINAL ORDINANCE SUBMITTED THE DRAFT ORDINANCE TO F.W.C. FOR THEIR COMMENT. THE FIRST ORDINANCE THAT WAS SUBMITTED THEY DID SEND BACK WITH COMMENT CHANGES WERE MADE RESUBMITTED TO F.W.C..

THEY ULTIMATELY SAID THAT IF THAT WAS APPROVED BY COMMISSION THEY WOULD, THEY WOULD FORESEE PASSING THAT PERMIT REQUEST. ONCE IT WAS ONCE IT WENT THROUGH BOTH READINGS HERE AT THE COMMISSION LEVEL WE FORMALLY SUBMITTED THE PERMIT WE DID RECEIVE THAT. AS WE ALL KNOW WITH COVID AND EVERYTHING ELSE SOME THINGS DID SLOW DOWN. IT DID TAKE US A LITTLE BIT OF TIME TO GET THE PILINGS AND SIGNAGE PLACED. BUT THAT IS WHERE WE'RE AT. SO AT THE TIME IT WAS APPROVED TO THE TIME THEY WERE IN THE WATER WE WERE LOOKING AT ABOUT SIX MONTHS.

>> ADAM MAYOR. >> YES, SIR. >> AS FAR AS THE SAFETY OF THE SAILBOATS AND THE KIDS THAT ARE IN THE WATER YOU KNOW, I'M KIND OF SECOND-GUESSING ABOUT THAT 300 FEET. WITH ALL THE PARKERS AND EVERYTHING IN PLACE. WE HAVEN'T HAD -- MARKERS AND EVERYTHING IN PLACE.

YOU HAVEN'T HAD ANY DISRUPTION ANY ILLEGAL LEGAL WAVERUNNERS OR WHATEVER YOU CALL THEM. SO ARE WE CAPABLE, ABLE TO LEAVE IT AS IT IS OR IS IT

UP FOR DECISION TONIGHT? >> MADAM, MAYOR, COMMISSION ALEXANDER THAT WOULD BE UP

TO THE COMMISSION. >> OKAY. >> ALL RIGHT.

>> COMMISSIONER SESSIONS. >> I DON'T KNOW IF YOU WOULD PROBABLY BE BEST SUITED, MAYBE THE POLICE DEPARTMENT, TO FOLLOW UP WITH QUESTION IS ANYONE AWARE OF ANY PROBLEMS SINCE IT HAS BEEN IN STATUS QUO POSITION THE WAY IT IS THAT NOW?

>> COMMISSIONER SESSIONS I COULDN'T SPEAK TO THE ENFORCEMENT EFFORTS BUT WE DO HAVE OUR CODE COMPLIANCE MANAGER PEGGY IN THE AUDIENCE THAT MAY BE ABLE TO

ASSIST US WITH SOME OF THOSE QUESTIONS. >> AND I UNDERSTAND THERE ARE AN ENTOURAGE OF COMPLAINTS FROM THE NEIGHBORS BUT I'M MORE CONCERNED ABOUT THE SAFE AND WELL-BEING OF INDIVIDUALS THAT CAN POTENTIALLY BE HURT.

[00:40:02]

>> GOOD EVENING MADAM MAYOR, COMMISSIONERS. THERE IS A LARGE NUMBER OF WAVE RUNNERS THAT USE THIS BOAT RAMP TO LAUNCH FROM EVERY WEEKEND.

MY CODE OFFICERS ARE THERE EVERY WEEKEND TO MONITOR THE ACTIVITY.

THEY DO A LOT OF ENFORCEMENT WORK WITH THE WAVERUNNERS. THE SAME WITH ANY NEW RULE THERE WAS A LEARNING CURVE AT THE BEGINNING BECAUSE NOTHING HAD BEEN ENFORCED FOR QUITE SOMETIME. WE HAD TO DO A LOT OF EDUCATION.

EXPLAINING TO PEOPLE WHAT THE NEW RULES WERE. THERE HAS BEEN SOME ENFORCEMENT ACTIVITY. IT GOT TO A POINT YOU GET TO KNOW THE SAME PEOPLE EVERY WEEKEND THAT COME OUT. SO SOONER OR LATER THERE WERE SOME ENFORCEMENT BEING DONE BY THE SHERIFF'S DEPARTMENT OR OUR MARINE UNIT.

OVERALL, MOST OF THE PEOPLE FOLLOW THE RULES. THERE ARE SOME THAT ARE NOT WILLING TO FOLLOW THE RULES THAT'S WHY WE HAVE THE HELP OF OUR OTHER JURISDICTIONS

HELP US OUT OR ANOTHER DEPARTMENTS. >> MR. PERONA.

>> I HAVE TO SAY THAT YOUR BEING THERE, YOUR STAFF BEING THERE AT THE PARK HAS BEEN PROBABLY ONE OF THE BEST THINGS THAT'S HAPPENED. I GET MORE COMPLIMENTS FOR THAT. CAN YOU BELIEVE GETTING A COMPLIMENT ON A

CODE ENFORCEMENT PERSON. >> THAT HOUSE YOU PULLED DOWN JUST A MINUTE AGO TRUST

ME THAT NEIGHBORHOOD WILL BE JUMPING FOR JOY. >> THEY KNOW THE GAME THEY KNOW THE PLAYER THEY KNOW WHAT'S GOING ON. THEY KNOW THE SENSITIVITY OF ALL THE ACTIVITIES THAT ARE GOING ON AT THE SAME TIME AND THAT LITTLE ITTY-BITTY PARK. IT GETS SMALLER AND SMALLER ESPECIALLY ON WEEKENDS AND HOLIDAYS. WE'RE ABLE TO DO IT. IT IS A GEM AND IT'S IMPORTANT FOR US TO KEEP THAT GOING. I WILL TELL YOU THE KEY TO

ALL THAT IS YOUR STAFF THERE REALLY. >> YES, SIR.

>> A COUPLE QUESTIONS. AND A COUPLE STATEMENTS. MR. REALS THE SWIM AREA THAT'S DESIGNATED DOES IT IS IT WITHIN THE SAME BOUNDARY THAT'S INDICATED HERE BY THE

500 FEET? YOU HAVE IT ON THE SCREEN. >> MADAM MAYOR, COMMISSIONER JOHNSON, THE SWIM AREA AS DELINEATED BY ORDINANCE. IF YOU LOOK AT WHERE THE RED LINE HERE INTERSEXTING THE GREEN LINE BY ORDINANCE -- INTERSECTS THE GREEN LINE BY ORDINANCE THAT'S THE MARKER FOR THE DESIGNATED SWIM AREA.

AT SOME POINT IN OUR HISTORY THE SWIM AREA WAS EXPANDED TO THE NORTHERN AREA OF THAT

GREEN BOX. >> SO RIGHT NOW WE HAVE THE BUOYS AND MARKERS.

>> CORRECT. THE GREEN BOX THERE INDICATES THE CURRENT SWIM

AREA. >> PREVIOUS COMMISSION I DON'T EVEN KNOW WHAT ORDINANCE NUMBER THAT IS DESIGNATED THE SWIM AREA SPECIFICALLY AS.

>> 130 FEET WEST OF THE MAIN WATER LINE ABOUT 180 FEET LONG.

THE COORDINATES ARE IN THE ORDINANCE. IF YOU WOULD LIKE ME TO READ THEM I KNOW HOW NOW.

SO WHEN WE FIRST TALKED ABOUT THIS I WAS A PROPONENT OF THE 300 FEET I WAS THE LONE DISSENTING VOTE BACK WHEN WE STARTED THIS BECAUSE I WAS LOOKING FOR A LITTLE MORE DATA AND MORE SCIENCE INTO DESIGNATED THE AREA HERE.

NOW THIS IS THE NEW ONE PROPOSED. SO I DIDN'T BRING THIS FORWARD BECAUSE AS A DISSENTER I COULDN'T BRING IT FORWARD TO ASK YOU GUYS TO DO MORE WORK TO TALK ABOUT IT AGAIN. BUT I DO, I AM HIP WITH THE IDEA AND I'M OKAY WITH THE AREA THAT WE HAVE INVESTED A SIGNIFICANT AMOUNT OF MONEY, $15,000 FOR INSTALLATION OF WHAT WE'VE DONE TO DATE. BUT I DO WANT TO TALK ABOUT THE SWIM AREA. THE FOLKS THAT I TALK TO AND HERE'S WHY.

WE HAVE A LOT OF COMPETING INTERESTS. I HAVE SPENT THOUSANDS OF HOURS AT JAYCEE PARK BECAUSE I HAVE RAISED BOTH MY CHILDREN THERE, ONE IS 22 AND ONE IS 18 NOW. SO I'VE USED THE PLAYGROUND, I'VE USED THE BEACH, I'VE USED THE BOAT, I'VE USED PADDLE BOAT OR WHATEVER THEY'RE INTO NOWADAYS.

THE FOLKS THAT I TALK TO IN ADDITION TO MY OWN EXPERIENCES THEY'RE WORRIED ABOUT THE ABILITY TO PULL UP A VESSEL AND ANCHOR THE VESSEL OFF THE BEACH.

THEY DON'T KNOW WHERE TO DO IT, RIGHT. WE DESIGNATED THE KAYAK AND CANOE LAUNCH AS JUST THAT THE KAYAK AND CANOE LAUNCH. WE DON'T WANT TO INTERFERE

[00:45:03]

WITH THAT PROCESS WHICH IS THE SOUTHERN BOUNDARY OF THAT GREEN SQUARE THERE SO WE DON'T WANT INTERFERE WITH THAT THAT'S A PADDLE-POWERED EQUIPMENT.

IT'S NOT ENGINE POWERED. SO THE FOLKS THAT DO COME TO JAYCEE PARK THAT WANT TO HAVE A BARBEQUE THAT HAVE COME THERE BY BOAT WHERE DO THEY PARK? BECAUSE YOU CAN'T PARK I CAN TELL YOU NOW SO I KNOW WHAT THE ANSWER IS I'VE HEARD IT.

YOU PARK AT THE BOAT RAMP DOCK. THAT'S NOT GOOD.

YOU DON'T DO THAT. THERE'S A CODE THAT YOU JUST DON'T PARK YOUR BOAT AND WALK AWAY IT FROM BECAUSE YOU HAVE TO GET THE BOATS IN AND OUT.

SO WHERE DO THEY PARK IF THEY WANT TO USE THE PARK AND THEY COME BY BOAT?

>> WE ASK THEM TO ANCHOR BEYOND THE SWIM ZONE OUTSIDE THE SWIM ZONE.

>> DO YOU KNOW HOW DEEP THE WATER IS THERE? >> IT'S VARIES DUE TO HOUR

AND DAY. >> IT VARIES, RIGHT. IT'S ALSO PART OF THE CHANNEL THAT LEADS TO JENNINGS COVE WHICH IS TO THE SOUTH OF THAT PICTURE HERE. IT'S CLOSE TO THE CHANNEL THAT WILL GO TO JENNINGS COVE IF YOU'RE BY G.P.S. COORDINATES 130 FEET OFF. IT'S INTERESTING.

IF THEY WERE TO DROP OFF PASSAGES ON THE BEACH WHERE WOULD THEY DO IT?

-- PASSENGERS ON THE BEACH WHERE WOULD THEY DO IT? >> WE DO HAVE BOATS THAT WILL COME IN TO TEMPORARILY TIE UP TO THE DOCK, UNLOAD THEN WE ASK THEM TO GO AND ANCHOR RIGHT OUTSIDE THE SWIM ZONE. SO THE DOCKS ARE USED AS

TEMPORARY LOADING AND UNLOADING ZONES. >> OKAY.

THAT'S A GOOD POINT. THAT'S GOOD. I GUESS MY CONCERN.

I'M JUST LOOKING AT THE MULTIFACETED USE OF JAYCEE PARK.

I'M GOOD WITH WHAT WE HAVE ALREADY IN MOTION. I'M JUST WORRIED ABOUT THE SWIM AREA. DO WE HAVE AN ORDINANCE IN PLACE? I'M NOT SURE WHY WE DON'T JUST ENACT THE ORDINANCE THAT WAS ALREADY VOTED BY THE COMMISSION PRIOR TO ALL OF US BEING UP HERE. I JUST WANTED TO BRING THAT POINT UP TONIGHT. WE'RE NOT TALKING ABOUT THAT SPECIFIC BUT HERE TONIGHT SINCE IT'S BEEN BROUGHT FORWARD IT'S JUST ONE OF THE THOUGHTS AND ONE OF THE IDEAS AND FOLKS THAT USE THE PARK ASK ME THOSE QUESTIONS. INCLUDING MYSELF AND MY OWN FAMILY MY OWN CHILDREN. WELL, DAD WHAT DO I DO? I'M JUST BEING REAL ABOUT

THE SITUATION. I APPRECIATE IT. >> CAN I ASK YOU A QUESTION ARE YOU SAYING THAT WE OUGHT TO DESIGNATE THE SWIM AREA TO BE SOMETHING DIFFERENT THAN BECAUSE WHAT IT IS IN THE ORDINANCE IT HAS NOW GROWN.

>> SO THE WAY I INTERPRET THE ORDINANCE WHERE THAT YELLOW CIRCLE IS WHERE THE

SWIM AREA SHOULD STOP. >> ARE YOU SAYING THAT THAT'S WHAT SHOULD HAPPEN?

>> I KNOW. >> BUT IF IT'S NOT THAT WAY WE COULD OTHERWISE MAKE THE ORDINANCE ABOUT THE SWIM AREA TO BE WHAT'S REALLY HAPPENING.

>> WE COULD DO THAT. >> YEAH. >> COMMISSIONER PERONA.

>> IT'S REALLY TWO DIFFERENT IDEAS. ONE WE'RE HERE ABOUT THE FIVE YOU00 FEET AND I'M HAPPY TO HEAR THAT -- 500 FEET AND OKAY WE DID IT IT'S FINE. COMMISSIONER JOHNSON BRINGS UP A REALLY GOOD POINT.

I'M OVER AT THE PARK EARLY IN THE MORNING. I GO BADGER JANEY ONCE IN A WHILE. SHE SHOWED ME THIS WE WALKED OUT INTO THE WATER THERE OR BY THE WATER. THERE IS NO PLACE FOR A BOAT TO DOCK ON SHORE.

YOU HAVE TO BUOY IT OUT PAST THE RAMPS THAT ARE THERE. I'M THINKING MAYBE THERE IS A CONSIDERATION THAT WE SHOULD BE LOOKING AT IS TAKING THAT SOUTHERN TIP AND SHORTENING THE SWIM AREA AND MAYBE BROADENING THAT A LITTLE BIT SO THAT BOATS COMMITTEE GO IN. I'M NOT SAYING I WANT TO DEAL WITH THAT TONIGHT BUT THAT'S THE SECOND ISSUE WE SHOULD BE TALKING ABOUT. WE SHOULD BE TALKING ABOUT RELOOKING AT THE ENTIRE JAYCEE PARK AND HOW IT'S SET UP AND ALL THE THINGS THAT WE ENVISIONED. I THINK THAT'S GOING TO BE A VERY INFORMATIVE AND SOMETHING THAT'S OF BENEFIT TO THE ENTIRE COMMUNITY. BUT RIGHT NOW I THINK IT'S IMPORTANT FOR US TO STAY ON POINT AND TALK ABOUT THE 500 FOOT VERSUS THE 300 FOOT.

I'M GOING TO SAY RIGHT NOW THAT I AM A REALLY OUT OF ALL THE THINGS THAT WE'VE EVER DONE THIS ONE HERE I DON'T GET IT. I AGREE THAT THE 500 FOOT IS IN THERE WE HAVE ALREADY GOT AN EXPERIENCE OF FOLKS, ESPECIALLY DURING THE SUMMER KIDS SWIMMING IN THE SWIM AREA, YEAH! AND YEAH, IT IS IT'S A LITTLE TOUGHER ON THE BOATERS AND THINGS LIKE THAT AND I UNDERSTAND THAT BUT WE HAVEN'T HAD THE ISSUES WITH THE JET SKIS AS MUCH SINCE THEN, AND ALL THE OTHER

[00:50:03]

ISSUES. SO I WILL SAY THIS TO MY COMMISSION, WE HAVE SOLVED THAT PROBLEM. LET'S NOT CREATE ANOTHER ONE.

BUT I DO THINK WE NEED TO GO INTO THE SECOND PART OF THAT AND GET SERIOUS ABOUT LOOKING AT JAYCEE PARK AS A WHOLE HOW CAN WE MAKE THE AMENITIES THERE WORK FOR

EVERYBODY. >> IF YOU GO TO THE 500 FOOT DEPICTION.

>> YEAH, I AGREE. I'M ALMOST WATCHING IT IN REALTIME WHEN I GO OUT AND I JUST WATCH HUMANS. IF WE INTERACT WITH THESE NEW CONDITIONS ARE THEY FOLLOWING THE RULES THAT HAVE BEEN PUT FORTH? THEY ARE.

IT TOOK A LITTLE LEARNING CURVE LIKE YOU SAID. AT THE SAME TIME COMMISSIONER YOU'RE RIGHT AT THIS POINT I DON'T KNOW IF WE HAVE ENOUGH TIME, MAYOR I THINK YOU ASKED ABOUT THAT HOW LONG HAS IT BEEN SINCE IT WAS IMPLEMENTED.

WE'RE STILL DEALING WITH THE CORONAVIRUS WE DON'T EVEN KNOW WHAT THE USE IS GOING TO BE THIS TIME NEXT YEAR. IT IS GOING TO BE DIFFERENT. ARE FOLKS GOING TO BE ACTING DIFFERENTLY. WHAT DOES THE WINTER SEASON BRING FOR US SPRINGTIME BRING. ARE FOLKS GOING TO BE COMING TO FORT PIERCE MORE OFTEN WHICH WE HOPE THEY DO, AS TOURISTS COME AND JOIN US OUT AT JAYCEE PARK.

YOU'RE RIGHT, AT THIS POINT WE HAVE A MODEL WE PUT IT IN PLACE AND WE SPENT A LOT OF MONEY. THE 500 FEET IS SOMETHING FOLKS ARE JUST GETTING USED,

INCLUDING MYSELF. >> AND YEAH, WE HAVEN'T HAD THAT MUCH EXPERIENCE WITH IT YET. I MEAN, I JUST THINK IT WOULD BE FOOLISH TO CHANGE SOMETHING THAT WE HAVE SPENT A LONG TIME AND A LOT OF MONEY GETTING THERE.

I WILL ALSO SAY THAT YOU KNOW, WE DON'T GET A LOT OF LETTERS OF PRAISE, I'M SURE YOU'RE SHOCKED TO HEAR THAT. WE GET MOSTLY LETTERS OF COMPLAINTS BUT ON THIS ISSUE, ON THIS PARK ISSUE I HAVE GOTTEN MORE LETTERS OF THANK YOU, OF TRIBUTE, OF GRATEFULNESS BECAUSE THINGS HAVE SETTLED DOWN IN THE PARK AND THE NEIGHBORS, THE NEIGHBORS DON'T HEAR THE JET SKIS AS MUCH ANYMORE. I MEAN I JUST, -- I JUST HAVE NOT HAD THAT EXPERIENCE WITH ANY OTHER ISSUE WHERE PEOPLE HAVE ACTUALLY EXPRESSED TO ME A NUMBER OF PEOPLE THAT THEY'RE VERY, VERY GLAD OF WHAT WE DID.

AND I THINK THAT'S ALSO PART OF CODE ENFORCEMENT BEING THERE, TOO.

I KNOW THAT IS BECAUSE THAT PARK IS SUCH AN ATTRACTION FOR SO MANY DIFFERENT ACTIVITIES. WE WERE HAVING THAT ATTRACTION AND WE WERE HAVING IT DURING COVID ESPECIALLY WHEN THE BEACHES DOWN SOUTH WERE CLOSED AND PEOPLE WERE COMING UP AND USING OUR PARK. SO WE TOOK A LOT OF HEAT FOR CLOSING DOWN THE PARK BECAUSE OF THAT. THAT WE WANTED TO KEEP PEOPLE SAFE. OUR OWN RESIDENTS IN THE NEIGHBORHOOD SAFE AND THE PEOPLE IN THE WATER SAFE. AT ANY RATE UNLESS THERE'S ANY MORE DISCUSSION WITH

ZACH I'M OPEN. >> THIS IS A LITTLE UNCONVENTIONAL COMMISSIONER SESSIONS IS THE ONE THAT BROUGHT THIS FORWARD. I WOULD SURE LIKE TO HEAR FROM HIM. I DON'T WANT TO STEP ALL OVER HIS TOES.

HE OBVIOUSLY HAD A REASON FOR IT AT THE TIME. I DON'T MEAN TO BE CALLING YOU OUT COMMISSIONER SESSIONS BUT IT'S IMPORTANT FOR ME TO KNOW YOU HAVE HAD YOUR SAY THERE'S SOMETHING THAT WE'RE MISSING OR WHATEVER, THIS IS YOUR

OPPORTUNITY? >> WELL, AS FAR AS THE IMPACT IS CONCERNED IT'S SORT OF LIKE WHAT MIKE SAID EARLIER WE REALLY DON'T KNOW THE IMPACT BECAUSE OF THE COVID SEASON. THE REAL TEST WILL COME WHEN IT BECOMES BUSY, I UNDERSTAND WE HAD A COUPLE OF INCIDENTS WHERE WE WERE OPEN NO ONE ELSE WAS BUT BY THE SAME TOKEN WE HAD HALF OF OUR POLICE DEPARTMENT OUT THERE THEN, TOO.

AND CODE ENFORCEMENT MEANWHILE THEY ARE WORKING HARD TO MAKE SURE THERE WEREN'T ANY ISSUES. SO I DON'T KNOW IF WE COULD REALLY CONSIDER THAT A REAL TEST. TIME WILL TELL IN THE FUTURE WHEN WE HAVE OFFICERS AND CODE ENFORCEMENT OUT DOING THEIR JOB ELSEWHERE OF WHETHER OR NOT REALISTICALLY THIS IS GOING TO POSE A HAZARD. BUT MY CONCERN WAS GET THE BEST BANG FOR THE BUCK. MEANWHILE I LIKE THE IDEA OF ALLOWING ALL THE CITIZENS IN FORT PIERCE TO HAVE ACCESS TO THE WATERWAY. IT'S FREE, IT'S POSSIBLE AS MUCH AS POSSIBLE WITHOUT LIMITING ANYONE WITHSTANDING SAFETY.

[00:55:07]

WHEN IT'S SAFETY THEN IT'S TIME TO REEL IN WHEN IT'S PARKING, THAT'S AN ISSUE FOR US TO ADDRESS AND WE NEED TO ADDRESS THAT. THE CITY OF FORT PIERCE WHICH IS A MINISTERIAL THING, IN MY OPINION, JUST TAKES SPENDING SOME MORE MONEY. BUT I LIKE WHAT'S GOING ON AT THAT PARK.

IT'S PROBABLY ONE OF THE BIGGEST ENTERTAINERS IN TERMS OF ATTRACTING TOURISTS TO THE WATERWAY. I JUST DON'T WANT TO LIMIT PEOPLE THAT COME HERE FROM AFAR AND THEY ARE ATTRACTED TO THAT AREA BECAUSE OF THE CURRENTS AND THE ABILITY TO BE ABLE TO PUT JET SKIS ON THE WATER WITHOUT THE CURRENT INTERFERING WITH THEM. SO THERE ARE SO MANY DIFFERENT REASONS WHY THIS IS A WIN-WIN FOR SOMEONE THAT HAS A JET SKIFUL ME PERSONALLY I'M OUT OF THE JET SKI BUSINESS. BUT I KNOW THERE ARE A LOT OF YOUNG PEOPLE HERE AS WELL AS TOURISTS THAT UTILIZE THAT AREA. I JUST WANT TO MAKE SURE WE GET THE BEST BANG FOR THE DOLLAR FOR EVERYBODY INVOLVED.

>> ANYBODY ELSE BEFORE I OPEN THE PUBLIC HEARING? THIS IS THE PUBLIC HEARING.

ANYONE WISHING TO ADDRESS THIS ISSUE PLEASE COME FORWARD.

>> MADAM MAYOR IF I MAY CLEARLY THE PROPOSED AMENDMENT ADVERTISED TONIGHT AND STATED IS ONLY TO CHANGE POTENTIALLY THE DISTANCE FROM 500 FEET TO 300 FEET.

I WOULD HAVE A LOT OF HEARTBURN IF THERE WERE ANY DISCUSSION ABOUT PASSING ANY TYPE OF MOTION OR AMENDMENT TO THE SWIM ZONE IN THIS HEARING.

>> GOT IT. >> DON'T WANT TO HAVE YOU TO HAVE HEARTBURN.

I KNOW WE WERE TALKING ABOUT SWIMMING. WE HAVING THIS CALL BACK HAD NOTHING TO DO WITH THE SWIMMING AREA IT WAS JUST THE 500 FEET TO 300 FEET.

>> WELCOME STATE YOUR NAME AND ADDRESS. >> 1715 BAY SHORE DRIVE FORT PIERCE. RESIDENT FOR 20 YEARS NOW. FIRST OF ALL I WANT TO THANK THE CODE ENFORCEMENT JANE SPECIFICALLY. SHE DOES A GREAT JOB OF HANDLING ISSUES. I APOLOGIZE FOR THE MASK. THE DIFFERENCE SHE'S MADE WITH THE RULES NOW THAT WE HAVE RULES. WE DIDN'T HAVE IN THE PAST HAS MADE A WORLD OF DIFFERENCE. I THINK GOOD DECISION COMES FROM GOOD DATA THIS IS THE DATA. IF WE WERE TO REDUCE TO 300 FEET WE'RE SAVING THE AVERAGE BOATER 27 SECONDS BE IT JET SKI A BOAT OR PADDLE BOAT. TO GET TO 300 FEET TAKES 40 SECONDS TO GET TO 500 TAKES 68 SECONDS. THE SAFETY OF OUR CHILDREN AT THAT BEACH ALONE SHOULD JUSTIFY THE 27 SECONDS THAT WE'RE ASKING EACH BOATER TO TAKE JUST AS PRECAUTIONARY. I DO RESPECTIVELY DISAGREE WITH MR. JOHNSON.

I DON'T BELIEVE MOTOR BOATS SHOULD BE NEAR OUR BEACH THEY SHOULD BE CONTROLLED.

BEACHING BOATS WE HAVE THE COVE, WE HAVE ALL THE DIFFERENT SPOTS THAT YOU CAN TAKE YOUR BOAT. THIS IS THE ONE STOP THAT MY TWO-YEAR-OLD AND FIVE-YEAR-OLD GRANDSON CAN SWIM WITH NO INTERFERENCE FROM BOATS OR TIDES OR SURF IT'S A GREAT SPOT. SO THANK YOU FOR CONSIDERING THAT.

>> THANK YOU, SIR. >> CAN YOU STATE YOUR NAME FOR THE RECORD AGAIN, SIR.

I'M SORRY I DIDN'T CATCH IT. YOUR NAME? >> DAVID UNDERHILL.

>> ANYONE ELSE WISHING TO ADDRESS THIS ISSUE PLEASE COME FORWARD.

>> GOOD EVENING LISA POTTER 1400 MARINER BAY. YOU HAVE ALL SEEN ME MANY TIMES I HAVE BEEN BEFORE YOU TALKING ON THIS ISSUE FOR I DON'T KNOW A YEAR AND A HALF. THE MOST RECENT TIME WAS HERE WAS ACTUALLY TO TELL YOU THANK YOU PERSONALLY FOR ENACTING THIS ORDINANCE. MY FEELINGS HAVEN'T CHANGED.

I STILL THANK YOU FOR ENACTING IT. I APPRECIATE ALL YOUR DISCUSSION TONIGHT. I DON'T NECESSARILY HAVE ANYTHING NEW TO ADD I JUST WANTED TO REITERATE THAT I AM VERY PASSIONATE ABOUT THIS SINCE THE SIGNS WENT IN PLACE I WAS THINKING LATE MAY BUT EARLY JUNE MR. REALS SAYS.

I HAVE OWNED MY HOME SINCE 2010 THIS SUMMER FIRST TIME SINCE THE SIGNS WENT IN WE'VE HAD GREAT ENFORCEMENT FROM PEGGY, THE POLICE MARINE UNIT AND FOLKS ON-SITE AS WELL AS THE SHERIFF'S MARINE UNIT. IN FACT THEY WERE ON OUR DOCKS AT ONE POINT THE SHERIFFS AND THEN THEY WOULD CALL THEIR BOAT AND WHAT NOT. SO THE ENFORCEMENT HAS BEEN GREAT.

[01:00:01]

WE REALLY APPRECIATE IT. IT WAS THE FIRST NOW FIRST TIME IN MANY, MANY YEARS THAT IT IS A SAFE PLACE FOR EVERYONE TO USE. I AM SYMPATHETIC TO COMMISSIONER JOHNSON WHAT YOU WERE SAYING ABOUT FOLKS USING THEIR BOATS AND WHAT NOT. I'M SURE THERE IS SOME SOLUTION THAT WE CAN FIND.

BUT I WOULD JUST BEG YOU PLEASE FOR NOW LET'S GIVE THIS MORE TIME.

LET'S NOT CHANGE THE 500 FEET FOR NOW BECAUSE IT SEEMS LIKE IT'S WORKING.

WE DON'T KNOW WHAT THE FUTURE HOLDS. LET'S SEE HOW IT GOES.

>> THANK YOU, MA'AM. ANYONE ELSE WISHING TO ADDRESS THIS ISSUE PLEASE

COME FORWARD. >> EVENING MAYOR, COMMISSIONERS.

I SHOULD HAVE INTRODUCED YOU STATE REPRESENTATIVE DOLORES HOGAN JOHNSON IS IN THE

HOUSE. THANK YOU FOR BEING HERE. >> THANK YOU.

I HAVE GOTTEN SOME CALLS AND CONCERNS REGARDING THIS. I GOT IN TOUCH WITH CHARLENE ADAIR WITH THE PARKS COMMITTEE. I'M A VISUAL LEARNER SO I WENT OUT THERE TODAY AND SAW A FAMILY WITH SMALL KIDS YOU KNOW IN THE SWIM ZONE.

SO I GOT A PICTURE OF YOU KNOW THE 300 FEET AND THE SWIM AREA.

THEN THE 500 FOOT BUOY. SO I APPLAUD THAT AND I WOULD SUPPORT THAT IT STAYS THE WAY IT IS. I'M HEARING WITH THE CODE ENFORCEMENT AND ALL THE OTHER ENFORCEMENT AGENCIES WORKING TOGETHER TO CONTROL. BECAUSE PEOPLE LOVE OUR AREA. CHARLENE AND I WERE LAUGHING TODAY I SAID IT ALWAYS PLEASES ME TO HEAR WHEN PEOPLE COME FROM THE SOUTH AND MOVE UP HERE EVEN AND JUST I HAVE THING OR MOVING THEY'RE JUST DAZZLED BY THE FREE ACCESS WE HAVE TO THE WATER TO THE OCEAN AND EVERYTHING. OF COURSE AS YOU ALL MENTIONED THE COVID SITUATION BROUGHT UP A LOT. I WAS ALSO TOLD ABOUT, YOU KNOW, YOUNG PEOPLE BEING ON THE JET SKIES AND WHATEVER THEY'RE CALLED MOTOR CAST.

BUT THEY'RE A LOT OF SPACES BETWEEN THE LITTLE BUOY-TYPE THINGS FOR NOT SWIM AREA.

THEY HAVE BEEN SEEN GOING IN AND OUT BECAUSE IT'S TEMPTING.

SHE SHARED WITH ME AN INCIDENT WHERE ONE OVERTURNED AND OVERTHROUGH THE DRIVER. THE JET SKI DIDN'T STOP WELL, IT STOPPED JUST SHY OF A LITTLE KID. SO I THINK IT'S IMPORTANT TO MAINTAIN WHAT YOU HAVE.

I APPRECIATE THAT. >> THANK YOU VERY MUCH. THANK YOU FOR BEING HERE.

ANYONE ELSE WISHING TO ADDRESS THIS ISSUE PLEASE COME FORWARD.

ANYONE ELSE? >> MAYOR HUDSON I HAVE A WRITE-IN THAT I NEED TO

READ. >> PLEASE. >> THIS IS FROM MR. BRUCE MURRAY OF 1710 FRANCIS COURT. GOOD EVENING YOU ALL KNOW WHERE I STAND ON THIS ITEM AT LEAST THOSE OF WHO YOU READ YOUR E-MAIL AND PREPARE FOR THE MEETING. SORRY ABOUT THAT. I AM ADAMANTLY AGAINST THIS CHANGE IN THE POSITION OF THE IDLE SPEED BOUNDARY IN JAYCEE PARK.

PRIOR TO POSTING OF THE PROPOSED ORDINANCE I ARGUED INCREASED RICK TO PARK USERS AND ATTENDEE INCREASED RISK HIGH DEMAND ON STAFF AND UNNECESSARY COSTS TO IMPLEMENT. EXPECTING LONG DELAYS IN F.W.C., AND FLORIDA D.E.P.

APPROVAL AND VAST PUBLIC CONFUSION AND POSSIBLE ISSUES WITH THE SAILING FOUNDATION AGREEMENT TO DO A USELESS MEANINGLESS AND UNNEEDED CHANGE THAT IS ILLEGAL UNDER STATE STATUTE WHEN PASSED. NOW THAT THE SPECIFIC WORD BE OF THE ORDINANCE IS PUBLISHED I FIND IT HARD TO BELIEVE THAT ANY COMMISSIONER WOULD NOT FIND IT EMBARRASSING TO SUPPORT THIS.

THE PREAMBLE YOU'DS THE SAME LANGUAGE AS THE PREVIOUS ORDINANCE STATING THAT IT IS NECESSARY FOR SAFETY. IF 500 FEET WAS NECESSARY FOR SAFETY HOW CAN 300 FEET IMPROVE SAFETY WHEN IT EXPOSES 50% OF THE SWIM AREA TO INCREASED RISKS, OPENS THE AREA IN FRONT OF THE SAILING CLUB TO RISK, ENDANGERS NONMOTORIZED OTHERSERS OF THE SMALLER PROTECTED AREA SETS. I HAVE HEARD NO EXPLANATION OR ARGUMENT TO SUPPORT THE FALSE PREMISES THAT THIS CHANGE TO 300 FEET WILL CREATE A SAFER ENVIRONMENT THAN THE EXISTING 500 FOOT BARRIER.

WHICH HAS BEEN RECEIVED -- WHICH HAS RECEIVED ACCOLADES FROM CITIZENS THROUGHOUT THE CITY FOR ITS SAFETY AND PARK COMFORT IMPROVEMENT. I'M INCLUDING A CITIZEN'S LETTER ATTACHED TONIGHT'S AGENDA. IF THIS PROPOSED ORDINANCE IS PASSED I CAN ASSURE YOU IT WILL FACE PUBLIC CHALLENGE ON BOTH JURISDICTIONAL AUTHORITY AND JUSTIFICATION IN YOUR OWN WORDS IF IT AIN'T BROKE DON'T FIX IT. THIS AIN'T BROKE. LEAVE IT ALONE.

>> ALL RIGHTY. IS THERE ANYONE ELSE THAT WOULD LIKE TO ADDRESS THIS BEFORE I CLOSE THE PUBLIC HEARING? OKAY.

[01:05:01]

PLEASE COME FORWARD. >> WILLIAM PERRY 1700 COCONUT DRIVE.

I WANT TO THANK THE MAYOR AND THE COMMISSIONERS FOR PASSING SOME VERY IMPORTANT ORDINANCES RELATIVE TO THE SAFETY OF JAYCEE PARK. THE REDUCED SPEED LIMITS AND SIGNAGE AND INCREASED ENFORCEMENT ARE WORKING. IT'S OBVIOUS TO ANYONE WHO GOES OUT TO THE PARK OR LIVES IN THE AREA. I ALSO WANT TO THANK CHARLENE ADAIR AND HER PARK COMMITTEE MEMBERS FOR THE TIME, EFFORT AND PERSONAL EXPENSE THAT THEY'VE GIVEN FOR THE BENEFIT OF THE CITY AND THE CITIZENS OF FORT PIERCE. JUST A TINY BIT OF HISTORICAL PERSPECTIVE.

BEN FRANKLIN WHEN HE WAS LEAVING INDEPENDENCE HALL SHORTLY AFTER RATIFYING THE CONSTITUTION CAME OUT OF THE BUILDING, THIS IS 1787, THERE WAS A CROWD THERE AND SOMEONE SHOUTED OUT WHAT HAVE WE GOT, WHAT FORM OF GOVERNMENT? IS IT GOING TO BE A REPUBLIC OR A MONARCHY? AND HE QUICKLY REPLIED A REPUBLIC IF YOU CAN KEEP IT. THINK ABOUT WHAT HE WAS SAYING.

HE WAS SAYING IT'S UP TO YOU THE PEOPLE THROUGH YOUR ELECTED OFFICIALS TO MAKE SURE THAT THE GOVERNMENT WORKS PROPERLY, PROTECTS PEOPLE AND SERVES NEEDS.

SO WE'VE BEEN GIVEN A BEAUTIFUL, PEACEFUL, SAFE PUBLIC PARK IF WE CAN KEEP IT. IT'S UP TO YOU TO DO THAT. IT'S UP TO THE REST OF US TO SEE THAT YOU DO THAT. SO AGAIN I THANK YOU FOR ALL YOUR EFFORTS AND I'M HOPING THAT THINGS CAN STAY AS THEY ARE RELATIVE TO THE ORDINANCES AND OFTEN GET

BETTER AS FAR AS THE PARK. >> THANK YOU, SIR. ANYONE ELSE WISHING TO ADDRESS THIS PLEASE COME FORWARD.

>> YES, SIR. >> I'M RON HOLEMAN I LIVED A 113 MARINADE BOULVARD.

I DON'T HAVE MORE TO ADD BUT TO COMPLIMENT THE MAYOR AND THE BOARD AND CHARLENE AND HER GROUP FOR ALL THE WORK THEY'VE DONE ON BEHALF IT HAS MADE IT MUCH SAFER PLACE FOR EVERYONE, ESPECIALLY THE KAYAKERS AND THE PADDLE BOARDERS.

BECAUSE IT GIVES THEM A BUFFER AREA BETWEEN THE END OF THE SWIM ZONE AND 500 FEET WHERE EVERYBODY IS GOING AT IDLE SPEED. THEY START CREATING THE WAKES AND PROBLEMS FOR NAVIGATION THAT THEY WOULD HAVE.

SO THANK YOU VERY MUCH FOR EVERYTHING THAT YOU HAVE DONE.

>> THANK YOU, SIR. ANYONE ELSE WISHING TO ADDRESS THIS ISSUE PLEASE COME FORWARD.

>> CHARLENE ADAIR 1710 FRANCIS COURT. MADAM MAYOR, COMMISSIONERS AS A FREQUENT VISIT EUROOR OF JAYCEE PARK YEAR-ROUND I HAVE SEEN MANY CLOSE CALLS.

THE LIABILITY FOR THE CITY WAS CERTAINLY AT RISK DURING THOSE EVENTS WHICH WAS ONE, THERE WERE A LOT OF THEM. THANKS TO YOUR SOUND THINKING ON DECEMBER 16TH, YOU PASSED AN ORDINANCE THAT WAS PREAPPROVED BY S.W.C. REQUIRING IDLE SPEEDS WITHIN A RADIUS OF 500 FEET FROM THE BOAT RAMP WHICH ALSO SURROUNDS THE SWIM AREA AND THE YOUTH SAILING CLUB. IT TOOK ANOTHER SIX MONTHS TO GET THE APPLICATIONS AND PERMITS COMPLETE FROM F.W.C., ARMY CORPS OF ENGINEERS, U.S. COAST GUARD AND FDEP CULMINATING 14 MONTHS OF WORK. LAW ENFORCEMENT AND CODE ENFORCEMENT NOW HAVE THE LAWS AND SIGNS REQUIRED FOR ENFORCEMENT AND THEY'RE DOING AN OUTSTANDING JOB. THE CURRENT SWIM BUOY THAT ARE OUT THERE ARE INCLUDED IN THE LATEST F.W.C. APPLICATION AND PERMIT. I THOUGHT I WOULD LET YOU KNOW THAT. THE CURRENT ARE INCLUDED IN THAT.

IT RECOGNIZES THE FLORIDA STATUE 327.46 THAT REQUIRES 500 FEET AND CONTINUES TO

[01:10:06]

STATE THAT SWIM, BEACH AND SAILING CLUB AREAS NEED PROTECTION BUT THIS ORDINANCE TAKES THAT AWAY. CHANGING 500 FEET TO 300 FEET IS NOT ADDRESSED.

I KNOW ALL THE NUMEROUS E-MAILS AND PHONE CALLS OPPOSING THIS ORDINANCE.

IMAGINE A LEVEL LIABILITY ASSUMED BY THE CITY IF YOU KNOW WILLFULLY ENDANGER CITIZENS WITH STRONG PUBLIC OPPOSITION ON RECORD. A FEW FACTS.

F.W.C. APPROVAL SHOULD BE DONE BEFORE IT'S DONE PER DOCUMENT TITLE ORDINANCE LANGUAGE STANDARD OPERATING PROCEDURE WHICH HAS BEEN SENT TO ALL OF YOU.

CHAPTER 68 D-210023 A ADMINISTRATIVE CODE STATES IF THE ORDINANCE DOES NOT COMPLY WITH STATE STATUTE IT WILL BE DENIED. STATE STATUTE IDLE WAKE NO WAIK ZONE BE CREATED WITHIN 500 ZONE. IT WAS FOLLOWED TO THE CURRENT ORDINANCE. F.W.C. REVIEWED IT TWICE ALONG WITH FULL APPLICATION PACKAGE BEFORE PRESENTING IT TO YOU. THE STATE REQUIRES RADIUS OR HALF CIRCLE SO WE CAN'T DICTATE DISTANCE FROM SHORE LIKE WE WOULD.

IT'S NOT EXCLUDING ANYONE IT'S KEEPING OUR CITIZENS SAFE, IT FOLLOWS STATE STATUTE. SPEEDS ARE SAFER FROM MANY WATER SPORTS OPERATING IN THE SMALL AREA. IF YOU MAKE THE CHOICE TO GO AHEAD WITH THIS ORDINANCE PLEASE AT LEAST FOLLOW THAT PROCESS STATED EARLY. THE BUDGET TO DO THIS WORK COULD CERTAINLY BE BETTER SPENT BY MAKING ADDITIONAL IMPROVEMENTS.

THANK YOU SO MUCH. >> THANK YOU, MA'AM. THANK YOU, MA'AM.

ANYONE ELSE WISHING TO ADDRESS THIS SUBJECT PLEASE COME FORWARD.

ANYONE ELSE? OKAY I'M GOING TO CLOSE THE PUBLIC HEARING.

I ENTERTAIN DISCUSSION OR A MOTION. >> MADAM MAYOR, I'M GOING JUMP RIGHT IN THERE LET'S JUST GET A MOTION OUT HERE.

I THINK WE'VE ALREADY HEARD THE CONSENSUS FROM THIS BOARD.

I WILL MAKE A MOTION THAT WE WE DO NOT APPROVE ORDINANCE 20-028.

>> SECOND. >> SECOND. FOR THE RECORD WHAT DOES THAT DESIGNATION DO AS FAR AS ITS DISTANCE IS CONCERNED FOR CLARITY PLEASE.

I UNDERSTAND BUT I WANT THE PUBLIC TO KNOW. >> MR. SWEENEY --

>> I'LL MAKE SURE THAT IN CONJUNCTION WITH WILL REALS IT WILL MAINTAIN THE ORDINANCE AS IS ON THE BOOKS AND THE 500 FOOT DISTANCE AS CURRENTLY DEMAR INDICATED BY

THE CHANNEL MARKERS WILL REMAIN WHERE THEY ARE. >> THANK YOU, SIR.

>> OKAY. I'LL SAY THIS AGAIN 300 OR 500 WON'T MAKE A DIFFERENCE IF PROPER NOTICE ISN'T GIVEN WE DON'T HAVE THE VISIBLE PARAMETERS IN PLACE.

PEOPLE THAT VIOLATE THE ORDINANCES MOST TIMES INDIVIDUAL THAT'S ARE NOT EVEN FROM HERE. THE PEOPLE THAT ARE OUT THERE ON A DAILY BASIS ARE THE PEOPLE THAT WILL COOPERATE AND DO THE RIGHT THING.

BUT IN THE ABSENCE OF THE CITY MAKING SURE THAT VISIBLE PARAMETERS ARE PUT IN PLACE ARE GOING TO SUBSEQUENTLY HAVE ACCIDENTS THE TYPE OF ACCIDENTS THAT WE'VE BEEN TALKING ABOUT. SO IF WE ARE GOING TO BE REAL ABOUT THIS LET'S BE REALISTIC. I AMGEN FOR THE SAFETY I'M NOT PERSUADED BY ANYTHING OTHER THAN THE FACT THAT IT WILL POSE A I HAVE HEARD THE NEIGHBORS BUT AGAIN IN THE ABSENCE OF THE NECESSARY BARRIERS, WHICH ACCORDING TO WHAT WE HAVE HERE MAYBE WE NEED EVEN MORE BARRIERS PUT IN PLACE THOSE ACCIDENTS THAT WE TALKED ABOUT WILL SUBSEQUENTLY HAPPEN. SO I JUST HOPE THE CITY TAKES THAT INTO CONSIDERATION FROM A LIABILITY STANDPOINT. THANK YOU.

>> THANK YOU, SIR. >> OKAY, SO WE HAVE A MOTION AND A SECOND.

ARE WE READY TO VOTE. COMMISSIONER ALEXANDER ARE YOU THERE?

>> YES. I'M HERE. >> OKAY.

>> THIS IS A MOTION TO NOT APPROVE OR OPPOSE ORDINANCE 20-028.

>> YES. COMMISSIONER ALEXANDER. >> YES.

>> COMMISSIONER JOHNSON. >> YES, MA'AM. >> COMMISSIONER PERONA.

>> YES, MA'AM. >> COMMISSIONER SESSIONS. >> YES, MA'AM.

>> MAYOR HUDSON. >> YES, MA'AM. >> THANK YOU ALL.

THANK YOU FOR YOUR HARD WORK AND THANK EVERYBODY IN THE AUD ENCE FOR YOUR HARD WORK.

WE APPRECIATE IT. >>> NEXT ITEM IS AN UPDATE ON THE DEMOLITION OF 2607

[a. Update on the demolition of 2607 Avenue D - Continued from February 18, 2020 as Resolution No. 20-R12]

AVENUE D WHICH WAS CONTINUED FROM THE FEBRUARY 18, 2020 MEETING AS RESOLUTION

20-R12. >> THIS IS ACTUALLY I BELIEVE IS YOUR SECOND UPDATE SINCE FEBRUARY. THERE'S NOT MUCH OF AN UPDATE TO GIVE.

[01:15:04]

I SPOKE WITH MISS NORMA AGAIN THE OTHER DAY. SHE HAS A CONTRACT THAT SHE'S WORKING WITH TO TRY TO GET SOME PLANS DRAWN UP. IT STILL HAS NOT HAPPENED AN APPLICATION STILL HAS NOT BEEN MADE. IF THIS WAS ANY OTHER YEAR I WOULD PRESS THE COMMISSION TO MOVE FORWARD. BUT WITH OUR CURRENT CIRCUMSTANCES KNOWING, I KNOW MISS NORMA SAID SHE DID HAVE SOME HEALTH ISSUES THAT SHE HAD DEALT WITH OVER THE PAST MOVE. CONTRACTORS ARE HARD TO GET WORK THROUGH RIGHT NOW. THE GOVERNOR EVEN WITH HIS EXTENDED ORDER ALLOWS BUILDING PERMITS TO GO ADDITIONAL TIME. BASED ON OUR CURRENT CIRCUMSTANCES STAFF WILL RECOMMEND AN ADDITIONAL CONTINUATION JUST BASED ON

THE CURRENT CIRCUMSTANCES. >> WHAT HAVE WE DONE ON THE PAST CONTINUATION OF A

CERTAIN TIME. >> WE HAVE BEEN GOING WITH I BELIEVE EVERY THREE MONTHS.

>> YEAH. IS WILL ANY DISCUSSION? -- IS THERE ANY DISCUSSION?

>> YOU NEED ACTION ON THIS FOR A CONTINUATION. >>.

>> FIRST. I WILL MAKE A MOTION FOR THE CONTINUANCE.

>> SECOND. >> 90 DAYS. >> FOR 90 DAYS IN THE

SECOND. CALL THE ROLL PLEASE. >> COMMISSIONER ALEXANDER.

>> YES. >> COMMISSIONER JOHNSON. >> YES.

>> COMMISSIONER PERONA. >> YES. >> COMMISSIONER SESSIONS YES,

MA'AM. >> MAYOR HUDSON. >> YES, MA'AM.

THANK YOU, PEGGY. >>> NEXT WE HAVE COMMENTS FROM THE PUBLIC.

[14. COMMENTS FROM THE PUBLIC Any person who wishes to comment on any subject may be heard at this time. Please limit your comments to three (3) minutes or less, as directed by the Mayor, as this section of the Agenda is limited to thirty minutes. The City Commission will not be able to take any official actions under Comments from the Public. Speakers will address the Mayor, Commissioners, and the Public with respect. Inappropriate language will not be tolerated.]

THIS IS THE TIME FOR ANY MEMBER OF THE PUBLIC WHO WISHES TO ADDRESS THE COMMISSION. YOU WILL HAVE THREE MINUTES AND YOU WILL HAVE A WARNING AT THREE SECONDS, THREE SECONDS AND IF YOU WILL STATE YOUR NAME AND ADDRESS

FOR THE RECORD FOR ME PLEASE. >> ADAM MAYOR MY NAME IS TIM GUNTHER I'M A RESIDENT AT 162 VISTA COURT I'M ALSO A BUSINESS OWNER I OWN THE FLORIDA HEMP CHECKIVE. I'M HERE REGARDING A COMMENT ON THE PARKLETS THAT YOU HAD PROPOSED THAT WE ARE TRYING OUT DOWNTOWN. I SENT A PACKET IN.

THIS IS A PICTURE OF WHAT YOU GUYS HAD INITIALLY SENT. CHEYENE AND COMMISSIONER JOHNSON THEY HAVE BEEN VERY ACTIVE. IT WAS A GREAT PROGRAM TO GET STARTED. THE NEXT COUPLE PAGES IS I TOOK A BUNCH OF PICTURES OF THE PARKLETS IN QUESTION. APPARENTLY MADAM MAYOR YOU SAID A COMMENT EARLIER ABOUT USUALLY HEARING THE NEGATIVE. YOU NEVER HEAR THE POSITIVE WHICH IS TRUE IN THIS CASE. SO APPARENTLY YOU HAD SOME ENTITIES SAYING WE DON'T WANT THIS ANYMORE. THE PARKLET PROGRAM. SO I TOOK IT TO OUR TEAM AND PULLED 36 BUSINESS -- POLLED 36 BUSINESSES. THE REASON IT'S IMPORTANT THERE ARE SEVERAL BUSINESS OWNERS HERE BECAUSE OF THE COVID CRISIS PEOPLE ARE NOT GOING INTO THE STORES. SO YOU GIVE THEM A SPACE TO BE ABLE TO PARTICIPATE.

OUR SPACE WE HAVE A DOMINOS STAND ON FRIDAY AND SATURDAY NIGHT IT SO GIVES THE PUBLIC SOMETHING TO DO OUND OUTSIDE OF JUST WALKING AROUND AND WE SUPPORT ALL THE OTHER BUSINESSES. THE LAST PAGES ARE THE SIGNED PETITION.

IT'S NOT AN OFFICIAL PETITION BUT IT HAS EVERY PERSON THAT SIGNED.

IT HAS THE PHONE NUMBERS FOR EACH PERSON AND YEAS, NAYS. I WILL SAY ONE BUSINESS VOTED TWICE EVEN WE TRY TO -- SO FOUR NOS BUT I WILL COUNT IT AS THREE JUST SO YOU ARE CLEAR. LET'S SAY THAT IT'S HAD A POSITIVE IMPACT ON OUR BUSINESS. HEMP IS SOMETHING THAT'S MISUNDERSTOOD BY A LOT OF PEOPLE. SO IT'S ALLOWED TO US HAVE CONVERSATIONS WITH PEOPLE OUTSIDE WHO ARE NOT COMFORTABLE COMING INTO A BUSINESS YET JUST BECAUSE OF THE COVID CRISIS. AS FAR AS MY OTHER DOWNTOWN BUSINESS AUDIENCE MEMBERS WHO ARE HERE AS WELL. WE HAVE SEEN ACTIVITY AT DIFFERENT VENUES LIKE PUBLIC HOUSE WHICH IS RIGHT AROUND THE CORNER FROM US AND ON A FRIDAY AND SATURDAY NIGHT AND THURSDAY NIGHT IT GIVES THEM THE OPPORTUNITY TO HAVE AN OUTDOOR AREA WHERE THEY WANT IT. WHERE YOU SEE A LOT OF PEOPLE JUST REMAIN SOCIALLY DISTANT BUT LIKING THE OUTSIDE. HE IS BRINGING OTHER THINGS IN HIS PARKLET ON THE WEEKEND SO AS OF AT LEAST THROUGH DECEMBER THE SEASON IS COMING UP. WE TOOK OURS ALMOST ALL AROUND.

>> ANYONE ELSE? WISHING TO ADDRESS THE COMMISSION PLEASE COME FORWARD.

[01:20:04]

>> I LIVE AT 3268 LAKE SHORE DRIVE IN FORT PIERCE. I'M ALSO A BUSINESS OWNER DOWNTOWN. I ON SHEEP AND SHORE THINGS. QUITE HONESTLY AS FAR AS I CAN ONLY SPEAK FOR MY BUSINESS BUT COVID IS NOT OVER YET.

IT'S NOT GOING TO BE OVER FOR A WHILE AND I HAVE SEEN A DRAMATIC DECREASE IN THE AMOUNT OF PEOPLE COMING INTO MY SHOP, FEELING COMFORTABLE THERE.

WE REQUIRE THE MASKS AND I THINK THERE'S A LOT OF PEOPLE, ESPECIALLY THE OLDER GENERATION, MYSELF INCLUDED THAT STILL ISN'T OVER THE FEAR OF CATCHING THIS THIS DISEASE. SO FROM MY STANDPOINT I WILL TALK ABOUT THE PARKLET.

I'M REALLY LOOKING FORWARD TO THE SEASON. MY PARKLET IS GOING TO BE USED FOR EVENTS THAT I HAVE COMING UP. I HAVE AN OPEN HOUSE, I HAVE STEP IN SHOPS. WE HAVE FRIDAY ART WALK. WHAT WE LIKE TO DO IS IF IT'S GETTING A LITTLE OVERCROWDED WE'LL HAVE PEOPLE SIT OUTSIDE FOR A LITTLE BIT. WE'LL BRING OUT A GLASS OF WINE IF THEY WANT TO THEN BRING THEM IN THE STORE IF THEY FEEL COMFORTABLE OR WHATEVER.

WE'RE PLANNING ON HAVING MUSIC OUTSIDE. WE'VE HAD ARTISTS SIT OUTSIDE IN OUR PARKLETS. SO AS FAR AS I'M CONCERNED IT'S A BIG PLUS.

I KNOW YOU ONLY HEAR THE NEGATIVES WE ALL HEAR THE POSITIVES.

I'VE HAD A LOT OF PEOPLE SAY TO ME THIS HAS MADE SUCH A HUGE DIFFERENCE DOWN HERE.

IT LOOKS SO NICE. SO IF I CAN JUST PASS THAT ALONG TO YOU THAT THERE HAVE BEEN PROBABLY AS MANY POSITIVES AS NEGATIVES. THANK YOU FOR YOUR

CONSIDERATION. >> THANK YOU VERY MUCH. >> ANYONE ELSE WISHING TO

ADDRESS THE COMMISSION PLEASE COME FORWARD. >> GOOD EVENING.

MY NAME IS JULIAN HEWITT I LIVE AT 62 VIRGINIA PARK BOULVARD.

I ALSO OWN A BUSINESS HERE ON SECOND STREET HARD ACT LOUNGE.

A LOT OF YOU GUYS WERE AT MY RIBBON COUNT CEREMONY. I WANT TO SECOND WHAT TIM

AND BECKY SAID FOR THE PARKLET. >> AS A BUSINESS OWNER COVID ISN'T OVERMENT ONE OF OUR BIG SELLING POINTS BEING DOWNTOWN BEING ON SECOND STREET IS THE ABILITY TO SHUT THE STREETS DOWN AND HAVE BLOCK PARTIES, PUB CRAWLS YOU NAME IT. WITH US NOT BEING ABLE TO DO SO I UTILIZE PARKLET I'M ABLE TO BRING FOOD TRUCKS IN SET SOME TENTS UP AND GIVE IT A VISUAL AESTHETIC THAT SOMETHING BIGGER IS GOING ON WHICH IN THAT CASE CREATES BUSINESS FOR SOME OF MY SURROUNDING BUSINESS OWNERS AS WELL. WE UNDERSTAND IT WAS A TEMPORARY THING WE TOTALLY GET IT. WE JUST WANT TO LET YOU KNOW IT'S BENEFITED. ME PERSONALLY MY BUSINESS IT'S BENEFITED ME EXPONENTIALLY IN SO MANY DIFFERENT WAYS. WE HOPE WE CAN KEEP IT.

WE KNOW YOU DO HEAR THE NEGATIVES THAT'S WHY WE ARE HERE AS WELL.

I AM PART OF THE DOWNTOWN BUSINESS ALLIANCE. TELL YOU THANK YOU FOR ALLOWING TO US HAVE IT FOR AS LONG AS HAVE YOU. JUST HOPING THAT AT SOME POINT WE CAN MAYBE COME TOGETHER AND FIGURE OUT A REASONABLE RESOLUTION THAT CAN KIND OF BENEFIT EVERYBODY. I THINK WE'RE TAKING UP 12 PARKING SPACES TOTAL. YOU KNOW WE HAVE ALL STREET PARKING TWO FREE PARKING GARAGES. I THINK WE'RE ONE OF THE ONLY CITIES IN FLORIDA THAT

HAS THAT. >> THANK YOU, SIR. >> ANYONE ELSE WISHING TO ADDRESS THIS PLEASE COME FORWARD.

>> HI. 1706 CORTEZ BOULVARD. I OWN NOTIONS AND POTIONS ON

SECOND STREET. >> A LITTLE BIT CLOSER TO THE MIC.

>> SO THE PARKLETS HAVE BEEN AMAZING AND I WANT TO SAY THANK YOU.

WE UNDERSTAND THAT THEY ARE TEMPORARY WE ARE ONLY ASKING TO GET US THROUGH SEASON.

PEOPLE ARE STILL NOT COMFORTABLE GOING INSIDE, ESPECIALLY NOW BECAUSE IT'S 100% CAPACITY AND THEY SAY THAT YOU KNOW. IT IS 100% CAPACITY I DON'T WANT TO GO IN THERE LIKE A STUFFED SARDINE WHEREVER IT MAY BE.

SO THE PARKLETS HAVE BEEN, I HAVE HAD PEOPLE RECOGNIZE MY BUSINESS, PEOPLE THAT WOULD NOT HAVE NOTICED IT BEFORE. WE HAVE SPENT A LOT OF MONEY ON THE PARKLETS AND THEY ARE VERY DIFFICULT TO TAKE APART. WHICH WE WILL, AND WE ARE BUT IT DOESN'T JUST TAKE A DAY, YOU KNOW. ANY WAY THEY HAVE HELPED US TREMENDOUSLY SO I WANTED TO SAY THANK YOU SEE IF WE CAN FIGURE OUT A SOLUTION THAT WE CAN GET THROUGH SEASON. I HAD AN ARTIST OUTSIDE

[01:25:02]

FRIDAY NIGHT. PEOPLE ARE SITTING IN THE RAIN IN THE PARKLETS.

IT WAS POURING AT PUBLIC HOUSE AND THEY WERE OUT THERE IN THE RAIN BECAUSE THEY DIDN'T WANT TO GO INSIDE AND I GET THAT. I HAD AN ARTIST OUT THERE SHE HAD HER PAINTINGS OUT THERE SHE LITERALLY WAS PAINTING OUT THERE PEOPLE STOPPED. THEY WATCHED, THEY WERE ABLE TO WATCH AT A DISTANCE SAFELY. SHE SOLD TWO OF HER PIECES THAT SHE PAID HER ELECTRIC BILL. SHE WOULDN'T HAVE DONE IT OTHERWISE.

SO IT DOESN'T JUST HELP US AS BUSINESSES IT ALSO HELPS THE LITTLE PEOPLE, YOU KNOW EVERYBODY IN THE COMMUNITY. THE CUSTOMERS, THEY ALL LOVE IT.

SO THANK YOU. >> THANK YOU VERY MUCH. ANYONE ELSE WISHING TO

ADDRESS THE ISSUE PLEASE COME FORWARD. >> MADAM MAYOR AND COMMISSIONERS THANK YOU. JOSE RUIZ I'M AN OWNER IN DOWNTOWN JAY CUT'S BARBERSHOP. I GOT SAY I'M PRETTY IMPRESSED WITH ALL THE BUSINESS THAT'S ARE HERE TODAY THAT CARE FOR OUR BUSINESSES.

WE PUT TOGETHER D.B.A. FOR LAST TWO YEARS I GOT TO SAY I'M PRETTY IMPRESSED WITH HOW SUCCESSFUL WE WORKED WITH THE CITY, WITH MAIN STREET AND WITH THE DOWNTOWN BUSINESSES TO BUILD A COMMUNITY WITHIN EACH OTHER. THIS PARKLET WAS PRESENTED BY THE CITY. WE WERE SHOCKED AT FIRST WE THOUGHT WE WERE RISKING A LOT OF PARKING. BUT SOMETIMES YOU GOT TO TAKE THESE SACRIFICES TO SEE IF IT WORKS OR NOT. THAT'S THE ONLY WAY YOU WILL GET YOUR ANSWERS.

MOST OF YOUR COMPLAINTS CAME WHEN THE BARRICADES WERE OUT THERE AND BUSINESSES REQUESTED IT NOT KNOWING WHAT IT WAS. SO THE BARRICADES WERE TAKING UP PARKING THAT THEY WEREN'T BEING OCCUPIED. BUT THE PEOPLE THAT KEPT THE PARKLETS THEY DID A TREMENDOUS JOB IN MAKING IT LOOK VERY BEAUTIFUL.

I'M A BARBER IN DOWNTOWN AND I HEAR ALL THE NEGATIVE, THE POSITIVE AND THE SECRETS.

I GOT TO SAY

>> NO SECRETS ON THE VIDEO.

TABLE I GET A LOT OF PEOPLE SAYING WOW I DIDN'T KNOW THERE WAS A STORE RIGHT THERE. YEAH, YOU'RE RIGHT BECAUSE THEY'RE HIDDEN THEY'RE IN THE BUILDING. ONCE YOU WALK IN IT JUST GRABS YOUR ATTENTION.

NOW THEY'RE ABLE TO STRESS THAT IN THEIR PARKLET. SO IT DRIVES YOU -- TO EXPRESS THAT IN THEIR PARKLET. THAT'S A BEAUTIFUL THING.

THAT'S ONE WAY TO MAKE FORT PIERCE BEAUTIFUL IS BY DECORATING AND PUT SOME GREEN LIFE OUT THERE AND SOME BENCHES AND PICNIC AREAS.

YOU WANT IT TO BE A PLACE TO HANG OUT THAT'S DOWNTOWN AND THIS PARKLET HAS MADE IT AN OPPORTUNITY FOR EVERYONE TO EN JOY IT. WHY NOT JUST EXTEND IT A

LITTLE FURTHER AND WE'LL SEE HOW IT GOES. >> THANK YOU, SIR.

>> THANK YOU. >> ANYONE ELSE, YES, SIR.

>> MADAM MAYOR AND COMMISSIONERS. I'M CHRIS HIGGINS THE PUBLIC HOUSE. WE CAME IN JUST TO SPEAK BRIEFLY WITH REGARDS TO THE PARKLET SITUATION. WE WERE STARTLED WHEN WE FIGURED IT WAS COMING TO AN END LAST WEEK ACTUALLY SOMETIME EITHER TONIGHT OR TOMORROW THEY'RE GOING TO START TAKING THEM DOWN. WE'VE BEEN CLOSED CURRENTLY 187 DAYS AT OUR BUSINESS THREE DAYS SHY OF ABOUT SIX MONTHS NOW. WE HAVE BEEN OPEN NINE DAYS AT THIS POINT IN TIME AND THE PARKLETS HAVE GIVEN US A FEW DIFFERENT WAYS TO ARTICULATE WHAT WE DO NOW AND GIVES THE PATRONAGE THE ABILITY TO GET A DRINK AND COME OUTSIDE AND CONSUME THE BEVERAGE THAT THEY'RE HAVING WHICH WE CALL DISTANCE DRINKING BUT OBVIOUSLY BEING SOCIALLY DISTANT AS WELL OR OBSERVING THE COVID SCENARIO. WE FEEL MOVING FORWARD WE WOULD LIKE TO SEE IF WE CAN GET A LITTLE ADDITIONAL RUNWAY IN FRONT OF US IN REGARDS TO THE PARKLETS REMAIN FOR AT LEAST TWO OR THREE MORE MONTHS OR OBVIOUSLY UNTIL THE PARADE.

WE DON'T KNOW IF WE HAD BOON OPENING DURING THE PROGRAM OF THAT PILOTTED BY THE CITY WE THANK YOU GUYS FOR THAT. WE WANT TO KNOW IF THERE'S ANY WAY WE CAN EXTEND IT MOVING FORWARD. THAT'S WHERE WE'RE AT AT THIS POINT IN TIME.

HOPING TO SEE THE SEASON COMES BACK PEOPLE START TO ARRIVE IN COPIOUS AMOUNTS INTO DOWNTOWN HOPEFULLY WE CAN BENEFIT FROM IT. THAT'S WHERE WE ARE TONIGHT.

THANK YOU VERY MUCH. >> ANYONE ELSE WISHING TO ADDRESS THIS ISSUE PLEASE

COME FORWARD. >> GREG RUSSELL 201 HEARTMAN ROAD.

I GUESS I WILL BE THE FLY IN THE OINTMENT HERE. THE PARKLET PROGRAM UNDERSTAND D THE DESIRE FOR IT BY A LOT OF THE DOWNTOWN BUSINESSES. ONE OF MY ISSUES WITH IT FROM THE BEGINNING WAS WE'RE A DAYTIME BUSINESS. THE PARKLETS ARE THERE 24 SLR 7 THEY -- 24/7 THEY AFFECT PARKING 24/7. A LOT OF THE BUSINESS THAT'S SEEM TO BENEFIT FROM THEM SOME DO ALL DAY LONG BUT MOST DO IN THE EVENING THE

[01:30:03]

RESTAURANTS AND THE BARS THOSE THINGS. WHEN I INITIALLY SPOKE TO CHEYENE I SAID CHEYENE ISN'T WILL A WAY WE CAN MAKE THIS GOOD FOR THE PEOPLE THAT NEED IT AT NIGHT BASICALLY, AFTERNOON, EVENING AND ALLOW MY CUSTOMER, WHICH IS AN OLDER CUSTOMER WHO IS NOT GOING TO WALK FROM THE PARKING GARAGE TO MY BUSINESS WHEN IT'S 100 DEGREES OUTSIDE THEY'RE JUST NOT GOING TO DO IT.

THEY WANT TO HAVE CONVENIENT CLOSE BY ON STREET PARKING AS MOST BUSINESSES DO. I UNDERSTAND THE BUSINESS THAT'S HAVE BENEFITED FROM IT. I HAD AN INFORMAL PETITION IN MY BUSINESS ALSO ACROSS THE STREET IN THE SUNRISE CAFE. I PRESENTED THAT PETITION TO THE PARKING COMMITTEE WHEN I SPOKE IN FRONT OF THEM SIX WEEKS AGO.

IT WAS ABOUT 200 SIGNATURES ON IT. I DIDN'T GO OUT AND SOLICIT ANY SIGNATURES IT WAS FROM PEOPLE WALKING INTO MY BUSINESS AND SAYING WHAT ARE THOSE. WE SAID WELL, THEY'RE PARKLETS.

WE HAVE A SIGN UP SHEET HERE IF YOU DON'T LIKE THEM NO PRESSURE YOU KNOW IF THEY'RE FINE. WE ENDED UP WITH 200 SIGNATURES BETWEEN MY BUSINESS ONE ACROSS THE STREET PEOPLE WHO DIDN'T THINK THEY WANTED TO BE ABLE TO PARK CLOSE AND WALK IN THE DOOR. I UNDERSTAND HOW THEY BENEFIT SOME BUSINESSES. BUT IF WE EXTRAPOLATE THAT AND EVERY BUSINESS HAD A PARKLET THERE WOULD BE NO PARKING DOWNTOWN. THE PARKING SPACES THAT ARE THERE UP AND DOWN THE STREET ARE FOR THE BENEFIT OF ALL THE BUSINESSES.

WHEN CERTAIN BUSINESSES UTILIZE THE PARKLET ONLY FOR THEMSELVES THEY ACTUALLY ARE TAKING AWAY PARKING FROM THE WHOLE OF DOWNTOWN. RIGHT NOW I BELIEVE THERE'S MY UNDERSTANDING IS THERE'S 12 SPACES THAT ARE BEING UTILIZED.

YOU KNOW I'VE GOTTEN USED IT TO IT'S LESS THAN THE 50. WHAT WE HAVE TO REALIZE IT'S NOT SIMPLY 12 SPACES. THOSE 12 SPACES SHOULD TURN OVER EVERY TWO HOURS IF PEOPLE PARK THERE AT THE MAXIMUM AMOUNT OF TIME THEY'RE SUPPOSED TO.

SO THOSE 12 ACTUALLY BECOME 48 SPACES THROUGHOUT THE DAY THIS ARE UTILIZED BY THE PARKLETS. AGAIN I WOULD LIKE TO SEE THEM COME DOWN PERSONALLY.

THANK YOU. >> THANK YOU, SIR. >> ANYONE ELSE?

>> I'M I'M BONNIE I'M ONE OF THE OWNERS OF TACO DIVE. I UNDERSTAND WHAT MR. RUSSELL IS SAYING AT THE BEGINNING WHEN THERE WERE MANY OUT THAT THEY WERE NOT BEING UTILIZED PROPERLY. I'M TELLING YOU FROM A BUSINESS OWNER NOW WE'VE DONATED AND GIVEN SO MUCH TO THIS COMMUNITY AND CHECKIVELY WE HAVE SPENT THOUSANDS OF DOLLARS ON THE PARKLETS WE NEED A PARKLET. WE WERE STRUGGLING, YOU KNOW. OUR LUNCH BUSINESS IS NOT VERY GOOD RIGHT NOW.

PEOPLE DON'T WANT TO GO INTO THE RESTAURANTS BECAUSE IT IS 100% CAPACITY.

COLLECTIVELY THE PEOPLE THAT ARE HAVING THE PARKLETS OUT NOW ARE UTILIZING THEM PROPERLY. THEY ARE AESTHETICALLY BEAUTIFUL.

COLLECTIVELY I KNOW WE HAVE SPENT THOUSANDS OF DOLLARS MAKING DOWNTOWN BEAUTIFUL AGAIN. I'M A PROPONENT TO KEEP THEM AND I HOPE THAT THEY DO.

THANK YOU. >> ANYONE ELSE?

>> MADAM MAYOR, COMMISSIONERS I'M A DOWNTOWN BUSINESS OWNER.

>> STATE YOUR NAME FOR MEASE PLEASE. >> AND YOUR ADDRESS.

>> NEIL. >> I OWN A BUSINESS AT 100 SOUTH SECOND STREET IN THE GALLERIA BUILDING. I OWN DELICIOUS WHICH IS THE DELI ON SECOND STREET.

WE JUST OPENED UP ANOTHER BUSINESS CALLED GLASS CULTURE ON ORANGE AVENUE IN THE SAME BUILDING. TO MR. RUSSELL'S POINT ABOUT THE AVAILABILITY OF PARKING RECENTLY I DON'T THINK THAT'S BEEN AN ISSUE. IT ARE HALL -- LITERALLY EVERY DAY THERE HAS BEEN PLENTIFUL PARKING ESPECIALLY AROUND THAT BUILDING.

I THINK ME AND THE FORT STEAKHOUSE ARE THE ONLY TWO TAKING UP PARKLET SPACES ON THAT SIDE OF SECOND STREET. SO I'M IN FAVOR OF KEEPING THEM.

THEY DO MAKE DOWNTOWN BEAUTIFUL. WE HAVE SPENT A LOT OF MONEY ON THEM. I THINK THEY EVEN MAKE THE WALKING AREA THE SIDEWALKS A LOT SAFER FOR PEOPLE. BEING A NEW BUSINESS OWNER IT HAS BROUGHT ON A LOT OF ATTENTION DURING A VERY DIFFICULT TIME. WE OPENED DELICIOUS IN DECEMBER. SO JUST A COUPLE MONTHS BEFORE ALL THIS COVID STUFF HAPPENED. I CAN'T ROMNEY WHO SAID IT EARLIER TO THEIR POINT -- I

[01:35:02]

CAN'T REMEMBER WHO SAID IT EARLIER TO THEIR POINT YOU SAY HEY, WHAT'S THIS, WHAT'S THAT BECAUSE YOU'RE MORE VISIBLE. I JUST WANTED TO SECOND WHO MOST OF US HAVE ALREADY SAID ABOUT THE PARK LETS WE WANT TO KEEP THEM AND SEE THEM GET EXTENDED AND THANK YOU GUYS FOR LETTING US TO DO IT TO BEGIN WITH BUT WE NEED A LITTLE BIT MORE. THANK YOU, SIR. ANYONE ELSE.

ANYONE ELSE. >> OKAY. WE'LL MOVE ON.

[15. COMMENTS FROM THE CITY MANAGER]

NEXT WE HAVE COMMENTS FROM THE CITY MANAGER. MR. MIMS ARE YOU STILL WITH

US. >> YES, MA'AM, YES, I AM. MADAM MAYOR MEMBERS OF THE CITY COMMISSION AT THIS POINT OF THE AGENDA WE DO HAVE -- WHICH THE MONTHLY PURCHASE ORDER REPORT AND ALSO THE CORONAVIRUS UPDATE. BUT AT THIS TIME IF YOU DON'T MIND I WOULD LIKE TO ALLOW OUR DIRECTOR OF PUBLIC WORKS AND HOPEFULLY OUR CITY ENGINEER TO COME BEFORE AND YOU GIVE YOU AN UPDATE AS TO OUR RESPONSE TO THE VARY INTENSE RAIN EVENTS THAT WE'VE HAD -- VERY INTENSE RAIN EVENTS THAT WE'VE HAD

RECENTLY IN THIS AREA. >> I THINK THAT WOULD BE VERY WELCOME.

WHO WOULD LIKE TO GO FORWARD. -- TO GO FIRST.

>> MR. ANDREWS YOU GET TO START WITH THE BAD NEWS.

OR THE GOOD NEWS. >> MADAM MAYOR, COMMISSIONERS AFTER A WEEK OF HEAVY RAIN AS WE ARE ALL AWARE WE DID HAVE A BREAK TODAY.

OUR SYSTEM IS RECOVERING SOMEWHAT. ALL IN ALL I KNOW WE'VE HAD SOME LOCALIZED FLOODING IN DIFFERENT STREETS. BUT OVERALL WE FARED PRETTY WELL WE DID HAVE SOME OVERTOPPING MAY PLOWER CANAL WENT OVER ITS BANKS AT ONE POINT. THE INDIAN HILLS RECREATION AREA IS PRETTY WELL FULL PROBABLY AT THE HIGHEST I'VE SEEN IT SINCE IT WAS CONSTRUCTED.

WE DID HAVE SOME PROBLEMS WITH OUR NEW STATION THAT WE INSTALLED AT E STREET.

WE HAD THE AFTER THE FIRST DAY WHEN WE HAD THE FLOODING PROBLEMS WE HAD THE CONTRACTOR RIGHT OUT THERE HAD THE PUMP MANUFACTURER RIGHT OUT THERE.

WE HAD THE PRIME CONTRACTOR THERE AND HE INSTALLED A BACKUP PUMP.

HE ADJUSTED THE FLOATS AND I THINK WE HAVE THAT PROBLEM SOLVED AND KEEPING AN EYE ON IT. I HAD REPORTS THROUGHOUT THE WEEKEND OF THEY CONTINUED TO WATCH IT AND EVERYTHING. SO I THINK WE HAVE THAT PROBLEM SOLVED.

I DON'T BELIEVE WE HAD ANY OVERFLOW AT SEVENTH STREET AT ANY TIME.

SO ALL IN ALL I THINK WE DID FAIR PRETTY WELL. WE DID HAVE SOME PROBLEMS ON THE BEACH. OUR PROBLEM STREETS THAT WE USUALLY HAVE.

THE WORK THAT WE DID ON BAY SHORE AND REA VISTA SEEMED TO, WOULD.

WE HAD ONE PROBLEM AT THE -- SEEMED TO WORK. WE HAD ONE PROBLEM AT RIO VISTA WHERE IT TIES ONTO A 1 A WE HAD A FLOODING PROBLEM RIGHT IN THAT AREA.

WE DO HAVE AN APPLICATION IN TO DOT RIGHT NOW TO MAKE A CONNECTION TO MAKE A CONNECTION INTO THAT DRAINAGE SYSTEM. THAT IS CURRENTLY UNDER REVIEW HOPEFULLY WE CAN GET THAT SOLVED. ALL IN ALL I THINK WE DID VERY WELL. I WILL BE HAPPY TO ANSWER ANY QUESTIONS.

>> DO YOU KNOW HOW MANY INCHES. I'VE HEARD FROM PEOPLE THE FLOODING THIS TIME WAS SO MUCH WORSE THAN MANY PEOPLE EVER REMEMBER, INCLUDING

TROPICAL STORMS AND THAT KIND OF THING. >> YEAH, IT'S BEEN VERY STRANGE. IT'S A RAINFALL EVENT THAT DIFFERENT AREAS OF THE TOWN RECEIVED DIFFERENT AMOUNTS. I'VE HAD ONE REPORT THAT WE HAVE HAD IN EXCESS OF 14 INCHES AT ONE POINT. IT WAS ESTIMATED BETWEEN 11 AND 14.

THAT COMES FROM THE MELBOURNE WEATHER CENTER. >> RIGHT.

>> WE'VE HAD A LOT OF RAIN. >> IN A SHORT PERIOD OF TIME. >> WHAT ABOUT THE BENT CREEK

AREA? >> WE HAVE NOT HAD THE FLOODING PROBLEMS THAT WE

[01:40:05]

HAD AT THE APARTMENTS OUT THERE HISTORICALLY. IT SEEMS LIKE THAT AREA WAS A LITTLE LESS ON RAINFALL AMOUNT AND I THINK WE FARED PRETTY WELL ON THAT END.

>> OKAY. OKAY. THANK YOU.

>> COMMISSIONER PERONA. >> THANK YOU FOR BEING HERE, JACK.

I SENT AN E-MAIL TO THE CITY MANAGER. I'M SURE WE ALL GOT PHONE CALLS WHEN YOU SEE THE WATER CREEPING UP TO YOU YOUR FRONT DOOR EVERYBODY GOES INTO PANIC MODE, INCLUDING MYSELF. WE'VE SEEN THAT HAPPEN BEFORE. WE REALLY NEED TO HAVE A WAY THAT FOLKS CAN GET A QUICK ANSWER ON ALL THAT. CALLING EXCEPT FOR JEREMIAH WHO IS AN ENGINEER THE REST OF US REASON ENGINEERS AND YOU'RE NOT GOING TO GET A QUICK ANSWER WE WILL TRY TO GET YOU A QUICK ANSWER. BUT THERE NEEDS TO BE A WAY FOLKS CAN PICK UP THE PHONE AND CALL CITY HALL SOMEWHERE, MAYBE YOU CAN HELP ME. WHO CAN THEY CALL, WHO CAN THEY TALK TO GET A QUICK ANSWER ABOUT WHAT'S GOING ON AND SHOULD THEY BE REALLY CONCERNED, SHOULD THEY PACK UP AND MOVE THE KIDS AND THE DOG OUT OF THERE OR FIND SOME TYPE OF INFORMATION THAT WILL PUT THEIR MIND AT EASE AND GIVE MEN A SENSE OF

COMFORT IN THIS DELUGE THAT WE'VE HAD. >> I KNOW OUR DEPARTMENT RECEIVED NUMEROUS AMOUNT OF THAT CALLS WE RESPONDED TO. I'M SURE PUBLIC WORKS DID THE SAME THING. WE REALLY DO TRY TO RESPOND TO CALLS THAT COME IN.

SOMETIMES WHEN PEOPLE CALL IN FROM PRIVATE DEVELOPMENTS QUITE FRANKLY THEY MAY BE A LITTLE TAKE A LITTLE LONGER TO GET BACK TO THEM BECAUSE THERE'S A LOT OF INSTANCES WHERE WE KNOW THAT IT'S A PRIVATE DEVELOPMENT. WE HAVE NO JURISDICTION IN THERE. WE HAVE A LOT OF CALLS ALL OVER THAT WE RESPOND TO.

>> I JUST THINK RELEASE A WAY WE NEED TO BE ABLE TO COMMUNICATE INFORMATION TO THE PUBLIC. THESE ARE GRAND CONCERNS. YOU ARE READING IN THE PAPER EVERY DAY ABOUT VIRUS -- FIRES OUT WEST AND WHAT CAN HAPPEN TO US.

HERE IT IS WE HAVE BEEN RAINING EVERY DAY. AS YOU SAY MAYOR, THE INCHES ARE EITHER FOUR, FIVE, SIX, 10, WHATEVER IT IS. BUT THEY ARE THERE AND THEY'RE A CONCERN AND PEOPLE WANT TO PREPARE FOR THAT. SO WE SHOULD BE THE HUB FOR BEING ABLE TO GET OUT THERE AND GIVE THESE TYPE OF RESPONSES.

AT LEAST LET THEM KNOW WHAT'S HAPPENING THAT WE'RE NOT ASLEEP AT THE WHEEL.

THAT WE HAVE BEEN DOING INFRASTRUCTURE AND A LOT OF INFRASTRUCTURE CHANGES OVER THE YEARS WITH OUR DRAINAGE WATERS AND THINGS LIKE THAT. SO IT'S IMPORTANT.

I WILL SAY IN A COMMENT THAT THE DAY AFTER I MEAN WHEN WE START GETTING A BREAK ON EVERYTHING. I STILL SAW WATER MOVING OUT ON HUTCHINSON ISLAND.

IT WAS MOVING. IT WAS GOING DOWN A GRATE THAT WAS BUBBLING UP COMING IN FROM SOMEWHERE ELSE. SO I HAD THE CONFIDENCE IN MYSELF TO FEEL THAT THE SYSTEM IS WORKING. IT'S NOT HAPPY BUT IT IS WORKING.

THAT'S HELPFUL. AGAIN THERE ARE A LOT OF PEOPLE OUT THERE PRETTY FRUSTRATED WITH THE FACT THAT THEIR FEARS GOT GOING AND RIGHTLY SO.

WE JUST NEED TO BE ABLE TO GET THERE AND HAVE MAYBE A SYSTEM OF BEING ABLE TO RESPOND TO THAT. EVEN IF IT'S SOMETHING ON OUR WEBSITE THAT SAYS HEY, YOU KNOW, CITIZENS IN FORT PIERCE WHERE WE'VE HAD EXAMPLE X AMOUNT OF RAIN HERE'S WHAT'S HAPPENING. IF YOU HAVE AN UNUSUAL SITUATION HERE'S WHAT YOU NEED TO DO. THINGS LIKE THAT. I THINK IT'S IMPORTANT TO BE ABLE TO RESPOND TO THESE FOLKS. THE COMMISSION WE AS COMMISSIONERS PROBABLY KNOW NOT MUCH MORE THAN WE DO. BUT WE'RE ABLE TO GET THE RESPONSE. I WAS GETTING A LITTLE BIT FRUSTRATED.

I WANT SOMEBODY THERE ON MONTAGUE ABOUT THE FLOODS -- ON MONTAGUE ABOUT THE

FLOODS. >> WHAT I WILL LIKE TO US DO SEND OUT THE NOTIFICATION MESSAGES DIRECTING FOLKS TO THE WEBSITE IN ADDITION TO THAT CREATE A SERVICE TAB, WHATEVER IT IS ON THE WEBSITE IMMEDIATELY THAT TAKES THEM TO AN INFORMATION PAGE ABOUT THE EVENT. I KNOW THAT'S A LOT OF BEHIND THE SCENES WORK.

[01:45:02]

IT TRULY IS. I'M NOT SAYING YOU TWO ARE THE RESPONSIBLE PARTIES FOR THAT BUT AS A CITY YOU'RE RIGHT. WE NEED TO BE LEADING THAT IN THE TECHNOLOGY ERA THAT WE'RE IN. IN ADDITION, FOLKS WERE CONFUSED OFFER WHETHER THEY WERE PRIVATE OR WAS IT CITY OF FORT PIERCE, WAS THE NORTH ST. LUCIE OR ST. LUCIE COUNTY. WHERE DOES ONE START, WHERE DOES ONE END AND IT WAS VERY CONFUSING. THERE WERE SOME MAJOR WASHOUTS. ONE WAS IN I THINK PALM GROVE OVER OFF 25TH STREET.

I THINK THAT'S NORTH ST. LUCIE SOOMPT THEY WERE TRYING TO GET IN CONTACT WITH THOSE FOLKS AND THEY COULDN'T SO THEY WERE LIKE I DON'T KNOW WHAT TO DO NOW.

THAT'S PART OF THE CITY OF FORT PIERCE. WHATEVER INNOVATIVE WAY WE CAN MAKE IT HAPPEN I'M READY TO DO THAT. DID WE GET, MAYBE I MISSED

IT DID WE GET AN UPDATE TEXT MESSAGE SENT OUT? >> I GOT THEM FROM ST. LUCIE COUNTY. I GOT THEM FROM ST. LUCIE COUNTY.

BECAUSE YOU HAVE TO SIGN UP FOR THAT. THAT BASICALLY JUST TELLS YOU WHAT TO EXPECT, OR WHAT I THINK YOU'RE TALKING ABOUT SOMETHING A LITTLE BIT, IT SOUNDS LIKE WHAT WE DO WHEN WE HAVE TO DO WITH A HURRICANE AND THE SPECIAL PLACES ON THE WEBSITE WHEN THE HURRICANE IS COMING THIS IS WHAT YOU NEED TO DO.

THIS IS THE LATEST TRACKING. >> EVEN IF THE O.C. HAS A MESSAGING SERVICE THAT'S ALREADY THERE YOU CAN ITEMIZE IT BY ADDRESS, BY JURISDICTION AND POST A MESSAGE TO JUST THOSE INDIVIDUAL THAT'S HAVE SIGNED UP FOR THE PROGRAM.

I THINK THAT'S AN IMPORTANT PART. USE THEIR SYSTEM AS ONE OF OUR PARTNERS. BUT US SENDING A MESSAGE FROM THE CITY OF FORT PIERCE

SAYING COME HERE WE'LL TELL YOU MORE. >> BUT ALSO, TOO WE HAVE TO HAVE THE ABILITY OF THAT HOMEOWNER TO BE ABLE TO SAY WHAT'S HAPPENING TO THEM SPECIFICALLY. WHAT IS HAPPENING TO ME. I GO DOWN THE STREET I DON'T SEE THE IMPACT NEAR AS BAD AS IT IS IN FRONT OF MY HOUSE.

THAT'S THE PART THAT REALLY WE HAVE TO BE ABLE TO HAVE THE ABILITY TO DO THAT.

I DON'T KNOW IF A FIX CAN BE PART SEE CLICK IF YOU CAN GET YOUR CAMERA UP OVER THE QUARTER AND SAY YEAH THIS IS MY PROBLEM GET A QUICK RESPONSE ON THAT.

BUT THIS WAS LIKE A DRESS REHEARSAL FOR ALL THE DISASTERS THAT CAN HAPPEN.

I JUST WOULD LIKE US TO GET BETTER AT THAT SO THEY GET FRUSTRATED AND THEY CALL US, WHICH IS GREAT, BUT THAT MAY NOT BE THE FASTEST WAY TO GET INFORMATION.

>> MR. SESSIONS. >> AS FAR AS MY AREA IS CONCERNED I DO BELIEVE THAT THERE WAS A GREAT DANGER THAT WAS MUCH IN TERMS OF FLOODING AND I THINK A LOT OF HIT TO DO WITH HURRICANE PREPARATION AND CLEANING OUT THE DRAINAGE PUBLIC WORKS HAD TAKEN THAT ON. A LOT OF THAT BEFORE COVID SEASON.

I NOTICED THAT. BUT THERE WASN'T MUCH FLOODING IN DISTRICT 1.

I DIDN'T GET MANY COMPLAINTS. IT MAY HAVE HAD A LOT OF WHAT JACK SAID, THAT'S THE WAY GOD WORKS SOMETIMES SPORADIC IN CERTAIN AREAS. I DO BELIEVE A LOT OF HIT TO DO WITH THE DRAINAGE BEING CLEANED OUT. IT HAS BEEN A LOT WORSE.

REST ASSURED IT'S COME UP TO MY DOORSTEP ON NUMEROUS OCCASIONS IN TROPICAL STORMS. BUT THIS PARTICULAR RIFLE WE -- RAINFALL I DIDN'T HAVE MUCH PROBLEMS OVER IN DISTRICT ONE. WHEN I RIDE AROUND I DIDN'T SEE MUCH OF IT. AGAIN, I COMMEND PUBLIC WORKS IN PREPARATION FOR THE HURRICANE I DO BELIEVE THAT WAS A CONTRIBUTING REASON FOR THAT.

>> I THINK WE'RE ALSO SEEING, I REMEMBER, EARLIER THIS YEAR OR WAS IT LATE LAST YEAR WE WENT TO RESILIENCY SEMINAR OUT AT THE CENTER AND THE COUNTY PUT IT ON.

THIS WAS A WHOLE GLOBAL LOOK AT WHAT FLORIDA IS JUST GOING TO BE HAVING INCREASING FLOODS AND FLOODING BECAUSE OF THE AMOUNT OF PEOPLE THAT LIVE HERE AND BECAUSE OF THE STRAIN ON ALL OF OUR SYSTEMS AND THAT WE'RE -- BECAUSE OF WHATEVER OTHER CAUSES THAT THIS IS BEYOND FORT PIERCE AND BEYOND ST. LUCIE COUNTY.

THE WHOLE STATE CAN GET VERY, VERY SATURATED VERY, VERY EASILY.

>> SO I DON'T KNOW IF YOU ANYTHING YOU WANT TO ADD.

>> JUST TO SPEAK FROM A MAINTENANCE SIDE. FIRST THING THURSDAY MORNING WE HAD CREWS OUT. YOUR PUBLIC WORKS DEPARTMENT WHEN WE HAVE RAIN EVENTS

[01:50:04]

LIKE THAT IT'S NOT JUST THE STREETS AND DRAINAGE DIVISION THAT'S ADDRESSING DRAINAGE ISSUES. WE'RE NOT ABLE TO MOW GRASS AND THINGS LIKE THAT SO MUCH OF OUR DEPARTMENT TURNS TO STORM WATER AND MAINTENANCE OBSTRUCTIONS.

WE GOT THE CALL WE DID HAVE A FAILURE AT SOUTH EIGHTH STREET.

WE DID HAVE STAFF ON HAND USING SOME OF OUR SMALLER PUMPS UNTIL THE CONTRACTOR COULD GET OUT THERE WITH LARGER PUMPS. THEY WORKED TIRELESSLY THROUGH THURSDAY TRYING TO CLEAR ALL THE CATCH BASINS. WE KNOW -- WE HAVE KNOWN PROBLEM AREAS. WE HIT THOSE IMMEDIATELY. WE TRY TO ADDRESS AS MANY PHONE CALLS AS WE COULD GET. WE PUT A COUPLE EXTRA PEOPLE ON STAND BY EVENING THIS KNOWING WE WERE EXPECTING A LOT MORE RAIN. WHILE WE DID RECEIVE A LOT OF RAIN FROM THURSDAY THROUGH THIS MORNING THE GOOD THING ABOUT IT IS IT RAINED A WHILE THEN IT STOPPED. IT RAINED A WHILE THEN IT STOPPED. AS COMMISSIONER PERONA SAID WHENEVER WE DO HAVE THOSE LITTLE LULLS IN THE RAINFALL. THE SYSTEM IS WORKING THE WATER IS MOVING IT'S JUST SO MUCH RAIN IN SUCH A SHORT AMOUNT OF TIME THAT THE SYSTEM IS CHARGED AND IT JUST CAN'T GO ANYWHERE. ONCE IT DUPS SUBSIDE A LITTLE BIT ASK WE'RE ABLE TO GET THE WATER MOVING OFF THE STREETS. THAT'S ONE BLESSING WE DID HAVE THIS WEEKEND. IT DID STOP LONG ENOUGH THAT WE AVOIDED MAJOR PROBLEMS OVER THE WEEKEND. OVER THE FRIDAY THROUGH THIS MORNING WE ONLY HAD TWO CALLOUTS FOR RAIN EVENTS OVER THE WEEKEND SO THAT'S PRETTY GOOD.

>> THANK YOU. >> MR. REALS DID YOU GET NOTIFIED THROUGH THAT APP AT

ALL OR WAS IT MOSTLY PHONE CALLS? >> MOSTLY PHONE CALLS.

I'M NOT SURE I WOULD ASSUME WE PROBABLY DID GET SOME SEA CLICK FIX I VALENTINE SEEN THOSE YET. -- I HAVEN'T SEEN THOSE YET. WE DID GET PHONE CALLS.

NUMEROUS PHONE CALLS. >> DO WE HAVE AN ESTABLISHED, DO WE HAVE A PHONE NUMBER? SADLY I DON'T KNOW BECAUSE I'VE NEVER EVEN USED OR LOOKED UP A PHONE NUMBER TO

CALL 1-800-MIKE-REAL COMES RESCUE ME. >> WE DO HAVE A PRIMARY --

DOES THAT GO TO AN ON-LINE PERSON? >> THAT DOES IT NOT.

IT DOES HAVE TO GO THROUGH 911 ON CALL IS DISPATCHED FROM OUR E.O.C. THEY WOULD MAKE A CALL THROUGH 911 THEY WOULD DISPATCH OR ON-LINE PERSON FOR THE WEEKEND.

>> AS WE KNOW JUST IN COMMON SENSE TELLS US THAT FLOODWATERS THEY THERE ARE MANY PERILS ASSOCIATED WITH IT. IT COULD BE DRAINAGE SYSTEM THAT'S CLOGGED. WHEN YOU PULL THE DEBRIS AWAY FROM IT IT'S GOING TO FLUSH POTENTIALLY. IT ALSO IS AN ISSUE WE HAVE NOTIFICATION TODAY BECAUSE OUR SEWER SYSTEMS GET BACK CHARGED. IT COULD BE A VERY PER NIL THAT MANNER BECAUSE THERE WAS A -- PERIL IN THAT MANNER BECAUSE THERE WAS A NOTICE ABOUT THE WASTE WATER PLANT BEING OVERRUN. THAT'S AN ISSUE.

WE HAVE AN OLD CITY WE HAVE OLD SYSTEMS. WE HAVE LOWER PROPERTIES WE'RE TRYING TO DO THE BEST WE CAN I KNOW AND YOU GUYS DO A GOOD JOB AT ADDRESSING THOSE ISSUES AS MUCH AS YOU CAN ON A DAILY BASIS. IT'S A CHALLENGE.

IT TRULY IS. >> 100 YEAR RAINS ARE BECOMING MORE FREQUENT.

>> IT IS. >> YES. YEAH, RIGHT, RIGHT, RIGHT.

>> CLASSIFY THAT NAME. >> SO MAYBE WE CAN ALL PUT OUR COLLECTIVE HEADS TOGETHER AND IN PREPARATION FOR THE NEXT SUCH EVENT IN A WAY TO BE ABLE TO BE RESPONSIVE TO OUR CITIZENS IN A MANNER THAT WE CAN PLAN.

I HEAR WHAT COMMISSIONER PERONA IS SAYING. THEY'RE ANXIOUS THEY WANT TO HEAR FROM SOMEBODY. THAT SEEMS TO HAPPEN A LOT TOO WITH WHEN THERE'S AN OUTAGE THEY WANT MAKE SURE THAT F.U.A. KNOWS THAT THERE'S AN OUTAGE.

I KNOW THAT SERVICE IS SOMETHING WE GET USED TO. >> THIS IS NOTHING NEW.

WE HAVE DEVICES WE HAVE E-MAIL ADDRESSES WE DO HAVE PHONES AS FAST AS WE CAN GET

THAT INFORMATION OUT. >> TEXTING MIGHT BE THE WAY TO DO IT.

TEXTING MIGHT BE THE WAY TO GO. >> BEER THE ONES CATCHING A LOT OF CALLS IF WE CAN HEAR FROM ENGINEERING ESPECIALLY WHEN YOU KNOW THIS THING IS HAPPENING OR PUBLIC WORKS TO SAY HEY HERE'S WHAT'S HAPPENING HERE'S WHAT WE'RE DOING ABOUT IT. WE CAN HELP AND BE PART OF THE SOLUTION RATHER THAN US HAVING TO GO DIVE AND BOTHER MR. MIMS OR SOMEBODY ELSE, I'M NOT FEELING SORRY ABOUT

[01:55:10]

THAT AT ALL, BY THE WAY, WHEN WE GET THE PHONE CALL AND SAY YES I JUST GOT A MEMORANDUM FROM MY ENGINEERING DEPARTMENT HERE'S WHAT'S GOING ON. THEY KNOW THAT THIS IS AN ISSUE. SIT TIGHT IF IT DOESN'T GET ANY BETTER HERE'S A NUMBER YOU CAN CALL. THAT'S THE EASY OLD WAY TO BE ABLE TO DO IT.

THEN WE HAVE ALL THE NEW TECHNOLOGY THINGS FOR EVERYBODY ELSE.

>> WE GET TEXTS NOW FROM THE POLICE DEPARTMENT WHEN CERTAIN THINGS ARE HAPPENING SO THAT THAT WOULD BE, THAT MIGHT BE THE WAY TEXTING THE COMMISSIONERS AND MYSELF WHEN SOMETHING THAT A LOT OF PEOPLE ARE GOING TO BE ACHED BY IN THAT WE NEED TO KNOW

AND HAVE THE ANSWER TO. >> I WAS ABOUT TO FOLLOW UP AND SAY THAT MADAM MAYOR, IF WE CAN COULD GIVE THIS THE SAME TYPE OF PRIORITY THAT WE GIVE THE POLICE DEPARTMENT IN TERMS OF ISSUES WHEN THINGS HAPPEN THAT WE NEED TO KNOW.

YOU ANTICIPATE THE PUBLIC IS ASKING A LOT OF QUESTIONS ABOUT THAT'S THE WAY TO HANDLE IT WITH THE POLICE DEPARTMENT. WE CAN GET THAT --

>> THANK YOU. THANK YOU GUYS FOR YOUR HARD WORK.

>> MR. MIMS DO YOU HAVE ANYTHING ELSE? >> OH, OF COURSE.

WELL, I WANT TO FOLLOW UP AND SAY THAT IN THESE PARTICULAR SITUATION WHEN WE HAVE AN AFTERNOON OR OVERNIGHT THUNDERSTORM THAT CREATES THIS TYPE OF TORRENTIAL RAIN IT IS VERY HARD TO PLAN FOR A RESPONSE I HAVE TO COMMEND OUR PUBLIC WORKS AND ENGINEERING DEPARTMENT WITH THEIR RAPID RESPONSE AS WELL AS THE POLICE DEPARTMENT. I THINK THE CITY OF FORT PIERCE FOR A VERY GOOD JOB WITH LOCALIZED FLOODING IN CERTAIN AND SPECIFIC LOCATIONS AND OTHER PARTS OF OUR CITY THEY WERE JUST A LITTLE DAMP. I DO BELIEVE THAT WE RESPONDED VERY WELL. IF THERE IS A WAY WE CAN IMPROVE WITH COMMUNICATION WE WILL DEFINITELY LOOK TO DO SO. IN SOME CASES WE SEE THESE AFTERNOON THUNDERSTORMS CREATING MORE DAMAGE THAN TROPICAL STORMS. WE'VE EXPERIENCED THAT OVER THE LAST COUPLE OF YEARS. SO MOVING ON I DO WANT TO ALSO FOLLOW UP ON A DISCUSSION THAT YOU ALL HAD ABOUT J.C. PARK.

I WANT TO AGAIN ECHO YOUR -- JAYCEE PARK AND I WANT TO AGAIN ECHO YOUR SENTIMENT WITH THEIR EFFORTS. MOVING FORWARD I HAVE SEEN OUR CODE ENDORSEMENT BEING PRESENT AT JAYCEE PARK AND I DO BELIEVE I KNOW PEGGY WANTS TO FIGHT ME EVERY TIME WE TALK ABOUT THIS. BUT I DO BELIEVE THAT WE'RE GOING TO CONTINUE THAT PRESENCE. I SEE I HAVE SEEN MORE ORDER, I'VE SEEN MORE CALM AND I HAVE SEEN MORE COMPLIANCE WITH CODE ENFORCEMENT BEING PRESENT.

WHEN THERE ARE INSTANCES WHEN THE CODE ENFORCEMENT DEPARTMENT CANNOT HANDLE THE CONDUCT OR THE BEHAVIOR OF THE INDIVIDUALS IN OUR POLICE DEPARTMENT WILL GLADLY STEP IN. I WANTED TO LET YOU ALL KNOW OF OUR PLANS MOVING FORWARD WITH THAT. LASTLY, I JUST WANTED TO COMMENT ON THE PARKLET SITUATION. AS YOU ALL KNOW WE'VE DEVELOPED THIS AS A BUSINESS CAPACITY EXPANSION PROGRAM. ESPECIALLY WHEN THE BUSINESSES THEIR CAPACITY WAS DEFINITELY RESTRICTED BY THE STATE. WE HAD TO FIND A WAY TO HELP OUR LOCAL BUSINESSES. BUT DUE TO THE FACT OF THE RECENT GOVERNOR'S EXECUTIVE ORDER THE BUSINESS CAPACITY RESTRICTIONS HAVE BEEN LIFTED THEREFORE THE PROGRAM HAS BEEN ENDED. WE WILL BE PICKING UP THOSE BARRIERS I THOUGHT THEY WERE PICKED UP TODAY BUT I KNOW WE HAD SOME FLOODING ISSUES THAT WE HAD TO RESPOND TO.

THAT IS THE GAME PLAN UNLESS YOU ALL GIVE DIRECTION TO THE CITY STAFF TO CHANGE THAT APPROACH. WITH THAT MY COMMENTS ARE COMPLETE.

>> THANK YOU MR. MIMS. I DID WANT TO KNOW WHAT THE CHOSEN TIMING OF STOPPING THE PARKLETS NOW AND THAT'S BECAUSE IT COINCIDES WITH THE GOVERNOR'S EXECUTIVE

ORDER. IS THAT WHAT YOU SAID? >> YES, MA'AM.

IT IS A BUSINESS CAPACITY IMPROVEMENT OR OR ASSISTANCE MEASURE.

>> SO WE HEARD A LOT OF TALK TONIGHT ABOUT THE FACT THAT IT HAS BEEN A VERY POSITIVE THING IN THAT COVID IS STILL VERY MUCH A REAL THING. SO I GUESS MAYBE WE

[02:00:03]

COMMISSIONERS OUGHT TO TALK ABOUT WHAT, IF ANYTHING, WE WANT TO DO DIFFERENTLY WITH THE PARKLETS. COMMISSIONER ALEXANDER WOULD YOU LIKE TO START.

SORRY I DIDN'T GO TO MR. SWEENEY DO YOU HAVE ANYTHING?

>> I HAVE A COUPLE THINGS. >> OH, OKAY. >> GO RIGHT AHEAD.

>> DO PARK LETS. GO AHEAD. >> MR. MIMS A COUPLE REQUESTS AND I APPRECIATE YOUR INFORMATIONAL UPDATES. I NOTICE YOU SEND E-MAILS AT ODD HOURS IN THE EVENING THEN ON SATURDAYS AND SUNDAYS.

I APPRECIATE THAT INFORMATION. SO DON'T THINK THAT I'M NOT APPRECIATIVE AND I'M GLAD THAT YOU WORK SO HARD. BUT I ALSO WANT TO KEEP YOU SANE. SO I SAY THAT WITH A SMILE ON MY FACE IF YOU'RE WATCHING THIS ON TV. BUT IF YOU COULD SOME OF THESE UPDATES THEY'RE VERY GENERAL UPDATES. I DON'T KNOW IF THERE'S AN OPPORTUNITY FOR YOU TO ADD OUR E-MAIL ADDRESSES, MAYBE IT'S MISS COX IF WE COULD ADD E-MAIL UPDATES TO OUR PARTNERS. WE GET THEM FROM THE P.D. WE TALKED ABOUT GETTING ADDITIONAL CITY STAFF UPDATES DURING EVENTS AND-TYPE ISSUES THAT ARE HAPPENING. BUT THINGS LIKE FDOT I'M NOT SURE WE'RE ON THE LIST FOR GETTING AN IMMEDIATE UPDATE SOMETIMES D.E.P. SENT OUT INFORMATION TODAY THAT RELATED TO THE STORM EVENT WHICH RELATED TO THE FORT PIERCE UTILITIES AUTHORITY.

I KNOW THAT'S A GENERAL E-MAIL THAT IS SENT OUT. I'M NOT SHWHAT YOU ARE THAT LIST LOOKS LIKE. BUT I KNOW -- I'M NOT SURE WHAT THAT LIST LOOKS LIKE.

DURING THAT ENPRIOR PANDEMIC MR. MIMS HAS BEEN SENDING US UPDATES.

WE WOULD AUTOMATICALLY GET THOSE. I'M NOT SAYING I DON'T WANT TO HEAR MR. MIMS PLEASE FEEL FREE TO E-MAIL AT YOUR LEISURE AS YOU DO.PMAYBE IF WE T UPDATES CONTINUOUSLY WE WOULD ALL BE INFORMED WHEN IT HAPPENS.

>> THEN HE WOULDN'T HAVE TO THEN HE WOULDN'T HAVE OR FOLLOW UP WITH INFORMATION.

>> YOU'RE NOT TRYING TO ELIMINATE MY JOB ARE YOU? >> NO, NOT AT ALL.

HECK NO. >> I TOLD YOU I STILL WANT YOUR FEEDBACK.

>> IT WOULDN'T BE THAT EASY ANYWAY.

>> THAT'S RIGHT.

TO PHONE IN. WHAT'S GOING TO CHANGE.

>> YEAH. WE CAN DEFINITELY WORK WITH THE CITY CLERK AND 73 WE CAN GET YOU ON THAT SUBSCRIBERS LIST FOR SOME OF THESE AGENCIES.

>> I THINK I'VE MENTIONED UP HERE BEFORE ABOUT D.O.T. UPDATES.

THERE'S SOME BIG ROAD PROJECTS THAT ARE GOING TO BE HAPPENING OR HAPPENING IN OUR CITY. IT'S NICE TO HEAR ABOUT THOSE.

IT'S NICE TO HEAR ABOUT MIDWAY ROAD AND ITS EXISTENCE OF CONSTRUCTION WHICH WILL GO ON I THINK FOR THE NEXT WHO KNOWS HOW MANY YEARS.

>> CENTURIES SOME PEOPLE THINK. BUT THOSE ARE EXAMPLES.

I THINK WOULD BE BENEFICIAL. THANK YOU. >> ANYTHING ELSE.

>> MR. SWEENEY. >> MISS COX. >> I JUST WANTED TO BRING TO EVERYBODY'S ATTENTION THAT THE RENEWAL SEASON HAS ENDED.

THIS WAS OUR VERY FIRST YEAR THAT WE WERE ABLE TO DO ON-LINE RENEWAL.

I JUST WANTED TO SHARE WITH YOU THAT IT WAS A GREAT SUCCESS OVER HALF OF THE INDIVIDUALS RENEWING THEIR BUSINESS RECEIPTS WERE ABLE TO DO SO ON-LINE WHICH WAS EVEN MORE IMPORTANT DURING THIS TIME OF CITY HALL BEING CLOSED.

SO IT WAS A REALLY GREAT EXERCISE. I JUST WANT TO GIVE A GREAT SHOUTOUT TO THE I.T. STAFF FOR THEIR EFFORTS. WE WAITED LONG AND HARD TO HAVE THE ON-LINE PROGRAM. AND IT REALLY DID, IT WORKED AS IT WAS DESIGNED TO WORK.

NOT 100% OF THE BUSINESSES ARE ABLE TO BECAUSE THEY HAVE TO PROVIDE CERTAIN INFORMATION SO THEY WEREN'T ABLE TO DO IT ON-LINE. BUT YOU KNOW IT WAS A GREAT SUCCESS AND I THINK BECAUSE OF THAT THEY YEAR THE END OF THE RENEWAL SEASON WE'VE HAD, WE HAVE A LOT FEWER NUMBER OF UNRENEWED BUSINESS TAX RECEIPTS.

THAT'S GOING TO BE GREAT AS WE MOVE FORWARD. >> WE'VE DONE A GREAT CUSTOMER SERVICE FEAT FOR OUR BUSINESSES. THAT'S GREAT.

YEAH, THANK YOU I.T., THANK YOU CLERK'S OFFICE. WELCOME TO 21ST CENTURY,

RIGHT. >> THE OTHER THING I WANTED TO MENTION AND REMIND ALL OF YOU IS THAT WE'RE GOING TO BE NEXT MONDAY THE 12TH WE WILL BE HAVING THE FPUA INTERVIEWS OF ALL THE CANDIDATES AT THE CONFERENCE AGENDA AS OPPOSED TO THE

[02:05:01]

CONFERENCE AGENDA. WE HAVE ACTUALLY CANCELLED THE CONFERENCE AGENDA SCHEDULED IT A AS SPECIAL MEETING SO THAT WAY YOU ARE ABLE TO, IF YOU SO CHOOSE,

MAKE YOUR DECISION ON MONDAY. >> WE WILL BE NOTICED AS

SUCH. >> OF THE CANDIDATES. SO WE WILL DO SIX INTERVIEWS. I WOULD LOVE YOUR FEEDBACK. DO YOU -- I KNOW WHEN WE DID THE CITY ATTORNEY INTERVIEW I KNOW I WAS 20, 25 MINUTES PER PERSON.

DO YOU HAVE A TIMELINE IN MIND THAT YOU WOULD LIKE TO LIMIT EACH CANDIDATE TO? I THINK IT'S A GOOD PRACTICE TO HAVE A DEFINED AMOUNT OF TIME THAT WAY EVERYBODY IS

GETTING EQUAL TIME. >> I HAVE BEEN THINKING ABOUT THAT.

I'M WONDERING IF WE MIGHT WANT TO DO IT LIKE WE DID WHEN WE HAD THE PRESENTATIONS FROM KINGS LANDING WHERE WE EACH OF US ASKED ONE QUESTION.

THE CANDIDATE MADE A PRESENTATION AND EACH OF US ASKED ONE QUESTION ASKED THE SAME QUESTION OF ASKED THE SAME QUESTION OF ALL THE CANDIDATES.

SO YOU HAD THE -- >> MADAM MAYOR I WOULD RESPECTFULLY I WOULD AGREE WITH DOING ONE OF TWO THINGS. WHICH WOULD BE A SET TIME LIMIT BUT THAT MAY BE DIFFICULT BECAUSE IF YOU HAVE A QUESTION POSED THEN A LONG WINDED ANSWER PARTICULARLY THEN THE BUZZER MAY GO OFF BEFORE ALL OF YOU GET A CHANCE. THAT MAYBE THE BETTER WAY TO DO IT.

YOU WILL CERTAINLY GET SOME CANDIDATES SPEAK LONGER IN THE ANSWERS.

BUT FROM A FAIRNESS PERSPECTIVE, WHICH I'M ALWAYS CONCERNED ABOUT FIRST AND FOREMOST IT WILL BE VERY DIFFICULT TO SAY EVERYBODY DIDN'T GET TO ASK A QUESTION, GET THE RESPONSE. IT MAY BE SOMETHING AS SIMPLE AS THREE MINUTE INTRODUCTION ABOUT YOURSELF A QUESTION FROM EACH OF THE COMMISSIONERS AND A BRIEF

CLOSING STATEMENT. TWO MINUTES OR LESS. >> I HAVE DONE A LOT OF THINKING ABOUT THIS. HE'S RIGHT. SO THREE OF US UP HERE THAT

HAVE BEEN GOING THROUGH THESE ON-LINE FORMS. >> I WAS JUST THINKING ABOUT THAT A COUPLE THREE MINUTE INTRODUCTIONS TWO MINUTES FOR EACH QUESTIONS THAT MAKES 13 MINUTES THEN HAVE YOU TWO MINUTES TO CLOSE IT OUT SO IT'S LIKE 15 MINUTES JUST IS THAT MAGIC NUMBER TIMES THAT BY SIX NOW ALL OF A SUDDEN WE'RE AT YOU KNOW AN HOUR AND A HALF INTO THE MORNING HOURS THAT DOESN'T INCLUDE OUR DELIBERATION OR BREAKS IN BETWEEN EACH CANDIDATE COMING IN. THE OTHER QUESTION I HAVE ABOUT THAT IS IT'S GOING TO BE A SPECIAL MEETING IT'S GOING TO BE PUBLICIZED SO RELEASE GOING TO BE POTENTIAL UNFAIR ADVANTAGE MAYBE IF WE ASK ALL THE SAME QUESTIONS, I DON'T KNOW. MAYBE AN APPLICANT IS MORE PREPPED IF THEY'RE LISTENING

AT THE SAME TIME AND WATCHING. >> WE HAVE RESERVED THE CONFERENCE ROOM WHERE WE WILL ASK ALL THE CANDIDATES TO WAIT DURING THE MEETING.

>> CHECK THAT BOX. >> THAT WAS SOMETHING THAT, THANK YOU CLERK FOR HANDLING. THAT I KNOW WE CAN'T STOP THEM FROM GETTING ON THEIR IPHONES AND STUFF LIKE THAT. IF THEY DO DO I NEED TO KNOW ABOUT IT.

I'M SURE EVERYBODY IS PROFESSIONAL, RESPECTFUL IN THIS MATTER.

I JUST WANT TO MAKE SURE IF THERE'S A FOLLOW UP QUESTION OR A CLARIFICATION QUESTION WE AS A COMMISSION CAN OBVIOUSLY REQUEST A QUESTION AND GET THROUGH SOME QUICK RESPONSE. THIS IS VERY IMPORTANT DECISION.

I LIKE THE FORMAT. >> THREE MINUTES OPENING, TWO MINUTES PER QUESTION AND

TWO MINUTE CLOSE. >> ROUGHLY. WE ARE SHOOTING FOR THAT.

>> I THINK THE BIG THING REMEMBER THEY WEREN'T LOOKING FOR A POLITICAL SEAT SO THEY'RE NOT GOING TO BE LONG WINDED LIKE WE ARE POTENTIALLY.

>> HAPPY DAY. >> WHICH IS PROBABLY MY FAULT WHICH IS WHYDY IT ON ZOOM. -- WHICH WHY IS I DID IT ON ZOOM.

>> THAT MEET WILLING START AT 9:00. >> THEY HAVE BEEN ADVISED.

>> YES, MA'AM. >> FOLLOW UP TO GIVE THEM THE FORMAT AND LET THEM KNOW

WHERE THEY ARE TO BE WAITING. >> ALL RIGHT.

TOWN COMMISSIONER PERONA SAYS NOT TO TEXT EACH OTHER. >> RIGHT.

OR I'LL FIND OUT. ALL RIGHTY. IS THAT IT?

>> THANK YOU. NOW WE'RE ONTO COMMISSION REPORTS IS THAT RIGHT.

[16. COMMENTS FROM THE COMMISSION]

>> COMMENTS FROM THE COMMISSION. >> COMMISSIONER ALEXANDER.

>> COMMENTS FROM THE COMMISSION. >> YES.

>> I ONLY HAVE ONE COMMENT OF CONCERN THAT IS

[02:10:02]

PRESENT EVERYWHERE YOU GO. WE NOT KNOWING THIS BUT MY QUESTION IS I HEARD COMMISSIONER PERONA SAY HE WENT THROUGH AN OR DEAL WITH IT.

WAS THIS DONE WITH THE REST OF THE COMMISSIONERS OR ANYBODY HE CAME IN CONTACT

WITH? >> WAS THERE CONTACT TRACING WITH THE REST OF US?

>> NO. >> I DID NOT HAVE ANY, FORTUNATELY.

>> IF I CAN RESPOND TO THAT. >> CAN I RESPOND TO THAT COMMISSIONER.

>> YES. >> OKAY. WE HAD MY WIFE AND I WERE QUARANTINED FOR A LONG PERIOD OF TIME IT WAS JUST WHEN SCHOOL OPENED BACK UP AND SOME OF HER RESPONSIBILITIES AT SCHOOL GOT HER IN CONTACT WITH SEVERAL FAMILIES AND SEVERAL FOLKS THAT WE DID. BEFORE I FOUND OUT THAT SHE TESTED POSITIVE I OBVIOUSLY WAS INFECTED ALSO. IT JUST SO HAPPENED IT WAS AT THAT -- EVERY ONCE IN A WHILE RELEASE A MONTH WHERE WE GET THREE WEEKS BEFORE THE NEXT MEETING THAT'S EXACTLY RIGHT AFTER THE LAST MEETING IS EXACTLY WHEN I WAS INFECTED WITH THE VIRUS. WENT THROUGH THE WHOLE PROCESS WITHOUT REALLY MISSING ANYTHING FOR THAT PERIOD OF TIME. SO REALLY I DIDN'T COME INTO CONTACT WITH ANYBODY AT CITY HALL DURING THAT PERIOD OF TIME.

THAT WAS BY CHANCE. >> OKAY, BY CHANCE. WOULD WE HAVE OTHER EMPLOYEES THAT WE THINK IT'S NOT BY CHANCE. THEY HAVE TO GO HOME AND BE QUARANTINED. I'M BEEN IN QUARANTINE SINCE MARCH ME AND MY FAMILY.

I GO OUT FOR A BREATH OF AIR I GO TO THE DOCTORS. I'M JUST CONCERNED THAT, YOU KNOW, WE DON'T KNOW WHO MAY BE A CARRIER. I JUST WANTED TO KNOW IF WE FIND OUT THEN WHY THE HEALTH DEPARTMENT HASN'T BEEN THERE FURTHER TO DO TRACING OR CONTACT TRACING. BUT THAT'S JUST A THOUGHT, A CONCERN OF MINE.

>> OKAY. THANK YOU COMMISSIONER PERONA. >> THANK YOU.

WE TALKED ABOUT PARKLETS A LITTLE BIT. I THINK WE'RE GOING TO HAVE TO GET INTO I WOULD RATHER HAVE MAYBE CHEYENE HELMS AND BE ABLE TO COMMUNICATE WITH US THE POSITIVES, THE NEGATIVES AND ALL THE OTHER ISSUES.

WE'RE INTERESTED AT ALL IN EVEN TALKING ABOUT EXTENDING THIS WE REALLY NEED TO KNOW ALL THE IMPACTS TO ALL THE BUSINESS OWNERS IN DOWNTOWN. THERE MAY BE DIFFERENT TIMES THAT WE DO THIS. THERE MAY BE A DIFFERENT WAY THAT WE DO THIS.

I WOULD SURE LIKE TO ACCOMMODATE. IT WAS REALLY NICE TO HEAR THANK YOU CITY FOR DOING THE RIGHT THING AND HELPING US OUT AS BUSINESSES.

THAT'S EXACTLY WHAT WE SHOULD BE DOING ALL THE TIME WE JUST WANT TO MAKE SURE WHEN WE GIVE SOMETHING. WE HAD HEARD FROM ANOTHER LONG-TERM OWNER OF A BUSINESS IN DOWNTOWN. I THINK THERE'S A WAY THAT WE CAN DO BOTH.

AGAIN YOU KNOW IT MIGHT BE MORE OF A TIMING. MAYBE RELEASE A WAY TO MAKE THESE PARKLETS A LITTLE BIT -- MAYBE THERE'S A WAY TO MAKE THESE PARKLETS A LITTLE BIT. THEY ARE PRETTY OR 98 AND BEAUTIFUL AS EVERYONE HAD SAID. THERE HAS TO BE SOMETHING THAT WE CAN FIGURE OUT BETWEEN STAFF AND OURSELVES. WE CAN COME UP WITH A PROGRAM IF WE DO WANT TO EXTEND THIS. THERE MAY BE A WAY THAT WE CAN DO THIS AND NOT NEGATIVELY IMPACT ANY OF THE BUSINESSES. SO THAT'S JUST A DISCUSSION I WOULD LIKE TO HAVE MAYBE AT A CONFERENCE AGENDA WHERE WE ACTUALLY HAVE A

CONFERENCE AGENDA. >> BUT THEY'RE GOING TO DISMANTLE THEM.

>> IF YOU'RE PLANNING ON DOING ANYTHING TONIGHT IT'S REALLY NOT FAIR TO THE PUBLIC BECAUSE WE REALLY NEED TO HAVE IT ON THE AGENDA AND HAVE FOLKS HERE SPEAKING TO US ABOUT ALL THE ISSUES SO -- I DON'T FEEL COMFORTABLE DOING THAT.

>> RIGHT. >> I AGREE. I AGREE WITH YOU.

>> I MEAN IF THE ORDER WAS OUT THERE. THE ONLY THING THAT WE COULD DO IS MAYBE EXTENDING IT FOR A VERY SHORT PERIOD OF TIME. WE'LL HAVE TO HAVE A MEETING

[02:15:03]

AMONGST WITH US AND STAFF TO BE ABLE TO COME UP WITH A FORMATIVE PLAN.

>> WE ALSO NEED TO MAKE IT CLEAR THAT THIS IS COVID RELATED THIS IS NOT FOREVER.

THIS IS NOT THERE IS GOING TO BE AN END TO THIS AT SOME POINT.

>> MADAM MAYOR, LIKE FLARED ONE OF THOSE STORE OWNERS SPEAK ABOUT THE CHRISTMAS PARADE. I CAN JUST IMAGINE DOWNTOWN BEING BURSTING AT THE SEAMS. I THINK WE NEED TO RECONSIDER TAKING THEM DOWN RIGHT NOW.

LET THEM KNOW IT'S NOT PERMANENT. BUT THE REST OF THE YEAR AT

LEAST, I THINK. >> SO BACK OFTEN THAT IS -- ON THAT.

THE SEASON IS COMING IT'S NOT JUST LIKE IT WAS LAST THREE OR FOUR MONTHS.

YOU HAVE BUSINESS THAT'S ARE PLANNING TO FOR FOLKS WE BECOME A DIFFERENT COMMUNITY WHEN THE SEASON IS HERE. I THINK THAT'S PART, THAT'S GOING TO BE PART OF THE INFORMATION. THAT'S PART OF THOSE DATA AND CALCULATION THAT'S WE HAVE TO TAKE INTO CONSIDERATION TO MAKE SHDECISION.

I JUST GOT A FEELING WE CAN SIT HERE AND DO IT RIGHT NOW AND SAY YEAH LET'S JUST GO AHEAD EXTEND IT I THINK WE MIGHT BE MAKING A MAJOR MISTAKE.

>> WE NEED INPUT. >> I WOULD LIKE TO HEAR FROM THE COMMUNITY.

>> RIGHT. JUST AS FAR AS THAT. I WOULD LIKE TO PLAN THAT.

IF YOU WANT TO TAKE THAT I HAVE A COUPLE OTHER THINGS IF YOU WANT TO TALK ABOUT

THAT RIGHT NOW. >> LET'S TALK ABOUT THE PARKLETS.

FIRST OF ALL I WANT TO WELCOME IN PEOPLE THAT CAME IN HERE TONIGHT, OBVIOUSLY, THEY WERE ORCHESTRATED THEY CAME IN HERE TO ADDRESS THEIR ELECTED OFFICIALS.

THAT'S THE WAY BUSINESS IS SUPPOSED TO BE. I COMMEND THEM FOR THAT.

AS WE SIT HERE WE WERE ABLE TO HEAR REAL LEGITIMATE REASONS FROM BOTH SIDES TO SOME DEGREE MAKES IT A LITTLE DIFFICULT. BUT BY THE SAME TOKEN AGAIN WE NEED TO TAKE THE SAME PERSPECTIVE THAT I HOPE MOST OF US ARE AND THAT IS TO LET THE VIRUS DICTATE WHAT WE DO AND FOLLOW WHAT THE SCIENTISTS ARE SAYING.

EVEN WITH THE NUMBER OF CASES AS OF YESTERDAY, THERE'S BEEN A SLIGHT INCREASE. I'M SITTING HERE READING THE HEALTH DEPARTMENT OUT OF 38,830 PEOPLE POSITIVITY RATE WENT UP FOR THE FIRST TIME TESTERS 3.75 TO ALMOST 4% WHICH IS A LARGE PERCENTAGE FROM THE HEALTH DEPARTMENT.

THEN AS FAR AS INDIVIDUALS THAT WERE TESTED A SECOND TIME, THE POSITIVE RATE WENT UP FROM 5.2% TO 5.16% THAT IS PEOPLE THAT HAVE ALREADY HAD IT ONCE THAT ARE TAKING IT AGAIN AND THAT'S AN INCREASE. SO IN ESSENCE WHAT I'M SAYING IS THE VIRUS DICTATES. THIS EVEN THOUGH OUR GOVERNOR HAS MADE A DECISION TO OPEN UP 100% CAPACITY REST ASSURED PUBLIC, CITY OF FORT PIERCE BY NO MEANS DOES THAT MEAN THAT YOU SHOULD NOT HANDLE THIS MATTER IN A PRECAUTIOUS MANNER DON'T LET IT SLIP UP ON YOU. BECAUSE AT THE POINT IN TIME WHEN WE WERE SHUT DOWN COMPLETELY, THE NUMBERS WERE VERY LOW COMPARED TO WHAT WE'VE GONE THROUGH. SO WE JUST HAVE TO WATCH AND OBSERVE THIS SITUATION.

I UNDERSTAND THE BUSINESS THAT'S HAVE COME FORWARD TONIGHT.

I NOT WITH OUT FOR FIRST TIME MYSELF -- I WENT OUT FOR FIRST TIME MYSELF THIS PAST SUNDAY TO CHUCK'S. AS SOON AS I WALKED IN THE DOOR I RAN TO THE PATIO AND IT THE RAINING OUTSIDE. I WAS GETTING WET. BUT I DID NOT FEEL COMFORTABLE INSIDE THE BUILDING. BECAUSE I KNOW THAT THE RESTAURANTS ARE NOW AT 100% CAPACITY AND THIS VIRUS IS STILL ALIVE.

THE HOSPITALS WILL LET YOU KNOW THAT. CALL YOUR HOSPITAL DIRECTOR.

I CALL HIM ABOUT EVERY OTHER DAY TO CHECK ON THINGS. HEEL ALLY LET YOU KNOW HOW THINGS ARE -- HE'LL LET YOU KNOW. THE DATA ITSELF AND SCIENCE

[02:20:04]

ITSELF DICTATES AS FAR AS MY PERSPECTIVE IS CONCERNED AND THE DECISION THAT'S I MAKE FROM THIS IS TO PROTECT THE PEOPLE. I JUST DON'T THINK TAKING THOSE PARKLETS AND REMOVING THEM RIGHT NOW IN LIGHT OF A GOVERNOR SAYING YOU CAN GO AT 100% IS NOT GOING TO BE SAFE FOR THE RESIDENTS. IF THAT'S AN EXTRA PRECAUTIONARY MEASURE THAT WE CAN PUT IN PLACE THAT WILL HELP ASSIST THERE'S NO GUARANTEED WAY WE HAVEN'T FOUND ONE OUT YET. BUT ANYTHING THAT WILL HELP ASSIST US IN TRYING TO MAKE THIS PLACE AS SAFE AS POSSIBLE THEN SO BE IT.

I REMIND EACH OF YOU THAT WE GOT CAUGHT IN THIS SITUATION WHERE WE WERE NUMBER ONE IN THE STATE OF FLORIDA. ST. LUCIE COUNTY WAS. SO THERE WAS SOMETHING THAT WE DID WRONG. I HAVEN'T FIGURED OUT YET. MY INTUITION TELL ME I DON'T WANT TO CONTINUE TO MAKE THAT MISTAKE POSSIBLY AGAIN BECAUSE THEY SAY THAT THE PEAK SEASON WILL PROBABLY COME BACK INFLUX IN NOVEMBER.

SO IN PREPARING FOR THE WORST CASE SCENARIO AND PRAYING FOR THE BEST CASE SCENARIO I THINK IT'S INCUMBENT UPON TO US TAKE ALL THE NECESSARY MEASURES THAT WE POSSIBLY CAN TO PROTECT THE CITIZENS OF THE CITY OF FORT PIERCE.

THANK YOU. >> SO I'M INCLINED TO WANT TO EXTEND IT TEMPORARILY AND ALSO HAVE WHAT YOU SUGGESTED HAVE SOMEBODY MAKE CHIIAN OR WHO EVER MR. MIMS MAKING A PRESENTATION SEE IF WE CAN ACCOMMODATE WHAT THE BUSINESSES THAT WERE HERE TONIGHT WANT AND ALSO THE TROUBLE THAT IT'S CAUSE THE OTHER BUSINESS.

I GO IN AND I KNOW WHAT MR. ROSLO IS TALKING ABOUT. EVEN THOUGH HE ONLY ONE PERSON HERE MOST OF THE PEOPLE HERE WERE FOR KEEPING THE PARKLETS THEY WERE FOR KEEPING THEM TEMPORARILY THROUGH SEASON. THEY WERE CERTAINLY NOT GOING TO ADD ANY. WE'RE NOT GOING TO ADD ANY MORE.

WHETHER THE NUMBERS ARE INCREASING OR NOT I AGREE WITH COMMISSIONER SESSION THAT'S THE PERCEPTION IS IT'S STILL NOT SAFE TO BE IN A CROWDED CLOSED IN PLACE.

THE PERCEPTION IS THERE. SO I THINK THAT AT SOME POINT, I HOPE THAT WE WILL GET BACK TO THAT KIND OF NORMALCY. BUT I DON'T KNOW WHEN THAT'S GOING TO BE. DO YOU HAVE ANY THOUGHTS ON THAT COMMISSIONER JOHNSON?

>> I DO. I I AGREE WITH THE SENTIMENTS.

IT'S GOOD TO HEAR FROM THE FOLKS THAT THAT HAVE THE STORIES TO TELL GOOD OR BAD.

IT TELLS US WHERE WE SHOULD BE HEADED. I MENTIONED THE OTHER DAY IN THE D.B.A. MEETING WHEN I WAS TALKING WITH SOME FOLKS IT WAS AN IDEA, A SUGGESTION YOU KNOW IT'S A HYBRID IDEA AND I DON'T KNOW EXACTLY IF IT WOULD WORK IT PROBABLY DOES NOT. BUT IT'S AN IDEA. WHAT IF THE PARKLETS BECAME A ROVING-TYPE PARK LET SYSTEM. I RODE DOWN SOME INTERSECTIONS AND STREET BLOCKS WHETHER IT'S THIS BLOCK ON WEEK NUMBER ONE, WEEK NUMBER TWO OF THE MONTH IT'S THIS BLOCK, WEEK NUMBER THREE MAYBE IT REPEATS AND STARTS AGAIN AT THE BEGINNING STAGES. EITHER IT'S ONE THROUGH FOUR OR I DON'T KNOW. IT'S A BUNCH OF IDEAS. I DON'T KNOW IF IT WORKS OR NOT BUT IT'S AN OPTION. BECAUSE RIGHT NOW IT IS SPORADIC.

THERE WERE 12 BUSINESSES TAKING ADVANTAGE OF THE PARKLET PROGRAM AS INDICATED TONIGHT. THAT'S WHAT I WROTE DOWN ANYWAY.

SO IT'S AN OPPORTUNITY. BUT THEN ALSO I THINK AT ONE POINT EVEN MR. ROSLO EVEN THOUGH HE WAS IN THE MINORITY TALKING ABOUT I NEED YOUR HELP.

I REMEMBER SEEING AN E-MAIL NOT TOO LONG AGO HE WAS ASKING FOR CAN I JUST RESERVE MY THREE OR FOUR SPACES MY SAME AMOUNT OF SPACES JUST FOR MY FOLKS TO

PARK MY PATRONS TO PARK THERE. >> HE TOLD ME.

>> SO I THINK THAT'S A GOOD IDEA. THAT'S ANOTHER WAY OF

ACCOMMODATION. >> THAT CAN BE JUST AS TEMPORARY AS THE PARKLETS.

>> SEE THAT'S THE DISCUSSION WE NEED TO HAVE. THERE'S A WAY I GUARANTEE YOU THIS IS A GREAT IDEA. WE'VE HELPED BUSINESSES OUT AND CONTINUED TO HELP BUSINESSES OUT WITHOUT BEING DETRIMENTAL TO ANYTHING. ALSO THIS SUBJECT CAME UP IN THE PARKING COMMITTEE ALSO BECAUSE WE'RE TAKING AWAY VALUABLE PARKING.

THIS IS A BALANCE. IT COMES BACK DOWN TO THE BALANCE OF TRYING TO DO THE

BEST FOR EVERYBODY. >> JAYCEE PARK ALL OVER AGAIN.

>> I'M JUST SAYING THAT RATHER THAN, YOU KNOW, BE QUICK TO DECISION SO LONG WE

[02:25:04]

HAVE SOMEWHAT OF A CONSENSUS. SO MAYOR YOU'RE ASKING ABOUT MAYBE JUST EXTENDING THIS UNTIL WE HAVE THIS MEETING IS THAT WHAT YOU'RE SAYING?

>> THAT'S WHAT I'M SAYING. EXTENDING IT WITH THE IDEA THAT WE'RE GOING TO TRY TOE REACH AN ACCOMMODATION. IT -- TRY TO REACH AN ACCOMMODATION.

>> I'M INTERESTED TO FIND OUT FROM MR. MIMS WHEN DOES HE THINK THAT WE CAN GET STAFF TOGETHER WITH INFORMATION TO HELP US OUT THROUGH THIS PROCESS?

>> OKAY, WELL, I GUESS I BELIEVE RIGHT NOW THE NEXT CONFERENCE THAT WE HAVE WOULD BE IN THE MONTH OF NOVEMBER UNLESS YOU WANT TO CALL A SPECIAL MEETING TO DISCUSS THIS ISSUE. BUT I DO BELIEVE THAT WE CAN PROBABLY HAVE STAFF COME UP WITH SOLUTIONS TO REMEDY THIS SITUATION RATHER QUICKLY.

THIS IS WHY I SAY THAT. WE CONTINUELY HAVE PROGRAMS WHEREBY WE HAVE RIGHT OF WAY PROGRAMS, WE HAVE RIGHT OF WAY PERMIT PROGRAMS WHEREBY AN APPLICANT CAN APPLY TO HAVE WHETHER IT'S COUPLE TABLES ON THE SIDEWALK OR WHETHER TO UTILIZE THE RIGHT OF WAY FOR A TEMPORARY PERIOD OF TIME. WE HAVE AN ADMINISTRATIVE SYSTEM THAT WE CAN INTERNALLY REVIEW AND MAKE A DETERMINATION ON THESE TYPE OF USES. WE'RE TALKING ABOUT 12 PARKING SPACES.

WE HAVE A CITY OF 30 SQUARE MILES. WE HAVE SEVERAL COMMERCIAL CORRIDORS WE NEED TO BE ABLE TO LOOK AT THIS HOLISTICALLY AND COMPREHENSIVELY AS THE ENTIRE CITY. WE HAVE TO BE CAREFUL BECAUSE PARKING IS A PREMIUM. PARKING SPACES SOMETIMES GO FOR IN THE NEIGHBORHOOD OF OUR CURRENT ASSESSMENT THE COST OF A PARKING SPACE IS ROUGHLY ABOUT $6,000 A YEAR.

SO PARKING IS A PREMIUM. WE NEED TO BE VERY CAREFUL WHAT WE DO WITH OUR PARKING MOVING FORWARD. WE HAVE NEW BUSINESSES, WE HAVE NEW CONSTRUCTION COMING TO OUR CENTRAL BUSINESS DISTRICT. WE REALLY NEED TO CONSIDER ALL OF THESE PARAMETERS. BUT I BELIEVE TO ANSWER YOUR QUESTION IN THE SHORT

SESSION NOVEMBER COMMISSIONER PERONA. >> I WOULD ASK YOU TO IF STAFF CAN -- I KNOW THEY'RE INTIMATELY INVOLVED WITH ALL THE ISSUES WITH ALL THE PLUSES AND MINUSES IF YOU FEEL THAT STAFF CAN COME UP WITH A PLAN REACH OUT TO THE BUSINESS OWNERS AND COME UP WITH SOMETHING THAT WE HAVE HAVE A PRETTY GREAT CONSENSUS AS FAR AS THE BUSINESS OWNERS THAT CAN GO THAT CAN GET US THROUGH AT LEAST TO THE END OF THE YEAR THEN AS FAR AS I'M CONCERNED I DON'T NEED A WORKSHOP FOR THAT. I JUST NEED TO HEAR WHAT YOU HAVE TO OFFER AND MAYBE AT OUR NEXT COMMISSION MEETING TWO WEEKS FROM NOW WE CAN ORDAIN THAT.

COULD THAT BE THE PLAN? >> DEFINITELY WE CAN DEFINITELY COME UP WITH SOMETHING WITHOUT A DOUBT. I DO BELIEVE A PERMIT-TYPE SITUATION WITH AN APPLICATION AND A SIMPLE REVIEW WOULD RESOLVE THE ISSUE.

WE CAN COME UP WITH A NOMINAL FEE OR LIKE WE HAVE DONE WITH THE SIDEWALK CAFE.

WE WAIVED THOSE FEES UNTIL BASICALLY THE END OF THIS YEAR.

WE CAN DO THE SAME THING. BUT I DO BELIEVE WE CAN COME UP WITH SOME SOLUTION.

>> THAT WOULD INCLUDE ACCOMMODATING THE BUSINESS THAT'S ARE REALLY DEPENDENT ON THIS FOR THE SOCIAL DISTANCING AND ALSO THE BUSINESS SOMEHOW ACCOMMODATING MR. ROSLO IN SOME WAY. IS THAT RIGHT?

>> WELL, I REALLY WANT US TO BE CAREFUL WHEN WE TALK ABOUT RESERVING PARKING SPACES. PARKING SPACES AND PUBLIC RIGHT OF WAY ARE FOR THE GENERAL PUBLIC THAT CAN BE FOR A BUSINESS PATRON, IT CAN BE FOR VISITORS OF DOWNTOWN OR OTHER AREAS. WE ALLOW EVERY BUSINESS TO RESERVE THEIR OWN PARKING SPACES WE'LL HAVE A CATASTROPHE. SO WE REALLY HAVE TO BE REALLY YOU KNOW CAUTIOUS IN HOW WE DO THAT. AT LEAST YOU KNOW WHAT THE

SENTIMENT IS IF IT CAN BE ACCOMMODATED IN SOME WAY. >> ABSOLUTELY.

>> YES, SIR. >> SO MY QUESTION IS I THINK WE SHOULD DO IT SOONER RATHER THAN LATER FOR SURE. WE HAVE NOTICED A SPECIAL MEETING WE'RE GOING TO CONVENE NEXT MONDAY. I DON'T LIKE TO STACK THINGS ON TOP OF EACH OTHER.

BUT COULD WE HAVE, IF WE DON'T DO IT NEXT MONDAY THE FOLLOWING MONDAY WHICH IS OUR REGULAR MEETING CAN WE DO IT DURING THE UPDATES OR REPORTS AND HAVE SOME

INFORMATION. >> YES. >> YES.

[02:30:03]

IF YOU WOULD LIKE TO DO IT AS AN ITEM ON THE CITY COMMISSION MEETING THEN OCTOBER 19TH WOULD BE OUR NEXT CITY COMMISSION MEETING WE CAN PLACE IT UNDERNEATH

CITY COMMISSION. >> SOUNDS GOOD. >> WITH STAFF

RECOMMENDATION. >> WITH STAFF RECOMMENDATIONS.

AND TO HEAR THE PLUSES AND MINUSES AND REQUESTS THAT HAVE BEEN MADE.

LIKE I JUST BROUGHT THAT ONE FORWARD THAT I HAVE SEEN AN E-MAIL THAT SAID COULD I HAVE THOSE SPACES. MR. MIMS JUST GAVE US A POINT OF WHY WE SHOULD OR SHOULD NOT. ANY QUESTIONS THAT HAVE BEEN MADE LET'S TALK ABOUT IT AND

PUT IT OUT ON THE TABLE. >> THANK YOU. >> THANK YOU.

>> EVERYBODY OKAY WITH THAT? YES. >> YOU HAD MORE.

THAT'S FINE. TAKE YOUR TIME. >> I WANT TO GO BACK TO THE FLOOD INFORMATION. AND I THINK WE TALKED ABOUT TAT WE HAVE SOME REALLY GOOD THINGS. HOPEFULLY STAFF NEEDS TO MOVE FORWARD WITH THAT HELP US WITH THAT FORMAT, ESPECIALLY IN EMERGENCY. IT SHOULD BE AN EMERGENCY RESPONSE. THERE SHOULD BE SOME FORMAT THAT WE HAVE FOR EMERGENCY RESPONSE THAT INCLUDES THESE TYPE OF THINGS WHERE WE CAN MAKE SURE THAT WE ARE THEY'RE BEING VERY INFORMATIVE TO THE RESIDENTS. I LAUGH EVERY TIME AND I HAVE NEVER SAID THIS OUT LOUD, BUT THE CITIZENS HAVE SEA CLICK FIX.

IT'S A NEW APP ON MY PHONE SEA NICK FIX. >> I KNOW YOU'RE GOOD AT

THAT, TOO. >> I KNOW. IN THE ABSENCE OF HAVING A FORMAT OR A FORMAL WAY THAT FOLKS CAN GET AS CLOSE AS IMMEDIATE ANSWERS AS THEY CAN IT'S GOING TO BE A SEA NICK FIX. WE WOULD RATHER BE DOING WHOLE LOT. SO LET ME SEE, I'VE GOT THAT. I DO APPRECIATE VERY PROUD OF THE COMMISSION TONIGHT. I THINK WE HANDLED THE NO WAKE DISTANCE AT JAYCEE PARK THAT GOT TO BE A MONSTER ALL OF ITSELF.

I THINK WE HANDLED THAT IN A VERY INTELLIGENT AND A VERY FORMATTED WAY.

I WANT TO THANK ALL OF YOU FOR DOING THAT. THAT WAS WONDERFUL.

FINAL THING I REALLY SERIOUSLY AND I THINK COMMISSIONER JOHNSON HIT IT ON THE HEAD WE NEED TO TALK ABOUT JAYCEE PARK. WE NEED TO PUT THAT UP AS YOU ONE OF OUR STRATEGIC PLANS FOR WHATEVER WE GOT TO DO TO MOVE THAT UP ON OUR LIST. I EVEN HAVE SOMEONE, I HAVE A CIVIC ORGANIZATION THAT WANTS TO TAKE PART OF JAYCEE PARK LIKE THE KIDS PLAYGROUND AND WANTS TO OWN IT. OWN IT IN A WAY THAT THEY ARE THE RESPONSIBLE TO IT AND HELPFUL IN MAKING SURE THAT IT'S UPDATED, IT'S PAINTED, IT'S GOT THE FENCING RIGHT AND ALL THAT KIND OF STUFF. I'M NOT SAYING THAT THAT'S SOMETHING WE'RE GOING TO DO BUT THERE'S A LOT OF INTEREST WITH FOLKS OUT THERE TO MAKE SURE THAT THIS DESTINATION PARK IS THE BEST ONE OF THE BEST GEM THAT'S WE HAVE IN FORT PIERCE. OBVIOUSLY BEING USED VERY MUCH.

WE HAVE THE ABILITY TO BE ABLE TO GO BACK AND TAKE A LOOK AT THIS THING FOR ALL THE USES THAT WE SEE ARE HAPPENING THERE. TO MAKE SURE FOLKS CAN GO THERE KNOW THEY'RE GOING TO HAVE A GREAT TIME AND GREAT EXPERIENCE THEY'RE GOING TO BE SAFE WHILE DOING IT. THAT'S JUSTING SOME I WOULD LIKE TO MOVE UP ON THE PRIORITY LIST AND MAKE SURE WE DO SOMETHING LIKE THAT. I WOULD LIKE TO SEE THAT

HAPPEN BY THE END OF THE YEAR. >> WOULDN'T THAT BE

SOMETHING THAT THE PARKS COMMITTEE WOULD START WITH? >> YEAH.

I JUST HATE KICKING THINGS BACK TO THE PARKS COMMITTEE ALL THE TIME.

MAYOR, I MEAN, YOU'RE THE MAYOR YOU CAN GET ANYTHING DONE YOU WANT.

>> OH, IT TAKES THREE OF US. IT TAKES THREE OF US. I'M JUST WONDERING IF THAT'S SOMETHING IF WE GIVE THEM DIRECTION MAYBE THAT'S IT IF WE GIVE THEM DIRECTION FROM THE COMMISSION ABOUT WHAT WE WANT. WHICH IS A MORE GLOBAL VIEW OF IT PARTICULARLY WITH THE SWIM AREA AND WITH ALL THE COMPETING AREAS.

THAT THE CIVIC ORGANIZATION WANTS TO DO THAT. MAYBE THEY CAN LOOK AT EVERY

POSSIBLE USE AND POSSIBLE STAKEHOLDER. >> I THINK IT WOULD BE A GOOD IDEA. AT THE SAME TIME I THINK WE CAN ACCOMPLISH SOME OF OUR TASKS RIGHT HERE IN JUST CONVERSATION AND LOOK AT THE HISTORY OR LOOKING AT WHAT'S IN PLACE TODAY. I THINK THE PARKS COMMITTEE INVOLVEMENT WOULD BE BENEFICIAL BASED ON LAST MONTH'S MEETING WHEN WE HAD THE SPORTS COMMISSION COME

[02:35:05]

IN GIVE A PRESENTATION AND BRING THEM IN ON THAT FRONT OF WHERE THE OTHER AMENITIES AT THE PARKS. NOT JUST JAYCEE BUT IN THIS CASE WE WILL FOCUS IN ON JAYCEE. WHAT OTHER APPEARINGS DO WE HAVE TURNING INTO YOU KNOW PICKLE BALL COURTS OR THOSE SAND VOLLEYBALL OPPORTUNITIES AND LOOKING AT HOW WE INVITE ALL OF THE CITY AND OUR TOUR ISTS TOGETHER AS JAYCEE PARK.

SO I DON'T KNOW I'M TORN WITH LIKE COMMISSIONER SAID I'M NOT SURE.

DO WE NEED TO PUSH IT TO THE COMMITTEE OR NOT? >> MAYBE WE NEED SOME MORE DISCUSSION. THEY MIGHT HAVE A SPECIFIC TASK AFTER WE HAVE MORE

DISCUSSION. >> WE MAY NEED TO REACH OUT TO GET SOME PROFESSIONAL HELP WITH THAT. RATHER THAN GO TO THE PARKS COMMITTEE THEY'RE MUCH LIKE WE ARE. THEY INVESTIGATE SOMETIMES IT TAKES THEM A LITTLE BIT LONGER. THIS IS SOMETHING WE NEED TO GET UP AND RUNNING SOONER RATHER THAN LATER. MAYBE HAVING SOMEBODY COME IN AND COUNSEL US AND COME UP WITH A DESIGN. I DON'T MEAN TO GET OR 98 WE ALREADY HAVE IT -- ORNATE WE

ALREADY HAVE IT THERE. >> COMMISSIONER SESSIONS. >> I DO BELIEVE THE PARKS COMMITTEE SHOULD PLAY A VERY IMPORTANT PART IN THIS BECAUSE THAT'S THE MAJOR ISSUE AS IT RELATES TO THE PARK TRYING TO FACILITATE PARKING IF WE COULD DO THAT THAT WOULD PROBABLY ELIMINATE ABOUT 60% OF THE PROBLEMS AS IT RELATES TO THE PARK. BUT REST ASSURED AS WE IMBARK ON TRYING TO -- EMBARK ON TRYING TO MAKE JAYCEE PARK BIGGER OR FIND OTHER ACTIVITIES TO PUT IN JAYCEE PARK AND MAKE IT MORE OF AN ATTRACTION I ALWAYS TRY TO PUT MYSELF IN INDIVIDUALS PLACES WHEN I SIT UP HERE AND MAKE DECISIONS.

I SAY THAT TO SAY THIS THAT PARK IS CENTRALLY LOCATED IN A VERY CLOSE BOUNDARY OF RESIDENTS. IT'S GOING TO BE INCUMBENT UPON TO US MAKE SURE THAT THEY HAVE SOME INPUT IN ALL OF THIS BECAUSE ALSO FACE IT, THERING ARE TO BE A LOT OF UPSET PEOPLE OUT THERE. I HAVE SIT AND NOTICED THE TONE OF THINGS AS I'VE SET HERE. NOT TO COME DOWN ON BECAUSE AGAIN LIKE I JUST SAID IF IT WERE ME I WOULD FEEL THE SAME WAY, TOO. IF YOU GOT A PARK AND I LOOK OUT WITHIN ABOUT 25 FEET OF MY BEDROOM WINDOW AND I GOT ALL KINDS OF ACTIVITY GOING ON. THOSE PEOPLE HAVE LEGITIMATE CONCERNS.

WE JUST NEED TO MAKE SURE THAT AS WE EMBARK ON TRYING TO FIGURE OUT HOW WE'RE GOING TO IMPROVE THIS AND MAKE THIS A BETTER PLACE FOR TOURIST PURPOSES WE ARE GOING TO HAVE TO INCLUDE THEM AND LET THEM BE APART OF IT.

MAYBE IT'S ABOUT TIME THAT THE CITY OF FORT PIERCE WE GET US SOME PROPERTY IN AN ISOLATED AREA AND BUILD A PARK. IT WILL MAKE SOME MONEY, OBVIOUSLY IT WILL. WE HAVE WHAT WE NEED. THESE ARE THE KINDS OF THINGS THAT AS WE SIT HERE AND GROW WE'RE TRYING TO I THINK BUST THE TEAMS OF CLOTHES THAT ARE GETTING A LITTLE TIGHT. IT'S GETTING TIGHT OUT THERE RIGHT NOW AT JAYCEE PARK IT WON'T BE ABLE TO TAKE MUCH MORE IN TERMS OF ACTIVITY AND EXPANSIONS. SO WE JUST NEED TO BE CAREFUL.

I WANT TO MAKE SURE EVERYBODY IS INCLUSIVE AND BEING ABLE TO USE THE PARK.

BUT BY THE SAME TOKEN WE CAN ONLY GET SO MUCH OUT OF HOW MANY ACRES IS OUT THERE? MY ESTIMATION ABOUT 30 ACRES, 25, 30 ACRES OF LAND. SO WE JUST NEED TO KEEP THAT IN MIND AS WE EMBARK ON TRYING TO MAKE THINGS BETTER OR IMPROVE OR EXPAND

ACTIVITY ON THAT PARK. >> SO MAYBE THE STRATEGIC PLANNING CONFERENCE IS THE BEST PROCESS. THAT GIVES US WHEN WE'RE IN STRATEGIC PLANNING WE'RE THINKING ABOUT WHAT IF, WHAT IF WE DID THIS AND WHAT IF WE DID THAT AS OPPOSED

ADDRESSING SPECIFICS. >> I AGREE WITH COMMISSIONER JOHNSON.

[02:40:03]

THIS IS OUR CHARGE. WE NEED TO HAVE THE PARKS COMMITTEE TAKE A LOOK AT WHAT WE'RE DOING AND MAKE SURE THAT WE'RE CROSSING TS AND DOTTING IS.

WE ARE COMMUNICATING WITH THE RESIDENTS IN THE AREA. I LIVE TWO BLOCKS AWAY FROM JAYCEE PARK SO I'M OVER THERE ALL THE TIME. IT IS CHANGING.

WITH COVID AND ALL THESE OTHER THINGS THAT HAPPENING THERE'S A LOT OF CHANGING GOING ON. PEOPLE WANTING TO GET OUTSIDE.

>> GREAT PLACE FOR IT. >> RATHER THAN KICK IT TO THE PARKS COMMITTEE THAT'S A GOOD SUGGESTION. I THINK THERE'S SOME GROUNDWORK THAT WE HAVE TO DO FIRST. WE HAVE TO COME UP WITH A STRATEGIC PLAN A VISION.

TAKE A LOOK AT WHAT WE HAVE. HOW WE CAN MAKE IT BETTER. IF WE NEED PROFESSIONAL HELP I THINK IT'S IMPORTANT ENOUGH TO BE ABLE TO GO AND FIND MAYBE A CONSULTANT THAT CAN COME IN AND SAY HEY, LOOK AT THIS IS VERY SIMPLE THINGS YOU CAN DO.

IT ISN'T GOING TO COST YOU WHOLE LOT OF MONEY AND MAKE THIS THING EVEN MORE DYNAMIC. I DON'T KNOW IF THAT'S GOING TO HAPPEN.

BUT THAT'S EXACTLY WHAT I WANT TO HEAR WHEN IT'S ALL OVER WITH.

I'M JUST SAYING FROM MY PERSPECTIVE I WOULD LIKE TO MOVE THAT UP ON OUR LIST.

IF SO THEN WE NEED TO BE ABLE TO DISCUSS THIS IN THE VERY NEAR FOUGHT.

>> REAL QUICK BEFORE YOU MOVE ON MR. MURRAY WITH A.D.A. IMPROVEMENTS IT A LONE WE CAN DO AN ASSESSMENT ON A.D.A. IMPROVEMENTS SAY WOW LOOK AT WHAT WE DID.

HE BROUGHT UP SOME VERY VALID POINTS. >> OBVIOUSLY, IF YOU WERE ALL THERE YOU SAW THE ACCESS TO THE WATERWAY WITH THE A.D.A. MAP THAT'S DOWN THERE RIGHT NOW. WHEN THEY WERE DOING THAT I WAS GOING WHAT THE HECK.

NOW I FIGURED IT OUT. AND IT'S BEING USED THAT WAY.

>> RIGHT. BUT HE'S RIGHT IT DOESN'T HAVE THE HANDICAP OR THE

TABLE OR ANYTHING. IT JUST HAS THE MAT. >> THERE'S WAYS WITH COMMITTEE DO THAT. I APPRECIATE YOUR INDULGENCE ON THAT.

WITH THAT I'M GOOD. >> MR. SESSIONS. MAIN THING WITH THE PARKLETS EARLIER I JUST WANT TO TRY TO WORK SOMETHING OUT AND I UNDERSTAND BOTH SIDES.

THE RESTAURANTS DEFINITELY NEED TO BE CONSIDERED THEY'VE TAKEN A VERY HARD HIT AS A RESULT OF COVID-19 AND WE ARE TRYING TO GET BACK IN THE MOMENTUM OF TRYING TO MAKE SOME MONEY. WE DON'T HAVE ANY MONEY TO GIVE THEM SO I WANT TO DO ALL I CAN TO ASSIST THEM IN MAKING THEIR MONEY ON THEIR OWN.

CAN'T GIVE A MAN A FISH BUT YOU CAN EQUIP HIM AND TEACH HIM HOW TO FISH.

I DON'T WANT TO DO ANYTHING TO JEOPARDIZE THEM BECAUSE I KNOW YOU A YOU LOOK AROUND I DON'T WHAT HE WHAT IT IS RESTAURANTS ARE DOING EITHER EXTREMELY WELL OR EXTREMELY BAD. THAT'S THAT ARE DOING WELL ARE MAKING MONEY BUT THOSE SOME OUT THERE THAT ARE DOING EXTREMELY BAD. THAT'S WHY THEY HAVE CLOSED DOWN. BUSINESSES SUCH AS ROSLO WE HAVE TO ALSO TAKE INTO CONSIDERATION THE NORM FOR THEM DOING BUSINESS THEY HAVE TO HAVE, ESPECIALLY IN DOWNTOWN AREA CLOSE PROXIMITY FOR OTHER PATRONS. WHILE IT IS A PRIVILEGE WE HAVE TO BE CAREFUL HOW WE TAKE PRIVILEGES AWAY FROM PEOPLE.

THIS PRIVILEGE WAS TAKEN AWAY THE NORM WAS TO HAVE THE PRIVILEGE IN PLACE.

THEY'VE HAD THIS PARKING IN FRONT OF THEIR BUILDINGS FOR A PERIOD.

SO WE CAN'T JUST STEP IN THERE AND TAKE IT AWAY. I'M HOPING THAT WE FIND A WAY IN AN AMICABLE FASHION AND I BELIEVE WE CAN TO FIGURE THAT OUT.

PERHAPS WE CAN IN FRONT OF THOSE TYPES OF BUSINESSES SUCH AS WHAT THEY HAVE WE CAN HAVE PARKING SPACES OPEN BUT IN FRONT OF THE RESTAURANTS WE CAN CONTINUE TO HAVE THE PARKLETS. I DON'T WANT IT TO BE ACROSS THE BOARD EITHER ALL OR NONE. IT'S NOT POINTED AT YOU DIRECTLY CITY MANAGER BUT I JUST DON'T THINK IT'S GOING TO BE FAIR RIGHT NOW. I KNOW AS WE PROGRESS PEOPLE HAVE GOT TO UNDERSTAND THINGS ARE GOING TO CHANGE. BUT AN OVERNIGHT CHANGE I DON'T THINK IS FAIR IN LIGHT OF WHAT PEOPLE ARE GOING THROUGH RIGHT NOW.

WE NEED TO DO ALL WE CAN TO GET THEM BACK IN THE RIGHT MOMENTUM OF DOING BUSINESS AND MAKING MONEY. AS WE GET HERE AND WE TALK ABOUT PROGRESSING AND PLANNING THAT WILL EVENTUALLY MAKE THIS CITY BIGGER AND HEY, THERE WILL

[02:45:03]

BE PRIVILEGES AND THEY WILL BE CONSIDERED PRIVILEGES BUT THIS WAS A SMALL TOWN THAT'S GROWING OVERNIGHT NOW. WE JUST HAVE TO BE CAREFUL HOW WE TAKE THE SPOON OUT OF PEOPLES A MOUTHS. SO WE JUST NEED TO DO ALL WE CAN AND WORK WITH PEOPLE.

RIGHT NOW I DON'T THINK IT'S JUST AS SEVERE WE GOT TO GO ACROSS THE BOARD AND PUT A RULE IN PLACE THAT MAY IMPACT PEOPLE DIFFERENTLY. I THINK WE CAN ACCOMMODATE AND FACILITATE PEOPLE ALL OF THE PEOPLE THAT WERE HERE TONIGHT.

THEY KNEW THEY WERE ABOUT TO TAKE THEM OUT THEY CAME IN HERE ORGANIZED BOTH SIDES CAME. IN I UNDERSTAND HOW THEY FEEL ABOUT IT.

>> I ALSO WANT TO SAY -- JUST OUT TO THE PUBLIC JUST BE CAREFUL I UNDERSTAND THAT THINGS HAVE OPENED BACK UP AT 100% BY NO MEANS SHOULD YOU STOP USING EXTRA PRECAUTIONARY MEASURES WITH SOCIAL DISTANCING AND WEARING YOUR MASK BECAUSE THE SCIENTISTS SAY AGAIN NEXT MONTH WE'RE GOING TO BE BACK IN A WORST PREDICAMENT THAN WHAT WE WERE IN AUGUST. I DON'T KNOW. I'M NOT A DOCTOR SAME NOT A SCIENTIST BUT I DO LISTEN TO THEM. FOR PEOPLE THAT DON'T LISTEN TO THEM YOU CAN LOOK AT YOUR FELLOW GOVERNMENT AND YOU SEE WHAT TYPE OF PREDICAMENT YOU FIND OURSELVES IN. LESSON LEARNED BY ME IS ONE THAT I SEE.

I DON'T NECESSARILY HAVE TO EXPERIENCE MYSELF PERSONALLY. THAT'S IT FOR ME.

THANK YOU. >> MR. JOHNSON. >> A COUPLE THINGS.

A PROVED LETTER OF SUPPORT TO COUNTY COMMISSIONERS REQUESTING A FREEWAY STOP SIGN OR AT LEAST EVALUATE A STOP SIGN. SO I WILL BE ANXIOUS TO SEE WHAT THE PUBLIC COMMENT IS GOING TO BE ON THAT ITEM IF IT COMES FORWARD TO THE COUNTY COMMISSION AND STARTS A DISCUSSION ITEM. WHETHER IT'S THROUGH THE REPORT THAT THE GIVEN OR MAYBE BY OUR LETTER BEING A CATALYST MOVE IT TO THE NEXT LEVEL I DON'T KNOW WHAT IT'S GOING TO BE BUT I WILL BE ANXIOUS TO SEE HOW THAT COMES ABOUT. IT'S BEEN A LONG TIME COMING.

A BIG DISCUSSION ITEM. THERE'S JACK OUT THERE. IF YOU EVER HEAR ANYTHING JACK SEND IT OUR WAY SO WE CAN BE READY. BECAUSE I KNOW FOLKS ARE

GOING TO CALL FOR AND AGAINST. >> I WANT TO KNOW WHEN IT'S ON THE AGENDA IF IT'S GOING TO BE ON THE AGENDA AT THE COUNTY.

>> ABSOLUTELY. LOOKING AT THE PARKLET IDEA VERY SOON IT SPURS THAT OTHER CONVERSATION WE HAD ABOUT TWO YEARS AGO ABOUT JCPENNEY PARKING LOT.

SECOND STREET BISTRO PARKING LOT WHAT ARE WE GOING TO DO WITH THAT.

WHAT IS THE LONG-TERM THINKING IS IT AN OPPORTUNITY FOR US.

IS IT AN OPPORTUNITY FOR US TO HAVE A PUBLIC AND A PRIVATE PARTNERSHIP.

WHICH IS WHAT WE TALKED ABOUT DO. SO I'M LOOKING FOR AND I'M LOOKING FORWARD TO THAT INFORMATION COMING TO US. SO WE CAN HAVE A REAL CONVERSATION ABOUT THE TO 10 FOR PARKING INFRASTRUCTURE, PARKING IMPROVEMENTS.

MAYBE A PARKING STRUCTURE AT THAT LOCATION. IT'S A REAL DEAL.

HERE CORONAVIRUS IS TEACHING US LESSONS. IT'S TEACHING US OPPORTUNITIES. IT'S TEACHING US THINGS THAT WE'VE TALKED ABOUT SUCH AS I THINK WE HAD ONE OF OUR CONFERENCE AGENDAS. WE LOOKED AT A SMALL SECTION OF ORANGE AVENUE TURNING THAT INTO THE PERMANENT BUT IS NOT ON PERMANENT PARKLET PROGRAM WHERE YOU CAN PARK THERE DURING THE HOURS OF I DON'T KNOW 8:00 TO 4:00 THEN ALL OF A SUDDEN AT 4:00 THE CONES COME OUT AND BOOM IT CHANGES NOW YOU CAN'T PARK THERE ANYMORE AND RESTAURANTS EXPAND THEIR FRONTAGE.

YOU REMEMBER THAT PRESENTATION. >> C.R.A..

>> THAT'S RIGHT, C.R.A. THERE'S A LOT OF OPPORTUNITIES SO WE HAVE TO BE DYNAMIC AND QUICK ON OUR FEET BUT ALSO SLOW TO REACT FOR OVERREACTION WITH PROPER PLANNING AND THEN IT'S GOING TO TIE RIGHT IN TO AND I'VE SAID IT WE'VE ALL SAID IT MANY TIMES IS THAT GREEN WAYS AND TRAILS. LOOKING AT THE NEXT OPPORTUNITIES ASK WHAT WE'RE GOING TO DO THERE. IT WAS JUST A DISCUSSION ABOUT THE GREEN WAY TRAIL. I THINK MR. MIMS, MR. MIMS WHAT WAS THE CONVERSATION WE WERE MOVING FORWARD WITH SOME ITEMS. DO YOU RECALL?

[02:50:02]

>> YES, SIR I DO BELIEVE YOU ASKED ABOUT THE STATUS ON THE GREEN WAY TRAILS YOU SPOKE ABOUT HOW IN INDIAN RIVER COUNTY YOU WERE SEEING SOME EXHIBITION WORK AS A MATTER OF FACT, I HAD A BRIEF MEETING WITH MR. ANDREWS HE TOLD ME ABOUT SOME OF THE UPCOMING WORK THAT HE WAS GOING TO FACILITATE WHETHER THAT'S CONSTRUCTION OR DESIGN. IF HE'S IN THE AUDIENCE CAN CAN STAND UP TELL YOU WHAT HE IS PREPARING TO DO. BUT WE ARE MOVING FORWARD WITH THE GREEN WAY AND TRAILS INITIATIVE FOR THE MULTIPURPOSE ACCESS WAVE AND CONNECTIVE.

OF COURSE ULTIMATELY HOPEFULLY IT WILL CONNECT ACROSS CONNECTING SAVANNAH TO THE RECREATION AREA. I THINK THAT IS FUNDED AS WELL.

I THINK ALL OF THIS IS FUNDED. IT'S JUST A MATTER OF IDENTIFYING THE CONSULTANTS AND THE CONTRACTORS TO MAKE IT HAPPEN.

>> IS THERE THE SECTION THAT'S GOING TO BE RELEVANT GETTING THE GREEN WAY TRAILS DOWNTOWN. JACK IS HERE IN THE AUDIENCE.

JACK IS LIKE I'M NOT SURE I WANT TO COME FORWARD. >> IF THERE'S ANYTHING TO ADD IT TO. THEN IT'S GOOD TO KNOW SO WE CAN BE CHAMPIONS WITH YOU IN

YOUR PROCESS. >> MAYOR AND COMMISSIONERS I BROUGHT HIM UP-TO-DATE LAST WEEK. LET ME GO THROUGH EACH SEGMENT REAL FAST TELL WHERE YOU WE'RE AT. FIRST SEGMENT THROUGH THE INDIAN HILLS RECREATION AREA IS SCHEDULED FOR CONSTRUCTION. WE HAVE ALREADY BEEN BEFORE THE COMMISSION. WE HAVE A LITTLE GLITCH WITH THE CONTRACTOR IN MAKING ALL THE PRECERTIFICATION WITH D.O.T. PROBABLY ANOTHER TWO WEEKS THEY'LL HAVE THE CLEARANCE FROM D.O.T. AND THE CONTRACTORS READY TO GO INTO CONSTRUCTION RIGHT THERE. HOPEFULLY IN THE NEAR FOUGHT WE'LL HAVE THE FIRST LEG NEAR FUTURE WE'LL HAVE THE FIRST LEG UNDER CONSTRUCTION.

THAT WILL GO FROM F.E.C. CROSSING ON THE SOUTHERN SIDE UP TO INDIAN HILLS DRIVE THAT WILL BE THE FIRST SECTION. THE NEXT SECTION WHICH IS CALLED THE HIGHWAY MEN TRAIL GAP SECTION IS FROM INDIAN HILLS DRIVE TO GEORGIA AVENUE. I HAVE REQUESTED A CONSULTANT TO PROVIDE FOR DESIGN PLANS. I WILL BE BRINGING THAT TO THE COMMISSION THE NEXT COMMISSION AGENDA FOR APPROVAL TO HAVE ENGINEERING DESIGN PLANS COMPLETED.

THERE'S 100% FUNDING FOR THAT. D.O.T. IT WAS ON THE MEETING WITH THEM TODAY. THEY ARE 99% SURE THEY HAVE FUNDING FOR THAT CONSTRUCTION. THAT WILL BE MOVING THAT'S ABOUT A $700,000 PROJECT FOR CONSTRUCTION THERE. THE REMAINING PHASE WHICH IS THROUGH THE DOWNTOWN AREA I DO HAVE FUNDING FOR THE DESIGN OF THAT. THAT IS A LITTLE MORE DIFFICULT AREA BECAUSE WE HAVE NUMEROUS OBSTACLE THAT'S WE HAVE TO OVERCOME.

WE HAVE TO GET OVER CITRUS AVENUE BRIDGE. WE HAVE TO GET OVER THE TRAIN TRACKS. WE HAVE TO GET THROUGH DOWNTOWN.

SO THESE ARE ALL THE THINGS THAT WOULD BE PART OF THAT DESIGN TO COME UP WITH AN ACCEPTABLE PATH AND COMBINATION OF HOW WE'RE GOING TO APPROACH IT.

THAT'S UP COMING. I ANTICIPATE REQUESTING A PROPOSAL FOR THAT PROBABLY WITHIN THE NEXTLY DAYS. I WILL GO -- WITHIN THE NEXT 30 DAYS.

>> YOU WERE TALKING ABOUT THE PRPOSAL FOR DESIGN OF THAT THIRD PHASE.

HOW FAR NORTH IS THAT? >> THAT WILL GO ALL THE WAY TO NORTH CAUSEWAY.

>> OKAY. >> SO THERE'S BEEN SOME DISCUSSION.

I WANT TO MAKE SURE EVERYBODY IS CLEAR FOR THE MAYOR AND I SITTING ON T.P.O. MONTHS AGO WHEN WE BROUGHT THIS FORWARD WE WERE TALKING ABOUT THE FUNDING OF IT. D.O.T. SAID YES WE'RE IN IT WE ARE PARTNERING WITH EVERYONE IN ST. LUCY COUNTY ONE OF THE COMMISSIONERS I MENTIONED IN THIS MEETING I

[02:55:05]

JUST WANTRO MIND EVERYONE IF GREEN WAY AND TRAIL DOES GO DOWN THROUGH THE DOWNTOWN AREA WE HAVE TO START TALKING ABOUT PARKING INFRASTRUCTURE.

THAT'S WHY I BRING UP BISTRO JCPENNEY PARKING LOT. I BRING THAT UP.

I BRING UP COMMISSIONER HUTCHINSON IN THAT MEETING TALKED ABOUT THE 2006 DESIGN OF TWO MORE FLOORS BEING ADDED TO THE COUNTY'S PARKING GARAGE.

AND D.O.T. BEING APART OF THAT BECAUSE IF WE'RE GOING TO CREATE INFRASTRUCTURE THAT'S GOING TO TAKE AWAY PARKING WE HAVE TO REPLACE THAT AMENITY JUST LIKE COMMISSIONER SESSIONS. I BRING ALL THOSE THINGS UP I TRY TO JUST BRING IT ALTOGETHER BECAUSE IT'S A REAL CONVERSATION THIS IS REAL LIFE STUFF AND IT'S HAPPENING. THESE THINGS ARE IN THE BACKGROUND AND WHEELS ARE TURNING AND T.P.O. AND D.O.T. THEY'RE PUSHING FOR IT.

JACK HAS PROPOSALS GOING ON THE STREET. WE NEED TO HAVE CONVERSATIONS ABOUT THIS STUFF AND WHAT OPPORTUNITIES THERE ARE TO REPLACE, ADD TO, AMEND WHATEVER IT IS ALL THE PARKING INFRASTRUCTURE. NOW WE HAVE A PARKING REPORT THAT'S COMING OUT. YOU THINK ABOUT THESE THINGS THEY WILL START HITTING REALLY QUICKLY. WE NEED TO BE READY TO MOVE ON ALL OF THEM AND HAVE REAL

DISCUSSIONS ABOUT EACH ONE. >> HE HAS THE MONEY. SO WE NEED TO DO IT.

>> JACK'S GOT MONEY?

THANK YOU VERY MUCH. >> THANK YOU MR. ANDREWS. >> I JUST WANTED TO CORRAL ALL THOSE OPPORTUNITIES AND THOUGHTS BECAUSE I THINK SOME OF THIS WILL HIT BEFORE OUR STRATEGIC PLAN SESSIONS. IT'S JUST GOING TO HIT. IT'S GOING TO HIT US WHETHER IT'S ON AN AGENDA OR IT'S GOING TO BE A PROPOSAL OR T.P.O. WILL BRING IT UP.

SOMEONE IS GOING TO BRING IT UP ALONG THE WAY. SPEAKING OF T.P.O. I DO HAVE A CONFLICT. SOMEONE IS MY BACK KBRUP FOR WEDNESDAY.

ARE YOU ABLE TO ATTEND COMMISSIONER? >> COMMISSIONER SESSIONS IS ABLE. THAT WAS MY OTHER T.P.O. WEDNESDAY AT 2:00.

I HAVE THE PACK THE FOR YOU. >> IT'S NOT A VIRTUAL MEETING.

-- I HAVE THE PACKET FOR YOU. >> IT'S NOT VIRTUAL.

>> I HAVEN'T EVEN OPENED IT YET. THERE YOU GO.

T.P.O. PACKET. THAT'S ALL I HAVE, THANK YOU, MA'AM.

>> SO I WON'T TAKE LONG. BUT I WAS GOING TO BRING UP THE SAVANNAH ROAD I'M ANXIOUS FOR THAT TO HAPPEN. I THINK THAT'S BEEN TALKED ABOUT AND IN THE WORKS AND IT'S BEEN BANDED BY BUT NOBODY HAS COME TO GRIPS IT WITH.

SO I REALLY APPRECIATE STAFF WRITING A LETTER AND MAKING THIS A FORMAL REQUEST BECAUSE THERE ARE PEOPLE OUT THERE WHO LIVE ON INDIAN RIVER DRIVE WHO ARE VERY ANXIOUS FOR THIS TO HAPPEN. ALSO TONIGHT WE DID WAVE GARDEN SECOND READING SO THAT IS SOMETHING TO CELEBRATE BECAUSE THAT'S GOING TO BE WELL ON ITS WAY FOR FORT PIERCE. WE WILL HOPE THAT MIDWAY ROAD GETS DONE SOON.

AND THE T.P.O. WILL BE LOOKING AT TURNPIKE EXCHANGES AS WELL AS I-95 EXCHANGES AT ITS MEETING ON WEDNESDAY. THAT WILL BE A GOOD DISCUSSION WITH THE T.P.O. AND ALSO WE APPROVED 112 NEW HOUSING TONIGHT IN A REALLY NICE -- A DEVELOPER THAT LOOKED LIKE HE WENT ABOVE WAY AND BEYOND WHAT WE REQUIRE TRYING TO MAKE IT A NICE DEVELOPMENT. SO I THINK I'M VERY PROUD OF US TONIGHT. SO WITH THAT I THINK WE CAN ADJOURN.

IF EVERYBODY WILL MOVE OUT TO THE FOYER. IF YOU WANT TO SEE ANYBODY YOU CAN SEE THEM OUT IN THE FOYER.
