WE HAVE A NEW COMMISSION ON THE BOARD SO I BROUGHT UP THE HIGHLIGHTS OF WHAT WE'RE GOING TO BE GOING OVER ON THE STATE PROGRAM. YOU'LL SEE A LOT OF REPEATING FROM LAST YEAR AND THEN THERE'S ALSO SOME NEW ITEMS ON THE PROGRAM AS WELL FOR US TO LOOK AT. SO FIRST AND FOREMOST I WANT TO TALK ABOUT WHO OUR DELEGATION IS BECAUSE WE HAD TWO CHANGES THIS PAST ELECTION TIME. WE CAME BACK WITH SENATOR GAIL HERALD, THIS PAST ELECTION WAS ACTUALLY HER RE-ELECTION IN THE GENERAL. WE HAVE REPRESENTATIVE ERIN GRAHL. [00:05:03] REPRESENTATIVE TOBY OVERDORF. REPRESENTATIVE KALEY TUCK. AND OUR NEW ONE WHO REPLACED REPRESENTATIVE JOHNSON IS REPRESENTATIVE DANA TRUBOLSKY. SHE IS OUR NEW REPRESENTATIVE AND WE HAVE ALREADY HAD A MEETING WITH HER AND SHE IS VERY EAGER TO SUPPORT US IN ANY ENDEAVORS THAT WE HAVE GOING FORWARD. SO I THINK SHE'S GOING TO BE A GREAT PARTNER FOR US. MOVING ON WE'RE GOING TO START TALKING ABOUT THE PROGRAM HERE. FIRST ITEM ON THERE WAS THE FLORIDA JOB GROWTH GRANT FUND. AS YOU KNOW THIS PAST LE LEGISLATIVE SESSION, THE GOVERNOR VETOED THIS LINE ITEM IN THE BUDGET. HOWEVER LOOKING FORWARD, WE HAVE BEEN A RESIP EVENT GRANT FUND SO THE CITY OF FORT PIERCE -- RECIPIENT OF THIS GRANT FUND SO THE CITY OF FORCE PIERCE, THIS WAS GREAT FOR THEM TO BE -- FORT PIERCE SO THIS WAS GREAT FOR THEM TO BE ABLE TO EXPAND. LAST YEAR THE LEGISLATURE FAILED IN REAUTHORIZING THE PROGRAM SO WE'RE ASKING THEM TO SUPPORT LEGISLATION WHICH WILL IMPLEMENT A SIMILAR PROGRAM OF THE QUALIFIED TARGETED TASK INDUSTRIES, I'M SORRY, QUALIFIED TARGETED TAX INDUSTRIES FUND. I AM TONGUE-TIED TONIGHT. DOING IT WITH A MASK IS A TOTALLY DIFFERENT EXPERIENCE. THE QTI HELPS OUT ESPECIALLY US IN OUR I WOULD SAY MARKETING TO COMPANIES AND ESPECIALLY OUR MANUFACTURING COMPANIES THAT ARE ALREADY HERE TO BE ABLE TO HELP THEM EXPAND ESPECIALLY IF THEY ARE LISTED ON THE QTI REFUND. SO THIS IS A PROGRAM THAT WE WOULD LIKE TO SEE COME BACK AND BE REIMPLEMENTED. UNFUNDED MANDATES, WE NEED TO KEEP THIS ON HERE EVERY YEAR, BECAUSE EVERY YEAR THERE IS AT LEAST ONE BILL THAT IS AFFECTING OUR HOME RULE OR PROVIDING US AN UNFUNDED MANDATE. SO WE SHOULD KEEP THIS ON THERE. NEXT UP IS LOCAL FUEL TAX AND INDEXING. CURRENTLY RIGHT NOW THE STATE DEPARTMENT OF TRANSPORTATION HAS THE ABILITY TO INDEX THEIR FUEL TAX ASSOCIATED WITH THE CONSUMER PRICE INDEX. SO WHATEVER THE CPI IS THEY'RE ABLE TO ADJUST THEIR FIELD TAX TO THAT LEVEL. WE HERE DO NOT HAVE THAT ABILITY. WE ARE SET AT A FIXED RATE AND THAT RATE IS WHAT WE HAVE TO KEEP IT AT. THE FEDERAL GOVERNMENT RIGHT NOW IS DISCUSSING MOVING OVER TO INDEXING THEIR FUEL TAX. SO THAT WILL LEAVE THE FEDERAL GOVERNMENT THE ABILITY TO INDEX, THE STATE GOVERNMENT THE ABILITY TO INDEX, BUT THAT WILL LEAVE THE LOCAL GOVERNMENTS NOT THE ABILITY TO INDEX. SO THIS ACTUALLY CALLS FOR STATUTORY CHANGE FOR THIS TO HAPPEN. SALES TAX FAIRNESS, THIS IS SOMETHING THAT HAS REPETITIVELY BEEN AN ISSUE FOR US HERE ON THE COLLECTION OF SALES TAX WHEN IT COMES TO ONLINE AND ECOMMERCE SALES FOR OUT OF STATE RETAILERS. YOU ARE FAMILIAR WITH THE WAYFAIR COURT CASE THAT OCCURRED AND IT WENT IN FAVOR OF THE STATE. SO WE WOULD LIKE THE STATE TO ACTUALLY PUT THIS IN STATUTE THAT SALES TAX IS REQUIRED TO BE COLLECTED FROM ONLINE E-COMMERCE RETAILERS OUTSIDE OF STATE. RIGHT NOW CURRENTLY IT'S IF YOU HAVE BRICK AND MORTAR IN FLORIDA YOU HAVE TO PAY THE SALES TAX. PUBLIC SAFETY AND SCHOOL RESOURCE OFFICERS, TWO YEARS AGO WE HAD THE HORRIFIC TRAGEDY THAT HAPPENED IN SOUTH FLORIDA. ONE OF THOSE REACTIONS WAS MANDATING SCHOOL RESOURCE OFFICERS IN EVERY SCHOOL OR THE GUARDIAN PROGRAM. ST. LUCIE COUNTY WENT WITH THE SCHOOL RESOURCE OFFICERS SO WE ARE MANDATED TO HAVE A SCHOOL RESOURCE OFFICER IN EVERY SCHOOL. WE ALSO NEED TO FUND THOSE SCHOOL RESOURCE OFFICERS. SO WHAT WE WOULD LIKE TO DO IS PARTNER UP WITH THE SCHOOL DISTRICT IN PUSHING THEM TO FULLY FUND THAT ALLOCATION TO THE SCHOOL DISTRICT TO FUND THOSE SRO'S. THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION BEACH AMENDMENT MANAGEMENT FUNDING, THIS TABLE HERE SHOWS YOU EVERYTHING THAT WE HAVE SUBMITTED FOR FUNDING THIS YEAR. SO WHAT WE NEED TO DO IS GO AND PUSH THE LEGISLATURE TO FULLY FUND THE BEACH PROGRAM. SO NOT NECESSARILY A PROJECT, [00:10:01] BUT FULLY FUND THE BEACH PROGRAM TO WHERE THESE PROJECTS ARE RANKED ON A LIST. CURRENTLY WE DON'T HAVE THAT RANKED LIST. AND WE NEED TO SEE WHERE THESE PROJECTS ARE RANKED AND PUSH THE LEGISLATURE TO FUND TO THAT LEVEL SO THAT ALL OF THESE PROJECTS ARE FUNDED. AND THIS ACTUALLY GOES TOWARDS THE FORT PIERCE SHORE PROTECTION PROJECT WHICH IS AS WE KNOW IT SOUTH FORT PIERCE BEACH AND THE SOUTHERN ST. LUCIE BEACH PROJECT AND THE FORT PIERCE INLET MANAGEMENT PROJECT. THIS IS THE SAND TRAP WE HAVE LOCATED IN THE INLET AREA. UNFORTUNATELY WE WENT FOR RFP A FEW YEARS AGO. WE WERE QUOTED AT AN AMOUNT. WHEN WE ACTUALLY WENT TO GO FOR CONSTRUCTION, THAT AMOUNT SIGNIFICANTLY INCREASED. THIS AMOUNT IS THAT DIFFERENCE WHICH WE ARE ASKING FOR TO BEGIN CONSTRUCTION ON THAT SAND TRAP. >> QUICK QUESTION ON THAT. THOSE ITEMS ARE ON THE LIST HOWEVER YOU SAID THEY'RE NOT FUNDED, IS THAT CORRECT, FROM THE STATE? >> THEY ARE NOT FUNDED AS OF RIGHT NOW. >> THEY'RE ON THE LIST? >> YES, THEY ARE ON THE LIST. >> WE'RE JUST NOT FUNDING AS A STATE. WE'RE NOT FUNDING THAT LOW ON THE LIST WHICH IS WHERE WE ARE. >> SO EVERY YEAR WHAT IT IS IS THAT THE PROGRAM OPENS UP TO RECEIVE APPLICATIONS. AND WHAT THEY DO IS THEY RECEIVE THE APPLICATIONS, THEY REVIEW THEM, AND THEN THEY PUT THEM ON A RANK LIST. AND THEN ONCE WE'VE RECEIVED THAT RANK LIST, WE TYPICALLY SEE WHERE WE ARE ON THAT AND WE GO AND PUSH THE LEGISLATURE TO FUND SO THAT ALL THE WAY DOWN TO THE LEVEL SO THAT ALL OF THESE PROJECTS ARE FUNDED. THIS IS THE SAME THING THAT HAPPENS WITH THE MUSEUM GRANTS, THE CULTURAL ARTS GRANTS, THOSE ARE ALL ON A RANKED LIST THEN WE GO UP AND SAY HEY WE NEED YOU TO FUND THIS TO $20 MILLION BECAUSE THAT WILL ENSURE OUR PROJECTS ON THE RANK LIST ARE FUNDED. THE FORT PIERCE SHORE PROTECTION PROJECT, BECAUSE IT IS A FEDERAL PROGRAM AND WE SHARE THE COST OF THAT WITH THE ARMY CORPS OF ENGINEERS, WHEN THEY WANT TO PAY FOR IT, IT TYPICALLY PUTS US HIGHER ON THAT RANK LIST TO BE ABLE TO DO THAT. THE FORT PIERCE INLET MANAGEMENT PROJECT BECAUSE IT IS A FEDERAL INLET OWNED BY THE ARMY CORPS, WE TYPICALLY GET RANKED HIGHER ON THAT LIST. A LOT OF OUR PROJECTS BECAUSE THEY'RE FEDERALLY SHARED GET RANKED HIGHER. >> THANK YOU. >> COMPREHENSIVE WATER REFORM, WE RECEIVED A LOT OF FEEDBACK ON WE WANT TO SUPPORT WATER INFRASTRUCTURE PROJECTS, WE WANT TO SUPPORT STORM WATER. WE WANT TO SUPPORT THE SEA LEVEL RISE ISSUE WE'RE HAVING. WE COMPRESSED THAT INTO ONE BIG STATEMENT ON COMPREHENSIVE WATER REFORM TO BE ABLE TO PRETTY MUCH TOUCH ALL OF THAT ALL IN ONE STATEMENT. SO WE DIDN'T HAVE SEVERAL DIFFERENT OUTLINED -- ON THAT. PORT OF FORCE PIERCE, WE'RE GOING TO SUPPORT ALL OF THE FULL PROJECTS WITHIN THE FLORIDA DEPARTMENT OF TRANSPORTATION SEAPORT PROGRAM AND THE DEPARTMENT OF TRANSPORTATION ECONOMIC DEVELOPMENT. EVERY YEAR THE WE MAKE SURE D.O.T. GETS THEIR FUNDING FROM THE STATE AND IN TURN WE GET OUR PROJECT FUNDED IN THEIR LIST. IMPACT FEES, I'M PUTTING THIS ON HERE BECAUSE WE HAVE HAD SEVERAL PIECES OF LEGISLATION REGARDING IMPACT FEES AND OUR AUTHORITY OVER THOSE IMPACT FEES. SO THIS IS PROPOSED AS LEGISLATION WHICH WOULD PREEMPT OUR AUTHORITY TO SET IMPACT FEES. IN RELATION TO THIS, THERE'S ANOTHER STATEMENT THAT WAS NOT INCLUDED ON HERE, BUT IT'S IN REGARDS TO YOUR BUILDING PERMIT FEES, AND ONE OF THOSE WAS TO SUPPORT LEGISLATION WHICH WILL AMEND FLORIDA STATUTE 553.80 AS WELL AS ALLOWING MORE FLEXIBILITY ON THE USE OF THESE FUNDS. AND I THINK THAT IS WRITTEN ACTUALLY IN YOUR PROGRAM IN FRONT OF YOU. UNFORTUNATELY IT DIDN'T MAKE IT ON MY PRESENTATION. BUT THIS IS IN REGARDS TO TT THE 2019 LEGISLATION. ACCORDING TO THEM WE CAN ONLY TAKE THE AVERAGE OF OUR PAST FOUR FISCAL YEARS, IT TAKES TO DO OUR BUILDING PROGRAM, ONLY THAT AMOUNT CAN YOU CARRY FORWARD. SO WE WOULD LIKE THEM TO BETTER DEFINE IT OR GIVE US BETTER FLEXIBILITY BECAUSE THAT IS THE ONLY WAY WE CAN FUND OUR BUILDING DEPARTMENT. MICRO MOBILITY PROGRAMS, THIS IS [00:15:06] SPECTACULAR TO YOUR BICYCLE PROGRAMS, YOUR SCOOTER PROGRAMS. THIS IS A NEW STATEMENT WE HAVE ADDED HERE BECAUSE OF EVERYTHING THAT WE HAVE EXPERIENCED DUE TO THE COVID-19 PANDEMIC, WE HAVE SEEN A LOT OF HOLES THAT HAVE OCCURRED WHEN IT COMES TO ACCESSIBILITY TO BROADBAND. SO WE WANT TO SUPPORT EFFORTS TO PROMOTE ACCESSIBILITY AND ESPECIALLY AFFORDABILITY OF BROADBAND SERVICES TO COMBAT THE O OVER REPORTING OF CONNECTIVITY THROUGH DATA CONNECTION AND A GRIEVANCE PROCESS TO CORRECT INACCURATE MAPS. THERE ARE COMMUNICATION SERVICES WHO REQUIRE TO REPORT TO THE STATE WHERE THEY HAVE THEIR BROADBAND, WHERE THEY HAVE THEIR WIFIS, WHERE THE ACCESSIBILITY IS. SO THOSE STATES ARE ABLE TO MORE EFFECTIVELY IDENTIFY THE HOLES AND BE ABLE TO ADDRESS THEM. RIGHT NOW THERE IS NO DATA IN THE STATE OF FLORIDA THAT CAN SHOW WHERE ARE OUR HOLES ARE. WE CAN BECAUSE WE'RE HERE IN THE LOCAL LEVEL. WE KNOW WHERE THE HOLES ARE. BUT AS A STATE LEVEL, THERE ISN'T ANYTHING, NO DATA HAS BEEN COLLECTED DOABILITY SHOW WHERE OUR HOLES ARE WHEN -- CLESHTHED TO BE -- COLLECTED TO SHOW WHERE OUR HOLES ARE WHEN IT COMES TO BROADBAND. SO I'M APPRECIATING THE FACT THAT WE ARE KEEPING THAT THERE AND THAT MESSAGE ALIVE. AND ANY OF OUR REPRESENTATIVES, WE NEED TO MAKE SURE THAT THEY UNDERSTAND EVERY ONE BUT ONE OF THOSE REPRESENTATIVES THAT YOU HAVE HEARD FROM ME PERSONALLY, AND I'M JUST SAYING THAT NEEDS TO BE OUR CHARGE ALL THE TIME. AND I WOULD JUST LIKE TO GET A LITTLE BIT MORE REGULARITY ON THAT. I WOULD ALSO LIKE TO GET THAT MESSAGE OUT THERE TO SAY, WE HAVE THE INLET. WE'RE DOING EVERYTHING WE CAN FROM A CITY PERSPECTIVE TRYING TO MAINTAIN THAT ISSUE. YOU NEED TO DO YOUR PART. SO THOSE ARE THE TWO MAIN THINGS FROM ME. SO STATE OF FLORIDA, WE ARE THE ONLY STATE IN THE WHOLE UNITED STATES THAT HAS THIS COASTLINE, THIS AMOUNT OF COASTLINE. FOR US AND SOUTH CAROLINA ARE THE ONLY TWO STATES THAT HAVE AN ISSUE OF EROSION. THEY DO A LARGE VOLUME OF STERILIZATION SERVICES THAT GO THROUGH OUR PROGRAM. THEY ARE THE ONLY PROVIDER OF ALL THREE LOCAL JURISDICTIONS. THEY WILL FOLLOW ALL OF THE CDC GUIDELINES AND PEOPLE WILL BE ABLE TO MAKE AFTER HOURS CONTACT VIA EITHER FACEBOOK OR THEIR WEBSITE. STAFF WILL BE THERE LONGER THAN THOSE HOURS. SO THERE WILL BE AN OPPORTUNITY FOR AFTER HOURS CONTACT AS WELL. AND DURING THAT SIX MONTHS THEY'RE GOING TO START DEVELOPING THE HUMANE SOCIETY. ESTABLISHING A BOARD OF DIRECTORS, FUND RAISING, STARTING COMMUNITY OUTREACH, ALL OF THE THINGS IT TAKES TO GET A HUMANE SOCIETY UP AND RUNNING. ONE OF THE OTHER ITEMS THEY ARE LOOKING INTO IS THEY WOULD LIKE TO GET A GENERATOR IN CASE. >> IF THEY GET ONE, THEN WE WON'T HAVE ANY HURRICANES. >> IT'S TRUE. THE COUNTY WILL HAVE THEIR OWN SERVICE AGREEMENT, THE CITY WILL HAVE THEIR OWN SERVICE AGREEMENT. BUT WHAT WILL BE DIFFERENT FROM THE PAST IS THE AGREEMENTS WILL BE IDEAL. SO THE SERVICES PROVIDED TO THE COUNTY WILL BE THE SERVICES PROVIDED TO THE CITY. IF IT'S A PER ANIMAL FEE, THE PER ANIMAL FEE THE COUNTY PAYS IS THE SAME FEE THE CITY PAYS. SO EVEN THOUGH THEY'RE SEPARATE CONTRACTS, THEY'LL BE THE SAME JUST A DIFFERENT TITLE AT THE TOP. OPERATION SOS UNDERSTANDS THAT IT COSTS MONEY TO GET STARTED, SO THEY HAVE ARRANGED FOR A $20,000 LOAN TO THE SUNRISE HUMANE SOCIETY SO THAT THEY HAVE THAT INITIAL FUNDING TO GET THEMSELVES UP AND RUNNING. OVERSIGHT; IN THE RFP THAT WE PUT OUT, WE HAD A LARGE SECTION THAT WAS PRETTY DETAILED REGARDING OVERSIGHT, REGARDING OVERSIGHT OF THE FACILITY, REGARDING OVERSIGHT OF THE ANIMAL CARE AND THE SUNRISE HUMANE SOCIETY HAS AGREED TO EVERYTHING WE HAD LISTED IN THE RFP. SO WHAT WE'RE SAYING IS THAT THE SEMIANNUAL SHELTER INSPECTION WILL BE INCLUDED IN THE LEASE AND WILL BE DONE TWICE A YEAR VERSUS THE BIMONTHLY INSPECTIONS OF THE ANIMAL SERVICES AND CARE. AND THAT WILL BE PUT INTO OUR SERVICES AGREEMENT BECAUSE THAT'S ABOUT THE CARE OF THE ANIMALS. BOTH INSPECTIONS WILL HAVE WRITTEN REPORTS IF ANY DEFICIENCIES ARE IDENTIFIED, THAT WOULD BE REQUIRED IN WRITING. THERE WILL BE A TIMEFRAME FOR CORRECTING AND THEN THERE WILL BE PENALTIES IF CORRECTIONS ARE NOT MADE. SO THOSE THREE THINGS ARE THE SAME FOR BOTH, BUT ONE WILL BE IN THE LEASE FOR THE FACILITY, AND THE OTHER WILL BE IN THE SERVICE AGREEMENT FOR THE CARE OF THE ANIMALS. THE RENTAL LEASE AGREEMENT, SO THE SUNRISE HUMANE SOCIETY IS PROPOSING A MONTHLY RENTAL FEE CALCULATED AT 20% OF THE PRIOR MONTH'S IMPOUND FEES. THEY'RE GOING TO TAKE OVER THE PREVENTIVE MAINTENANCE INCLUDING PEST CONTROL, BE RESPONSIBLE FOR ANY DAMAGE THAT'S DONE. THE CITY OF FORT PIERCE HOWEVER WILL MAINTAIN RESPONSIBILITY OF THE ROOF, THE GROUNDS, THE FENCES, ANY PLUMBING, ELECTRICAL, OR HVAC ISSUES. ESSENTIALLY ALL OF THE UPGRADES AND REPAIRS WE JUST MADE, WE'RE GOING TO MAKE SURE STAYS MAINTAINED. THE SUNRISE HUMANE SOCIETY HAS REQUESTED THAT WE AND THE COUNTY PAVE THE PARKING AREA TO THE EAST SIDE OF THE FACILITY. IT'S WHERE THE GATE WAS OPENED UP. AND IT'S BEEN DIRT AND GRAVEL AND EVERY TIME IT RAINS IT GETS NASTY AND GETS POTHOLES. THEY'RE REQUESTING THAT IT BE PAVED FOR SAFETY REASONS, THERE'S A VARIETY OF REASONS BUT ESSENTIALLY IT'S SAFETY. IN THE PROPOSAL THEY HAVE PROPOSED AT LEAST FOR ONE YEAR WITH A FOUR YEAR RENEWAL. STAFF RECOMMENDS THAT THE LEASE AND THE SERVICE AGREEMENTS BE THE SAME TERMS. AND WE ALSO SUGGEST THAT THEY BE TIED TOGETHER. SO IF THE SERVICE AGREEMENT IS CANCELED, THE LEASE IS TERMINATED. THAT WAY THEY WOULD NOT CONTINUE TO MAINTAIN POSSESSION OF THE BUILDING BUT WE DON'T HAVE A CONTRACT FOR ANIMAL CARE. WE LEARNED THAT ONE THE HARD WAY, THAT THE LEASE AND THE SERVICE CONTRACTS DO HAVE TO BE TIED TOGETHER. AND THEN JUST SOME QUICK ADDITIONAL INFORMATION, IN THE PROPOSAL THEY HAVE REQUESTED A TERMINATION BY EITHER PARTY WITH 60 DAYS NOTICE. STAFF IS RECOMMENDING A MINIMUM OF 120 DAYS FOR TERMINATION WITHOUT CAUSE. AND THEN IN THE SERVICE CONTRACTS IN THE LEASE, THEY'LL BE TERMINATION CONTRACTS THAT WOULD BE 60 DAYS FOR CAUSE. THEY USUALLY HAVE A TIME PERIOD FOR CORRECTION. AS WE SAID WE DO THE INSPECTION AND FIND A DEFICIENCY, ONLY WHEN THOSE FIXES DON'T HAPPEN DO WE GO INTO THE POSSIBILITY.
