WE PRAY GOD THAT THEY WILL LOOK BEYOND THE HORIZON AND SEE THE NEEDS OF OUR PEOPLE. WE'RE IN A CITY, GOD, THAT RIGHT NOW IS BOOMING BUT THERE ARE ALSO PEOPLE WHO ARE HURTING. WE'RE IN A CITY, GOD, WHERE OTHERS ARE BEING BLESSED WHILE OTHERS FEEL THEY'RE BEING LEFT BEHIND. BUT WE ARE TRUSTING AND BELIEVING GOD THAT THE DECISIONS THAT WILL BE MADE ON THEIR BEHALF THAT WE WILL BE LIFTED UP IN THE NAME OF JESUS. FATHER WE THANK YOU RIGHT NOW FOR THOSE THAT HAVE BEEN ENTRUSTED, GOD, WILL BE IN THE SAFETY FOR US. WE SAY KEEP YOUR ARMS OF PROTECTION AROUND THEM. SHIELD THEM FROM ALL HURT, ARM OR DANGER. AND LORD, I'M PRAYING I'M PRAYING SO HARD FOR UNITY, GOD, REGARDLESS OF WHAT DENOMINATION WE BELONG TO, REGARDLESS OF WHAT POLITICAL AFFILIATION WE BELONG TO I'M PRAYING FOR UNITY FOR OUR CITY. THE CITY COMMISSION SERVES BOTH THE LEGISLATIVE AND QUASI-JUDICIAL ROLE. WHEN ACTING AS A LEGISLATIVE BODY THE COMMISSION ENGAGES IN LAW MAKING ACTIVITY BY PASSING LAWS AND ESTABLISHING POLICIES.

WHEN ACTING AS A QUASI-JUDICIAL BODY THE COMMISSION IMPLIES -- APPLIES THOSE LAWS AND POLICIES IT'S HELD TO STRICTER PROCEDURAL REQUIREMENTS. THE PROCEEDINGS ARE LESS FORMAL THAN PROCEEDINGS BEFORE A CIRCUIT COURT BUT ARE MORE FORMAL THAN THE NORMAL COMMISSION HEARING.

EXCUSE ME, THAN THE NORMAL COMMISSION MEETING.

QUASI-JUDICIAL PROCEEDINGS MUST FOLLOW BASIC STANDARDS OF NOTICE AND DUE PROCESS AND DECISIONS MUST BE MADE BASED ON EVIDENCE. THEREFORE COMMISSIONERS HAVE A DUTY TO CONDUCT THE QUASI-JUDICIAL PROCEEDINGS MORE LIKE JUDGES THAN LEGISLATORS.

THAT IS WHY THE COMMISSION HAS ESTABLISHED THE UNIFORM PROCEDURES FOR QUASI-JUDICIAL HEARINGS THAT WILL BE FOLLOWED THIS EVENING.

IF YOU LISTENED TO THE READING BY THE CITY CLERK THE PRESENTATION WE'RE GIVING YOU TODAY IS A LITTLE DIFFERENT THAN OUR STANDARD DEMOLITION AND I'LL EXPLAIN THAT AS WE GO. THIS PROPERTY WAS CONDEMNED IN MAY OF 202021. THERE'S TWO CONDEMNATIONS AT THIS LOCATION ONE FOR THE HOUSE ONE WAS FOR THE CARPORT DUE TO THE CONDITION OF THE CARPORT THE BUILDING INSPECTOR DID RECOMMEND DOING A NOTICE OF UNSAFE BUILDING FOR DEMOLITION WHILE THE PROPERTY, THE MAIN HOUSE DOES HAVE AN UNSAFE BUILDING FOR REHABILITATION.

SO THE HOUSE ITSELF IS STILL ELIGIBLE TO BE REHABBED.

THE CARPORT WAS IDENTIFIED TO BE DEMOLISHED.

IN SEPTEMBER, 2021, WE RECEIVED NOTICE THAT THE CARPORT HAD COLLAPSED. THEN DUE TO ITS CLOSE PROXIMITY TO THE ELEMENTARY SCHOOL PAUL THOMAS OUR BUILDING OFFICIAL SIDE AN AFFIDAVIT OF IMMEDIATE DANGER. IN THIS CASE WE HAVE REMOVED THAT STRUCTURE IT'S JUST THE CARPORT THAT GOT REMOVED.

NOW WHAT WE'RE IN FRONT OF YOU TODAY IS MAKING SURE THAT WE FOLLOWED ALL OF OUR STEPS PROPERLY.

SO THE CARPORT WAS ACTUALLY DEMOLISHED BY THE CITY VENDOR ON SEPTEMBER 28TH OF THIS YEAR.

SECTION 5 OF THE CONDEMNATION PROCEDURES SAYS WHEN THE OPINION OF THE BUILDING OFFICIAL THERE'S IMMINENT DANGER HE HAS THE AUTHORITY TO ORDER IT DEMOLISHED. THEN THE LAST SECTION WHEN SUCH ACTION IS TAKEN THE PROCEDURES FOR DEMOLITION OUTLINED IN SECTION 2 SHALL COMMENCE AS SOON AS REASONABLY POSSIBLE AFTER THE FACT WHICH IS WHY WE'RE

BEFORE YOU TONIGHT TO GIVE THE OWNER THE OPPORTUNITY TO SAY, YOU SHOULDN'T HAVE DONE THAT.

SO THAT'S WHY WE'RE HERE TONIGHT.

REGARDING NOTICE IN MAY, 2021, THE NOTICE OF UNSAFE AVAILABILITY WAS SENT TO THE OWNER.

IT WAS RETURNED TEMPORARILY AWAY UNABLE TO FORWARD.

IN JULY, THE NOTICE RESENT BY REGULAR U.S. POSTAL AND THAT WAS RETURNED NOT DELIVERABLE AS ADDRESSED UNABLE TO FORWARD. UPON RECEIPT OF THE TITLE SEARCH I WAS NOT ABLE TO FIND ANY ADDITIONAL RESEARCH -- ADDRESSES. I DID SEARCH.

I FOLLOWED THOSE UP THEY'RE NOT KNOWN ADDRESSES.

AND THE CITY CLERK SENT NOTICE FOR TONIGHT'S HEARING BOTH CERTIFIED AND REGULAR MAIL AND ALL MAIL HAS BEEN RETURNED UNCLAIMED. SO WE HAVE NOT HAD ANY SUCCESSFUL ATTEMPT AT CONTACTING THIS OWNER.

IT IS A NONHOMESTEADED PROPERTY AND IT'S NOT OCCUPIED. THERE'S BEEN NO ACTIONS BY THE OWNER TO TRY AND ADDRESS ANY OF THE VIOLATIONS.

WE DO HAVE AN ACTIVE LOT CLEARING CASE AT THIS LOCATION. IT IS THERE'S NO UTILITIES.

NO BUILDING PERMITS AND AS I MENTIONED WE DID COMPLETE THE TITLE SEARCH AT THIS LOCATION.

THIS IS THE BEFORE PHOTO WHEN WE STARTED IN MAY.

AND THEN YOU CAN SEE THE CARPORT COLLAPSED IN SEPTEMBER. THEN IT WAS REMOVED.

SO THE MAIN STRUCTURE IS STILL STANDING WITH JUST THE CARPORT BEING REMOVED AT THIS TIME.

THIS IS JUST A BRIEF OVERVIEW AND AS YOU CAN SEE THE ELEMENTARY SCHOOL IS ABOUT 125 FEET AWAY.

I KNOW WHEN I WAS A TOMBOY, IN AN ELEMENTARY SCHOOL THAT WOULD HAVE BEEN A LOT OF FUN TO PLAY AROUND.

SO THAT'S THE DEFINITION OF ATTRACTIVE NUISANCE.

>> WHICH PARCEL IS IT. >> THE PARCEL IS THIS PARCEL RIGHT HERE. SO YOU HAVE ABOUT 50 FEET HERE AND A ROADWAY SO IT'S ABOUT 100 FEET AWAY FROM THE SCHOOL. RIGHT DOWN THE STREET.

SO FOR THAT REASON IS WHY PAUL THOMAS DID DECLARE IT AN IMMINENT DANGER TO THE NEIGHBORHOOD.

ACTIONS AGAIN ARE A LITTLE DIFFERENT IF SUFFICIENT EVIDENCE WAS SUPPORTED TO THE EMERGENCY DEMOLITION.

IF YOU FEEL THAT WE DID NOT PRESENT SUFFICIENT EVIDENCE YOU CAN CHOOSE NOT TO ADOPT THE RESOLUTION.

AND THE STEPS FOR THIS POINT THERE IS A 30 DAY APPEAL WINDOW AS ALWAYS AND THEN IF NO APPEAL IS RECEIVED AT THIS TIME WE'LL HAVE THE INVOICE SENT TO THE PROPERTY OWNER PLACING A LIEN ON THE PROPERTY.

>>> SO MADAM MAYOR, COMMISSIONERS WE ARE HERE FOR 2202 AVENUE I. FOR A CONDEMNATION AND DEMOLITION HEARING. THIS CASE WAS INITIATED IN MAY 2019, AT THAT TIME THE BUILDING INSPECTOR RECOMMENDED AN AFFIDAVIT OF UNSAFE BUILDING WITH THE OPTION TO REHABILITATE THIS STRUCTURE.

IN JULY OF THAT SAME YEAR, THE OWNER APPLIED FOR A FENCE PERMIT TO REPAIR BUT THE PERMIT DID EXPIRE WITHOUT ANY WORK BEING DONE AND NO OTHER PERMIT ACTIVITY HAS TAKEN PLACE AT THIS TIME.

DUE TO CONTINUED DETERIORATION, CODE ENFORCEMENT REQUESTED THAT THE BUILDING DEPARTMENT DO A FOLLOW UP INSPECTION JULY OF THIS YEAR WHICH THEY DID AND DUE TO THE ADDITIONAL DETERIORATION THEY CHANGED THE RECOMMENDATION TO RECOMMEND THAT THE STRUCTURE BE DEMOLISHED. AGAIN, NOTICE OF THE UNSAFE BUILDING WAS SENT CERTIFIED MAIL AND RETURNED UNCLAIMED.

IT WAS THEN SENT REGULAR U.S. POSTAL BUT THAT MAIL WAS NOT RETURNED. I DID NOT RECEIVE THAT BACK.

BUT I DID NOT RECEIVE ANY CONTACT FROM THE OWNER EITHER. AND IN JULY OF THIS YEAR, A TITLE SEARCH WAS CONDUCTED WE WERE NOT ABLE TO IDENTIFIED -- IDENTIFY ANY ADDITIONAL ADDRESSES FOR THE OWNER TWO. ADDITIONAL PARTIES WERE IDENTIFIED BOTH WERE SENT NOTICE.
