CITY ORDINANCE SECTION 105.1 PERMIT REQUIRED AND 105.4 POINT 2 EXPIRED PERMIT. THIS CAME BEFORE YOU APRIL 21ST, 2021. ON OCTOBER 18TH, 2021, THERE'S A 90 EXTENSION OF TIME GRANTED AND ON JANUARY 20TH OF 2022 AN AFFIDAVIT OF NON-COMPLIANCE WAS RECORDED AND FINES BEGAN.

AS OF MARCH FIRST THE FINES TOTAL $4130 WITH $30 BEING RECORDING FEES AND SPECIAL MAGISTRATE IN THIS CASE THERE WAS AN AGREEMENT FOR AN EXTENSION THAT WAS GRANTED BY THE PLANNING DEPARTMENT FOR THEM TO OBTAIN A TEMPORARY USE AND CONDITIONAL USE AND THAT EXTENSION WAS IN PLACE IN OCTOBER AND WAS STILL IN PLACE WHEN YOUR ORDER EXPIRED IN JANUARY. HOWEVER THAT TIME WAS NOT CLEARLY INDICATED TO THE RESPONDENTS THAT IT WAS A SEPARATE TIMEFRAME FROM THE PLANNING PROCESS AND THAT WAS NOT COMMUNICATED WITH OUR DEPARTMENT SO WHEN THE OF THE OF COMPLIANCE WAS RECORDED WE WERE NOT AWARE OF THE EXTENSION AGREEMENT THAT THE RESPONDENTS HAD WITH THE PLANNING DEPARTMENT. SO STAFF'S RECOMMENDATION AS OF TODAY IS TO STAY THE FINES OF JANUARY 20TH, 2022 WHEN THEY BEGAN AND TO PROVIDE A ONE YEAR EXTENSION TO THE RESPONDENTS TO ALLOW THEM TO REMEDY THE ORDER BY RENEWING THE EXPIRED PERMITS AND MAKING NECESSARY PROVISIONS AND CONDITIONAL USES AS REQUIRED THAT ARE REFLECTED IN THE ORDER DETERMINING VIOLATION.

THERE ARE THREE CRITERIA TO CONSIDER IN REQUEST OF THIS.

ONE, THE GRAVITY OR SERIOUSNESS OF THE VIOLATION IS MODERATE AND ANY ACTIONS TAKEN TO CORRECT WERE NOT CORRECTED BY THE ORIGINAL VIOLATOR AND ACTION WAS TAKEN BY ANY OWNER OR PARTY TO BRING THE VIOLATION INTO COMPLIANCE AND PERMITS WERE OBTAIN BUT THEY EXPIRED AND REVISIONS ARE REQUIRED TO RENEW THE PERMITS AND NO REVISIONS HAVE BEEN RECEIVED.

PERMITS WERE APPLIED FOR IN OCTOBER OF 2021 BUT WERE REJECTED IN PLAN REVIEW AND NO RESPONSE HAS BEEN RECEIVED.

AND NUMBER THREE, THE NUMBER OF TIMES THE VIOLATOR WAS PREVIOUSLY FOUND IN VIOLATION BY CODE ENFORCEMENT, SPECIAL MANAGE STATE, OR OTHER QUASI JUDICIAL WHERE OTHERWISE, ADMITTED GUILT IN ANY SUCH PROCEEDING WHICH IS ZERO TIMES.

WE'VE BEEN IN CONTACT WITH THE CITY PLANNING DEPARTMENT FOR TWO YEARS AND WE'RE ACTUALLY, WE WERE STILL WAITING ON A RESPONSE FROM THE PLANNING DEPARTMENT FROM OCTOBER OF 2021.

HE STOPPED RETURNING MY CALLS AND THEN DID A LITTLE WORK AND THEN COMPLETELY STOPPED. SO I BASICALLY TOOK HIM TO SMALL CLAIMS COURT AND I HAVE NOT GOTTEN NONE OF THAT MONEY BACK, NOR DO I REALLY EXPECT IT BUT BASICALLY YOU KNOW, I THOUGHT HE WAS CERTIFIED TO DO THE JOB. I HAVE THE CONTRACT BUT IT'S REALLY BLURY BECAUSE IT'S LIKE SINCE 2018 SO THAT, NO WORK ON THAT PROPERTY HAS BEEN DONE FOR YEARS.

IT SHOULD NOT HAVE BEEN ANYONE ON THE PROPERTY TO EVEN, I DON'T KNOW HOW THE CITY COULD HAVE EVEN GOT IN TO TAKE PICTURES BECAUSE IT HASN'T BEEN TOUCHED IN YEARS SINCE I FILED THE COMPLAINT AND TOOK THEM TO COURT.

AND I CAN'T AFFORD $10,000 IN FINES AT ALL.

THE HOUSE IS OVER BURDENED WITH PERSONAL AFFECTS INCLUDING THE KITCHEN WHICH IS WHERE IT SEEMS THE PROBLEM IS AND IT'S DIFFICULT TO WORK IN THERE'S A CONSEQUENCE. I THOUGHT I WOULD BE ABLE TO ADDRESS ALL OF THIS VERY DISTINCTLY WHEN I WRECEIVED A LETTER ON JANUARY 28TH BY TINA TELLING ME THAT SHE WAS VACATING THE PROPERTY ON FEBRUARY 28TH. I THOUGHT SINCE SHE SAID SHE WAS MOVING OUT THAT SHE WOULD AND WE COULD HAVE AN EMPTY HOUSE AND ADDRESS EVERYTHING IN A VERY PROFESSIONAL STRAIGHT FORWARD MANNER, MAKING ALL SORTS OF REPAIRS AND WHAT NOT.

BUT SHE SAID SHE EXPECTS ME TO EVICT HER BECAUSE OF HER COMPLAINT OR HER APPEARANCE HERE TODAY AND THAT IS NOT SO, BUT I DO NEED TO POINT OUT THAT THE LEASE HAS EXPIRED AND SHE IS A MONTH-TO-MONTH TENANT NOW AND SHE DID GIVE ME NOTICE THAT SHE WAS MOVING OUT ON FEBRUARY 28TH.
