THIS YEAR IS OBVIOUSLY ACCOMPANIED BY THE DRAFT ORDINANCE THAT INCLUDES A FEW PROVISIONS THAT HAVE BEEN ADDED BASED UPON PREVIOUS FEEDBACK. SO MAKE THIS A LITTLE EASIER I DID PROVIDE THIS POWER POINT TO SHOW WHAT WAS NEW AND REVISED FOR EASIER FOLLOW-ALONG. THE CURRENT PROCUREMENT CODE WAS ENACT IN 1983 AND HAS BEEN UPDATED TWICE IN 1998 AND AGAIN IN 2018. CENTRAL I WILL THE NEW REWRITE OF OUR CURRENT PROCUREMENT CODE SEEKS TO OVER HAUL IT BY ADDING NEW PROVISIONS AND REVISIONS WITH THE GOAL OF IMPROVING PROCUREMENT PROCESS AS BOTH THE PROCURING ENTITY AND FOR THE PROCUREMENT APPLICANT. WE ARE GOING TO HIGHLIGHT 15 SPECIFIC PROCUREMENT AREAS TONIGHT. JUST AS A HOUSEKEEPING MEASURE, THE SECTIONS THAT I WILL GO THROUGH SOME OF THE NUMBERS HAVE CHANGED BECAUSE OF THE REVISION NUMBERS HAVE ACTUALLY CHANGED. SO JUST TO KEEP THAT IN MIND. SECTION 2440 EXEMPTIONS. THIS IS A NEW PROVISION THAT MORE EXEMPTIONS IN FLORIDA STATUTE TO BE SPECIFIC 287 COVER THE GOODS AND THE SERVICES THE COMMISSION HAS APPROVED ON A MORE FREQUENT BASIS LIKE INTERLOCAL AGREEMENTS AND ACQUISITION OF REAL PROPERTY. PROVISION OF MEDICAL SERVICES. THESE ARE THE TYPES OF AGREEMENTS THAT THE COMMISSION HAS APPROVED IN THE PAST. >> THEY ARE EXEMPTED FROM WHAT? >> WELL FROM THE PROCUREMENT. THE SOLICITATION AND COMPETITIVE SOLICITATION PROCESS. >> FOR CLARITY FOR THE AUDIENCE AND US. CATEGORIES. THIS BEEN REVISEED WITH THE ADDITION OF THE EXEMPTION SECTION WE NOW HAVE 2-241 AS A NEW ORDINANCE NUMBER WITH THE REVISION OF THE CURRENT CODE THRESHOLD WHERE IT NOW INCREASES THE AMOUNT FOR DIRECT AND INFORMAL SOLICITATIONS. SO DEPARTMENT DIRECTORS WILL NOW HAVE THE AUTHORITY TO MAKE DIRECT PURCHASE THERE'S VALUED UP TO $2,500. THE CITY MANAGER STILL RETAINS THE AUTHORITY TO APPROVE PURCHASES UP TO $50,000 WITHOUT COMMISSION APPROVAL BUT WILL NOW HAVE AUTHORITY TO APPROVE RENEWALS OR EXTENSIONS OF CONTRACTS INCLUDING PIGGY-BACK AGREEMENT, SO LONG AS THE THRESHOLD REMAINS LESS THAN $50,000. SECTION 2-446 SOURCE SELECTION AND WAIVER OF COMPETITION. THIS IS A REVISION OF THE SOURCE SELECTION REQUIREMENTS WHERE THE NEW CODE SECTION CONTINUALLY AUTHORIZES USE OF COMPETITION SOURCES SUCH AS AN RFP ORQ TO PURCHASE GOODS AND SERVICES, WE'LL ALSO AUTHORIZE OTHER SOURCES OF PROCUREMENT COMPETITION SUCH AS COAL BRAND PURCHASES WHICH WE'LL COVER. THIS SECTION LAWS THE COMMISSION TO WAIVE IT UPON RECOMMENDATION AND DETERMINE THAT WAIVERS IN THE BEST INTEREST OF THE CITY. SECTION 2-450 SOLE SOURCE PROCUREMENT IS BEING REVISED AS A SEPARATE CODE SECTION THAT WILL REQUIRE ELECTRONICALLY POSTING A DESCRIPTION OF THE MATERIALS, GOODS AND CAN COMMODITYS OR SERVICES TO BE PURCHASED FOR FIVE BUSINESS DAYS AND THERE AFTER MAKE A WRITTEN DETERMINATION THAT ONLY A SINGLE SOURCE IS AVAILABLE. SECTION 2-451 SOLE BRAND PROCUREMENT IS A NEW PROVISION THAT AUTHORIZED SOLE BRAND PURCHASES IF THE PROCUREMENT OFFICIAL MAKES A WRITTEN DETERMINATION THAT NO OTHER MANUFACTURER CAN MEET THE CITIES NEEDS, NO SUBSTITUTION EXISTS AND THE PURCHASES ARE IN THE BEST INTEREST OF THE SIOUX CITY. THESE ARE AUTHORIZED IN EACH CATEGORY BUT STILL MUST ADHERE TO THE COMPETITION REQUIREMENTS AND THE NUMBER OF REQUIRED QUOTES AND DETAILED SPES CITYICATION. THOSE HAVE TO BE ADHERED TO. SECTION 2-452. COOPERATIVE PROCUREMENT. PIGGY-BACKING IS CURRENTLY AUTHORIZED BUT REVISED THAT PARTICULAR PIECE IS NOW BEING REVISED TO SPECIFICALLY AUTHORIZE PURCHASING THROUGH PIGGY-BACK WHICH WOULD ALLOW [00:45:02] PURCHASES UNDER THE SAME PRICING AND TERMS AND CONDITIONS OF A CONTRACT THAT WAS COMPETED AND AWARDED BY ANOTHER GOVERNMENTAL AGENCY. JUST FOR THE PUBLIC'S SAKE. COOPERATIVE PROCUREMENT SOLICITATION WOULD BE SOLICITATION COMPETED BY NATIONAL COOPERATIVE ORGANIZATION SUCH AS SOURCE WELL, OMNIA PARTNERS OR THE FLORIDA SHERIFF'S ASSOCIATION. THOSE ARE SPECIFIC EXAMPLES WHERE THE CITY HAS MORE BUYING POWER ON A STATE OR NATIONAL SCALE TO FOCUS ON MORE STRATEGIC PURCHASES AND EFFICIENT PROCUREMENT. SECTION 2-455 UNAUTHORIZED PURCHASES AND EVERYTHING CALL CONDUCT SANCTIONS IS CURRENTLY RECOGNIZED IN OUR CODE BUT IT'S BEING REVISED IN TWO WAYS. FIRST IT WILL ENHANCE SANCTIONS AGAINST EMPLOYEES BY AUTHORIZING THE CITY MANAGER TO FORFEIT ANY OR ALL BALANCES THAT WOULD BE AN ADDITIONAL SANCTION TO THOSE PRESCRIBE IN OUR PERSONNEL POLICIES AND CODE. AND THEN WHILE OUR CURRENT CODE DOES ALLOW THE COMMISSION TO WAIVE A CONFLICT OF INTEREST WHEN AN EMPLOYEE BID IS IN THE BEST INTEREST OF THE CITY THERE WAS NOT A MECHANISM FOR IT AN EMPLOYEE TO BID SO THE SECOND REVISION WOULD NOW REQUIRE ANY EMPLOYEE INTENDING TO SUBMIT A BID PROPOSAL OR RESPONSE MUST NOTIFY THEIR DEPARTMENT HEAD, THE PROCUREMENT OFFICIAL AND THE CITY MANAGER IN WRITING WITHIN TEN CALENDAR DAYS OF THE SOLICITATION RELEASE. THEY CANNOT DIRECT I WILL OR INDIRECT I WILL PARTICIPATE IN THE PROCUREMENT PROCESS. ANYTIME EITHER BEFORE OR AFTER A THEIR NOTIFICATION AND THEIR FAILURE TO ADHERE TO THIS REQUIREMENT WILL RESULT IN DISQUALIFICATION AND POSSIBLE SUSPENSION OR DEBARRING FROM PARTICIPATION AND FUTURE SOLICITATION. SECTION 2-457. LOBBY LIMITATIONS. THIS IS A NEW PROVISION THAT WILL NOW PROHIBIT ANY EFFORTS TO COMMUNICATE WITH CITY EMPLOYEES DURING A COMPETITIVE SOLICITATION PROCESS. LOBBY AND THE CODE OF SILENCE DURING THE SOLICITATION PROCESS IS NOT NEW BUT THIS PROHIBITION PROHIBITS ANY ATTEMPTS TO MAKE CONTACT DOWN TO EVEN SENDING AN UNSOLICITED E-MAIL WITH A COPY TO THE PROCUREMENT OFFICIAL. VIOLATION OF THIS SECTION WILL RESULT IN DISQUALIFICATION AND POSSIBLE DEBAR MEANT FROM FUTURE SOLICITATIONS. SECTION 2-458 PROHIBITION AGAINST AWARDS TO CERTAIN PERSONS OR ENTITIES IS A NEW PROVISION THAT PROHIBITS AWARDING A CONTRACT IN DISQUALIFICATIONS OF SPECIFIC PERSONS OR ENTITIES THAT HAVE ENGAGED IN CERTAIN BAD ACTS WHICH INCLUDE FAILURE TO COMPLY WITH THE TERMS OF PREVIOUS AGREEMENTS TWO CITY. FAILURE TO DELIVER MATERIALS AND BREACH OF CONTRACT TERMS, REPEATED PERFORMANCE DEFI DEFICIENCIES AND FAILURE TO MEET REGULATORY OR REPORTING REQUIREMENTS. SECTION 2-459 PROTEST. IT'S REVISED TO PROVIDE A MORE MULTI-LAYERED DISPOSITION OF BID PROTESTS. THE CODE REQUIRES A NOTICE OF INTENT TO PROTEST BUT THE AMOUNT OF TIME TO FILE THE PROTEST HAS BEEN REDUCED. SO THE TIME HAS BEEN REDUCED FROM TEN DAYS TO NOW FIVE DAYS. THE REVISED VERSION RESTRICTS WHO IS DEEMED AN AUTHORIZED OFFICER ON BEHALF OF THE PROTESTER AND IT ALSO RESTRICTS THE TYPES OF CHALLENGES THAT SERVES AS THE BASIS FOR THE PROTEST. YOU CANNOT PROTEST CHOSEN PROCUREMENT METHODS THE EVALUATION CRITERIA, WEIGHT OF CRITERIA. THOSE ARE SOME OF THE EXAMPLES. UNDER THIS PROVISION THE PROCUREMENT OFFICIAL STILL HAS AUTHORITY TO RESOLVE THE PROTESTS BUT NOW THEIR DECISION THAT IS THE PROCUREMENT OFFICIALS DECISION CAN BE REVIEWED BY THE CITY MANAGER UPON REQUEST. SECTION 2-460 AUTHORITY TO SUSPEND OR DEBAR IS REVISED IN THAT IT CONTINUES TO AUTHORIZE THE PROCUREMENT OFFICIAL TO SUSPEND A PERSON OR ENTITY FROM CONSIDERATION FOR VARIOUS CAUSES THAT INCLUDES CRIMINAL CONVICTIONS A FAILURE TO PERFORM WITHIN THE SPECIFICATIONS OF A BUDGET OF A CONTRACT. THIS INCLUDES AUTHORIZATION TO SUSPEND OR DEBAR DUE TO EARTH [00:50:02] CALL VIOLATIONS OR DOCUMENTED HISTORY OF SIGNIFICANT DEVIATION FROM CONTRACT SPECIFICATION AND ENGINEERING STANDARDS OR DESIGN OR SAFETY REQUIREMENTS. SECTION 2-460 WE'RE STILL ON THIS. WANTED TO ALSO NOTE THAT WITH THIS REVISION THE CODE NOW INCREASES THE AMOUNT OF TIME FOR SUSPENSION UP TO 12 MONTHS. IT WAS 3 MONTHS AND THEN DEBAR MEANT HAS NOW BEEN REVISEED FOR UP TO FIVE YEARS PER VIOLATION BEFORE IT WAS JUST THREE YEARS. PER VIOLATION WAS NOT EVEN IN OUR CODE BEFORE. SECTION 2-461 PROCEDURES RELATED TO SUSPENSION DEBAR MEANT AND REINSTATEMENT. THIS IS WHAT WITH THE REVISION OF THE CODE. THE CODE NOW ESTABLISH AS PROCEDURE WHICH PROVIDES DUE PROCESS AND THAT THE PERSON OR ENTITY THAT'S SUBJECT TO SUSPENSION OR DEBAR MEANT MUST SUBMIT A WRITTEN RESPONSE TO THE NOTICE OF INTENT BUT THEY MAY ALSO BE AFFORDED A MEETING IT'S DEEMED APPROPRIATE BY THE PROCUREMENT OFFICIAL. THE OFFICIAL MUST PROVIDE THEIR FINAL DETERMINATION IN WRITING. AS PART OF THIS NEW PROCESS THE PERSON OR ENTITY THAT IS SUBJECT TO SUSPENSION, THEY CAN REQUEST A REVIEW OF THE PROCUREMENT OFFICIALS FINAL DETERMINATION BY SUBMITTING A WRITTEN REQUEST TO THE CITY MANAGER. SECTION 2-462 ADMINISTRATIVE PROCEDURES IS A NEW PROVISION THAT SIMPLY AUTHORIZES THE CITY MANAGER TO ESTABLISH A PROCEDURE MANUAL THAT'S CONSISTENT WITH THE REQUIREMENTS OF THE CODE. SECTION 2-463 STAFF TRAINING IS NEW AND REQUIRES THE CITY MANAGER TO REGULAR I WILL CONDUCT TRAINING ON THE PROCUREMENT ROLES. THE CITY MANAGER DIRECTED THE CREATION OF A NEW POSITION FOR A PROCUREMENT DIRECTOR WHICH HAS BEEN CREATED. INTERVIEWS ARE UNDERWAY TO PROVIDE A HIGHER LEVEL OF LEADERSHIP AND EXPECTATION OF THE CITIES PROCUREMENT AND PURCHASING PROCEDURES. WE ANTICIPATE THE DIRECTOR WILL IMPROVE OUR INTERNAL PROCESS STARTING WITH A HEARING TO THIS NEW CODE, IMPLEMENTING IT THROUGH A REVISED MANUAL AND STAFF TRAINING TO ENSURE CITY PROCUREMENT WILL ESTABLISH CONSISTENT, LAWFUL AND EVERYTHING CALL PURCHASES AS A WHOLE.
