[a. Presentation by John Tompeck, FPUA, Director of Utilities on utilities disconnections and the recent effluent discharge to the Indian River Lagoon.]

MISCELLANEOUS REPORTS WITH JOHN TOMPECK AND THE MOST RECENT EFLUENT DISCHARGE TO THE INDIAN RIVER LAGOON. MR. TOMPECK, WELCOME.

>>> GOOD AFTERNOON MAYOR HUDSON AND CITY COMMISSIONERS.

THANK YOU FOR THE OPPORTUNITY TO COME AND ADDRESS YOU THIS AFTERNOON.

I WANT TO BE TALKING ABOUT TWO SUBJECTS. THE FIRST ONE IS THE ISLAND WATER RECLAMATION FACILITY AND THOSE DISCHARGES TOOK PLACE ON OCTOBER 4TH AND OCTOBER 5TH. AFTER WE'RE FINISHED WITH THAT I WILL GO THROUGH THE ELECTRIC SERVICE DISCONNECTIONS. THIS ONE VERY QUICK SLIDE ON BACKGROUND INFORMATION THE PERMITTED CAPACITY OF THE WRF IS 10 MILLION GALLONS PER DAY AIRPORT OUR TYPICAL FLOWS ARE ABOUT 4.5 MILLION GALLONS PER DAY AND ALL THE TREATED AFFLUENT IS SENT TO A DEEP INJECTION WELL WITH MAXIMUM FLOW RATE OF 16 MILLION GALLONS A DAY. THAT'S WHAT THE PUMPS CAN HANDLE.

ON OCTOBER 4TH, AND OCTOBER 5TH IS WHEN WE HAD THE DISCHARGES INTO THE RIVER ON OCTOBER 4TH WE LOST ABOUT 500,000 GALLONS AND OCTOBER 5TH, WE LOST ABOUT 170,000 GALLONS. YOU CAN SEE WHAT KIND OF FLOWS WE HAD DURING THAT TIME. THIS IS A REAL INTERESTING CHART, AT LEAST AN ENGINEER WOULD THINK IT'S AN INTERESTING CHART. IT SHOWS THE RAIN VERSUS THE FLOWS. WHAT YOU CAN SEE IS YOU KNOW EVERYBODY KNOWS WE HAD AN AWFUL LOT OF RAIN DURING THAT WEEK. IT WASN'T NECESSARILY JUST THE INITIAL RAIN WE HAD ON SEPTEMBER 30TH IT WAS THE CONTINUED RAIN THAT WE HAD THROUGHOUT THE WEEK. YOU CAN SEE AS THE RAIN TOTALS GOT A LITTLE BIT LESS THAT THE GROUND WAS SO SATURATED THAT IT DROVE UP THE AMOUNT OF EFLUENT DEGREE RELEASED. WE SPIKED AT 19.2 MILLION GALLONS A DAY AT 20.

TO GIVE YOU AN IDEA HOW SATURATED THE GROUND STILL IS WE'RE STILL UP AROUND

[00:15:04]

NINE MILLION GALLONS A DAY. THE GROUND IS REALLY SATURATED.

YOU MIGHT WANT TO KNOW HOW STORM WATER ENTERS OUR SEWER SYSTEM.

WE HAVE A LOT OF CLAY PIPE AND SOME OF THAT PIPE IS OLD.

AS A MATTER OF FACT, MOST OF IT IS OLD. THERE'S CRACKS IN IT AND A LOT OF WATER GETS IN THROUGH THAT FAILED CONFLICT STRUCTURES, DAMAGE CLEANOUTS. THERE'S A LIST OF ITEMS. BUT WE STILL GET A LOT OF STORM WATER THAT GETS INTO THE WASTE WATER SYSTEM. OBVIOUSLY, AS WE DO ROAD WORK AROUND THE CITY WE FIND THESE PROBLEMS WE DO FIX THEM AS WE ARE DOING

RECONSTRUCTION. >> CAN I ASK YOU A QUESTION? >> SURE.

>> CAN YOU GO BACK TO THAT SLIDE. IF THERE'S A MIXTURE OF STORM WATER AND SEWER I'M A LITTLE CONCERNED ABOUT THE REVERSE.

WHAT DO YOU DO WHEN THERE'S SEWER WATER PERHAPS MIXING WITH STORM WATER?

>> TO THE BEST OF OUR KNOWLEDGE THAT'S NOT HAPPENING.

WE DON'T HAVE OLD CLAY WATER PIPES WE HAVE OLD CLAY STORM WATER OLD CLAY WASTE WATER PIPES. I DON'T BELIEVE WE HAVE ANY CLAY PIPES FOR FRESH WATER.

>> OKAY. ALL RIGHT. >> SO YOU KNOW THERE'S THINGS THAT WE'VE BEEN DOING AND WE CONSISTENTLY DO TO TRY TO LIMIT THE AMOUNT OF STORM WATER THAT'S GETTING INTO THE SYSTEM. ONE OF OUR CONTINUING R&R PROJECTS IS LINING STORM WATER PIPE. YOU SEE A PICTURE OF THAT THERE WE ACTUALLY PUT A NEW LINING INTO THE OLD WASTE WATER PIPE.

RIGHT NOW WE'RE DOING ABOUT A MILE PER YEAR. AND THE GOOD NEWS IS HERE WE'VE GOT A D.E.O. GRANT THAT'S OUT THERE THAT WE SUBMITTED FOR ABOUT 8.3 MILLION. WE THINK WE HAVE AN EXCELLENT CHANCE OF GETTING AWARDED THAT GRANT. THAT'S GOING TO BE A GRANT THAT'S GOING TO LINE WASTE WATER LINES IN THE CITY. THAT WOULD BE A GREAT THING FOR US.

I WANTED TO JUST TALK FOR ONE MINUTE ABOUT THE WHAT HAPPENED IN 2017, WHICH WAS HURRICANE IRMA. IN THAT CASE WE DISCHARGED ABOUT 10 MILLION GALLONS AND THAT WAS CAUSED BY A LOSS OF POWER. IN OTHER WORDS, WE DIDN'T HAVE ANY POWER TO THE DEEP INJECTION WELL PUMPS AND BECAUSE WE LOST BECAUSE THE -- SO BASED ON THAT WE DISCHARGED 10 MILLION GALLONS.

AS A RESULT, THE D.E.P. SENT US A CONSENT ORDER. WHAT WE DID THERE WAS WE ADDED TWO NEW TRANSFORMERS SO WE HAVE TWO SEPARATE ELECTRIC FEEDS, ONE FROM CAUSEWAY ONE FROM THE KING PLANT AND WE ALSO HAVE A TWO MEGA WATT EMERGENCY GENERATOR THAT COSTS US ABOUT $3 MILLION. AND THE NICE PART ABOUT THE EMERGENCY GENERATOR IS THAT WE CAN MOVE THAT WHEN WE GO TO THE NEW NEW WATER RECLAMATION FACILITY. THAT WAS A LOT DIFFERENT THAN WHAT WE HAD A FEW WEEK AGO. ESSENTIALLY THE SYSTEM WAS JUST OVERWHELMED WITH RAIN.

THAT'S REALLY WHAT IT CAME DOWN TO. ALL FOUR OF OUR PUMPS WERE WORKING FINE. WE WERE SENDING AS MUCH INTO THE DEEP INJECTION WELL AS WE POSSIBLY COULD. I THINK IT'S CRITICAL TO UNDERSTAND THAT THE WATER THAT NOT WITH INTO WAS FULLY TREATED. WE HAD TO DECHLORINATE.

WE CHLORINATE THE WATER BEFORE IT GOES INTO THE DEEP INJECTION WELL.

IF WE SEND IT TO THE RIVER WE DECHLORINATE IT SO IT REALLY IS FRESH WATER.

THIS IS JUST THE CASE OF THE SYSTEM BEING OVERWHELMED. I THINK ANOTHER THING THAT'S IMPORTANT TO UNDERSTAND IS THAT THERE'S FACILITIES UP AND DOWN THE COAST OF FLORIDA THAT DON'T HAVE DEEP INJECTION WELLS. THOSE CASES THE E FLRX FLRX LUEET JUST GOES INTO THE RIVER -- ONE EXAMPLE IS THE CITY OF MIAMI. THEY'RE IN THE PROCESS OF PUTTING IN DEEP INJECTION WELLS BUT THEY DON'T HAVE ANY YET.

SO ALL THE TREATED EFLUENT IS GOING INTO BISCAYNE BAY. BUT IT'S CLEAN.

YOU CAN DRINK THIS WATER IF YOU REALLY WANTED TO IT'S KIND OF A LITTLE BIT GREYISH.

>> GIVE US A DEMONSTRATION? >> I THOUGHT ABOUT BRINGING SOME OF IT WITH ME.

[00:20:10]

QUESTION. WHY FROM THE DATE TO TODAY YOU HAD TO SAY SOMETHING TO THE COMMISSION? I DON'T KNOW ABOUT THE REST OF YOU THAT'S VERY IMPORTANT

TO ME. >> I THINK WE SENT OUT SOME PRESS RELEASES I DIDN'T COME TO THE YOU KNOW THE COMMISSION SEPARATELY WHICH I CAN CERTAINLY DO ANY TIME YOU WOULD LIKE ME TO DO THAT. I WANT KNOW WHAT YOU WOULD LIKE TO DO? I'M FINE WITH COMING IN AND TALKING TO THE COMMISSION AT ANY TIME.

I WAS DELIGHTED TO BE INVITED TONIGHT. >> IF I MAY INTERRUPT.

>> YES, SIR. >> AND I THINK WELL, I DON'T THINK BUT I'LL SPEAK ON MY BEHALF SOMETHING AS CRITICAL AS THIS I WOULD APPRECIATE IT MYSELF TOO, IF IF WE COULD BE INFORMED ESPECIALLY WHEN IT COMES TO THE PUBLIC MY PHONE RINGS OFF THE AND PROBABLY HELP YOU OUT, TOO. BUT MORE IMPORTANTLY IF THEY CALL ME AND THEY DON'T CALL YOU. SO YOU CAN KEEP US POSTED AND INFORMED AND WE CAN CAN HANDLE THE POLITICAL PART OF IT. WHAT WE NORMALLY DO WE'LL POST SOMETHING ON WE ALSO POST SOMETHING ON OUR FACEBOOK PAGE THAT'S COMMON I CAN CERTAINLY MAKE SURE A LITTLE BIT BETTER COMMUNICATION I CAN SEND

SOME INFORMATION TO MR. MIMS. >> I DON'T THINK IT'S A VIOLATION AT ALL. YOU CAN CALL ME. I'LL ACCEPT YOUR PHONE CALL.

I LIKE YOU. WE GOOD. >> MR. TOMPECK, I'M TRYING TO REMEMBER ON MANY OCCASIONS YOUR STAFF SENDS US TEXTS.

THE COMMISSION CAN COULD PROBABLY BE ADDED TO THE TEXT LIST, ACTUALLY.

>> THE TEXT LIST WE'VE BEEN NORMALLY USING FOR ELECTRIC OUTAGES THAT'S WHEREU SEEING IT. YES, WE CAN CERTAINLY. ANYTHING THAT WE NEED TO BE INFORMED OF CERTAINLY THE COMMISSION NEEDS TO BE INFORMED OF IT AND I DON'T THINK THAT WOULD ADDING THE COMMISSIONS NEXT NUMBERS IS A WAY TO KEEP THEM INFORMED ALSO I WOULD THINK. YES, WE'LL MAKE SURE THAT HAPPENS IN THE FUTURE.

>> IN LOOKING AT THIS CURRENT OR THE CURRENT DISCHARGES ON OCTOBER 4TH AND FIFTH WE ARE TRYING TO THINK ABOUT IF THERE'S SOME WAYS TO PREVENT THAT IN THE FUTURE THAT IT WAS ESSENTIALLY 100 YEAR STORM SO HOPEFULLY WE'RE NOT GOING TO SEE TOO MANY OF THOSE. REALLY EVEN ADDING ANOTHER ADDING ANOTHER PUMP TO FILL UP THE DEEP INJECTION WELL WOULDN'T HAVE MADE A DIFFERENCE HERE EVEN FIVE PUMPS WOULDN'T HAVE MADE A DIFFERENCE IT WOULD HAVE ONLY ADDED ABOUT A MILLION-AND-A-HALF GALLONS OR SO. WE'RE LOOKING AT IS THERE A WAY TO INCREASE THE EFFICIENCY OF THE PUMP. WE'RE ALSO LOOKING AT SOME ADDITIONAL STORAGE AREAS BECAUSE IF YOU HAVE, IF I CAN PUT A MILLION GALLONS OR THREE-QUARTERS OF A MILLION GALLONS IN A TANK YOU SOLVED THE PROBLEM, AT LEAST IN THIS CASE YOU HAVE SOLVED THE PROBLEM. SO BASED ON THE SPILL WE DID DO SOME SAMPLING AS REQUIRED AND ENTEROCOCCI I THINK THOSE ARE THE TWO KROOTS CONTAMINATES THEY LOOK FOR. WE TOOK THOSE SAMPLES AND FDEP GRANTED US CLEARANCE ON OCTOBER 13TH THEY WERE HAPPY WITH THE SAMPLES. YOU CAN SEE ON THE RIGHT-HAND SIDE OF THIS SLIDE WHERE WE TOOK THE SAMPLES UPSTREAM DOWNSTREAM

AND ACROSS THE RIVER. >> WE ARE REQUIRED TO DO THAT BY REGULATION.

>> IT'S REQUIRED. AS SOON AS WE DISCHARGE INTO THE RIVER WE HAVE TO NOTIFY THE STATE WARNING POINT WHICH WE DID. SO WE DID EVERYTHING ACCORDING TO OUR DEPARTMENT. I DON'T EXPECT THAT WE'RE GOING TO SEE ANYTHING FROM THE D.E.P. NOW, OF COURSE, THE WAY TO REALLY SOLVE THIS PROBLEM IS

[00:25:04]

TO RELOCATE THE W.R.F. THERE HAS BEEN A LOT OF WORK THAT'S GOING ON WITH THAT RIGHT NOW AS YOU ARE AWARE WE HAVE WE HAVE BEEN WORKING A NICE PARTNERSHIP WITH THE CITY AND THE COUNTY. WE HAVE THE FINAL REPORT WE ALREADY HAVE TWO DEEP INJECTION WELLS ALREADY AND THEY'RE DESIGNED TO HANDLE THE FLOW SPIKES THAT WE SAW HERE. BUT WE ARE PREPARING WE ARE IN THE PROCESS OF PREPARING A DETAILED PRESENTATION JOINT COUNTY PU -- FPUA AND A CITY PRESENTATION THAT WE WILL AS KIND OF A WORKSHOP WITH EVERYBODY I'M NOT SURE WHEN THAT WILL HAPPEN.

I'M GUESSING LATE NOVEMBER, EARLY DECEMBER. I THINK THE PRESENTATION IS IN VERY GOOD SHAPE. THE ONLY ONE SLIDE THAT'S HARD TO WORK ON AND THAT'S THE ONE HOW WE'RE GOING TO PAY FOR THIS. WE'RE WORKING ON THAT SLIDE AND WE'RE WORKING ON SOME IDEAS TO COME UP WITH THE ANSWERS THERE.

SO THAT WILL IN ADDITION TO MOVING THE WATER RECLAMATION FACILITY OFF THE ISLAND IT WILL FREE UP SOME SPACE FOR YOU KNOW RE-- I THINK THAT'S GOING TO BE AN EXCITING OPPORTUNITY AND HOPEFULLY NOT TOO DISTANT FUTURE. THAT'S ALL I HAVE ON THE ON

THE DISCHARGE INTO THE RIVER. >> MR. PERONA.

>> THANKS, JOHN, FOR YOUR PRESENTATION. SO THE WORD EFFLUENT IT'S EFFLUENT THAT IS THE BY-PRODUCT OF SEWAGE WHEN IS IT SEWAGE AND WHEN IS IT

EFFLUENT? >> IT'S EFFLUENT IT'S JUST TREATED EPLUNT OR NOT TREATED EFFLUENT. ANYTHING THAT COMES INTO THE PLANT IS EFFLUENT.

>> OKAY. RIGHT. SO WE USE THE WORD ALL THE TIME. SOMETIMES INTO SHOWING THAT THE DISCHARGE WAS NOT SEWAGE AND YOU KNOW WE WERE JUST TRYING TO IDENTIFY THAT BECAUSE ALL OF US ARE VERY CONCERNED ABOUT OUR WATERWAYS BY DOING THIS TYPE OF THING.

I KNOW YEARS AGO WHEN THESE PLANTS WERE BUILT, THE INDIAN RIVER WAS A BIG PART OF THAT SOLUTION. WE TREATED IT SOMEWHAT WHEN THE TIDES WERE GOING OUT WE JUST DUMPED IN THE RIVER AND IT WENT OUT INTO THE OCEAN AND BECAME PART OF THE SYSTEM. I HAVE A 1934 DRAWING IN MY OFFICE THAT SHOWS THE SEWER

ENDING IN THE MIDDLE OF THE RIVER. >> RIGHT.

RIGHT. IT'S INTERESTING WHEN YOU GET ON BECAUSE YOU I KNEW THIS WAS COMING UP GOOGLED FLORIDA AND SPILLS IF YOU WANT SOME INTERESTING READING WHAT WE PUT INTO THE RIVER ON THOSE TWO TWO DATES COMPARED TO LIKE FIRST OF ALL AND THE OTHER ONES IT'S REALLY SCARY NOT ONLY INTO THE WATERWAYS BUT ALSO INTO THE ROADS AND IT WAS NOT TREATED AT ALL. SO I MEAN, I WAS TAKEN BACK BY THE AMOUNT IN JUST FIVE YEARS IT'S ALSO 1.5 BILLION GALLONS THAT'S A LOT.

BACK WHEN WE WERE BUILDING THE INFRASTRUCTURE FOR OUR STORM WATER AND EVERYTHING ELSE LIKE THAT, THE SEWER SOMETIMES RAN TOGETHER AND THERE WAS SOME CROSS OVER AND EVERYTHING ELSE. SO WHEN YOU GET THOSE SURGES YOU WOULD HAVE TO SAY IF IT'S A 9 MILLION GALLONS A DAY HALF OF THAT IS REAL SEWAGE AND HALF OF IT IS JUST STORM WATER. SO YOU STILL HAVE TO TREAT IT AS IF IT'S ALL SEWAGE, IS THAT RIGHT. WE TREAT IT ALL THE SAME WAY. YOU WERE TREATING A LOT OF RAINWATER AND ALL THAT. YOU HAD TO MAKE A CONSCIOUS DECISION TO DUMP THIS INTO THE RIVER, RIGHT? IT FLOWS OUT OF THE INTAKE FOR THE PUMPS AS I THAT FILLS UP IT FLOWS UP INTO A WEIR INTO ANOTHER CHAMBER WHERE IT'S TREATED TO TAKE THE CHLORINE OUT. AT THAT POINT IN TIME IT FLOWS INTO THE RIVER.

[00:30:03]

SO IT'S REALLY WHEN ESSENTIALLY THE WET WELL FILLS UP.

>> IT WASN'T A FAILURE OF ANYTHING NECESSARILY JUST AN OVERWHELMING OF THE SYSTEM THAT WE HAD. THAT'S EXACTLY RIGHT. IT WASN'T A FAILURE.

IT WAS JUST TOO MUCH RAIN. MY LAST QUESTION IS YOUR RENEWALS AND REPLACEMENTS OBVIOUSLY WITH OVER 100 MILES OF THESE PIPES THINGS LIKE THAT THAT ARE ALL OVER THE PLACE, BASICALLY FOR YEARS AND YEARS THE UTILITY AUTHORITY WAS ONLY RESPONDING TO MAJOR BREAKS OR IF WE WERE GOING TO GO AHEAD AND RESURFACE A ROAD YOU HAD A CHANCE TO GET DOWN IN THERE AND CHANGE OUT THE PIPES, OTHER THAN THAT, AT ONE MILE A YEAR I DON'T THINK JOHN YOU WILL BE AROUND WHEN WE GET THAT JOB

DONE. >> YOU'RE RIGHT. OF COURSE FIRST ANSWER IS NOT ALL THE 110 MILES OF CLAY PIPE IS LEAKING OR SOME OF IT IS LEAKING.

THE PIPELINING THING HAS BEEN A GAME CHANGER FOR US BECAUSE IT'S ONE TENTH OF THE COST OF RIPPING UP THE STREET AND REPLACING THE LINE.

SO IT'S REALLY JUST, IT'S JUST A QUESTION OF HOW MUCH THAT WE CAN SPEND? WE HAVE DOUBLED THAT BUDGET IN RECENT YEARS SO WE COULD LINE MORE PIPE THAN WE HAD IN THE PAST. BUT IT'S STILL A STRUGGLE. THAT'S WHY THE THAT D.E.P.

OR GRAND COULD BE VERY HELPFUL TO US. HOW MUCH CAN YOU DO FOR 3.8

MILLION DOLLARS? >> I THINK IT DEPENDS PRIMARILY WHAT LOCATION IT IS. BUT YOU KNOW IF YOU CAN DO THE MATH YOU THINK WE CAN DO FOUR OR FIVE MILES. IF IT'S ALL ESSENTIALLY IN THE CRA I THINK THAT WOULD BE VERY HELPFUL BECAUSE THAT'S VERY CLOSE TO THE RIVER.

>> THANK YOU. >> AND YOU WE HAVE A PLAN TO DO THAT BUT YOU IDENTIFY

REALLY WHERE THE WEAKER SPOTS ARE, RIGHT? >> WE HAVE A PRIORITY LIST

FOR THE PIPES THAT WE'RE GOING TO LINE. >> RIGHT.

IDENTIFY THAT. YES, SIR. >> ONE QUICK QUESTION, JOHN YOU AND I HAD SOME CONVERSATION ABOUT THIS AND WE WERE TALKING I DIDN'T GET A CHANCE TO ASK YOU AND I DIDN'T THINK ABOUT IT IF YOU DON'T HAVE THE ANSWER THAT'S OKAY. WHAT IS THE LIFE SPAN OF THE WASTE WATER PLANT TODAY.

WHAT ARE WE PERMITTED THROUGH? DO YOU HAVE AN APPROXIMATE

DATE? >> I DON'T HAVE THAT. I THINK I WOULD BE GUESSING ON THAT ONE. I THINK WE JUST GOT A PERMIT RENEWAL NOT THAT LONG AGO.

WE COULD HAVE A DECENT LIFESPAN IT'S NOT GOING TO BE IN THE NEAR FUTURE WE

HAVE TO REPLACE OR MOVE THE PLANT. >> RIGHT.

>> THAT'S NOT REALLY THE CRITERIA. >> IT'S A BALANCE OF THE GROWTH AND WHAT WE DO IN THE CITY TO CONTRIBUTE TO THE, YOU KNOW, THE CAPACITY OF THE PLANT OR WHAT GOES AGAINST THE CAPACITY, RIGHT? WE HAVE BEEN AT 4.5 MILLION GALLONS FOR WHITE QUITE A WHILE. YOU THINK ABOUT THE JONG JEST OF PUMPS AND MECHANICAL DEVICES WHEN DO THEY FAIL WHEN YOU DO REPLACE IT.

IN COMPARISON TO A NEW WASTE WATER TREATMENT PLANT BEING BUILT SOMEWHERE ELSE YOU KNOW IT'S FUNNY WE TALK ABOUT ALL THOSE THINGS BUT THE NEW PIPING THAT DOESN'T NEED TO BE LINED THAT ISSUE IS STILL AN ISSUE BECAUSE WE HAVE AN OLDER CITY AND WE HAVE A LOT OF CLAY PIPE. THAT'S POSSIBLE, YEAH. YOU CAN SEE THE WATER WEEPING LIKE A BATHTUB DRAINING YOU CAN SEE IT GOING INTO THE MANHOLES.

I MEAN IT LITERALLY WAS JUST GOING DOWN THE DRAIN.

>> THE LIFT STATIONS WERE INUNDWAD WATER AS WELL. >> THEY WERE.

>> YES, SIR. >> I HEARD YOU SAY A FEW MINUTES AGO THAT THIS WAS 100 YEAR RAIN. BUT JUST A COUPLE YEARS AGO WHICH HAD 100 YEAR RAIN -- WE HAD 100 YEAR RAIN AND THE CREEK WAS FLOODED AND UNDER WATER.

HOW MANY 100 YEAR RAINS ARE WE GOING TO HAVE BACK-TO-BACK? OR BACK-TO-BACK HURRICANES LIKE WE DID IN 2005, 2004 WE'RE NOT PREPARED FOR IT. TALKING ABOUT REPLACING FOR THE PAST 18 YEARS THAT WAS

[00:35:11]

THE FIRST TYPE THEY WHEN I CAME ON BOARD IT WOULD BE DONE IN FIVE YEARS.

SO WE ARE ALREADY A FEW YEARS BEHIND THE EIGHT BALL A LOT OF PEOPLE THINK WE WILL SEE MORE 100 YEAR STORMS THAN WE HAVE IN THE PAST.

THOSE DEFINITIONS WERE MADE MANY YEARS AGO WHAT THEY CONSIDER TO BE 100 YEAR STORM MAY NOT BE 100 YEAR STORM ANYMORE. WITH REGARDS TO YOUR OTHER COMMENTS COMMISSIONER ALEXANDER I KNOW THIS WON'T BECOME APPARENT YET BUT WE GENUINELY HAVE MADE MORE PROGRESS IN THE LAST YEAR THAN IN THE LAST 15 IN TERMS OF WORKING TOGETHER WITH THE CITY AND THE COUNTY AND COMING UP WITH THE LOCATION

AND WHAT WE NEEDED TO DO. WE'RE REALLY DOWN. >> YES, YOU HAVE.

>> WE ARE REALLY DOWN TO THE POINT WHERE WE NEED TO FIGURE OUT HOW WE WILL PAY

FOR IT. >> IF ANYBODY HAS $131 MILLION WE'LL GLAD TO WRITE

YOU A VERY NICE THANK YOU NOTE. >> SO SECOND PART IS TO TALK ABOUT ELECTION SERVICE DISCAN CONNECTION SERVICES AND I WANTED TO GO THROUGH A QUICK TIMELINE WITH YOU. BACK ON MARCH 18TH WE SUSPENDED SERVICE FOR LACK OF PAYMENT AT THAT POINT IN TIME WE ALSO WAIVED ALL THE PENALTIES FEES THAT ACCUMULATED TO ABOUT 460,000. IN APRIL, ON APRIL 22ND, WE ADJUSTED THE P.C.A. DOWN $2. THE IDEA THERE WAS TO PUT SOME MONEY BACK INTO OUR RATEPAYERS POCKETS WE PUT ABOUT 1.2 MILLION THERE THE IDEA THERE WAS THAT IF YOU ARE OFF THE DISCONNECT LIST. OF COURSE NO PENALTIES OR LATE FEES WERE INCLUDED IN THAT PAYMENT PLAN. WE ESTABLISHED A FUND FOR MUSS TARD SEED FOR UTILITY ASSISTANCE SO FAR TO DATE, WE HAVE GIVEN MUSTARD SEED $100,000 THEY HAVE -- AND ALBI SO THERE'S STILL MONEY AVAILABLE THERE AND WE HAVE TRIED TO WE TRIED TO MAKE THE CRITERIA FOR APPROVAL VERY EASY. THE ONLY THING WE ASK FOR IS ANYTHING THAT COULD GIVE US THAT SHOWED THEY WERE AFFECTED BY COVID-19.

WHETHER IT BE WE DIDN'T ASK FOR NECK ELSE. WE TRY TO KEEP IT AS EASY AS WE CAN COULD SO THEY COULD PROIT'S IT. THEY HAVE BEEN A LITTLE OVERWHELMED, TOO BUT THEY HAVE DONE A GOOD JOB. I THINK WE'RE ALL FAMILIAR WITH THE WITH THE SCARES JULY 10TH AND SOCIAL SERVICES CARES ACT IS ABOUT 10.6 MILLION THAT WAS FUNDING THAT GOES DIRECTLY TO THE P.M. CANT THEY WERE GETTING UP TO $FOUR,000 F FOR INDIVIDUAL THE 200,000 $FOUR YOU00,000 ONE TIME FOR

[00:40:06]

PAYMENT MADE TO MUSTARD ABOUT 168 PEOPLE, RIGHT SO FAR, YES.

SO WHAT'S THE TOTAL AMOUNT AVAILABLE THERE IS STILL $115,000 OUT THERE AVAILABLE. THAT'S THE KEY FOLLOW ME HERE OUT OF $200,000 WE HAVE ABOUT $115,000 LEFT. FOR WHATEVER REASONS MUSTARD SEED AND ALPIE HAVE FAILED OR YOU'RE ELUDING TO THE FACT THAT MAYBE THE REQUIREMENT WAS TOO STRICT BECAUSE YOU WENT ON TO SAY THAT THE REQUIREMENT ITSELF WAS THE LEAST RESTRICTIVE IN YOUR OPINION AS POSSIBLE, I TAKE IT. AM I CORRECT?

>> WELL, THAT'S CORRECT. WE WANTED TO MAKE SURE THAT WE WEREN'T TRYING TO GET IN ANYBODY'S BUSINESS. WE JUST WANTED TO MAKE SURE THAT THEY WERE EFFECTIVE TO

MAKE IT FAIR FOR ANYBODY. >> I HAVE NEVER ENCOUNTERED A SITUATION WHERE ALL MY YEARS WHERE THERE WAS FREE MONEY AND THERE WAS MONEY LEFT OVER.

WHERE THAT BEING SAID THERE WAS SOMETHING THAT WAS PUT IN PLACE AND YOU MAY KNOW BETTER THAN I DO. I HAVE A GOOD IDEA WHERE THERE WAS A PROBLEM WITH DISPERSING THE MONEY BECAUSE DURING THIS SEASON, DURING COVID SEASON WITH THE PEOPLE'S LIGHT BILLS BEING AS HIGH AS IT IS AND YOU ABOUT TO TELL ME X AMOUNT OF PEOPLE ARE ABOUT TO GET THEIR LIGHTS CUT OFF, IT'S STILL THAT TYPE OF MONEY SOMEBODY HAS FAILED I DON'T NO IF IT WAS A LACK OF PUTTING PEOPLE ON NOTICE OR PERHAPS WHAT YOU ARE ELUDING TO BUT AT THE END OF THIS PROCESS. AT THE END OF THIS PROCESS IF WE HAVE NOT GIVEN THIS MONEY OUT THAT WAS EITHER MARKED FOR THIS PURPOSE FOR THIS PURPOSE TO ASSIST PEOPLE THEN THERE'S A PROBLEM HERE AND I'M HOPING THAT YOU CAN EDUCATE ME AND TELL ME WHAT THE PROBLEM IS SO PERHAPS WE CAN FIGURE OUT A SOLUTION AND GET THIS MONEY OUT TO THE PUBLIC. THE ONLY PROBLEM THAT HAS BEEN IDENTIFIED TO US IS FOR ADMINISTRATIVE REASONS MUSTARD SEED AND ALPIE WERE ASKING PEOPLE MAKE APPOINTMENTS AND I THINK BUT OVERALL I DON'T THINK THAT'S A MAJOR ISSUE BECAUSE I THINK AS HAS BEEN INDICATED TO US IT'S A MAJOR ISSUE BUT INITIALLY I THINK THAT WAS PART OF THE PROBLEM. I THINK PART OF THE PROBLEM PEOPLE ARE JUST NOT COMING IN FOR IT. WE'VE ADVERTISED THIS MULTIPLE TIMES. WE'VE ADVERTISED IT ON FACEBOOK, ON OUR WEB PAGE, WE'VE ADVERTISED THIS ON THE RADIO. SO I THINK WE'VE DONE --

>> WELL, WE SEND EVERYBODY A LETTER. >> AND IT WAS ALSO IN THE BILLINGS SEARCH. SEW I THINK WE'VE DONE A DECENT JOB OF ADVERTISING WE

JUST NEED MORE PEOPLE TO COME IN. >> THAT'S WHAT I'M TRYING TO FIGURE OUT HOW DO WE GET MORE PEOPLE TO COME IN. WHEN WE HAVE THESE FOOD DRIVES WE HAVE PEOPLE HALF A MILE DOWN THE ROAD AND PEOPLE NEED THE NECESSITIES OF LIFE IN ELECTRICITY IS ONE OF THOSE NECESSITIES, FOOD, WATER, SO I -- I MEAN, FOR THE LIFE OF ME, IT'S SOMETHING GONE WRONG HERE. WE JUST CAN'T LEAVE THAT KIND OF MONEY ON THE TABLE AND ABOUT TO CUT PEOPLE'S LIGHTS OFF.

[00:45:04]

I AGREE. I WISH WE HAVE MORE PEOPLE COME IN AND APPLY FOR THE ASSISTANCE THAT WAY. I CAN CERTAINLY CONTACT MUSTARD SEED AND ALPIE SEE IF THIS HAVE ANY FEEL FOR WHY PEOPLE HAVEN'T COME IN OR IF THEY HAVE SOME KIND OF A BACKLOG THAT'S HOLDING THIS UP, I DON'T THINK THERE IS IN TERMS OF PROCESSING

THE APPLICATIONS. >> BUT YOU KNOW, MR. TOM PECK A LOT OF TIMES YOU DELEGATE THINGS TO THIRD PARTIES AND SOMETIMES THEY DON'T MAKE IT A PRIORITY.

I'M NOT PICKING ON MUSTARD SEED AND ALP IE THAT'S JUST LIFE.

I SAY THAT ABOUT CITY HALL A LOT OF TIMES WE NEED TO TAKE CARE OF THIS STUFF OURSELVES INSTEAD OF DELEGATING THAT'S WHAT WE GET PAID TO DO. I DON'T KNOW WHAT'S GOING ON BUT MAYBE ALPIE AND MUSTARD SEED WOULD PROBABLY BE THE BEST QUESTION TO ASK THE QUESTION WHAT -- BEST PEOPLE TO ASK THE QUESTION WHAT WENT WRONG? WE ARE ABOUT TO CUT ALL PEOPLE'S LIGHTS OFF WITH ALL THAT MONEY ON THE TABLE.

>> WHEN WE STARTED THE PROGRAM WE WENT OUT, MYSELF, AND JAVI WENT TO THEM WENT THROUGH THE PROCESS WITH THEM MAKE SURE THEY UNDERSTOOD WHAT THEY WERE LOOKING AT. I THINK THEY UNDERSTAND THE PROCESS AND WE FELT THAT THEY WERE YOU KNOW THEY WERE STAFFED SUFFICIENTLY TO PROCESS THESE APPLICATIONS.

MUSTARD SEED AND ALPIE ARE BOTH EXPERIENCED IN THIS PARTICULAR HELPING PEOPLE WITH THEIR UTILITIES. MUSTARD SEED DOES THAT FOR US ON A REGULAR BASIS.

>> THAT'S RIGHT. THIS IS JUST EXPANDING. >> THIS WAS AN EXPANDING FOR COVID. I'VE TALKED TO STATEY AT MUSTARD SEED AND THEY ARE, THEY ARE HELPING PEOPLE WITH A LOT OF DIFFERENT THINGS BUT THEY FEEL LIKE THIS IS A PROCESS THAT THEY'RE MOVING RIGHT ALONG IN. STACEY SAID THE MONEY IS GOING TO BE GONE. THAT THE MONEY IS GOING TO BE GONE.

THEY'RE JUST WORKING THEIR WAY THROUGH IT. SO, AND ALPIE IS EXPERIENCED AT THAT, TOO. SO I THINK MAYBE WHAT WE'RE ALSO DEALING WITH IS THE FACT THAT COVID IS AFFECTING PEOPLE IN OTHER PARTS OF THEIR LIVES TOO AND HAS BEEN. HAS BEEN AFFECTING IT IN OTHER PARTS OF THEIR LIFE.

WITH THE CARES ACT, WITH THE ST. LUCIE COUNTY CARES ACT WHICH YOU MAY OR MAY NOT TALK ABOUT THAT IN A LITTLE BIT, TOO, IS THAT IS A, THAT'S EVEN AN EASY PROCEDURE SESS, RIGHT? ISN'T THAT SOMETHING THAT THE COUNTY IS DEALING WITH

PEOPLE ON? >> I UNDERSTAND THAT PROCESS HAS BEEN FAIRLY SMOOTH, YES.

>> YES, RIGHT. SO THERE'S MONEY THERE, TOO. GOOD MONEY THERE, TOO.

>> MAYOR, WHAT I SUBMIT TO YOU AND MR. TOMPECK IS, THIS I'VE SEEN GARDEN CITY AND WHO WAS IT MUSTARD SEED WHEN THEY PAY THE BILL AND THEY WHERE THEY GIVE OUT THAT

MONEY ON AVENUE Q. >> I'M NOT -- IT. >> HAPPENS ABOUT ONCE A

YEAR. >> I'M NOT FAMILIAR. >> I THINK IT'S ALPI EVGS.

>> I HAVE SEEN THE LONG LINES FROM 21ST STREET ALL THE WAY TO 25TH STREET WITH PEOPLE ARE STANDING UP HOURS AND HOURS AND HOURS AT A TIME TRYING TO GET THEIR LIGHT BILL PAID. THAT'S WHY THIS IS VERY CONFUSING TO ME.

BUT, AGAIN, ONLY THING THAT I COULD LOGICALLY DRAW A CONCLUSION IS THAT THE REQUIREMENT ITSELF IS WHAT THE PROBLEM IS BECAUSE THAT'S THE ONLY THING IN THE EQUATION THAT COULD POSSIBLY BE DIFFERENT. BECAUSE WHEN YOU SEE THOSE PEOPLE OUT THERE THEY'RE OUT WILL ALL DAY, ALL NIGHT, THE LINE IS FOUR BLOCKS LONG BUT YET HERE WE ARE HERE WITH MONEY ON THE TABLE. THERE HAS GOT TO BE SOMETHING HERE WITH REGARDS TO THE REQUIREMENTS ARE TOO STRICT OR SOMETHING BECAUSE THEY'VE NEVER HAD A PROBLEM AS YOU BOTH INDICATED GIVING OUT MONEY BEFORE.

SO, WHAT ARE THEY DOING DIFFERENTLY? I THINK THESE REQUIREMENT THAT'S YOU HAVE SIR THAT MAY BE A LITTLE BIT TOO STRICT. BUT WE NEED TO LOOK AT THIS SITUATION BECAUSE IF WE'RE GOING TO ALLOW PEOPLE POSSIBLY CHILDREN ELDERLY, TO GO WITHOUT ELECTION CITY IN THE CITY OF FORT PIERCE WITH THIS KIND OF MONEY SITTING ON THE TABLE THEN WE ALL NEED TO GET UP AND GET OUT OF HERE, INCLUDING ME

AND YOUR BOARD BECAUSE WE CAN'T DO OUR JOBS. >> WELL, I'LL CERTAINLY I APPRECIATE THE COMMENT. WE'RE CERTAINLY GET BACK WITH MUSTARD SEED AND ALPIE

[00:50:02]

AND REREVIEW THE CRITERIA. WE'RE REALLY NOT ASKING FOR VERY MUCH HERE.

JUST ANY KIND OF PROOF THAT THEY CAN SHOW US THAT THEY'RE AFFECTED BY COVID, THAT'S IT. NOTHING MORE THAN THAT. WE DON'T WANT THEIR LIFE'S HISTORY OR THEIR TAX RETURNS WE JUST WANT TO SHOW US SOMETHING THAT INDICATES THEY WERE AFFECTED BY COVID. THE OTHER THING I DON'T KNOW THE ANSWER TO BUT IT'S PROBABLY WORTH LOOKING INTO IS HOW MANY CASES THEY REJECTED AN APPLICATION.

>> THAT'S WHAT I WAS GOING TO SAY THAT'S EXACTLY THE DATA THAT HAS TO BE IMPLEMENTED TO LOOK AT THE FULL EQUATION. HOW MANY APPLICATIONS WERE

SUBMITTED VERSUS DENIALS. >> ALSO A CONSIDERATION OF APPOINTMENTS MR. TOMPECK MENTIONED APPOINTMENT THAT'S WERE BEING MADE SOMETHING ALONG THOSE LINES AS IF THAT MAY HAVE BEEN A FACTOR, AN ISSUE. MAYBE PEOPLE ARE MAKING APPOINTMENTS NOT NULL FILLING THEIR APPOINTMENTS OR MAYBE THEY CAN'T GET AN APPOINTMENT. I DON'T KNOW. WHAT BUT I DO KNOW -- BUT WHAT I DO KNOW IF WE GOT $100,000 SITTING THERE AND WE ARE ABOUT TO CUT PEOPLE'S

LIGHTS OFF AND THE MONEY WAS DESIGNATED FOR IT. >> MADAM MAYOR.

>> YES, SIR. >> DO WE REALIZE THAT THIS PANDEMIC IS SPILL AMONGST US? YOU KNOW, -- IS STILL AMONGST US?

>> WE ARE NOT CUTTING THAT OFF BECAUSE YOU CAN'T CUT IT OFF.

AND THAT'S THE WAY I FEEL ABOUT YOU KNOW THE PUBLIC SERVICE.

WE CAN'T STOP PUBLIC SERVICE. WE CAN'T STOP PICKING UP THE TRASH BECAUSE THEY ARE SAYING DON'T PUT YOUR TRASH OUT WHAT ARE THEY GOING TO DO WITH THE TRASH. BUT IT'S NOT THE TRASH THAT I'M CONCERNED ABOUT IT'S THE CHILDREN. WHAT IF YOU CUT IT OFF WHENEVER YOU PLAN TO CUT IT OFF THEN THE CHILDREN COME HOME FROM SCHOOL TO DO THEIR HOMEWORK THEY'RE OUTSIDE -- YOU'RE TARGETING CERTAIN GROUPS OF PEOPLE. IT'S THE POOR PEOPLE.

IT'S THE POOR PEOPLE THAT CAN'T PAY THEIR BILLS AND DON'T HAVE JOBS.

THEY ARE TRYING TO FEED THE CHILDREN. SOME FAMILIES MAY HAVE FIVE, SIX CHILDREN. BUT THERE'S NO EMPATHY AND I DON'T SEE EMPATHY AT ALL COMING FROM THE LEADERS OF THIS COMMUNITY. SURE THEY ARE.

BUT DON'T TURN THEIR LIGHTS OFF AND KIDS WILL COME HOME TO WHAT A DARK YOU WILL HAVE TO BE IN THE BACK. I JUST, YOU KNOW, IT'S EMBARRASSED HERE WE ARE WITH A COMMUNITY SERVICE UTILITIES AND THE COMMUNITY CAN'T USE THEIR UTILITIES.

THAT'S ABSURD. I'M THROUGH. >> COMMISSIONER PERONA.

>> YEAH, I THINK THE INFORMATION THAT WE REALLY NEED IS NOT HOW MANY GOT REJECTED BUT THE REASONS WHY THEY GOT REJECTED. AND I WOULD SUGGEST THAT, AND I DON'T MEAN TO BE PUTTING A LOT OF PRESSURE ON YOUR STAFF, BUT THIS IS THE ONLY PLACE IT SHOULD GO IS THAT YOU SHOULD HAVE SOMEBODY ASSIGNED TO OUTREACH FOR THE COMMUNITY, ESPECIALLY FOR THESE TYPE OF ISSUES.

TAKE THOSE LISTS OF REJECTS GO THROUGH THEM MAKE SURE THEY ARE BUT THEY GET ANOTHER LOOK BY THE FPUA AND THAT NEEDS TO HAPPEN. I WOULD SAY IN MY MIND IF I WAS ON YOUR BOARD RIGHT NOW I WOULD BE SAYING JOHN WE NEED TO GET A PERSON THAT'S DEDICATED TO CITIZEN OUTREACH IN OUR SERVICE AREA.

BECAUSE RELEASE A LOT OF THESE FOLKS THAT ARE REALLY DESERVING AND I THINK WE TALKED ABOUT THIS BEFORE, THEY CAN'T GET A RIDE TO THEIR APPOINTMENT.

I'M NOT SAYING ALL WHERE MOST OF THE FOLKS IS DIRE. THIS IS WHERE WE AS A COMMUNITY. THE DIFFERENCE BETWEEN FPL AND FPUA IS THE COMMUNITY ASPECT. THAT'S WHAT I EXPECT FROM MY COMMUNITY UTILITY PROVIDER.

AND I'M SURE THAT'S, IT'S PROBABLY BEING DONE BUT THAT'S THE COMMUNICATION I WOULD LIKE TO HEAR RIGHT NOW. THOSE REJECTED WHY AND DID THE UTILITY AUTHORITY IN THEIR OUTREACH PROGRAM WERE THEY THE LAST ONES TO SAY

[00:55:04]

YEA OR NO. >> OKAY. I CAN GET THAT INFORMATION FOUR. I DO THINK YOU NEED TO HAVE THAT PERSON OR PERSONS TO HELP THOSE PEOPLE THAT ARE FALLING THROUGH FALLING THROUGH THE HOLES IN THE SCREEN THAT ARE OUT THERE LOST WE HEARD FROM AND IT TUGS AT THE HEARTSTRING A LITTLE BIT. A DIFFERENCE BETWEEN AN I.O.U. AND A MUNICIPALITY UTILITY IS THIS THIS THAT IS THE DIFFERENT BETWEEN THE TWO ONE OF THE THINGS MESSING FROM THE PRESENTATION IS THAT WE'RE GOING THROUGH A PROCESS AND HAVE DECIDED ON A TIME FRAME ARE YOU GOING TO DO THAT? I WANT EVERYBODY TO UNDERSTAND THE GREAT LINKS THAT HAVE BEEN HAVE BEEN GONE TO TRY TO DO THIS.

WE WERE ORIGINALLY GOING TO START THOSE ON THE 27TH JULY. THE BOARD SAID IT'S TOO EARLY NO DISCONNECTS UNTIL SEPTEMBER 5TH. AS WE SAW THE LIST OF DISCONNECTS GET LARGER AND LARGER SO WE BY THE MIDDLE OF AUGUST THE DISCONNECT LIST HAD GOTEN UP TO ABOUT 2,000 PEOPLE. WE CERTAINLY DIDN'T WANT TO DISCONNECT 2,000 PEOPLE SO WE TOOK THE ADDITIONAL 2,000 PLUS PEOPLE AND PUT THEM ON AN AUTOMATIC PAYMENT PLAN. AND WHAT THAT DID WAS IT IMMEDIATELY TOOK THEM OFF THE DISCONNECT LIST AND IT GAVE THEM AT LEAST AN ADDITIONAL 60 DAYS TO MAKE A PAYMENT. THEY WEREN'T REQUIRED TO MAKE THEIR FULL BACK PAYMENT ONLY REQUIRED TO MAKE THEIR LATEST PAYMENT PLUS 112TH ESSENTIALLY OF THEIR BACK PAYMENT. BECAUSE THAT WAS SPREAD OVER 12 MONTHS WITH NO INTEREST. SO WE SENT THOSE LETTERS OUT AND IT TOOK US WE DID IT BY BILLING ROUTE SO IT TOOK US ABOUT SIX WEEKS TO GET THOSE LETTERS OUT.

AS A RESULT NOBODY WOULD BE CUT OFF UNTIL THEY GOT THOSE ORIGINAL LETTERS.

NOW WE'RE TWO MONTHS LATER AND THE FIRST ROUND OF THOSE LETTERS IS READY FOR DISCONNECT. AND OUR DISCONNECTS ARE CURRENTLY THE FIRST DISCONNECTS ARE SCHEDULED FOR WEDNESDAY. ONCE AGAIN THIS IS NOT, THIS IS NOT A WHOLESALE DISCONNECTION OF EVERY CUSTOMER.

IF WE LOOK I CAN GIVE YOU JUST A COUPLE OF SAMPLE NUMBERS BECAUSE WE HAVEN'T REALLY GOTTEN OUT TO THE END OF THE WEEK OR END OF THE MONTH.

BUT RIGHT NOW WE HAVE ABOUT 57 CUSTOMER THAT'S WERE DUE TO BE DISCONNECTED ON WEDNESDAY. 17 OF THOSE CAN CUSTOMERS HAVE ALREADY PAID AND I EXPECT SOME MORE OF THEM WILL PAY. SAME THING ON THURSDAY.

I THINK WE HAVE ABOUT 77 OR THERE ABOUT NUMBER OF CUSTOMERS.

THIS IS A COMBINATION OF NOT ONLY RESIDENTIAL BUT COMMERCIAL AS WELL.

WE EXPECT A LESSER NUMBER THAN THAT SO I THINK YOU WILL SEE THE NUMBERS WILL BE LESS THAN WHAT WE'RE ANTICIPATING. WE'RE DOING OUR BEST TO GIVE THE CUSTOMERS THE MAXIMUM AMOUNT OF TIME TO CALL, COME IN MAKE ARRANGEMENTS WHAT IS NECESSARY. SO THE LATEST DISCONNECTS WOULDN'T BE WOULDN'T HAPPEN UNTIL THE END OF NOVEMBER. I'M SORRY.

>> YES, SIR. >> YOU SAY 57 THEN YOU WENT TO 77 ON THE NEXT DISCONNECT,

WHAT'S THE TOTAL? >> I'M NOT SURE FOR THE WEEK.

BUT JUST TO GIVE YOU AN IDEA THE ROUTES ARE SOMEWHERE BETWEEN 240 AND 320 CUSTOMERS. SO THAT'S ABOUT WHAT YOU WOULD BE TALKING ABOUT IN A

[01:00:03]

NORMAL WEEK OF DISCONNECTS IF WE CARRY THAT FORWARD. 320 A WEEK?

>> MAXIMUM, YES. >> HOW MANY TOTAL, TOTAL? >> WELL, THE TOTAL RIGHT NOW IS ABOUT 2700, ALMOST 2800. BETWEEN THE VOLUNTARY PAYMENT PLAN AND THE

AUTOMATIC PAYMENT PLAN. SAY WHAT? >> 2800.

>> EVERYBODY GETS A CALL, RIGHT? >> EVERYBODY GETS A CALL.

YES. EVERYBODY GETS A CALL. >> AND CALLS HAVE BEEN BEING MADE OVER THE TIME TO THESE CAN CUSTOMERS. YES, THEY HAVE.

FROM THE CUSTOMERS. THEY HAVE. YOU USED LANGUAGE YOU DON'T WANT TO TAKE THE CASH REGISTER OUT OF THE SYSTEM YOU'RE A BUSINESSMAN AND I UNDERSTAND. BUT I GOT A MORE PRESSING ISSUE THAN TAKING THE CASH REGISTER OUT OF THE SYSTEM I GOT AN ISSUE WITH SOME ELDERLY PERSON THAT'S GOING TO BE WITHOUT LIGHTS I GOT AN ISSUE WITH A BABY THAT'S GOING TO BE WITHOUT LIGHTS AND I GOT AN ISSUE WITH INDO GENT PEOPLE THAT ARE GOING TO BE WITHOUT LIGHTS SO I'M NOT REALLY WORRIED ABOUT TAKING THE CASH REGISTER ABOUT THE SYSTEM WHAT I'M CONCERNED ABOUT IS HUMAN LIFE. WHEN YOU GET HERE AND YOU TELL ME 2800 PEOPLE ALMOST 320 PEOPLE A WEEK AND I SIT HERE AS CITY COMMISSIONER I HAVE FAILED. I CAN'T STAND THAT. I'M NOT GOING TO GO DOWN, YOU KNOW ME WITHOUT A FIGHT, ESPECIALLY WHEN IT COMES TO HUMAN LIFE.

SO WHATEVER IT TAKES FOR US TO GET THIS MONEY TO THESE PEOPLE I HOPE WE FIGURE IT

OUT, SERIOUSLY. >> JUST ANOTHER WORD, WE KNOW THAT YOU KNOW APPLICATIONS ARE IN PROCESS, WHETHER IT BE WITH THE COUNTY OR WHETHER IT BE MUSTARD SEED AND ALPIE WE HAVE A GOOD IDEA OF WHAT THOSE ARE ANYBODY WHO ALREADY IN THE PROCESS OF GETTING AN APPLICATION FOR ASSISTANCE IS NOT GOING TO

BE DISCONNECTED. >> ALL RIGHT. >> MR. PERONA.

>> I WAS -- MR. PERONA THIS COMMISSIONER ALEXANDER. >> DO YOU HAVE RECEIVABLES

IS THAT IT? >> I'M SORRY. I HAVE MORE SLIDES.

WE'LL LET YOU DO IT BECAUSE THAT WAS GOING TO BE MY QUESTION.

>> LET ME GIVE YOU AN IDEA. >> COMMISSIONER ALEXANDER DO YOU WANT TO SAY SOMETHING?

>> I -- WHEN I HEAR THE NUMBERS AT 2800 ACCOUNTS YOU KNOW, THAT IS THAT IS, THAT IS SHOWING WHAT THE NATION IS LIKE. NOT JUST THE CITY OF FORT PIERCE WE SHOULD TAKE CARE OF OUR OWN FIRST THEN WORRY ABOUT THE NATION.

BUT IT'S ALL INVENTORYING TOGETHER. I'M MORE CONCERNED ABOUT THE CHILDREN AND MEDICAL, THE EMERGENCY USE OF EQUIPMENT AND SO FORTH LIKE THAT.

YOU HAVE A LIST OF PEOPLE WHEN THERE'S A HURRICANE COMING THAT THEY ARE ON LIFE SUPPORT OR SOME TYPE OF SUPPORT IN THEIR RESIDENCE YOU DON'T TURN THEIR LIGHTS OFF DO YOU? YOU DON'T KNOW. THIS DOESN'T CHANGE THAT FOR

MEDICALLY RESIDENTIAL. >> SAME ARRIVALS ARE IN PLACE YOU HAVE TO MAKE NOTIFICATIONS AND THAT KIND OF THING SO THAT DOESN'T CHANGE.

>> OKAY. NOW WHAT ABOUT THE CHILDREN? YOU DON'T HAVE NO EMPATHY, NO SYMPATHY NO CONCERN ABOUT THE CHILDREN OF THIS COMMUNITY? YOU JUST THINK BECAUSE THEIR PARENTS MADE THEIR BED THEY GOT TO SLEEP IN IT?

>> NO, I DON'T BELIEVE THAT AT ALL. WE'RE TRYING TO WE HAVE TRIED TO COME UP WITH AS GOOD A PLAN AS WE COULD BASED ON THE SITUATION HERE.

IT'S NOT PERFECT. YOU GOT MONEY LEFT ON THE TABLE.

[01:05:05]

THEN YOU ARE TELLING ME YOU GOT 2800 TO SHUT DOWN. YOU WANT SOMEBODY TO COME IN THERE ON THEIR HANDS AND KNEES AND BEG ABOUT ELECTION CITY FOR THE CITY OF FORT PIERCE? THAT IS TRULY SAD IF THEY CAN'T, YOU CAN'T SEE PEOPLE STANDING IN LINE AND WONDER WHAT THEY WANT. THAT'S ALL I HAVE TO SAY

ABOUT IT. >> ALL RIGHTY. >> I'LL JUST GIVE YOU AN IDEA OF SOME OF THE NUMBERS ASSOCIATED WITH THE PAYMENT PLAN ACCOUNTS.

AS I MENTIONED BEFORE THE ROUTES ARE 240 TO 300 A WEEK WE EXPECT THAT NUMBER TO BE CONSIDERABLY LESS BASED ON THE AMOUNT OF PAYMENTS WE'LL RECEIVE.

AND THE CUSTOMERS THE FIRST SET OF CUSTOMERS TO BE CUT ARE ON WEDNESDAY.

THEY HAVE ALREADY BEEN NOTIFIED. >> CAN I ASK YOU A QUESTION?

>> SURE. >> AND I HOPE THERE'S A COMMON DENOMINATOR OR SOME SORT WHO WAS PRIORIZED WOULD BE IN FIRST ONES BEING CUT OFF VERSUS THE ONE THAT'S WILL BE CUT OFF NEXT MONTH OR JUST DOING EVENY MEANY MINEY MOW IT.

>> WAS WAS JUST BY OUR NORMAL ROUTES. WHEN WE STARTED IN AUGUST WE DECIDED WE ARE STARTING NOW. WHOEVER'S ROUTE WAS FIRST GOT THE FIRST ROUND OF LETTERS. ESSENTIALLY IS WHAT IT CAME DOWN TO.

>> NOTHING TO DO WITH THE AMOUNT. >> NOTHING TO DO WITH THE AMOUNT. NOTHING TO DO WITH ANY AREA OF THE CITY OR ANYTHING LIKE THAT. IT'S JUST THE ROUTE THAT WE DO THE REEDS ON.

>> SO A PERSON MIGHT OWE YOU $2,000 VERSUS $300 AND THEY CAN POSSIBLY BE ON THE LIST

TO BE CUT OFF WEDNESDAY? >> THAT'S EXACTLY RIGHT. IT'S NOT BASED ON THE AMOUNT

THAT THEY OWE OR ANYTHING LIKE THAT. >> THERE'S A PROBLEM WITH THAT IN AND OF ITSELF. THAT'S A PROBLEM IN MY OPINION ANYWAY.

BECAUSE, I MEAN, IF THEY ARE GOING TO BE CUT OFF YOU WOULD THINK THAT INDIVIDUALS THAT ARE MORE HARD PRESSED AS FAR AS YOUR CASH REGISTER IS CONCERNED WOULD BE CUT OFF QUICKER AND FASTER BECAUSE THEY OWE YOU MORE MONEY TO PUT MORE MONEY IN THAT REGISTER THAN THOSE THAT DON'T. YOU'RE A BUSINESSMAN COME.

ON NOW, I WANT YOU TO BECOME A HUMANITARIAN, TOO. BUT EVEN FROM YOUR PERSPECTIVE IF I LOOK AT IT FROM YOUR PERSPECTIVE YOU WOULD THINK THAT THAT WOULD

BE SOMETHING TO CONSIDER. >> LIKE I SAID WE DID IT BASED ON THE ROUTES AND WHETHER THAT BE RESIDENTIAL OR COMMERCIAL CUSTOMER WE DIDN'T MAKE ANY

DIFFERENTIATION THERE. >> ALL RIGHT, THANK YOU, SIR.

>> JUST A COUPLE OF OTHER ADDITIONAL NOTES. AS FAR AS I CAN DETERMINE WE'RE THE ONLY UTILITY IN FLORIDA THAT'S NOT DISCONNECTING CUSTOMERS FOR NONPAYMENT, THAT INCLUDES THE ALL THE I.O.U.S BACK IN THE THIRD WEEK OF SEPTEMBER.

THE P.S.E. WAS REQUESTED. SO ALL THE I.O.U.S ARE DISCONNECTING CUSTOMERS AND ALL THE MUNICIPAL UTILITIES THAT I'M AWARE OF IN TERMS OF WHAT'S CONNECTED WITH FMPA AND OTHERS ARE ALREADY DISCONNECTING. SOME OF THE OTHER UTILITIES OFFERED PAYMENT PLANS BUT AS FAR AS WE CAN DETERMINE FPUA IS THE ONLY UTILITY THAT CAME UP WITH THE MANDATORY PAYMENT PLAN. SO WE BOUGHT ALL OF OUR CUSTOMERS THAT WERE IN THAT CATEGORY AN ADDITIONAL TWO MONTHS TO MAKE SOME ARRANGEMENTS. TO GIVE YOU AN IDEA OF OUR COLLECTIONS ARE RUNNING ABOUT 5.7%. AND IN TERMS OF OUR DAYS OF CASH WHICH IS SOMETHING WE NORMALLY TALK ABOUT WE'RE DOWN TO ABOUT 82 DAYS OF CASH.

SO WHEREAS WE HAD 30 MILLION TO 32 MILLION WE ARE DOWN TO ABOUT 25 MILLION DOLLARS IN UNPRESTRICTED FUNDS THAT'S BASED ON 265,000 DOLLARS A DAY WHICH IS WHAT WE NEED TO RUN THE BUSINESS WE'RE ABOUT 92 DAYS OF CASH. WHICH IS JUST ABOUT THE

LEVEL THE MINIMUM LEVEL THAT THE GFOA RECOMMENDS. >> IF SOMEBODY IS LISTEN TO THIS TONIGHT AND WHAT CAN THEY DO WHAT IS THE BEST THING THAT THEY CAN DO.

[01:10:01]

I KNOW WE'VE BEEN TELLING THEM THROUGH LETTERS AND ALL KINDS OF COMMUNICATIONS AND PHONE CALLS HOW TO ACCESS HEALTH. YEAH, I'M GOING TO MAKE SOME OF MY FOLKS REALLY ANGRY AT ME HERE BUT I'M GOING TO RECOMMEND THAT THEY CALL CUSTOMER SERVICE. OUR CUSTOMER SERVICE PEOPLE WILL HELP THEM.

WE'LL DO WHATEVER WE CAN TO ASSIST THEM. >> WELL, THAT'S REALLY IMPORTANT. THAT'S REALLY IMPORTANT RIGHT NOW, I THINK.

AND I MEAN, I'M CONCERNED AND AS EVERYBODY ELSE IS UP HERE BECAUSE THESE ARE OUR CITIZENS AND THEY, AND I KNOW THAT YOU KNOW, AT SOME POINT YOU HAVE WE HAVE TO PAID THE PIPER I KNOW AT SOME POINT THEY CAN'T PUT IT OFF FOREVER.

BUT, I REALLY THINK THAT WE NEED TO MAKE THAT LAST-DITCH EFFORT TO MAKE SURE THAT EVERY CUSTOMER UNDERSTANDS THAT THERE'S HELP BECAUSE IT IS VERY FRUSTRATING TO KNOW THAT THERE'S MONEY OUT THERE THAT CAN BE HELPED AND THAT'S ON THE TABLE AND YET THERE THEY'RE GOING TO BE DISCONNECTED. I'M AS FRUSTRATED AS EVERYBODY ELSE I'M SURE YOU'RE FRUSTRATED TOO. -- TO GET ANY DISCONNECT.

WE WANTED TO PREVENT ANY DISCONNECT. >> I WOULD BE DELIGHTED IF SOMEBODY WOULD TELL ME WHAT COVID-19 ON NOVEMBER 15TH I WOULD SIMPLY SAY HEY WE'RE NOT GOING CUT OFF ANYBODY, PERIOD. BUT THERE'S JUST NO END IN SIGHT HERE. AFTER SEVEN MONTHS OF NO SERVICE DISCONNECTION AND THE FACT THAT WE'RE RUNNING THIS FAR BEHIND IN OUR CASH IT'S STARTING TO BECOME A

PROBLEM. >> I WILL SAY THIS, 2800 PEOPLE ABOUT TO GET THEIR LIGHTS CUT OFF AND 320 A WEEK WE ARE GOING TO HAVE SOME MAJOR PROBLEMS SO IF IT MEANS CUSTOMER SERVICE THEY HAVE DIN EXTRA HOURS FROM HOME AS WELL AS IN THE OFFICE THEY MAY NEED SOME MORE HELP BECAUSE IF YOU OPEN IT UP FOR CUSTOMER SERVICE, WELL, I KNOW PEOPLE ARE GOING TO START CALLING AND I CAN JUST IMAGINE THAT YOU WILL HAVE TO GO THROUGH WITH WHEN THESE LIGHTS START CUTTING OFF YOU ARE NOT GOING TO HAVE ENOUGH PEOPLE TO ANSWER THE PHONE. WE HAVE BEEN CAREFULLY MONITORING THAT WE WILL IDENTIFY THERE WILL BE DISCONNECTIONS WE DID GET A LARGE VOLUME OF CALLS AND UNFORTUNATELY OUR WAIT TIME ON CALLS WENT UP TO ABOUT 15, 16 MINUTE WHICH CONSIDER UNACCEPTABLE. BUT YOUR POINT IS WELL TAKEN.

AND I APPRECIATE YOUR CANDOR. I HOPE THEY HAVE SOMETHING IN FRONT OF THEM THAT THEY WILL BE ASSIST PEOPLE OTHER THAN THESE REQUIREMENT THAT'S I CAN'T FANTASIZE HOW OBVIOUSLY THEY ARE TOO DIFFICULT. BECAUSE IF WE'RE LEAVING THIS KIND OF MONEY ON THE TABLE AGAIN, THEN IT HAS TO BE SOMETHING GOING ON WITH THE REQUIREMENTS THEMSELVES, THE SCREENING PROCESS OR THE APPLICATION OR PERHAPS THE COMMISSIONER HAS POINTED OUT MAYBE TRANSPORTATION. WHAT ARE THE MUSTARD SEED WHERE DO THEY COLLECT FROM. WHERE DO YOU EXPECT THE PEOPLE TO COME FROM.

ARE THEY IN THE NEIGHBORHOODS? >> YEAH, I THINK SO.

WHERE DO THEYET SET UP? >> SEVENTH STREET. MUSTARD SEED AS FAR AS I

KNOW IS ON U.S. 1. >> RIGHT AROUND THE CORNER. THAT'S ALL THE INFORMATION I

HAVE RIGHT NOW. >> WE WILL BE MEETING TOMORROW THE FPUA BOARD WE WILL BE GETTING A REPORT TOMORROW. AND I THINK WE OUGHT TO FEED INTO THE BOARD WHAT THIS COMMISSIONS REAL CONCERNS IS.

WHICH THE BOARD I'M SURE HAS THOSE CONCERNS ALSO. SO I THINK THAT WE NEED TO

[01:15:04]

AT LEAST KNOW AND RECOGNIZE THAT IF THIS TIME HAS COME THEN AND I FOR ONE WOULD LIKE TO MAKE ONE MORE EFFORT TO MAKE SURE THAT THIS DOESN'T HAPPEN AND I WILL BE

SPEAKING TO THAT TOMORROW TO THE FPUA BOARD. >> I THINK THE FPUA BOARD HAS BEEN EMPATHETICKIC -- EMPATHETIC HERE. WE HAVE STOPPED DISCONNECTIONS TWICE. THIS PLAN WAS REALLY THE THIRD WAVE OF SLOWING IT DOWN. WE JUST DON'T REALIZE OR UNDERSTAND HOW MUCH FURTHER WHICH CAN GO WHAT'S THE DIFFERENCE BETWEEN THEM AND US?

>> THEY'VE HAD EXACTLY THE SAME DIALOGUE. THAT'S WHY WE CAME UP WITH THE MANDATORY PAYMENT PLAN FOR THE PEOPLE THAT ARE SO FAR BEHIND.

>> WHY DID THEY SEND YOU IN HERE WITH THIS. OBVIOUSLY IT'S NOT AN ISSUE OF CONCERN BECAUSE THEY WOULDN'T HAVE SENT YOU IN HERE WITH THIS?

>> I THINK I'M NOT EXACTLY SURE I UNDERSTAND THAT QUESTION.

>> LET ME EXPLAIN IT TO, YOU SIR,. >> YOU JUST PRESENTED ME WITH 2800 PEOPLE GETTING CUT OFF, 320 A WEEK. YOUR BOARD, YOU HAD A MEETING, OBVIOUSLY, THEY SENT NEW HERE WITH THIS INFORMATION.

THIS WAS NOT SERIOUS ENOUGH FOR THEM TO TAKE CARE OF THIS PROBLEM, WHY AM I BEING PRESENTED WITH IT? I DON'T MAKE THE DECISIONS BUT I'M GOING TO TAKE THE HEAT. IF THAT'S THE CASE I NEED TO PUT MYSELF IN A POSITION WHERE I CAN MAKE THE DECISIONS IF I'M GOING TO TAKE THE RESPONSIBILITY.

YOU PRESENTED IT TO ME. >> DIDN'T WE ASK FOR THIS PRESENTATION? I THOUGHT WE ASKED FOR THIS PRESENTATION? I'M GLAD WE DID.

BUT MY POINT IS. >> WE CAME IN HERE TODAY WITH THIS.

THIS IS THE INFORMATION. I DON'T CARE IF I ASK FOR IT OR NOT I'M GLAD WE DID ASK FOR IT. BUT I'M GRATEFUL GOD WE ARE DID ASK FOR IT.

BUT MY POINT IS THIS, WHY IS IT THE BOARD DIDN'T GET THIS ISSUE RESOLVED?

>> I THINK YOU KNOW WE'VE BEEN WORKING TOWARD THIS RESOLUTION FOR I DON'T KNOW TWO OR THREE MONTHS AT LEAST, AND I THINK YOU KNOW THE FPUA BOARD HAS PUSHED STAFF TO THINK OUTSIDE THE BOX AND COME UP WITH A PLAN THAT WE COULD DO IN TERMS OF ASSISTING OUR CUSTOMERS AND ALSO FOR YOU KNOW PUTTING OFF THESE SERVICE DISCONNECTIONS TO THE LAST POSSIBLE MOMENT. AND THAT'S WHY WE CAME UP WITH THE MANDATORY PAYMENT PLAN BECAUSE IT WAS THE BEST PLAN AVAILABLE SO WE WOULDN'T HAVE O DISCONNECT ANYBODY. YOU SAID HOLDING OFF TO THE LAST MOMENT. AGAIN I ASK YOU THIS PANDEMIC IS IT STILL OUT THERE? ARE YOU AWARE OF IT? I'M NOT BEING FACETIOUS IF WOULD BE PROACTIVE YOU WOULD HAVE A DIFFERENT TONE BECAUSE YOU WOULDN'T BE SPEAKING IF THEY WERE ELECTED INSTEAD OF US. SO YOU CAN BRING ANYTHING BACK TO US I APPRECIATE YOU COMING BACK BECAUSE THE ONLY REASON YOU CAME BACK BECAUSE I MADE MENTION ABOUT THAT SPILL. IT DIDN'T SET TO WELL WITH YOU IT DIDN'T SET WELL WITH ME. I HAVE TO HEAR FROM D.E.P.

ABOUT THE SPILL AND NOT YOUR OFFICE. >> LAST MOMENT LIKE YOU'RE GIVING THEM A DEATH SENTENCE. YOU MIGHT HURT SOMEBODY YOU KNOW, MIGHT NOT HAVE ELECTRICITY. JUST MIGHT.

I'M THROUGH. >> COMMISSIONER ALEXANDER BROUGHT UP A VERY INTERESTING POINT. IF THAT BOARD WAS ELECTED AS OPPOSED TO THIS BOARD THAT'S BEING PRESENTED WITH THIS INFORMATION, YOU WOULD HAVE A WHOLE TOTALLY DIFFERENT I CAN ASSURE YOU, TOTALLY DIFFERENT PRESENTATION BECAUSE NUMBER ONE, AND THAT'S WHY I SAY THAT, YOU KNOW, I SIT WILL AND I LOOK AT THE AUTONOMY OF THE BOARD AND WHY WE ARE IN THE PREDICTIONMENT THAT WE'RE IN IT'S BECAUSE THAT BOARD WAS ESTABLISHED TO DO EXACTLY WHAT WE'RE DEALING WITH HERE TONIGHT.

[01:20:05]

HOWEVER, IF YOU WOULD HAVE BEEN PRESENTING THIS TO ME LIKE THE CITY MANAGER IS GOING TO DO IN A MINUTE WE WOULDN'T BE DEALING WITH THIS NOT IF I HAD ANYTHING TO DO WITH IT. I WOULD BE ONE OF FIVE TO MAKE A DECISION AND THIS WOULDN'T BE HAPPENING. THAT'S ALL I GOT TO SAY, THANK YOU.

>> MADAM MAYOR. COMMISSIONER SO WHAT'S THE DECISION.

LET'S MAKE A RECOMMENDATION AS A BODY AND TELL OUR APPOINTED BOARD WHAT WE LOOK

FOR. >> I LIKE THAT. >> NUMBER ONE, THERE'S A PROBLEM WITH THIS REQUIREMENT OBVIOUSLY IT'S TOO STRICT.

INDIVIDUALS ARE NOT ABLE TO SATISFY IT. I DO NOT KNOW.

BUT WHAT I DO KNOW IS AS COMMISSIONER PERONA POINTED OUT THERE NEEDS TO BE AN INVESTIGATION TO FIND OUT WHY THIS MONEY IS SITTING ON THE TABLE.

IT WOULD BE ONE THING IF WE WERE HERE TONIGHT AND THIS WAS ABOUT TO HAPPEN AND WE DIDN'T HAVE ANY MONEY BUT HOW DARE WE SIT HERE AND THIS BOARD COME HERE TONIGHT WITH SOMETHING LIKE THIS WHEN WE GOT HALF THE MONEY SITTING ON THE TABLE.

THERE'S A PROBLEM. AND I KNOW MY PEOPLE, I KNOW FORT PIERCE I KNOW IF THEY KNEW WHAT WAS GOING ON OR KNEW THAT THEY HAD THE ABILITY TO GET THIS MONEY IT WOULDN'T BE SITTING THERE. THERE'S A PROBLEM THERE'S SOMETHING GOING ON COMMISSIONER. SO WE NEED TO FIND OUT WHAT'S GOING ON AND GET THIS

MONEY TO THE PEOPLE. >> I'LL TAKE A DETAILED LOOK AT THAT AND I'LL GLAD TO SEND THE REPORT OUT TO ALL OF YOU JUST TO GIVE SOME FEEDBACK.

I THINK IT'S IMPORTANT TO NOTE HERE YOU'RE RIGHT THERE SHOULDN'T BE ANY MONEY ON THE TABLE. BUT EVEN IF ALL THE MONEY WAS OFF THE TABLE THERE WOULD STILL BE A SIGNIFICANT NUMBER OF PEOPLE THAT WOULD BE SUBJECT TO DISCONNECTION.

>> YOU'RE RIGHT. MY HEART WOULDN'T BE DOING 100 MILES PER HOUR IT WOULD BE DOING ONLY 50 MILES PER HOUR. BUT IT IS WHAT IT IS.

RIGHT NOW IT'S AT 100. >> PLUS, THERE'S CARES ACT MONEY, TOO, ARE YOU

INCLUDING THAT? >> I THINK I NEED TO GO BACK AND LOOK AT THAT.

IT'S MY UNDERSTANDING THAT MAYBE, I'M NOT SURE ABOUT THIS BUT I THINK THEY MAY HAVE CLOSED THE APPLICATION PROCESS FOR CARES ACT BECAUSE I THINK THEY TOOK SOME OF THAT $16.6 MILLION AND PUT IT INTO SOME OF THE OTHER RELIEF ORGANIZATIONS

RATHER THAN TO ASSIGN IT TO INDIVIDUALS. >> YEAH, THAT'S IMPORTANT TO FIND OUT. BECAUSE WE WERE COUNTING ON THAT FOR OUR CUSTOMERS, TOO.

>> RIGHT. WE'VE HAD A GOOD NUMBER OF CUSTOMER THAT'S DID TAKE ADVANTAGE OF THAT. IF THEY'RE STILL IN THE APPLICATION STAGE THEY WON'T

BE CUT OFF AS LONG AS. >> LET ME TELL YOU ANOTHER THING, MAYOR, WHILE YOU ARE HERE FOR THE SAKE OF TIME I'M NOT GOING TO KEEP GOING ON THIS I THINK WE KNOW WHERE WE'RE GOING WITH THIS. BUT THE WORD ON THE STREETS IS THAT THE CARE IS JUST AS DIFFICULT TO OBTAIN AS THIS MONEY? PEOPLE CALLING ME ALL THE TIME. I'M APPLYING I CAN'T GET IT. I DON'T QUALIFY.

THEY KEEP TELLING ME I GOT TO HAVE THIS, I GO TO THE MEET THIS REQUIREMENT, I GOT

TO MEET THAT REQUIREMENT. WE ARE IN COVID WE GOT -- >> THAT'S ST. LUCIE COUNTY.

>> I KNOW, I KNOW. I UNDERSTAND THAT AND I UNDERSTAND THAT.

BUT WHEN YOU MAKE REFERENCE TO THAT BEING ANOTHER SOURCE WHAT I'M SAYING THEY'RE SAYING AT LEAST IT'S JUST AS DIFFICULT TO OBTAIN THAT MONEY AS IT IS OBVIOUSLY THIS MONEY. SO I'M REALLY DON'T FEEL COMFORTABLE SAYING CARES IS THERE, YEAH CARES IS THERE BUT I GOT SOME MONEY HERE I WANT TO GET IT TO THE PEOPLE.

THANK YOU. EYE BABY IS CRYING, MY ELDERLY ARE SICK.

MY BABIES ARE CRYING. I KNOW YOU WANT TO HEAR ME SHUT UP MY BABIES ARE CRYING, MY ELDERLY ARE SICK AND I GOT PEOPLE IN THE HOSPITAL. I KNOW IT AIN'T IMPORTANT TO

YOU BUT IT IS TO ME. >> ANY OTHER QUESTIONS? >> THANK YOU.

>>> HI. HOW ARE YOU. WE ARE NOT JUST MUTE YOURSELF UNTIL IT'S TIME FOR YOUR HEARING. OKAY, THANK YOU VERY MUCH.

[11. CONSENT AGENDA]

THE NEXT ITEM ON THE AGENDA IS CONSENT AGENDA. >> ANY ITEMS THAT ANY COMMISSIONER WOULD LIKE TO PULL FROM THE CONSENT AGENDA.

>> MOVE FOR THE APPROVAL. >> SECOND. >> I HAVE ONE QUESTION.

>> OKAY. >> WITH REGARDS TO THOSE CAMERAS.

[01:25:06]

FOR THE POLICE DEPARTMENT. CAN COULD WE GET SOMEBODY TO FILL US IN ON IT NOW THAT THIS WILL BE A NEW FORM OF EQUIPMENT THAT ITEM NUMBER FROM LAW ENFORCEMENT 81000

$$81,500. >> MR. MIMMS? >> THAT'S GOING TO BE SOMETHING NEW FOR US AND I WOULD LIKE FOR THE INFORMATION TO BE GIVEN TO THE PUBLIC IT'S GOING TO ADD TO OUR SECURITY AND IT'S GOING TO HELP US OUT TREMENDOUSLY, I BELIEVE. A LOT OF TIMES PUTTING PEOPLE ON NOTICE AND INFORMING THEM ABOUT WHAT YOU'RE ABOUT TO DO HELPS OUT A LOT OF TIMES.

SO COULD SOMEBODY EDUCATE US ON WHAT THESE CAMERAS ARE GOING TO BE USED FOR AND IT'S SOMETHING NEW TO FORT PIERCE IN TERMS OF USAGE. AM I CORRECT?

>> THE DRONES. >> IT'S A DRONE. I SAID CAMERA BUT THEY'RE

DRONES, THANK YOU, MAYOR. >> WE HAVE IN OUR AUDIENCE RIGHT NOW WE HAVE OUR DEPUTY CHIEF. I CANNOT SPEAK TO THE TECHNICAL SPECIFICATIONS OF THIS PURCHASE HOWEVER OUR DEPUTY CHIEF OR MEMBER OF THAT ORGANIZATION CAN.

HE WILL COME BEFORE AND YOU PROVIDE THAT INFORMATION.

OUR DRONE PROGRAM IS TO HAVE SOME TYPE OF SYSTEM THAT WE CAN PUT UP IN THE AIR BASICALLY FOR LOST CERTAINS OR SEARCHING FOR A CHILD, SEARCHING FOR AN ADULT.

ALSO SITUATIONS WHERE YOU KNOW WE DON'T HAVE AN AIR SERVICE.

WE HAVE A DIRE SITUATION WHERE WE'RE LOOKING FOR SOMEBODY IS WANTED WHO MAY HAVE SHOT SOMEBODY OR COMMITTED A HEINOUS CRIME. WITH COMMITTEE USE THOSE DRONES TO GO IN THAT -- WE CAN USE THOSE DRONES TO GO IN THAT AREA.

>> LET ME ASK YOU THIS, SIR, AS FAR AS LAW ENFORCEMENT, DOCTORING ACTIVITY, USING THESE DRONES -- DRUG ACTIVITY, USING THESE DRONES YOU WE DON'T WANT TO INVADE PEOPLE'S PRIVACY ARE WE GOING TO BE USING THEM FOR THAT PURPOSE?

>> WHENEVER WE CAN USE THEM. THE MAIN PURPOSE IS WHEN WE FIRST GOT THE DRONES WE HAD QUITE A FEW PEOPLE MISSING PERSONS WITH ALZHEIMER'S AND SO FORTH THAT WAS THE MAIN REASON FOR US APPLYING FOR IT. BUT LIKE YOU SAID IT CAN BE USED FOR MULTITUDE OF PURPOSES. AGAIN WE HAVE TO APPLY BY THE -- ABIDE BY THE F.A.A. RULES AND STANDARDS. MOST DEFINITELY CAN BE USED

IN A MULTITUDE OF SITUATIONS. >> OKAY.

BECAUSE I THOSE JITTER BUGS ON THE STREETS WHEN THEY KNOW THAT FORT PIERCE THEY WILL BE A LOT LESS RELUCTANT TO SELL DOPE ON THE CORNERS IF THEY KNOW WE ARE WATCHING US. YOU KNOW WHERE I'M GOING WITH THIS?

>> YES, I DO. >> THANK YOU, SIR. >> ANYTHING ELSE WE SHOULD

KNOW. >> THAT'S IT FOR THE DAY.

THANK YOU. YOU ALL RIGHT. >> WE HAVE A MOTION AND A

SECOND >> YES. >> CALL THE ROLL PLEASE.

>> COMMISSIONER ALEXANDER. >> YES. >> COMMISSIONER JOHNSON.

>> YES, MA'AM. >> COMMISSIONER PERONA. >> YES, MA'AM.

>> COMMISSIONER SESSIONS, YES, MA'AM. >> COMMISSIONER -- MAYOR

HUDSON. >> YES, MA'AM. >>> NEXT WE MOVE ON TO

THEY ARE LESS FORMAL THAN PROCEEDINGS BEFORE A CIRCUIT COURT BUT ARE MORE FORMAL THAN A NORMAL COMMISSION MEETING QUASI-JUDICIAL PROCEEDINGS MUST FOLLOW STANDARDS OF NOTICE AND DUE PROCESS AND DECISIONS MUST BE MADE BASED ON SUBSTANTIAL EVIDENCE. THEREFORE COMMISSIONS HAVE A DUTY TO CONDUCT A QUASI-JUDICIAL PROCEEDINGS MORE LIKE JUDGES THAN LEGISLATORS.

THAT IS WHY THE COMMISSION HAS ESTABLISHED THE UNIFORM PROCEDURES FOR QUASI-JUDICIAL HEARINGS THAT WILL BE FOLLOWED THIS EVENING.

>> THANK YOU VERY MUCH. HAVE WE MET THE ADVERTISING REQUIREMENTS?

>> YES, MA'AM WE HAVE MET THE ADVERTISING REQUIREMENTS FOR THIS ITEM.

>> WOULD YOU ASK THE CITY COMMISSIONERS IF THEY'VE HAD ANY EX PARTE COMMUNICATIONS.

[01:30:02]

YES. >> COMMISSIONER ALEXANDER HAVE YOU HAD ANY EX PARTE

COMMUNICATIONS ON THIS MATTER? >> NO.

>> COMMISSIONER JOHNSON. >> NO, MA'AM. >> COMMISSIONER PERONA.

>> NO, MA'AM. >> COMMISSIONER SESSIONS. >> NO, I DON'T RECALL.

>> MAYOR HUDSON. >> NO, MA'AM. >> NOW WOULD YOU LOOIC TO SWEAR IN THE WITNESSES. -- WOULD YOU LIKE TO SWEAR IN THE WITNESSES.

>> WOULD ANYONE WISHING TO SPEAK ON THIS ITEM. >> RAISE YOUR RIGHT HAND.

DO YOU SWEAR ON AFFIRM TO TELL THE TRUT, THE WHOLE TRUTH AND NOTHING BUT THE

TRUTH? >> YES. >> I DO.

>> THANK YOU. >> ALL RIGHTY. THANK YOU VERY MUCH.

NOW STAFF YOU WILL MAKE YOUR PRESENTATION. >> GOOD EVENING.

MADAM MAYOR MEMBERS OF THE COMMISSION. BEFORE YOU TONIGHT IS THE FIRST OF THREE CONDITIONAL USE APPROVALS WITH NO NEW CONSTRUCTION WITH REGARD TO DWELLING RENTALS. THE FIRST ONE IS BARSOTTI'S DRILLING.

THIS REQUEST IS FOR A MINIMUM OF 31 DAYS. LOCATION AGAIN IS LOCATED WITHIN THE OCEAN VILLAGE COMMUNITY IT'S LOCATED AT 1040 WINDWARD DRIVE UNIT 3402. FUTURE LAND USE MAP IS HUTCHINSON ISLAND RESIDENTIAL WITH A COMPATIBLE ZONING DISTRICT CLASSIFICATION MEDIUM DENSITY RESIDENTIAL. THE SYNOPSIS FOR RECOMMENDATION HAS BEEN STATED TO YOU. THE CITY DID PASS WITH ORDINANCE K-114 IN 2001 TO ALLOWING DWELLING RENTALS AS CONDITIONAL USES IN CERTAIN RESIDENTIAL ZONING DISTRICTS AND CONDITIONS OF APPROVAL WERE ADDED TO ALLOW WHEN DESIRABLE USE THAT AS WOULD NOT BE APPROPRIATE GENERALLY OR WITHOUT RESTRICTIONS THROUGHOUT A PARTICULAR ZONING DISTRICT BUT WHICH IF CONTROLLED AS TO THE NUMBER AREA LOCATION OR RELATIONSHIP TO THE NEIGHBORHOOD WOULD NOT ADVERSELY AFFECT THAT PUBLIC HEALTH, SAFETY, COMFORT, GOOD ORDER AND THE GENERAL WELFARE.

WHEN THE PLANNING STAFF RECEIVES ANY APPLICATIONS FOR A DWELLING RENTAL WE DO CHECK TO SEE IF THERE'S ANY CODE ENFORCEMENT OR POLICE DEPARTMENT VIOLATIONS THROUGH OUR TECHNICAL REVIEW PROCESS. AND IN 2011, FLORIDA LEGISLATURE THEN PREEMPTED A LOT OF THE REGULATIONS BUT THE STATE CANNOT PROHIBIT VACATION RENTALS OR REGULATE THE DURATION OR FREQUENCY OF RENTAL OF ANY VACATION RENTALS IN THE STATE OF FLORIDA. AT OUR PLANNING BOARD MEETING OF SEPTEMBER 8TH, 2020, THE PLANNING BOARD RECOMMENDED APPROVAL 6-1 VOTE WITH ONE ADDITIONAL CONDITION AND I WOULD LIKE TO TALK TO THE COMMISSION ABOUT THIS CONDITION. IT WAS NOW WILL BE OUR SIXTH CONDITION ADDED TO OUR FIVE GENERAL ONES OR OUR STANDARD RATHER. THIS IS TO REQUIRE THIRD PARTY LIABILITY INSURANCE. THIS REQUIREMENT WAS THE REASON FOR OUR DELAY IN PRESENTING TO THE COMMISSION THROUGHOUT OUR CONFERENCE AGENDA.

SUBSEQUENTLY WE HAD A PLANNING BOARD BEGINNING LAST WEEK WHERE WE DISCUSSED THIS FURTHER AND THE VICE CHAIRMAN, DID SPEAK TO THIS ISSUE WITH THE PLANNING BOARD. AND SINCE THAT TIME WE HAVE DISCUSSED SOME ITEMS WHICH WILL BE BEFORE YOU ON A COMMISSION AGENDA. THREES A NUMBER OF CODE AMENDMENT THAT'S ARE COMING FOR DISCUSSION AT THAT WORKSHOP.

BUT ALSO, OUR DISCUSSION ON VACATION RENTAL THAT WAS POSTPONED AND WE WOULD LIKE TO TALK TO YOU AT THAT TIME WITH OUR PROCESS HOW WE WOULD LIKE TO GO FORWARD WITH PERHAPS A WORKING COMMITTEE. BUT AGAIN THAT WILL BE THIS DISCUSSION AT THE CONFERENCE AGENDA. BUT WE WOULD LIKE TO HOLD OFF ON THIS CONDITION AND ADD IT OR NOT ADD IT THROUGH THIS WORKING COMMITTEE THAT WE WOULD LIKE TO TALK TO YOU ABOUT ESTABLISHING. RIGHT NOW WE DON'T KNOW THAT MUCH ABOUT THIRD PARTY LIABILITY AND HOW IT VARIES. IT IS OUR UNDERSTANDING FROM WHAT WE HAVE RESEARCHED THAT MOST OF THE PROGRAMS WHERE PEOPLE CAN CAN RENT FROM DO REQUIRE MILLION DOLLAR RENTAL INSURANCE BUT THAT IS JUST AS BETWEEN THE HOMEOWN ER AND THE RENTER AND NOT THROUGH A THIRD PARTY.

HAVING SAID THAT IT IS STAFF'S RECOMMENDATION THAT WE WOULD LIKE TO IMPOSE THE FIVE STANDARD CONDITIONS OF APPROVAL THAT WE HAVE BEEN IMPOSING ON ALL OF OUR VACATION RENTALS. AND THAT BEING ONE THAT A PROPERTY MANAGER FOR A

[01:35:03]

DWELLING UNIT SHALL BE AVAILABLE AT ALL TIMES AND THAT MANAGER SHALD RESIDE IN ST. LUCIE COUNTY AND BE REGISTERED WITH THE CITY. TWO, OUR GUIDE BOOKS THAT ARE AVAILABLE THROUGH OUR CODE ENFORCEMENT DIVISION SHALL BE PROVIDED TO RENTERS AND BE AVAILABLE AT ALL TIMES. THAT THE APPLICANT SHALL FILE FOR AND OBTAIN WITHIN 30 DAYS OF GETTING STATE LICENSE THROUGH OUR DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION THAT THERE SHALL BE NO MORE THAN TWO VEHICLES PER UNIT, AND THAT THE CITY OF FORT PIERCE TAX LICENSE NUMBER SHALL BE INCLUDED WITH ALL ADVERTISEMENTS. CITY COMMISSIONS ACTIONS COULD BE TO APPROVAL OF THE PROPOSED SUBJECT WITH NO CHANGE.

APPROVAL OF THE PROPOSED CONDITIONAL USE WITH CHANGE REQUESTED BY PLANNING STAFF TO REMOVE CONDITION SIX AT THIS TIME. AND DISAPPROVAL OF THE

PROPOSED CONDITIONAL USE. >> YES, COMMISSIONER ALEXANDER.

MY QUESTION IS WE SPOKE ABOUT THIS THIRD PARTY INSURANCE.

>> WE DID NOT SPEAK ABOUT THIS YET. THIS HAS ONLY BEEN THROUGH THE PLANNING DEPARTMENT. THESE ARE THE FIRST OF THE THREE THAT WOULD HAVE THIS CONDITION ON IT. THE PREVIOUS CONDITIONAL USES ON-LINE HAVE THE FIVE OR IF THEY HAD IT IT'S SOMETHING THAT WAS SPECIFIC LIKE THE DRIVEWAY OR SPARKING THAT THE CONDITION SIX. COMMISSIONER ALEXANDER YOU

MAY HAVE JUST HEARD OF IT THROUGH THE PLANNING BOARD. >> MY QUESTION WAS WE DID NOT DISCUSS THIS THIRD PARTY INSURANCE IN A PREVIOUS MEETING SOMEWHERE.

>> COMMISSIONER ALEXANDER, MADAM, MAYOR AND COMMISSION IT CAME UP AT OUR CONFERENCE AGENDA AS THE REASON WHY WE WERE REQUESTING A DELAY. BECAUSE WE WANTED TO LOOK

INTO THIS. >> THIS IS NOT THE FIRST TIME I'M HEARING THIS.

>> CORRECT. >> I DON'T THINK THIS IS SOMETHING THAT WE NEED TO REINVENT. IF IT'S BEING DONE ELSEWHERE IN OTHER CITIES IT WASN'T SO DIFFICULT TO GET HOWEVER IS GETTING THIS THIRD PARTY INSURANCE HIT TO BE THERE.

SOMEONE USED IT WHAT IS WHAT WE HAVE RIGHT NOW WITHIN THE CITY IS THAT WE DON'T REQUIRE THIS TYPE OF INSURANCE FOR ANY OTHER BUSINESS THIS CAME ABOUT THROUGH A REQUEST FOR ONE OF OUR PLANNING BOARD MEMBERS AS A LANDOWNER AND THAT PERSON WHO IS RENTING I AM JUST THINKING CHILDREN IN THE NEIGHBORHOOD THEY HUSHT

SOMEBODY WHO IS GOING TO BE LIABLE FOR THAT. >> THAT'S WHY IT IT REALLY

REQUIRES MORE RESEARCH AND INVESTIGATION. >> IT DOES BEFORE YOU BRING IT TO US AS A STANDARD CONDITION, IS WHAT I'M THINKING I DON'T KNOW KNOW WHERE I STAND AS A PLANNING DIRECTOR OR A STAFF. I'M NOT IN THE INSURANCE BUSINESS. I THINK THAT THERE IS A LOT OF GOOD REASON TO EXAMINE

THIS MORE. >> QUESTION JUST NEED TO KNOW A LITTLE BIT MORE.

[01:40:06]

>> I DON'T KNOW WHAT THE IMPLICATIONS OR COST IS. >> COMMISSIONER PERONA THEN

COMMISSIONER JOHNSON. >> I JUST SAY I WANT TO GIVE YOU A LOT OF CREDIT FROM THE PLANNING DEPARTMENT TO HIT PAUSE ON THIS. IT JUST SEEMS LIKE TOO MUCH GOVERNMENT, ESPECIALLY OUR LOCAL GOVERNMENT WANTS TO THROW THINGS ON NOT TOO SURE IF IT'S GOING TO HELP OR NOT BUT LET'S PUT IT IN THERE ANYWAY.

WELL, IT ENDS UP CAUSING ALL THESE OBSTRUCTIONS TO FOLKS TRYING TO JUST GET THE JOB DONE. I'M EXCITED TO HEAR THAT YOU'RE SITTING THERE SAYING IT'S THERE BUT I WANT TO PAUSE ON THIS I WANT TO TAKE A LOOK AT IT.

I WANT IT TO MEAN SOMETHING AND MAKE IT YOU KNOW SOMETHING THAT IS IMPORTANT TO WHAT WE'RE TRYING TO ACCOMPLISH YOU REALLY TAKE A LOOK AT IT YET IT'S STILL COSTLY AND REALLY ENDS ARERS NO VALUE TO THE PROJECT ITSELF.

WHEN YOU FIRST PULLED THAT ON AND PULLED IT BACK I WILL BE THANK YOU.

NOW WE WILL BE ADDING IT IF YOU DEEM THAT IT IS NECESSARY.

>> OR WE DEEM IT NECESSARY. >> OR WE DO. HIT THE PAUSE BUTTON IT'S OKAY EVEN IF WE MISS THIS ONE AND A COUPLE MORE AFTER IT IT'S JUST AT THE ENDS OF THE DAY WE'RE DOING THINGS THAT ADD VALUE TO OUR DECISIONS AND I REALLY

APPRECIATE THAT. >> I CAN COME TO FORT PIERCE AS A TOURIST AND WALK DOWN THE SIDEWALK. THE CITY DOESN'T REQUIRE ME TO HAVE LIABILITY INSURANCE JUST BECAUSE I'M IN THE CITY LIMIT OF THE FORT PIERCE. PEOPLE ARE COMING TO FORT PIERCE FOR A ONE, TWO, THREE, FOUR-DAY PERIOD, THEN THEY LEAVE AGAIN.

SO WHAT IS THE IMPLICATION. ANOTHER THING I HAVE TO ASK YOU, MAYBE WE HAVE TO SWEAR IN MISS COX TO GIVE US THE ANSWER, BUT I DON'T THINK SO, IS WHAT BUSINESS UNITS DO WE REQUIRE IN THE CITY OF FORT PIERCE? YOU APPLIED FOR A B.T.R. WHO

HAS TO SHOW LIABILITY INSURANCE? >> MADAM MAYOR, COMMISSIONERS MY UNDERSTANDING THE CERTIFICATE OF INSURANCE ARE REQUIRED OF CONTRACTORS AND POSSIBLY TOWING CAN COMPANIES.

THERE ARE OTHER. >> A SIGNIFICANT OF INSURANCE.

IS THERE ANYTHING TO ADD TO THAT THAT WOULD BE WORKY OF TESTIMONY?

OKAY, ALL RIGHT. THANK YOU, MA'AM. >> SO TO BE CLEAR, YOU'RE

NOT RECOMMENDING IT TONIGHT? >> THAT IS CORRECT MADAM MAYOR.

>> I JUST WANT TO MAKE SURE. IT'S NOT RECOMMENDED TONIGHT. WHAT I HAVE DONE WITH THE CONDITIONS WITH THE CONDITIONS OF APPROVAL I JUDGEIST HAVE THE STAFF

RECOMMENDATION. >> -- I JUST HAVE THE STAFF RECOMMENDATION.

>> HOPEFULLY I CAN SPEAK AND ADD A LITTLE BIT TO THIS CONVERSATION.

I DO BELIEVE WE ARE VERY, VERY GOOD INSURANCE CONSULTANTS.

ONE IS THE FLORIDA LEAGUE OF CITIES FMIT AND ALSO WE HAVE INSURANCE CONSULTANTS THROUGH A COMPANY KNOWN AS CYBER. THESE INSURANCE CONSULTANTS HAVE GUIDED US FOR A NUMBER OF YEARS THEY HAVE GUIDED US SUCCESSFULLY.

I DO BELIEVE WE SHOULD HAVE THEM WEIGH IN ON THIS SITUATION BEFORE WE AS A

CITY IMPOSE THESE TYPE OF RESTRICTIONS ON A DEVELOPER. >> GOOD IDEA.

BECAUSE THEY KNOW THEIR STUFF. I'M FINDING IT OUT SINCE I'M NOW ON THE BOARD. ALL RIGHTY. SO ANY OTHER QUESTIONS? OF STAFF. SO THIS IS A PUBLIC HEARING AND I WOULD LIKE TO HEAR FROM THE APPLICANT. YES, AND APPLICANT IS ON THE PHONE IS THAT CORRECT?

>> THAT IS CORRECT. >> YES, I'M HERE. I'M HERE.

>> COULD YOU IDENTIFY YOURSELF AND YOUR ADDRESS PLEASE.

>> THIS IS NANCY BARSOTTI. I CURRENTLY AM AT MY RESIDENCE IN PITTSBURGH, PENNSYLVANIA. BUT MY RENTAL PROPERTY THAT IS PART OF THE HEARING

[01:45:06]

TONIGHT IS IN OCEAN VILLAGE ON WINDWARD DRIVE UNIT 3402. >> YOU WERE SWORN IN I KNOW.

SO WOULD YOU LIKE TO SAY ANYTHING TO THE COMMISSION ABOUT YOUR APPLICATION?

>> WELL, I HAVE BEEN IN CONSTANT CONTACT WITH DENNIS GILMORE AS WELL AS LINDA ABOUT YOU KNOW ALL THE REQUIREMENTS THAT I NEEDED TO FULFILL.

I BELIEVE THAT I HAVE FULFILLED ALL THE REQUIREMENTS.

I HAVE ALREADY APPLIED FOR AND ALREADY AM PAYING COUNTY ST. LUCIE COUNTY AND FLORIDA TAXES. I UNDERSTAND ABOUT THE TAX NUMBER BEING ON MY ADVERTISING THE VEHICLES I DO HAVE A RENTAL AGENT TAKES CARE OF MY PROPERTIES AND SETS INSPECTS THEM ON AING ARES BASIS. I DO OWN TWO OTHER RENTAL PROPERTIES IN OCEAN VILLAGE BUT THEY'RE NOT SUBJECT TO THIS CONDITIONAL USE PERMIT BECAUSE THEY WERE BUILT MANY YEARS AGO, IS MY UNDERSTANDING.

SO ANYHOW I THINK I HAVE FULFILLED ALL THE REQUIREMENTS AND I WAS UNDER THE IMPRESSION THIS WAS THE LAST STEP IN GETTING APPROVAL.

>> ALL RIGHTY. DO COMMISSIONERS HAVE ANY QUESTIONS OF THE APPLICANT?

>> ALL RIGHTY. THANK YOU VERY MUCH. IS THERE ANY OTHER MEMBER OF THE PUBLIC WHO WOULD LIKE TO ADDRESS THIS ISSUE PLEASE COME FORWARD?

YOU WERE NOT SWORN IN, RIGHT? >> SORRY ABOUT THAT.

>> IT'S ALL RIGHT. >> DO YOU SWEAR TO TELL THE TRUTH, THE WHOLE TRUTH AND

NOTHING BUT THE TRUTH? >> I DO. IS THERE A SIGN-IN SHEET.

>> JUST STATE YOUR NAME AND ADDRESS FOR THE RECORD. >> SHARON GARZO, 715 OCEAN DRIVE UNIT D. I JUST WANT TO STATE ON THE RECORD AS YOU GUYS ALREADY KNOW MY POSITION I DO APPROVE FOR HER VACATION RENTAL TO GO FORWARD.

I JUST WANT TO ALSO IMPLEMENT THAT YOU GUYS TAKE JUDICIAL NOTICE OF BUILDING CODE REPORT 179 ALSO I WOULD LIKE YOU TO TAKE JUDICIAL NOTICE OF INFORMAL INTERPRETATION REPORT NUMBER 8027. ALSO I WOULD LIKE YOU GUYS TO TAKE JUDICIAL NOTICE OF MY FELLOW RESIDENTS PROPERTY RIGHTS.

THE RIGHT TO ACQUIRE, POSSESS AND PROTECT YOUR PROPERTY.

THE RIGHT TO ENJOY AND USE YOUR PROPERTY. TRITE EXCLUDE OTHERS FROM YOUR PROPERTY. THE RIGHT TO DISPOSE OF YOUR PROPERTY, THE RIGHT TO TO DUE PROCESS AS SHE'S GOING THROUGH QUASI-JUDICIAL HEARING.

THE RIGHT TO JUST COMPENSATION FOR PROPERTY TAKEN FOR A PUBLIC PURPOSE.

THE RIGHT TO RELIEF PAYMENT ON COMPENSATION WHEN A NEW LAW, REGULATION OR ORDINANCE OF THE STATE OR POLITICAL ENTITY UNFAIRLY AFFECTS YOUR PROPERTY.

AS ALSO INDICATED I WANT YOU TO TAKE JUDICIAL NOTICE THAT THERE IS NO REPORT FOR COMPETENCE SUBSTANTIAL EVIDENCE FOR YOU GUYS TO RULE AGAINST HER IN ANY WAY SHAPE OR FORM. ALSO HAROLD VERSUS HINKLE 1908 STATES THAT YOU MUST REALIZE ALL YOUR ORDINANCES ARE NOT LAW THEY ARE CORPORATE BYLAW THAT'S WE THE PEOPLE HAVE THE RIGHT TO RENT OUR PROPERTY. THANK YOU.

>> ANYONE ELSE WISHING TO ADDRESS THE COMMISSION ON THIS ISSUE, PLEASE COME FORWARD. ALL RIGHTY CLOSE THE PUBLIC HEARING.

AND I WILL ENTERTAIN DISCUSSION OR A MOTION. MADAM MAYOR.

I MOVE TO APPROVE WITH THE FIVE STAFF RECOMMENDATIONS COMMITTEE OMITTING THE

INSURANCE REQUIREMENT. >> THERE'S A SECOND. >> SECOND.

>> CALL ROLL PLEASE. >> MR. ALEXANDER. >> YES.

>> COMMISSIONER JOHNSON. >> YES, MA'AM. >> COMMISSIONER PERONA.

>> YES. >> COMMISSIONER SESSIONS. >> YES.

>> MAYOR HUDSON. >> YES, MA'AM. >> THANK YOU VERY MUCH.

>> GOOD NIGHT YOU ARE WELCOME TO STAY ON THE CALL IF YOU WOULD LIKE TO HEAR

THE REST OF THE MEETING. >> NOT PARTICULARLY I DO ENOUGH MEETINGS ON ZOOM WITH OTHER BOARDS. THANK YOU VERY MUCH FOR THIS HEARING AND THANK YOU FOR

YOUR APPROVAL. GOOD NIGHT NOW. >> YES, MA'AM.

[b. Quasi-Judicial Hearing - Application for Conditional Use with No New Construction submitted by property owner, Nick Danaluk, and applicant, Michelle Longarzo, for Conditional Use to operate a Dwelling Rental, offering lodging for less than six (6) months with a minimum rental period identified as two (2) days. The property is located at 715 South Ocean Drive, Unit L, and is zoned Hutchinson Island Medium Density Residential (R-4A). Parcel ID: 2401-504-0012-000-1.]

>>> THE NEXT ITEM IS A QUASI-JUDICIAL HEARING ON AN APPLICATION FOR CONDITIONAL USE WITH NO NEW CONSTRUCTION SUBMITTED BY PROPERTY OWNER NICK DANALUK AND APPLICANT MICHELLE LOGARZO FOR CONDITIONAL USE TO OPERATE A DWELLING RENTAL OFFERING LODGING FOR THAN SIX MONTHS WITH A MINIMUM RENTAL PERIOD OF TWO DAYS.

THE PROPERTY IS LOCATED AT 715 SOUTH OCEAN BOULVARD UNIT L AND IS ZONED

[01:50:04]

HUTCHINSON ISLAND MEDIUM DENSITY. HAVE THE ADVERTISING

REQUIREMENTS BEEN MET? >> ADVERTISING REQUIREMENTS FOR THIS ITEM HAVE BEEN MET.

CAN YOU ASK THE COMMISSIONERS FOR EX PARTE COMMUNICATIONS PLEASE.

>> YES, COMMISSIONER ALEXANDER HAVE YOU HAD EX PARTE ON THIS MATTER?

>> NO I HAVEN'T. >> COMMISSIONER JOHNSON? >> YES, MA'AM, I BELIEVE THAT I HAVE SPOKE WITHIN THE APPLICANT ABOUT THIS PROPERTY BEFORE.

>> COMMISSIONER PERONA? >> YES, MA'AM, I DON'T KNOW IF IT'S UNIT L BUT IT WAS IN

GENERAL TO 715 SOUTH OCEAN DRIVE. >> THANK YOU,

COMMISSIONER SESSIONS. >> THAT UNIT LOOKS FAMILIAR. I PROBABLY DID.

>> MAYOR HUDSON. >> YES, IT HAS BEEN A WHILE BUT I HAVE SPOKEN ABOUT 715

OCEAN DRIVE, YES. >> THANK YOU. >> AND NOW WE WILL PROCEED WITH SWEARING IN THE WITNESSES. ANYONE WISHING TO SPEAK ON THIS ISSUE PLEASE STAND AND RAISE YOUR RIGHT HAND. DO YOU SWEAR OR AFFIRM TO TELL THE TRUTH THE WHOLE TRUTH AND NOTHING BUT THE TRUTH?

>> YES. >> THANK YOU. >> READY.

STAFF WILL MAKE ITS PRESENTATION. >> HI, MAYOR MEMBERS OF THE COMMISSION. THIS IS SECOND VARY INDICATION RENTAL BEFORE YOU THIS EVENING FOR CONDITIONAL USE APPROVAL WITH NO NEW CONSTRUCTION.

THIS PRESENTATION AND THE SUBSEQUENT ONE WILL BE IN THE SAME DEVELOPMENT HOWEVER IN TWO DIFFERENT BUILDINGS. SO THE UNIT BEFORE YOU IS THE DANALUK REQUESTING MINIMUM OF TWO DAY RENTAL. IT'S LOCATED 715 SOUTH OCEAN DRIVE IN UNIT L.

IT'S REFLECTIVE ABOVE WITH A COMBATIBLE ZONING OF HUTCHINSON MEDIUM DENSITY RESIDENTIAL 4A. THE CITY PASSED IN 2001 OUR ORDINANCE WHICH ALLOWED FOR DWELLING RENTALS AS CONDITIONAL USES IN CERTAIN RESIDENTIAL ZONING DISTRICTS AND STAFF HAS REVIEWED THROUGH OUR T.R.C. ANY CODE ENFORCEMENT OR POLICY POLICE DEPARTMENT VIOLATIONS AND THERE ARE NONE. THE STATE PASSED THEIR REGULATIONS IN 2011, WITH THAT, ANY LOCAL LAW ORDINANCE OR REGULATION MAY NOT PROHIBIT A VARY INDICATION RENTALS OR REGULATE THE DURATION OR FREQUENCY OF RENTAL OF VACATION RENTALS. PLANNING BOARD RECOMMENDED ON SEPTEMBER 8TH, 2020 A RECOMMENDATION OF 7-0 RECOMMENDING APPROVAL OF THE CONDITIONAL USE TO REQUIRE THIRD PARTY LIABILITY. AT THAT MEETING AGAIN LIKE I SAID, THAT WAS A DUPLICATE, I APOLOGIZE THIS WOULD ADD CONDITION 6 THE THIRD PARTY LIABILITY INSURANCE REQUIREMENT. STAFF AGAIN IS RECOMMENDING APPROVAL OF THIS APPLICATION HOWEVER, WITH THE REMOVAL OF CONDITION 6 AT THIS TIME.

THE CITY COMMISSION'S ACTIONS ARE TO APPROVE THE PROPOSED CAN CONDITIONAL USE SUBJECT TO ALL SIX CAN CONDITIONS OF APPROVAL APPROVAL OF THE PROPOSED CONDITIONAL USE WITH A CHANGE RECOMMENDED OR REQUESTED BY PLANNING STAFF TO REMOVE CONDITION 6 AT THIS TIME OR DISAPPROVE OF THE PROPOSED CONDITIONAL USE. I'M HERE TO ANSWER ANY QUESTIONS.

ANY QUESTIONS OF STAFF? ANY QUESTIONS OF STAFF? OKAY.

NOW I WOULD LIKE THE APPLICANT TO COME FORWARD PLEASE.

DO YOU HAVE ANY QUESTIONS OF STAFF? >> YES, REAL QUICK.

MISS HOFMEISTER DO YOU HAVE A REPORT OF COMPETENCE OF SUBSTANTIAL EVIDENCE TO

BRING FORWARD OF ANYTHING DENYING THIS PERMIT? >> I DO NOT.

OKAY. THAT'S IT. >> YOU MAY BE EXCUSED.

>> THANK YOU. THANK YOU, GENERAL ER IF. STATE YOUR NAME AGAIN FOR US

AND YOUR ADDRESS WE KNOW WHO YOU ARE BUT FOR THE RECORD. >> LONGOGARZA UNIT L.

>> LET ME GET MY NOTES OUT HERE. IN UNIT L WE HAVE LIKE SHE HAD STATED ON THE RECORD THERE WAS ON THE INITIAL NOTIFICATION I HAVE FIVE CONDITIONS FIRST THE PROPERTY MANAGER OF THE VACATION RENTAL SHALL BE AVAILABLE AT ALL TIMES TO RESOLVE COMPLAINTS THAT WAS ONE OF THE CITY CODES.

MANAGER SHALL RESIDE IN ST. LUCIE COUNTY AND SHALL BE REGISTERED WITH FORT PIERCE. WE AGREED THAT. WE AGREE WITH THE GUIDE BOOKLETS WE ALREADY HAVE THEM IN OUR OTHER UNIT THAT'S NO PROBLEM.

THE APPLICANT SHALL FILE FOR ST. LUCIE COUNTY AND CITY OF FORT PIERCE BUSINESS TAX WE

[01:55:01]

HAVE THAT CURRENTLY. WE WILL ADD THIS PROPERTY ONTO THAT.

WE ARE ALREADY LICENSED BY FLORIDA DEPARTMENT OF BUSINESS PROFESSIONAL REGULATIONS. WE HAVE NO OBJECTION OF TWO VEHICLES.

THE CITY OF FORT PIERCE BUSINESS TAX LICENSE SHALL BE INCLUDED IN ALL ADVERTISEMENTS. WE ALREADY CURRENTLY DO THAT AND WE HAVE NO OBJECTION TO THAT. MY CLIENT JUST WANT TO REITERATE THE CONSTITUTIONAL RIGHTS. HE IS THE LEGAL PROPERTY OWNER OF 715 SOUTH OCEAN DRIVE UNIT L. HE HAS THE RIGHT TO ACQUIRE, POSSESS AND PROTECT HIS PROPERTY. HE HAS THE RIGHT TO USE AND ENJOY HIS PROPERTY WITH THE RIGHT TO EXCLUDE OTHERS, RIGHT TO DISPOSE OF PROPERTY, THE RIGHT TO DUE PROCESS AS WE ARE HERE TODAY. AND THE RIGHT TO THE JUST COMPENSATION TAKEN FOR PUBLIC PURPOSE. TO RELIEF PROPERTY COMPENSATION WITH REGULATION OR ORDINANCE THAT UNFAIRLY AFFECTS THE PROPERTY. AGAIN I WILL ASK YOU TO TAKE JUDICIAL NOTICE OF THE INTERPRETATION REPORT 8027 AND TAKE JUDICIAL NOTICE OF BINDING INTERPRETATION REPORT 179 DATED MARCH 3RD ,2020.

ALSO I WOULD LIKE YOU TO TAKE JUDICIAL NOTICE OF HAR OLD VERSUS HINKLE 1908 WHICH I ALREADY STATED ON THE RECORD. WITH REGARDS TO THE INSURANCE ISSUE IF YOU WANT TO READ INFORMAL INTERPRET REPORT 8027 I KNOW THIS IS RELATED TO FIRE ISSUES BUT IT DOES STATE IN THIS PARTICULAR INTERPRETATION THAT YOU CANNOT REQUIRE OTHER THAN YOU WOULD FOR NEW CONSTRUCTION.

SO IF YOU ARE BUILDING A NEW HOUSE AND YOU CAN'T FORCE THEM TO HAVE SOME KIND OF LIABILITY INSURANCE JUST BECAUSE THEY HAVE CHILDREN OR THEY MAY HAVE A PIT BULL OR WHATEVER THEY CAN SEE DEEM AS DANGEROUS TO THE CITY JUST SO THE PERCEPTION IS CLEAR THAT YOU KNOW WE HAVE THE RIGHT TO RENT IT. I DID SPEAK WITH MRS. HOFMEISTER WITH REGARDS TO THAT VRBO OR AIRBNB WHICH IS MOSTLY WHO PEOPLE RENT WITH THEY DO HOLAN INSURANCE POLICY WHICH MOST OF THEM -- THEY DO HOLD AN INSURANCE POLICY WHICH IS WHILE THAT PERSON IS RENTING SUBJECT TO TWO DAY RENTAL OR 30 DAY RENTAL IF GOD FORBIDS SOMETHING HAPPENS TO THE PROPERTY IT IS INSURED THROUGH A THIRD PARTY. SO THEY HAVE THEIR OWN INSURANCE.

THEY'VE BEEN DOING THIS A LONG TIME. I THINK VRBO IS LIKE 25 YEARS OR SOMETHING OR MAYBE THAT'S LIKE AIRBNB THEY'VE BEEN DOING IT FOR A WHILE.

I THINK THEY'RE PRETTY GOOD AT YOU KNOW TAKING CARE OF THE WHOLE INSURANCE ISSUE.

I THINK IT'S CONSTITUTIONALLY RIGHT TO FORCE, YOU KNOW, AN OWNER TO ADD THIS INSURANCE ONTO IT ESPECIALLY WHEN YOU HAVE YOU KNOW YOU HAVE OTHER BUSINESSES THAT DON'T HAVE TO THAT CAN COULD BE EVEN DEEM EVEN MORE DANGEROUS THAN THE WAY IT'S PERCEIVED AS A VACATION RENTAL. I HAVE HAD THE OTHER VACATION RENTAL ALMOST EXACTLY ONE YEAR TO TODAY. I WAS HERE WE HAVE IN NO PROBLEMS, WE'VE HAD NO POLICE CALLS. I AM THE PROPERTY MANAGER AND I HAVE NO ISSUES AND AM IN REGULAR COMMUNICATION WITH MY CLIENTS. FORTUNATELY, WE HAVEN'T HAD ANY ISSUES. I'M VERY THANKFUL. I HAVE TRIED OTHERS IN THE COMMUNITY TO BE JUST AS FORTHRIGHT WITH THEIR CLIENTS AND BE INVOLVED BECAUSE I THINK THAT'S THE KEY TO NOT HAVING ISSUES IS BEING AVAILABLE.

I'M ON CALL 24/7. IF THERE'S A PROBLEM THAT COMES UP FOR WHATEVER REASON WHETHER THEY'RE ILL OR WE PUT ON OUR SITE YOU KNOW, WAYS TO GET A HOLD IF THEY COME IN FROM ANOTHER STATE WE HAVE IN OUR REFRIGERATOR THE LOCAL POLICE DEPARTMENT, THE LOCAL FIRE DEPARTMENT, YOU KNOW ALL OF THOSE LOCAL THINGS THAT COULD BE POSSIBLY LIFE-THREATENING WE KEEP A FIRE EXTINGUISHER. I KEEP UP AWS AND STUFF LIKE THAT. SO I CONSIDER MR. DANALUK A RESPONSIBLE VACATION RENTAL OWNERS AND I HOPE EVERYBODY KIND OF FOLLOWS SUIT TO WHAT WE'RE DOING AND THAT'S JUST HOW I FEEL ABOUT THAT WHOLE INSURANCE ISSUE. DOES ANYBODY HAVE ANY

[02:00:01]

QUESTIONS? >> ARE THERE ANY QUESTIONS OF THE APPLICANT?

>> COMMISSIONER JOHNSON. >> YOU BRING UP A GOOD POINT IT SPURRED SOME THOUGHTS ON LIFE SAFETY. DOES THE BUILDING HAVE EXIT LIGHTING AT THE STAIRWELLS IN CASE OF AN EMERGENCY WHERE THERE'S A FIRE THE POWER GOES OUT? WE HAVE TO EXIT THE BUILDING IS THERE EMERGENCY LIGHTING OR INDOOR EXIT SIGNS?

>> IN OUR UNIT WE HAVE A FIRE SAFETY PLAN. BUT -- THERE'S NO LIT SIGN, NO. I HAVE AN EXIT SIGN ON BOTH OF MY EXIT BECAUSE YOU HAVE TO HAVE TWO EGRESSES SO I HAVE IT ON THE DOOR AND I HAVE IT ON THE WINDOW WHICH ARE MY TWO ESCAPE ROUTES IN D. THEN WHEN IT COMES TO L WE'LL DO THE SAME THING AND WE'RE ALSO GOING TO PROVIDE A FIRE LADDER BECAUSE THAT ONE IS ON THE SECOND FLOOR. SO GOD FORBID THERE'S A PROBLEM YOU KNOW THE LADDER IS RIGHT THERE AND LIKE I SAID I ALWAYS, ESPECIALLY IF THEY HAVE NOT THAT NOT EVERYONE IS IMPORTANT BUT IF THEY HAVE SMALL CHILDREN I GREET THE PEOPLE THERE AND I ACTUALLY WALK THROUGH THROUGH THE PROPERTY AND SHOW THEM THOSE TYPES OF CRITICAL SAFETY, LIFE SAFETY BECAUSE I DON'T WANT ANYTHING NEGATIVE TO HAMP I KNOW WE HAVE DISCUSSED ABOUT THE WHOLE FIRE SPRINKLER WHICH AGAIN THAT KIND OF GOES WITH THAT WHOLE INFORMAL INTERPRETATION 8027 WHEREOF IT SAYS IT CAN'T BE -- WHERE IT SAYS IT CAN'T BE IMPLEMENTED I TALK WITH THEM ON A REGULAR BASIS. IF I HAVE EVER HAD ANY QUESTIONS HE GETS BACK TO ME

LITERALLY RIGHT AWAY. >> I APPRECIATE THAT, ANYBODY THAT'S NEW COMING IN THEY'RE NOT AS FAMILIAR WITH THE PROPERTY AS AN OWNER WOULD BE IF THEY ARE GOING TO AND FRO EVERY DAY. JUST BY YOU PROVIDING THAT INFORMATION I THINK IT'S AN ADDED BENEFIT. THE CHARACTER OF THE BUILDING MIGHT BE CHANGING A LITTLE BIT AND THAT'S OKAY. IT IS. THAT'S NOT CHANGING MY DECISION BUT HAVE YOU PROVIDED SOME GOOD INFORMATION ON WHAT YOU DO

FOR YOUR CLIENTS. >> YES. EYE MEAN I DID SPEAK WITH -- I MEAN I DID SPEAK ABOUT HIM REGARDING OTHER THINGS WE COULD POSSIBLY DO.

WE ALSO HAVE OUR OWN ENGINEER AND I ACTUALLY WANT TO MAKE OTHER MORE YOU KNOW, MORE SAFE AN EGRESS LIKE IN UNIT D. I WOULD LIKE TO BE ABLE TO CHALK THE WINDOW ANDIC MAIT A SLIDER OR FRENCH DOOR. BUT TO GET UP AND OVER A WINDOW IS MUCH MORE DIFFICULT THAN TO GET THROUGH A SLIDING DOOR BUT I HAVE TO FIGHT MY H.O.A. GETTING THAT CHANGED. AM I ALLOWED TO I DO BROUGHT HIM OVER. NOT THAT I CAN'T DO IT OR CAN'T FILE A PERMIT FOR IT BUT IT'S BECAUSE IN OUR H.O.A. DOCS IT BASICALLY SAYS EVERYTHING HAS TO LOOK THE SAME SOOMPT IF WE HAVE ONE AND EVERYTHING ELSE DOESN'T HAVE ONE THEN IT CHANGES THE FACADE AND THAT'S NOT ALLOWED. BUT I HAVE PETITIONED FOR THAT FOR D EVEN STILL BECAUSE I REALLY FEEL THAT'S THE SAFEST WAY IS A DOOR AND

A SLIDER OR A FRENCH. YEAH. >> THANK YOU VERY MUCH.

>> OKAY. >> ANY OTHER QUESTIONS. >> CLARIFICATION THIS IS

YOUR RESIDENCE, RIGHT? >> WHICH ONE? >> L I THINK YOU IDENTIFIED

YOURSELF AS 715 UNIT L IS YOUR ADDRESS? >> SOMETIMES.

I RESIDE IN A FEW DIFFERENT LOCATIONS. BUT I MEAN IF IT'S OPEN I'M

THERE SOMETIMES. >> ALL RIGHT. I JUSTIFY WANT TO MAKE SURE I UNDERSTOOD THAT. THAT ADDRESS THAT YOU GAVE US FOR YOUR HOME ADDRESS SOUNDS JUST LIKE THE ONE THAT WE'RE TALKING ABOUT RIGHT HERE.

>> I THINK D IS ON MY APPLICATION NOTICE AS THE APPLICATION PRIMARY.

>> I JUST WANT TO BE CLEAR ON THAT. >> I MEAN, COME TWO DAYS AND STAY WITH MICHELLE AND THAT MIGHT BE -- GET READY BECAUSE WE JUST PURCHASED M SO I'LL BE BACK. I WONDER IF YOU GUYS WILL MISS ME IF I'M NOT HERE.

>> AND ALSO THREE OTHER PEOPLE HAVE EMPLOYED ME BECAUSE THEY'RE HAVING DIFFICULTIES WITH GETTING THROUGH THE PAPERWORK. I HAVE TALKED TO MRS. HOFMEISTER ABOUT I'M AVAILABLE I SAID THIS BEFORE IF ANYBODY WANTS MY HELP YOU KNOW WHETHER IT BE A RESIDENT, OR YOU KNOW TO HELP I FEEL LIKE I'VE GONE THIS FAR AND I DIDN'T KNOW ANY OF THIS STUFF BEFORE I MET THE CITY OF FORT PIERCE COMMISSIONERS, I DIDN'T KNOW ANY OF THIS STUFF. BUT I'M WILLING TO HELP.

>> ANY OTHER QUESTIONS OF APPLICANT? >>.

>> I ALWAYS SAY GOOD THINGS YOU ABOUT GUYS. >> THANK YOU VERY MUCH.

IS THERE ANYONE ELSE THAT WOULD LIKE TO ADDRESS THIS ISSUE? PLEASE COME FORWARD. ANYONE ELSE? ALL RIGHT.

[02:05:01]

SO WE'LL CLOSE THIS PUBLIC HEARING AND WE WILL ENTERTAIN DISCUSSION OR A

MOTION. >> I MOVE FOR APPROVAL WITH THE FIVE RECOMMENDATIONS.

>> THERE'S A MOTION AND SECOND. >> CALL ROLL.

COMMISSIONER ALEXANDER. >> YES. >> COMMISSIONER JOHNSON.

STAFF REVIEWS CODE ENFORCEMENT OR POLICE DEPARTMENT VIOLATIONS IF THERE ARE ANY THERE ARE NO VIOLATIONS AT THIS PROPERTY. AND IN 2011, OUR STATE LEGISLATURE PASSED THEIR REGULATIONS WITH REGARD TO THE VACATION RENTALS AND IT STATED THAT NO THAT A LOCAL LAW ORDINANCE OR RECOMMENDATION MAY NOT REGULATE THEIR DURATION OR FREQUENCY. THE PLANNING BOARD RECOMMENDATION ON SEPTEMBER 8TH WAS RECOMMENDING APPROVAL WITH THE CONDITION TO ADD THIRD PARTY LIABILITY INSURANCE. SUBSEQUENTLY, STAFF IS MAKING A RECOMMENDATION TO POSTPONE CONSIDERATION OF THAT CONDITION SIX AND GO WITH OUR FIVE STANDARD CONDITIONS OF APPROVAL THAT WE HAVE BEEN PRESENTING TO THE COMMISSION FOR ABOUT A YEAR NOW. I'M HERE TO ANSWER ANY

QUESTIONS. >> ANY QUESTIONS OF STAFF? >> OKAY.

THANK YOU VERY MUCH. SO NOW I WOULD LIKE FOR THE APPLICANT TO COME FORWARD PLEASE. THIS IS THE PUBLIC HEARING. AND YOU HAVE BEEN SWORN IN.

STATE YOUR NAME FOR THE RECORD AND MOTOR SHELL LONGARZO 715 SOUTH OCEAN

DRIVE UNIT B. DO HAVE YOU ANY QUESTIONS. >> MISS HOFMEISTER DO YOU HAVE A REPORT OF COMPETENCE SUBSTANTIAL EVIDENCE TO PRESENT TONIGHT?

>> NO, THERE IS NO VIOLATIONS. >> OKAY.

>> YOU MAY BE EXCUSED. >> THANK YOU. >> OKAY THIS IS FOR MRS. BALLIANTYNE I'M HER PROPERTY APPRAISER SHE LIVES IN PALM BEACH COUNTY.

IT IS IN OUR BUILDING AS WELL. I JUST WOULD LIKE FOR I'M JUST GOING TO REPEAT THE SAME THING BECAUSE IT'S QUASI-JUDICIAL HEARING I WOULD LIKE YOU GUYS TO TAKE JUDICIAL NOTICE OF HER RIGHTS THE RIGHT TO ACQUIRE AND POSSESS AND PROTECT HER PROPERTY. THE RIGHT TO USE AND ENJOY HER PROPERTY. THE RIGHT TO EXCLUDE OTHERS FROM HER PROPERTY.

THE RIGHT TO DISPOSE OF HER PROPERTY. THE RIGHT OF DUE PROCESS AS WE ARE HERE FOR QUASI-JUDICIAL. THE RIGHT TO COMPENSATION FOR PROPERTY TAKEN FOR A PURPOSE PURPOSE. THE CAN CONVERSATION AND THE NEW LAW REGULATION OR ORDINANCE AT THE STATE OR POLITICAL ENTITY UNFAIRLY ACHES HER PROPERTY. -- AFFECTS HER PROPERTY. I WOULD JUST LIKE YOU TO TAKE JUDICIAL NOTICE OF BINDING INTERPRETATION REPORT NUMBER 179.

ALSO TAKE JUDICIAL NOTICE OF INFORMAL INTERPRETATION ON NUMBER 8027 ALSO TAKE

[02:10:08]

JUDICIAL NOTICE OF HAR OLD VERSUS HINKLE SUPREME COURT LAW OF 1908.

ON MRS. MRS. BALLIANTYNE'S BEHALF SHE HAS NO OPTIONS TO THE FIVE RECOMMENDATIONS PRESENTED BY MRS. HOFMEISTER. I JUST WOULD LIKE TO BRING NOTICE TO THE COMMISSIONERS THAT I HAVE TRIED TO REGISTER AS A PROPERTY REPRESENTATIVE BEFORE THEY HAD REQUESTED THAT YOU FILE WITH THE COUNTY OR YOU FILE WITH YOU KNOW LIKE IF SOMEBODY WERE TO HAVE A COMPLAINT IN THE PUBLIC. THERE IS NOWHERE TO REGISTER FOR THAT. FOR THE ONE THAT'S WE OWN WE KEEP ON TOP OF OUR OWN BUT I WILL DO THE SAME FOR MRS. BALLIANTYNE BUT THERE ISN'T REALLY ANYWHERE TO FILE THIS. I DON'T KNOW IF YOU WANT TO LOOK INTO THAT.

I KNOW IT'S ONE OF THE REQUIREMENTS AND I HAVE TRIED.

I HAVE CALLED THE COUNTY AND THERE'S NOBODY SEEMS TO KNOW WHERE YOU'RE SUPPOSED TO REGISTER AS THE PROPERTY MANAGER. SO THAT WAS THAT.

I DON'T THINK WE HAVE ANY ISSUES WITH REGARDS TO THIS. I KNOW THAT SHE WOULD HAVE LIKED TO HAVE SPOKEN BUT SHE IS I THINK OUT OF TOWN. DO YOU GUYS HAVE ANY

QUESTIONS REGARDING THIS? >> QUESTIONS OF THE APPLICANT.

ANY QUESTIONS OF THE APPLICANT? >> OKAY, THANK YOU VERY MUCH. ANYONE ELSE WISHING TO SPEAK TO THIS ISSUE PLEASE COME

FORWARD. >> I HAVE SOMEBODY THAT SUBMITTED WRITTEN COMMENTS.

>> ALL RIGHTY. >> THIS IS FROM CHARLENE ADAIR OF 1710 FRANCIS COURT.

MADAM MAYOR AND COMMISSIONERS I RESPECTFULLY ASK THAT YOU ADD CONDITIONS TO THOSE LISTED THAT ADDRESS THE FOLLOWING ISSUES IN ORDER TO ENSURE THE WELL-BEING AND SAFETY OF THE COMMUNITY AND OF THE RENTERS OF THIS PROPERTY.

NO PERMITS ISSUED CONDITIONAL USE BTR UNTIL ALL REQUIREMENTS ARE SUCCESSFULLY MET AS LISTED IN THE T.R.C. COMMENTS BY BUILDING AND THE FIRE MARSHAL. CHANGE OF USE TO TRANSIENT, SITE PLANS, PLEASE INDICATE FOR THE PUBLIC REASSURANCE EXACTLY HOW THIS WILL BE MANAGED AND BY WHOM.

MAX NUMBER OF PEOPLE ALLOWED IN THE UNIT. THIS IS A GREAT SPRING BREAK LOCATION. REQUIREMENT TO PERFORM BACKGROUND CHECKS PER ARTICLE 17 THE CHILD SAFETY ORDINANCE SECTION 21-277 WITH FLORIDA STATUTE 7775.515 THIS PROPERTY IS ACROSS THE STREET FROM ONE PUBLIC PARK AND CLOSE TO SEVERAL OTHERS. POST A SIGN ACCESSIBLE TO INDICATE THE 24/7 PROPERTY MANAGER AND CONTACT INFORMATION FOR RESPONSE TO ISSUES RESPECTFULLY

SUBMITTED CHARLENE. >> IS THAT SWORN TESTIMONY. >> YES, MA'AM.

IT HAS BEEN ATTACHED TO THE AGENDA. >> OKAY.

THANK YOU VERY MUCH. SO BEFORE I CLOSE THE PUBLIC HEARING WOULD THE APPLICANT LIKE TO RESPOND TO ANY OF THAT PLEASE.

>> OKAY. WITH REGARDS TO THE FIRE MARSHAL IT'S ALREADY A KNOWN FACT THAT THE FIRE MARSHAL HAS NOTHING TO DO WITH THESE BECAUSE IT'S CONSIDERED A RESIDENCE. I KNOW THAT ON THE RECORD BEFORE I HAVE MADE STATEMENTS WITH REGARDS TO THE POSITION HE HAS NO POSITION OVER THIS BECAUSE IT'S NOT A COMMERCIAL PROPERTY. THIS IS A RESIDENTIAL PROPERTY THEREFORE, AGAIN, I GUESS I SHOULD READ 8027 ON THE RECORD BECAUSE SHE'S

BRINGING UP FIRE SPRINKLERS. HANG ON. >> YOU DO HAVE A TIME LIMIT

DURING THIS TIME. >> THREE MINUTES. WELL, BASICALLY IN 8027 IT SAYS STATUTE 23 -- PROPERTY OWNER MAY NOT REQUIRE FIRE SPRINKLERS IN ANY RESIDENTIAL PROPERTY BASED UPON USE OF SUCH PROPERTY RENTAL OR AS A CHANGE IN RECLASSIFICATION OF A PROPERTY AS A PRIMARY USE AS FAR AS TWO REPRESENTAL.

IT DOES STATE THAT IN THE FLORIDA DEPARTMENT OF PROFESSIONAL REGULATIONS INFORMAL INTERPRETATION, 8027. THIS IS THE FIRST TIME I'M

[02:15:03]

SEEING THIS THING WITH CHARLENE ADAIR, SORRY. SO THE SPRINKLES ARE OUT SHE DOESN'T HAVE ANY REQUIREMENTS. AS SOON AS THE PERMIT IS ISSUED SHE HAS NO PROBLEM FILING THE B.T.R. WITH ST. LUCIE COUNTY AND B.T.R.

WITH FORT PIERCE. B.T.R. THE B.D.P.R. AND ANY OF THE OTHER REQUIREMENTS I WILL BE HELPING HER. SHE WILL BE STARTING A COMPANY IT WILL ALL BE LEGITIMATE AS WE RUN OURS. AS FAR AS THE MAX PEOPLE ALLOWED IN THE UNIT THERE'S ALREADY AN ORDINANCE IN FORT PIERCE THAT STATES WHAT THAT IS AND I BELIEVE IT'S THREE

PEOPLE, BECAUSE IT GOES BY SQUARE FOOTAGE. >> RIGHT.

>> SO BACKGROUND CHECKS. >> THANK YOU. >> I WAS GOING TO TRY TO

HELP YOU. >> THE BACKGROUND CHECKS IF IT'S ON AIRBNB THEY DO A BACKGROUND CHECK RIGHT AWAY AS PART OF THEIR PROTOCOL IF YOU HAVE A FELONY YOU CAN'T RENT THROUGH AIRBNB. VRBO HAS, I BELIEVE A SIMILAR POLICY.

THERE IS NO NO RULE OR REGULATION ON THE BOOK THAT SAYS YOU HAVE TO DO A BACKGROUND CHECK. THERE IS NO AGENCY YOU CAN'T CALL, YOU CAN'T EVEN CALL FORT PIERCE POLICE DEPARTMENT AND ASK ABOUT SOMEONE BECAUSE THERE IS AN ACTUAL LAW THAT SAYS IF THEY CANNOT PULL ANYONE'S RECORD UNLESS THEY ACTUALLY HAVE REASON TO PULL IT. SO EVEN IF I WANTED TO LOOK UP SOMETHING ON ANYBODY I CAN'T JUST GO TO THE POLICE DEPARTMENT WELL, I DON'T LIKE SO AND SO AND HERE'S THEIR INFORMATION THEY'RE NOT ALLOWED TO BY LAW. SO THERE'S NO OTHER AGENCY TO BE ABLE TO DO THAT. IF YOU CAN'T DO IT WITH FORT PIERCED IN THIS IS OUR CITY WHERE DO THEY EXPECT US TO PULL THESE BACKGROUND CHECKS?

IT'S VETTED AND INSURED. >> OKAY. THANK YOU.

THANK YOU VERY MUCH. >> YOU DID IT IN TIME. >> GOOD JOB.

WE'RE CLOSING THE PUBLIC HEARING. SO ENTERTAIN A MOTION OR A

>> SECOND. >> ANY DISCUSSION? CALL ROLL PLEASE.

WE ARE LOOKING FORWARD TO BOTH SIDES OF THE ARGUMENT TO GIVE YOU GUYS GOOD DATA.

[02:25:04]

BUT I WANTED TO SAY THANK YOU VERY MUCH FOR THE PROCESS WHAT WAS GLAD TO BE

APART OF IT. >> THANK YOU VERY MUCH. >> ANYONE ELSE WISHING TO

ADDRESS THE COMMISSION PLEASE COME FORWARD. >> GOOD EVENING, MAYOR.

COMMISSIONERS, MY NAME IS EILEEN CLARK AND I'M HERE TONIGHT TO VOICE A CAN CONCERN ABOUT A ROOMING HOUSE THAT'S BEING RENOVATED ON 1309 NORTH 19TH STREET.

WHICH IS RIGHT AT THE CORNER OF M AND 19TH STREET. MY POINT IN COMING BEFORE THE COMMISSION TONIGHT IS THAT THIS BUILDING HAS BEEN CLOSED FOR THE LAST 10 YEARS.

IN RECENT MONTHS SOMEONE CAME IN, IT'S A CONTRACTOR, AND STARTED RENOVATING THIS BUILDING. FIRST THEY DID PLUMBING, THEN THEY DID ELECTRICAL WORK THEN THEY DID ALL TYPE OF RENOVATIONS. AS CONCERNED NEIGHBORS, MY NEIGHBORS BEHIND ME, WE WENT UP TO INVESTIGATE. THERE WAS NO PERMIT IN SIGHT, EXCEPT ONE THAT WAS DATED 2017. SO WE'RE CONCERNED BECAUSE WE DO NOT WANT A ROOMING HOUSE IN THE MIDDLE OF A RESIDENTIAL AREA PLUS, IT'S ONLY MAYBE 100 FEET FROM LINCOLN PARK ACADEMY. IN WHICH WHEN COVID-19 IS OVER WE WILL SEE KIDS WALKING THE STREET FROM SCHOOL TO HOME.

I'VE BEEN LIVING AT THIS ADDRESS SINCE 1977. IN THAT PERIOD OF TIME IT'S BEEN CLOSED 10 YEARS LIKE I SAID. BUT BEFORE THEN WE WOULD SEE THE POLICE TWO OR THREE TIMES A DAY AT THE ROOMING HOUSE.

WE WOULD SEE THE RIGS COME TWO OR THREE TIMES AT THE ROOMING HOUSE.

THERE'S NO PLACE FOR THESE PEOPLE TO SIT AT THE ROOMING HOUSE.

AND MY CONCERN IS THAT WE DO NOT WANT THAT TYPE OF ACTIVITY IN OUR NEIGHBORHOOD. AND I DON'T KNOW IF ALL OF THE CORRECT PROCEDURES WERE DONE IN ORDER FOR THIS PERSON TO COMPLETE THE WORK THAT THEY'VE DONE ON THE BUILDING. I HAVE NO IDEA BUT I'M QUITE SURE MR. MIMMS AND MY CITY COMMISSIONER MR. SESSION WILL LOOK INTO THE SITUATION AND MAKE SURE AND BRING SOMETHING FORTH. I DO HAVE A PETITION TONIGHT FROM THE NEIGHBORS THAT I COULD GET THIS AFTERNOON IN THE RAIN. BUT I CAN REASSURE YOU I WILL HAVE MORE. SO I HAVE MY NEIGHBORS THAT WILL COME AND GIVE ME

SUPPORT. >> PLEASE JUST STATE YOUR NAME.

>> OH, OKAY, DIANE WILLIAMS JOHNSON I RESIDE AT 18 11 AVENUE M.

I AM A PRODUCT OF ST. LUCIE COUNTY. I WAS RAISED IN THE NORTH ENDS OF ST. LUCY COUNTY AND I DECIDED MY HUSBAND AND I TO PURCHASE A HOME IN THE NORTHENED WHICH SITS RIGHT NEAR THAT ROOMING HOUSE. SO WITH KNOWING THE COMMUNITY AND OUT IN THE COMMUNITY WE WITNESSED EVEN WHEN I OPENED THERE WERE SOME KIDS WALKING TO LINCOLN PARK ACADEMY. I AM A SCHOOL BOARD EMPLOYEE I DID E-MAIL THE BOARD CHAIR TODAY AND A COUPLE OF OTHER THEY ASKED FOR MY PERMISSION TO FORWARD MY CONCERN AND I GAVE THEM MY PERMISSION BECAUSE THIS IS VERY SERIOUS, THIS IS SERIOUS BUSINESS, WE HAVE A NICE COMMUNITY AND WE WANT TO KEEP THAT IT WAY. YOU HAVE THINGS GOING ON WITH THE LEADERS MAKING IT BETTER ON THE NORTH END THERE. MR. SESSION YOU LIVE OVER THERE, TOO WE DON'T WANT THIS IN OUR COMMUNITY SO WE'RE JUST ASKING FOR YOUR ATTENTION IN THIS MATTER. MAYOR AND COMMISSIONERS. THANK YOU.

>> THANK YOU VERY MUCH. YES, MA'AM. YES, MA'AM.

[02:30:04]

>> GOOD EVENING MY NAME IS TINA HERICK I LIVE RIGHT ACROSS THE STREET FROM WHERE THIS BOARDING HOUSE OR ROOMING HOUSE IS GOING TO TAKE PLACE.

I HAVE LIVED IN THIS HOUSE FOR ABOUT 10 YEARS. I CAN SAY THAT THIS IS THE QUIETEST NEIGHBORHOOD I HAVE EVER LIVED IN.

I CAN SAY I'M VERY CONCERNED ABOUT WHAT MAY HAPPEN ONCE IT IS OPENED.

I'M REALLY CONCERNED ABOUT THE CHILDREN THAT'S WALKING THROUGH THE NEIGHBORHOOD BECAUSE TIME IS GETTING READY TO CHANGE AGAIN THEN OF COURSE LATEā– R ON SO I'M JUST VERY CONCERNED ABOUT WHAT MAY END UP HAPPENING AND LIKE I SAID I'M RIGHT ACROSS STREET. I CAN SEE EVERYTHING THAT'S COMING AND GOING.

SO I'M JUST VERY COMMITTEE CONCERNED. >> THANK YOU VERY MUCH.

YES. >> MAYOR HUDSON, COMMISSIONERS ALL OF YOU

IT'S A PLEASURE FOR ME TO BE BACK HERE AGAIN. >> STATE YOU YOUR NAME FOR

THE RECORD FOR US PLEASE. >> MR. STAFFORD FISHER. >> I KNOW WHO YOU ARE BUT I

WANT EVERYBODY ELSE. >> I JUST RECOVERED FROM COVID-19 AND IT WAS BAD.

IT WAS BAD. BUT I THANK GOD THAT I OVERCAME AND THAT I HAVE THE STRENGTH TO BE MY WIFE AND I WE LIVE LIKE LESS THAN 20 FEET AWAY FROM THAT ROOMING HOUSE WE HAVE SEEN THE NEXT DOOR HOUSE NEXT DOOR TO US A LOT OF DRUG DEALERS TO HAVE A SCHOOL THAT CLOSE BY WITHIN A MILE MY WIFE AND I WITH ARE PEACEFUL PEOPLE WE HAVE CHILDREN RIDING BICYCLE ON OUR STREET THEY CALL US GRANDMA AND GRANDPA I HAVE BEEN TO ROOMING HOUSE BEFORE DRUGS IS GOING TO MOVE IN ONCE DRUGS MOVE IN THE

CRIMES ARE GOING TO GO UP. >> WE HAVE PEACEFUL COMMUNITY WANT TO KEEP THAT IT WAY. THANK YOU, SIR. ANYONE ELSE WISHING TO

ADDRESS ON THIS ISSUE? >> ALL RIGHTY. THANK YOU SO MUCH.

THANK YOU SO MUCH FOR STAYING AND SHARING THIS WITH US.

WE APPRECIATE IT. >> THANK YOU. >> I WILL FORWARD IT TO MAYOR. ANYONE ELSE WISHING TO ADDRESS THE COMMISSION PLEASE COME FORWARD. HI, I'M SHARON LONGGARZA I'M HERE FOR MRS. FRANCE SHE'S HERE. MISS FRANZDY HER AIT WAS APPROVED WHICH WAS LAST NOT SHE MADE COMMENT SHE WAS AN SURVIVAL SHE DID NOT WANT TO DO -- ENVIRONMENTALIST AND THERE WAS OTHER FORMS LIKE AVAILABLE I'M ASKING THE COMMISSION TO CLARIFY OR TO BE ABLE TO GET THE ENGINEERING DEPARTMENT TO GIVE US NO PUN INTENDED A CONCRETE ANSWER. SO SHE I KNOW WHEN I TALK TO THE ENGINEERING DEPARTMENT I TOLD THEM THERE'S ROCK RIGHT WILL ON MANY DIFFERENT DRIVEWAYS ON BENNY.

SHE JUST WANTS TO USE ROCKS AS HER BASE FOR THAT AREA WHERE SO THAT DOESN'T AFFECT THE ROAD. I THINK MR. JOHNSON WAS WORRIED ABOUT YOU KNOW GOING IN AND OUT AND BEING RIGHT THERE AND DESTROYING THE ACTUAL PHYSICAL ROAD OF FORT PIERCE. SO THAT'S KIND OF WHAT SHE WOULD LIKE IS FOR IT TO BE BROUGHT BACK TO THE COMMISSION IF THAT'S POSSIBLE.

AND REALLY QUICK WITH REGARD TO THE FPUA COMMISSIONER SESSIONS HAD MADE A COMMENT ABOUT SEWAGE COMING UP. WELL, ON HERNANDO I HAVE PICTURES WHERE THE SEWAGE WAS ACTUALLY COMING UP AND WE CALLED THE FPUA AND THE FPUA BASICALLY TOLD US

[02:35:06]

DUE TO THE KING TIDE THERE WAS NOTHING THEY COULD DO IT.

WE TOLD THEM THERE WAS RAW SEWAGE IN THE STREETS AND THEY DID NOTHING.

JUST SO YOU KNOW. SO HOW DO WE BRING FORWARD 1361 BENNY DRIVE DO I NEED

TO MAKE AN APPOINTMENT FOR THAT? >> WHAT WE'LL DO IS WE DON'T HAVE A DIALOGUE RIGHT NOW BUT SOMEBODY WILL GET BACK TO YOU.

>> ALL RIGHT, THANK YOU SO MUCH. >> ANYONE ELSE WISHING TO ADDRESS THE COMMISSION PLEASE COME FORWARD. ANYONE ELSE?

>> RICK REED. ADDRESS PLEASE. 2625 SOUTH U.S. ONE.

TONIGHT WITH REGARDS TO THE CONVERSATION WITH THE FP, A AND THE IMPENDING CUTOFF OF 2700 ACCOUNTS TOMPECK SAID THAT PART OF THOSE WERE COMMERCIAL BUT I'M SURE THE VAST NUMBER I LOOKED WITH HIS PRESENTATION THE VAST NUMBER WERE OF COURSE RESIDENTIAL IF THERE'S THREE PEOPLE IN A HOME AND IT'S 2700 ACCOUNTS YOU CAN IMAGINE HOW MANY PEOPLE Y'ALL ARE GOING TO AFFECT OR THE U.A. IS GOING TO AFFECT.

THE MAYOR OF COURSE SITS ON THAT BOARD. WE HAD ONE OF THE OTHER BOARD MEMBERS SITTING IN THE BACK TODAY. AND Y'ALL CAN'T BE OBLIVIOUS TO COVID. Y'ALL WORK IN THIS BUILDING, MR. MIMMS YOU WERE GONE FOR A FEW DAYS SUPPOSEDLY HAD COME IN CONTACT WITH IT. THE COURTHOUSE IS ON PHASE ONE AGAIN. THEY'VE GOT IT COMPLETELY SHUTDOWN.

YOU CAN'T COME INTO CITY HALL, YOU CAN'T GO INTO THE FORT PIERCE UTILITY AUTHORITY. I AND MY FELLOW BOARD MEMBERS THROUGH LAST WEEK HAD PROVIDED 90,000 FREE MEALS TO OUR CITIZENS. YOU SHOULD STAND IN THAT LINE AND WATCH THE PEOPLE COME. IT'S THE MOST HUMBLING THING.

TO EVEN THINK AT THIS DAY AND TIME ABOUT TURNING OFF PEOPLE'S POWER COMMISSIONER PERONA I COMMEND YOU FOR YOUR KIND WORDS, COMMISSIONER SESSIONS, COMMISSIONER ALEXANDER. I NOTICE THAT WITH COVID THE CITY SHOULD BE AWARE BECAUSE IT SAYS FORT PIERCE EMPLOYEES WERE UNDERPAID FOR WORK DURING PANDEMIC I NOTICE WHEN I MADE A PUBLIC RECORDS REQUEST OF THE 19 THAT I SPOKE ABOUT A FEW WEEKS AGO OF THE 19 EMPLOYEES 1900 THAT MAKE OVER $100,000 IT'S AMAZING THAT WE HAVE THE MONEY FOR CERTAIN EMPLOYEES. I SAW A LADY THAT'S A TICKET TAKER I CALL HER A TICKET TAKER YOU TRANSFERRED HER SHE MADE OVER $100,000 LAST YEAR. AND FOR FUNERAL EXPENSES, FOR VACATION CAN COMP TIME.

I MEAN, IT'S THE BIGGEST SCREWING GOING ON AROUND. AND THEN, OUR EMPLOYEES THAT PICK UP OUR GARBAGE WE'VE DENIED THEM THEIR ABILITY WITH ALL THE CRAP GOES DOWN AT SOLID WASTE WITH MR. REELS THAT'S AN UNBELIEVABLE THING.

NOW Y'ALL WANT TO TURN OFF THE POWER THE U.A. WANTS TO TURN OFF THE POWER TO 2700 ACCOUNTS? I MEAN TALK ABOUT CRUEL. Y'ALL NEED TO PULL YOUR HEAD

OUT OF YOUR ASS YOU REALLY DO. >> ANYONE ELSE WISHING TO ADDRESS THE COMMISSION PLEASE COME FORWARD? ANYONE ELSE? OKAY. WE'LL CLOSE THE PUBLIC HEARING.

PUBLIC COMMENT PERIOD AND MOVE ON. NEXT WELL, HAVE COMMENTS

[15. COMMENTS FROM THE CITY MANAGER]

FROM THE CITY MANAGER. >> MADAM MAYOR MEMBERS OF THE CITY COMMISSION I WANT TO POINT OUT IN YOUR CITY COMMISSION AGENDA UNDER COMMENTS FROM THE CITY MANAGER THERE ARE A COUPLE OF REPORTS ONE OF THOSE REPORTS LINKS BACK TO A MEMORANDUM THAT I SENT YOU EARLIER I BELIEVE LATE LAST WEEK IT WAS ABOUT THE INFRASTRUCTURE. DID AN EXCELLENT JOB GOING THROUGH THAT REPORT AND THAT REPORT IS VERY SPECIFIC IT'S VERY DETAILED AS TO WHAT PROJECTS THAT WE ARE DOING WHAT PROJECTS WE HAVE COMPLETED. OUR RECEIVABLES WITH REGARD TO IS $1SO I REALLY THOUGHT THOUGHT WE WE WOULD SEE MUCH LESS OF A NUMBER DUE TO OUR PANDEMIC NUMBER BUT THAT'S NOT THE CASE. WHAT I HAVE SEEN IS MR. ANDREWS AND HIS TEAM HAVE DONE A VERY GOOD JOB ADMINISTERING OUR CONSTRUCTION PROJECTION WE HAVE PROJECTS COMING UP LIKE OUR RESURFACING PROJECTS.

[02:40:05]

MR. ANDREWS IS ALSO LISTED THOSE STREETS THAT ARE GOING TO BE RESURFACED AND I REALLY WANT YOU ALL TO TAKE A LOOK AT THAT REPORT. IT GIVES YOU A VAST AMOUNT OF INFORMATION AND I THINK WE HAVE A LOT OF CAPITAL IMPROVEMENT PROJECTS COMING UP THAT I WANT TO SIGNIFICANTLY IMPROVE THE APPEARANCE OF THE CITY OF FORT PIERCE. NOW I DO WANT TO ACTUALLY FOLLOW UP ON SOME OF THE THINGS THAT WE HEARD THIS EVENING. 1309 NORTH 19TH STREET I YOU KNOW I GREW UP ON 21ST STREET AND I WALK THAT, I WALK THAT CORRIDOR ABOUT 35 YEARS AGO. MISS CLARK PROBABLY SAW ME OVER THERE WALKING THROUGH.

THAT'S A TOUGH POOL. ACTUALLY I WILL BE HAPPY TO FOLLOW UP ON THAT SITUATION AND FIND OUT EXACTLY WHAT'S GOING ON FOR THAT COMMUNITY. THAT COMMUNITY YOU KNOW MY MOM STILL LIVES DOWN THE STREET THERE. SO YOU CAN COUNT ON ME TO FIND OUT AND I WILL REPORT TO THEY CITY COMMISSION AS SOON AS I FIND OUT WHAT IS HAPPENING. WHAT THE STATUS IS WHAT I CAN TELL YOU THAT IT IS LISTED AS A 10 ROOM 10 BATH, 10 UNIT FACILITY RIGHT NOW. SO I WILL GET BACK TO YOU

WITH THE INFORMATION THAT I FIND. >> AND MR. MIMMS WILL IS AN E-MAIL IN MY E-MAIL WITH THE DETAILS ON THAT WHICH I WILL FORWARD TO YOU FROM MISS WILLIAMS WHICH WAS I JUST GOT RIGHT BEFORE I CAME TO THIS MEETING.

SO IT'S IN WRITING AND YOU WILL HAVE IT. OF COURSE WE HAVE ALL HEARD

IT TONIGHT. >> YES. >> I WILL JUMP ON THAT

IMMEDIATELY. >> WE APPRECIATE THAT. >> HAVEN'T ROOMING HOUSES BEEN OUTLAWED IN FORT PIERCE? WE WILL HAVE TO DEFINITELY I BELIEVE THAT'S WHAT I HAVE BEEN TOLD BUT REST ASSURED THE WAY IT'S BUILT WITH NUMBER OF ROOMS AND NUMBER OF BATHROOMS IT'S A ROOMING HOUSE. JUST WITH ANOTHER NAME IT SHOULDN'T -- -- I KNOW WHAT YOU ARE THINKING ALSO REGARDLESS IF IT'S ALLOWED OR NOT WHAT IS NOT ALLOWED IS THAT TYPE OF WORK BEING THE CONSTRUCTION WORK BEING DONE IN A NEIGHBORHOOD FOR ANYWHERE IN FORT PIERCE WITHOUT A PERMIT.

>> ABSOLUTELY. AND I CAN ATTEST TO BACK IN THE DAY WHICH Y'ALL SPOKE EARLIER WHEN IT WAS A ROOMING HOUSE I USED TO WALK THE STREET FROM LINCOLN PARK COMING IN AND OUT OF THERE IT WAS A MAJOR PROBLEM THEN IT HAS BEEN A MAJOR PROBLEM SINCE THEN UNTIL THE TIME WAS CLOSED DOWN A LOT OF DRUG ACTIVITY.

SO WE DON'T WANT IT TO GO BACK TO WHAT IT WAS LIKE THEY TOLD YOU EARLIER WE GOT A QUIET NEIGHBORHOOD BELIEVE IT OR NOT. WE WANT TO KEEP THAT IT WAY.

>> YES, SIR. THE ONLY THING WE HAVE HELICOPTERS AND NOW WE GONNA HAVE SOME DRONES.

HELICOPTERS FLYING AROUND US ALL NIGHT. WE ARE KEEPING THAT DRUG ACTIVITY AWAY OFF THE STREETS. SO I'M LOOKING FORWARD TO DRONES IN THE NEIGHBORHOOD NOW AS OPPOSED TO HELICOPTERS.

>> YES, SIR. >> SO DEFINITELY WE WILL BE FOLLOWING UP ON THAT.

>> THANK YOU. >> ALSO, THERE IS MR. GUNTHER SPOKE IN THE AUDIENCE WE DEFINITELY WILL BE DISCUSSING THE PARKLET PROGRAM AS IT WAS AND AS IT POSSIBLY COULD BE AND THAT IS GOING TO BE PART OF OUR OCTOBER 27TH FPRA MEETING.

IT IS A JAM-PACKED GENERAL -- AGENDA. WE HAVE A LOT OF ECONOMIC AND REDEVELOPMENT ACTIVITY GOING ON WITH REGARD TO WE HAVE A NEW LEASE COMING UP FOR THE ROOF ROOTED IN CHANGE RIGHT NEXT TO THE LINCOLN THEATER.

WE'RE GOING TO BE OH MY GOSH I DON'T HAVE IT IN FRONT OF ME.

[02:45:01]

WE HAVE A COUPLE PROPERTIES ONE IS 708 NORTH 18TH STREET THAT WE'RE LOOKING AT DISPOSING OF THAT PROPERTY. ALSO WE'RE GOING TO HAVE THE C.R.A. ADVISORY COMMITTEE COME UP WITH RECOMMENDATIONS. WE VERY SHORT LIST THAT IS GOING TO BE DEVELOPED BY Y'ALL FOR THE FISHERMAN'S WHARF REDEVELOPMENT

OPPORTUNITY. >> THE MEANS COURT REPORT. THAT WILL INCLUDE A VISION FOR LINCOLN PARK AND A VISION FOR THE STREET SCAPE OF AVENUE D, THE UTILIZATION OF THE OLD COURT SCHOOL AS WELL AS THE UTILIZATION OF THE JACKIE CANAAN BUILDING WHICH CURRENTLY HOUSES LINCOLN PARK MAIN STREET. WE'RE ALSO GOING TO TAKE A LOOK AT THE OLD MONROE BUILDING RIGHT NEXT TO THE 13TH STREET PLAZA.

SO WE HAVE A SLEW OF ITEMS THAT ARE GOING TO BE INCORPORATED THAT MEETING BEGINS AT 4:00 P.M. ON OCTOBER 27TH. I BELIEVE WE HAVE YOU KNOW A LOT OF INITIATIVES MOVING FORWARD. SO I JUST WANTED TO END OFF ON THE CORONAVIRUS REPORT UPDATE. AND THE REPORT THE ONLY THE HIGHLIGHT ITEMS ARE THE NEW ITEMS. THERE'S NO NEED FOR YOU ALL TO KEEP READING THIS ON A RECURRING MONTHLY BASIS. I WANT TO POINT TO $99,000 THAT WILL BE ADDED TO OUR FLORIDA HOUSING ALLOCATION THAT WILL GIVE US A TOTAL AMOUNT OF $283,000 FROM THAT ORGANIZATION. WE HOPE THAT WE CAN PARTNER WITH ST. LUCIE COUNTY BECAUSE ST. LUCIE COUNTY HAS THE RESOURCES THEY HAVE THE PROGRAM. THEY HAVE THE TECHNOLOGY THAT QUESTION SUPPLEMENT WHAT THEY'RE DOING AND UTILIZE THIS MONEY FOR RENTAL AND MORTGAGE ASSISTANCE. NOW PREVIOUSLY WHEN WE DID THIS, OUR RENTAL AND MORTGAGE ASSISTANCE WENT DIRECTLY TO THE LANDLORD OR THE MORTGAGE HOLDER.

NOW WHAT THE COUNTY, I BELIEVE THE COUNTY, EXCUSE ME, IS GIVING MONEY DIRECTLY TO THE RESIDENTS, AND THE RESIDENT WILL THEN INTURN DETERMINE HOW THEY BEST SEE FIT TO USE THE MONEY. SO WE'RE GOING TO BE MEETING WITH THEM PROBABLY TOMORROW.

OUR STAFF AND THEIR STAFF TO SEE HOW WE CAN WORK TOGETHER TOWARD A COMMON GOAL TO HELP OUR COMMUNITY AND AS YOU HEARD TODAY THERE ARE SEVERAL PEOPLE THAT PROBABLY NEED THE HELP. ONE OF THE THINGS THAT FOLKS HAVE TO DO WHEN THEY'RE LOOKING FOR THIS TYPE OF ASSISTANCE IS JUST DEMONSTRATE THE LOSS.

WHETHER THAT'S A LOSS OF A FAMILY MEMBER A LOSS OF TIME AT WORK A LOSS OF NUMBER OF HOURS TAT HAVE BEEN DELEGATED THROUGH THEIR FLOOR.

SO THAT'S ALWAYS BEEN A CHALLENGE. DEMONSTRATING THAT LOSS.

BUT ONCE THAT LOSS HAS BEEN DEM ZPRAD THEY CAN QUALIFY FOR THE FUNDING.

SO I WANT YOU TO KNOW THAT WE'RE TRYING TO BE PART OF THAT SOLUTION AND WE'RE GOING TO DEEVERYTHING WE POSSIBLY CAN TO HELP OUR COMMUNITY.

-- GOING TO DO EVERYTHING WE CAN POSSIBLY CAN TO HELP OUR COMMUNITY.

THIS SUNDAY AND MONDAY WE ARE PARTNERING WITH ST. LUCIE COUNTY AND THE FLORIDA DIVISION OF EMERGENCY MANAGEMENT AND THE FLORIDA DEPARTMENT OF HEALTH AND THE MOBILE TESTING LAB WILL BE AT THE GYMNASIUM AND ON MONDAY OCTOBER 26TH FOR THE HOURS OF 9:00 TO 4:00 WHERE WE WILL BE HAVE FREE COVID-19 TESTING FOR OUR COMMUNITY. SO THIS IS ANOTHER COLLABORATIVE EFFORT BROUGHT TO YOU BY THE CITY OF FORT PIERCE WITH OUR COMMUNITY PARTNERS AND HOPEFULLY WE GET A LARGE TURNOUT TO JUST SEE WHERE FOLKS ARE AND MAKE OUR COMMUNITY AS SAFE AS POSSIBLE. BUT THAT IS GOING TO DO IT FOR ME AND I'M AVAILABLE FOR

ANY QUESTIONS IF YOU HAVE ANY. >> ANY QUESTIONS OF

MR. MIMMS. >> MISS CAME IN TALKING ABOUT THE DRIVEWAY AND YOU -- DO WE KNOW TO DATE THAT THERE'S AN APPLICATION. YOU AND I AT THE TIME.

>> WHEN I SPOKE TO YOU THERE WAS NOT I DON'T KNOW IF THERE IS NOW.

MORE IMPORTANTLY THAN THAT THERE'S AN IDEA AFTER I SPOKE TO THEM ABOUT DOING SOMETHING DIFFERENT OF LOOKING THROUGH OUR STANDARD DETAILS IN THE ENGINEERING WEBSITE RIGHT NOW. I KNOW THAT OUR STANDARD DETAILS CALL OUT CONCRETE WHICH I AGREE WITH UP NEAR THE ASPHALT SUBGRADE IN THE ROADWAY.

BUT I KNOW THERE'S OTHER DRIVEWAY DESIGNS IN THE CITY OF FORT PIERCE I BELIEVE THAT WE HAVE PROBABLY APPROVED LIKE BRICK PAVERS THEY MIGHT HAVE A CURVED SECTION THAT'S TRAPPING THE BRICK PAVERS, BRICK PAVERS ARE CONSIDERED TO BE

PERFECTOUS. >> BASED ON THE CONSTRUCTION.

PURVIOUS. >> IS THERE A TYPE OF APPLICATION THEY CAN CAN SUBMIT OR SOMETHING WE CAN HELP THESE FOLKS GET A DRIVEWAY IN?

>> THE ONLY PERMIT APPLICATION IS THE DRIVEWAY PERMIT THAT IS HANDLED BY OUR ENGINEERING DEPARTMENT. WE HAVE CERTAIN CITY OF FORT PIERCE TECHNICAL

[02:50:03]

SPECIFICATIONS FOR WHICH THEY HAVE TO FOLLOW. I DO NOT KNOW IF AT THIS TIME THAT HAS BEEN APPLIED FOR SINCE YOU AND I LAST TALKED.

BUT I WILL, I WILL HAVE MR. ANDREWS REACH OUT TO MISS MICHELLE AND MISS -- I

FORGET. >> FRANCE. >>.

>> MISS FRANCE. >> AND I WILL BE HAPPY TO HAVE HIM REACH OUT TO SEE

HOW WE CAN HELP. >> OKAY. I APPRECIATE THAT SIR.

>> THANK YOU. >> MR. SWEENEY. >> MADAM MAYOR, COMMISSIONERS THE ONLY QUICK NOTE THAT I HAVE IS THIS IS NOW YOU OUR SECOND MEETING IN OCTOBER. SO GIVEN WE HAVE COMPLETED ALL THE ITEMS ON THE AGENDA IT DOES NOT APPEAR THAT WE WILL BE HAVING A BACKUP MEETING NEXT WEEK.

JUST WANT TO CLARIFY THAT. NO NOTICE WILL BE GOING OUT OF A MEETING.

>> COMPLETED. >> YOU ARE CORRECT. >> BUT GIVEN --

>> ALL THE VOTING. THAT'S ALL I HAVE. THANK YOU, MA'AM.

>> MISS COX. >> I JUST WANTED TO FOLLOW UP ON MISS LONGARZA -- SO WE COLLECT THAT AND MAINTAIN THAT IN OUR OFFICE AND WE HAVE ACTUALLY BEEN POSTING THAT LIST OF ALL THE PROPERTY, ALL THE SHORT-TERM RENTALS AND THE PROPERTY MANAGERS INFORMATION IS AVAILABLE ON IN OUR PUBLIC RECORDS PORTAL.

SO FEBRUARY EVER WANTS TO KNOW WHO THE PROPERTY MANAGER IS FOR A SPECIFIC

PROPERTY THAT INFORMATION IS READILY AVAILABLE. >> SO THE REGISTRATION PART

OF IT IS PART OF THE B.T.R.. >> IT'S NOT A SEPARATE REGISTRATION.

ALL RIGHT. SO SOMEBODY NEEDS TO -- >> THAT'S ALL I HAVE.

>> THANK YOU. >> WHAT'S NEXT? >> COMMENTS FROM THE CITY

COMMISSION. >> ALL RIGHTY. MR. ALEXANDER.

>> YES MOTOR SHELL I DON'T WANT TO BUTCHER HER LAST NAME CAN I ASK HER TO FORWARD THOSE PICTURES OF THAT RAW SEWAGE THAT SHE SAW COMING OUT OF THE MANHOLE.

>> I'M NOT SURE SHE'S STILL IN THE CHAMBER. >> I CAN REACH OUT TO HER.

>> WE CAN CONTACT HER 24/7 SHE'S THE PROPERTY MANAGER, RIGHT.

>> WE KNOW HOW REACH HER THAT'S RIGHT. >> OKAY, THAT'S ALL I'M

ASKING. >> OKAY. AND ONE OTHER THING I HAVE 19TH STREET I REMEMBER WHEN THEY CLOSED THAT BUILDING BECAUSE OF THE NEIGHBORHOOD WISHED THAT THAT BUILDING NO LONGER BE A ROOMING HOUSE. I THOUGHT THE CITY OF FORT PIERCE DIDN'T ALLOW ANY NEW ROOMING HOUSES? NOW FOR SOMEONE TO BE ABLE TO RENOVATE THAT BUILDING WITH NONE OF THE CODE ENFORCEMENT AND DEPARTMENT THAT'S 19ING STREET AVENUE EVERYBODY GO BY THERE. SO IF THEY SEE SOMEBODY WORKING THERE WOULDN'T IT BE NICE TO STOP AND SEE WHAT'S GOING ON.

THEY SHOULDN'T BE ANY NEW ROOMING HOUSES. SO THE NEIGHBORHOOD SHOULDN'T BE COMING -- I GOT MY NOTICES WITH THE ROOMING HOUSE.

THEY HAVE BROUGHT IT TO MY ATTENTION. >> WE'RE GLAD THEY DID.

>> I'M GLAD THEY DID, TOO SOOMPT SO SO. SO YOU WEAN BE QUESTIONING ME. THEY -- WON'T BE QUESTIONING ME.

THEY ARE VERY CONCERNED. THE CHILDREN IT'S LIKE A ROCK THROW FROM LIKE THE PARK. KIDS CAN GO MISSING. SO IT NEEDS TO BE -- YOU UNDERSTAND ME, WITH SOME PURPOSE WITH WHAT THEY'RE GOING TO DO WITH THAT BUILDING IT'S ONE OF THE BUILDINGS WE TRIED TO TEAR DOWN.

BECAUSE IT'S A NUISANCE TO THE COMMUNITY. AND IT'S A SAFETY HAZARD.

SO AGAIN, I WANT TO PUT CAREER ENFORCEMENT ON THAT PUT SOME MEN ON THAT --

>> I YES, I THINK HE'S ALREADY ON THE CASE. >> I JUST WANT TO BE SURE.

OKAY. >> ALL RIGHT, THANK YOU. >> ALL RIGHT.

[02:55:01]

>> COMMISSIONER PERONA. >> THANK YOU, MAYOR. >> I'M GOING TO KEEP IT REALLY SHORT TODAY. I DO WANT TO SAY THAT I'VE GOTTEN A LOT OF PHONE CALLS AND CONGRATULATIONS FOR OUR NEW EXERCISE CORNER THERE ON INDIAN RIVER DRIVE.

FOLKS ARE THERE ALL THE TIME. OF COURSE IT WAS RAINING WHEN I GOT HERE THIS EVENING AND NOBODY WAS THERE. I'VE EVEN HAD SOME FOLKS REACH OUT AND SAY IF YOU PUT A LIGHT THERE WE WOULD GO THERE AT NIGHT AND WORKOUT.

SO I KNOW THAT THE PARKING COMMITTEE HAS INQUIRED ABOUT IT ALSO AND WANT TO KNOW BECAUSE IT IS THE FORT PIERCE CLUB CENTER THEY'RE PARKING THERE AND TO MAKE SURE THAT WE UNDERSTAND WHOSE PARKING IT IS AND WHO CAN USE IT AND THESE ISSUES CREATE A PROBLEM FOR THE YOU KNOW THE YACHT CLUB AND EVERYTHING ELSE LIKE THAT.

WE'RE GETTING TO THE POINT WHERE WE'RE CROWDING THINGS IN ALL OVER THE PLACE AND PARKING IS GETTING TO BE THE ISSUE. I WON'T RUIN THE STORY AND TELL YOU WHAT HAPPENED AT THE MEETING. BUT I WILL SAY THAT IT'S A VERY DYNAMIC GROUP, NICK, YOU WERE. THERE YOU JUST HAPPENED TO POP IN. OF COURSE THAT WILL BE LAST TIME YOU POP IN BECAUSE WE GRABBED YOU.

BUT I DO WANT TO THANK THEY DID A GREAT JOB PUBLIC WORKS PUT IT IN.

IT LOOKS GREAT. IT'S BEING UTILIZED. IF YOU HAVEN'T SOON IT -- SEEN IT IT'S AT THE CORNER OF INDIAN RIVER DRIVE AND SEAWAY RIGHT THERE IN THE FORT PIERCE YACHT CENTER RIGHT THERE ON THE CORNER. BEFORE WE USED TO HAVE ALL KINDS OF FOLKS HANGING OUT THERE NOW WE HAVE FOLKS THAT ARE BUFF AND WANT TO GET BUFF AND WANT TO EXERCISE AND DO ALL THE RIGHT THINGS. IT REALLY, IT REALLY PROMOTES WHAT FORT PIERCE IS ALL ABOUT. I DO APPRECIATE THAT.

>>. COMMISSIONER SESSIONS. >> I WANT TO JUST REMIND THE PUBLIC THAT WE ARE IN COVID-19 SEASON AND AS WE WERE IN AUGUST AND JULY AND AUGUST IT WAS VERY CRITICAL AND THINGS WENT DOWN IN TERMS OF NUMBERS IN CASES.

BUT LADIES AND GENTLEMEN, FORT PIERCE, ST. LUCIE COUNTY THINGS ARE GOING BACK UP AGAIN. AND THEY'RE GOING UP VERY QUICKLY AND I WOULD SAY TO YOU DO NOT TAKE THIS LIGHTLY I KNOW IT'S BEEN A LONG ROAD AND I KNOW IT'S WEARING US ALL OUT BUT STAYING ALIVE IS MORE IMPORTANT THAN ANYTHING RIGHT NOW AND THE ONLY THING THAT WE HAVE, FROM WHAT THE SCIENTISTS AND DOCTORS TELL US IS THAT WE HAVE JUST GOT TO BE EXTRA CAUTIOUS IN TERMS OF STAYING APART FROM EACH OTHER, SIX FEET, AND ALSO WEARING MASKS AND THERE'S NOTHING ELSE OTHER THAN TESTING.

I'M GLAD TO KNOW THAT THERE ARE GOING TO BE SOME TESTING DONE HERE REAL SOON AND IT'S GOING TO BE AS YOU POINTED OUT AS YOU HEARD OUR CITY MANAGER SAY IT'S MOBILE SO YOU WON'T HAVE TO GET OUT OF YOUR CAR. IT'S GOING TO TAKE PLACE TWO DAYS AND WHAT BETTER TIME THAN NOW. WHEN YOU SEE A CITY OR A COUNTY THAT CLOSES DOWN A COURTHOUSE LADIES AND GENTLEMEN, IT'S SERIOUS BUSINESS I DON'T CARE WHAT YOUR STATE GOVERNMENT HAS ALLOWED TO US DO IN TERMS OF ALLOWING TO US OPEN BACK UP COURTHOUSES ESPECIALLY RIGHT NOW CAN YOU IMAGINE WHAT THOSE JUDGES HAD TO GO THROUGH WITH THESE DOCK ITS BEING SIX MONTHS ALMOST BEHIND RIGHT NOW. GOD ONLY KNOWS WHAT THE COURTHOUSE IS GOING TO DO WHEN WE FINALLY GET BACK ON TRACK. THEY'RE GOING TO HAVE TO HIRE JUDGES, I BELIEVE FROM OTHER PLACES TO HANDLE THE DOCKET.

BUT IF THIS COURTHOUSE CLOSE DOWN BECAUSE OF COVID IF YOU CAN'T READ ON THE LINES READ BETWEEN THE LINES THIS IS SERIOUS BUSINESS DO NOT TAKE THIS LIGHTLY.

JUST DO WHAT WE HAVE TO DO. THEY HAVE TO REMIND MEKNOW COMM, LOOK, WEAR YOUR MASK.

I'M OUTSIDE THE DOOR. WEAR YOUR MASK. AND THEY'RE RIGHT.

WE NEED TO START WEARING OUR MASK AND TAKE THIS VERY SERIOUS BECAUSE I JUST, I DON'T WANT IT TO HIT US LIKE IT HIT US BEFORE. WE WERE NUMBER ONE IN THE

[03:00:04]

STATE OF FLORIDA WITH CASES. THE NUMBERS REPORT EXTRAING TO LOOK LIKE THAT.

WE HAVE TO MAKE SOMING A -- SACRIFICES WHEN THANKSGIVING COMES ACCORDING TO WHAT THE ACTIVITIES SAY SO. AGAIN YOU KNOW I JUST CAN'T TALK ABOUT THAT ENOUGH.

BUT IT'S SERIOUS BUSINESS AND I'M GOING TO SAY HERE I WON'T THINK TWICE IF I CALL MY CITY ATTORNEY AND IF THINGS KEEP GOING THE WAY THEY'RE GOING I MAY BE JUST A LITTLE CITY COMMISSIONER I MAY HAVE TO GO AGAINST THE FEDERAL GOVERNMENT STATE, WHATEVER I WILL USE MY AUTHORITY IF IT'S JUST REGGIE SESSIONS ALONE TO SHUT THIS PLACE DOWN IF IT GETS TO THE POINT WHERE WE CANNOT CONTROL THIS VIRUS EVEN AT THE POINT OF JUST OUR CITY AND I KNOW WE DO HAVE SOME AUTHORITY.

SO, YOU KNOW, I'M JUST PUTTING IT OUT THERE NOW I'M WATCHING THIS SITUATION.

NOTHING IS MORE IMPORTANT TO ME THAN THE LIVES OF PEOPLE.

I'M GOING TO DO ALL I CAN WHILE I CAN TO MAKE IT HAPPEN EVEN IF IT'S ALL ME BY MYSELF I'M GOING TO DO IT AND I BELIEVE BELIEVE I HAVE SOME OTHERS THAT WILL SUPPORT ME IN THIS ENDEAVOR IF NEED BE. SO LET'S TAKE THIS SERIOUS, LET'S GET TESTED. IF YOU GET TESTED YOU FIND OUT YOU GOT IT GO HOME A COUPLE WEEKS. I'M GOING GET TESTED TOMORROW.

IF I GET TESTED POSITIVE I'M NOT GOING TO BE EMBARRASSED I WILL SEE Y'ALL LATER I'M GOING HOME FOR A CAN COUPLE WEEKS DO WHAT THE DOCTORS TELL ME TO DO.

THERE'S NOTHING TO BE EMBARRASSED ABOUT. JUST DO IT.

TAKE CARE OF YOURSELF, PLEASE. ALSO ON THE ISSUE OF VOTING IT'S VOTING SEASON. GET OUT AND VOTE FOR THE CANDIDATE OF YOUR CHOICE.

TODAY WE HAD, I BELIEVE RECORD-BREAKING NUMBERS WITH BOTH PRECINCTS FOR EARLY VOTING. PLEASE GET OUT AND VOTE FOR THE CANDIDATE OF YOUR CHOICE BECAUSE THESE ISSUES THAT ARE FACING US RIGHT NOW WITH ALL OF THESE RACIAL ISSUES, THIS ANIMOSITY, THE RACIAL TENSIONS, COVID-19, GUESS WHAT, LIKE I TOLD A REPORTER FROM CHANNEL 12 TWO OR THREE MONTHS AGO, HE SAYS WHAT'S DIFFERENT? IT'S ELECTION TIME. IF YOUR POLITICIAN CAN'T ADDRESS YOUR ISSUES THEN YOU VOTE HIM OUT, INCLUDING ME. DO WHAT YOU HAVE TO DO. REST ASSURED, IF YOU DON'T THEN GUESS WHAT YOU GONNA WE'RE GOING TO BE IN A WORSE PREDICAMENT.

SO PLEASE GET OUT AND VOTE. I'M PROUD OF WHAT I SAW TODAY IN OUR CITY.

I THINK WE GONNA MAKE RECORD-BREAKING NUMBERS BECAUSE WE GOT AN EARLY START OF THE DAY I WAS JUST SO PROUD TO SEE PEOPLE THERE WAS A LINE FROM THE DOOR ALL THE WAY TO THE ROAD ALMOST. I HAVE NEVER SEEN NOTHING LIKE THAT IN MY LIFE.

SO THAT'S A GOOD SIGN. SO PLEASE, PLEASE WE'RE GONNA HAVE TWO WEEKS OF THIS EARLY VOTING AND THE THING ABOUT IT IS THIS, IF YOU VOTE ABSENTEE YOU CAN SENT YOUR ABSENTEE BALLOT IN. YOU CAN ALSO CALL GERTRUDE'S OFFICE AND REQUEST AN ABSENTEE BALLOT. IT DOESN'T GET MUCH BETTER THAN THIS.

LISTEN TO ME PEOPLE. IF I DON'T WANT TO TRUST THE MAIL YOU CAN GO TO THE EARLY VOTING POLL AND THERE'S A BOX AND YOU JUST STICK IT IN THE BOX.

>> OR ON THE BUT I WOULD SUGGEST YOU DO THAT BUT PLEASE VOTE.

WHAT'S THE STATUS ON BRIGHT LINE WHAT'S GOING ON. TO MY KNOWLEDGE I BELIEVE THERE'S STILL A STRONG INTEREST, HOWEVER AS YOU KNOW THAT OPERATION DID CEASE, THE OPERATING COULD BE SLIGHTLY DELAYED DUE TO WHAT WE'RE GOING THROUGH RIGHT NOW BUT THERE'S AILS BEEN STRONG INTEREST IN FORT PIERCE AND HOPEFULLY SWAY THEM OR DO WHAT WE HAVE TO DO TO BRING THIS MULTIMODAL REGIONAL TRANSPORTATION

[03:05:05]

NETWORK TO OUR BLUFL BEAUTIFUL CITY. THAT'S PRIORITY FOR US.

WE WILL CONTINUE TO EMBARK ON THAT MISSION. >> OKAY.

>> I THINK THE NAME OF THE DEVELOPMENT IS WILLOW LAKES. HOWEVER, THE ATTRACTION IS WAVE GARDEN THEY HAVE FACILITIES ALL OVER THE GLOBE.

BELIEVE IN JAPAN ALSO I BELIEVE IN EUROPE. FRANCE I THINK.

>> FRANCE. I THINK THEY'RE EVENING LOOKING AT AUSTRALIA.

BUT I DO KNOW THAT SOMETHING ATRACKED THEM TO BEAUTIFUL FORT PIERCE.

WHICH WE SHOULD BE PROUD OF. WE'RE GOING TO BE ONE OF A KIND DESTINATION FOR THIS 200 ACRE DEVELOPMENT. NOW THE ACTUAL WAVE GARDEN IS ABOUT 10 ACRES JUST BY ITSELF, IF I'M NOT MISTAKEN. THEN THEY'RE LOOKING AT THE POSSIBILITY OF BUILDING A COUPLE OF HOTELS AND ALSO SOME RESIDENTIAL UNITS ALONG WITH SOME COMMERCIAL AND SOME RETAIL. SO IT WILL BE A DESTINATION. IT'S GOING TO BE ANOTHER ATTRACTION FOR OUR CITY AND I THINK THIS IS GOING TO BE SOMETHING THAT IS GOING TO PUT FORT PEARSON A WORLD WIDE MAP NOT JUST REGIONAL NOT JUST NATIONAL BUT

WORLDWIDE. >> I KNOW HAVE INQUIRED OF ME BELIEVE IT OR NOT IT HAS BEEN PEOPLE FROM OUT OF TOWN. THEY'VE SEEN IT ON THE NEWS IN ORLANDO. I SPOKE WITH A YOUNG LADY SUNDAY SHE SAYS YOU Y'ALL ON THE NEWS. TALKING ABOUT THAT RESORT. WHAT'S COMING TO FORT PIERCE AND THAT'S A PRIME EXAMPLE OF SOME OF THE GOOD STUFF THAT'S COMING.

I JUST HOPE WHATEVER IT IS THAT KEEP THEM TO TO KEEP THE MOMENTUM GOING TO DO ALL THAT WE POSSIBLY CAN TO MAKE IT A REALITY BECAUSE EVEN THOUGH THIS IS A GREEN AREA I SEE IT SO OFTEN IT'S A LAND OF OPPORTUNITY. WITH VERY A LOT OF PEOPLE INTERESTED IN WHAT WE'RE DOING HERE AND WE'RE DOING GREAT THINGS, I BELIEVE.

SO PLEASE WHATEVER WE CAN DO YOU KNOW GET SOMEBODY ON SPEED DIAL.

YOU KNOW HOW I AM WHEN IT COMES TO CAN COMPANIES THAT ARE INTERESTED.

PLEASE GET A RELATIONSHIP WITH THESE PEOPLE. CATER TO THEM.

GO TAKE A TRUCK AND VISIT THEM. WHATEVER YOU HAVE TO DO.

TAKE THEM OUT TO DINNER ON THE TAXPAYERS I'M SURE THEY WON'T MIND.

>> YOU HAVE TO GO TO AUSTRALIA. I KNOW.

>> SEE YOU IN SIX WEEKS. >> SO LONG AS WE GET 'EM HERE THAT'S WHAT'S MOST IMPORTANT THING BECAUSE THAT SOUNDS CLOSE TO DISNEY WORLD. BUT AT ANY RATE DON'T TAKE THAT LIGHTLY LET'S DO WHAT WE HAVE TO DO. ALSO I HAD AN OPPORTUNITY TO SPEAK WITH ADAM NEIL WHO IS THE EDITOR. I HAD ADDRESSED SOME CONCERNS WITH HIM REGARDING WHY I DIDN'T PARTICIPATE IN THE DEBATE SO ON AND SOING FOR BECAUSE I DIDN'T LIKE THE IDEA, I DIDN'T FEEL COMFORTABLE WITH THE HISTORY IN TERMS OF HIRING MINORITIES AT T.C. PONG AND THE VIEW THAT THEY DID HAVE THEY HAD GOTTEN RID OF. HE AND I HAD A PHONE CONFERENCE ABOUT A WEEK AGO.

WE THE STARTED OFF SOMEWHAT HEATED. BUT AT THE END WE GOT ISSUES IN MY MIND RESOLVED. THIS YOUNG MAN TAKES FORT PIERCE VERY SERIOUS.

HE'S SOMEWHAT NEW ON THE SCENE. HE HAS A NEW DIFFERENT IDEAS IT'S A SLOW PROCESS. I WISH WE COULD MOVE FASTER. BUT HE BROUGHT SOME THINGS UP AND THEY'RE GOING TO ADDRESS THESE RACIAL ISSUES AND HE ACKNOWLEDGED THE IT.

WE NEED TO DO BETTER. WE ARE GOING TO DO BETTER. ONE THING HE DID POINT OUT AND I HAD TO AGREE WITH HIM HE SAYS COMMISSIONER, HE SAYS, YOU GOT SOME PROBLEMS OVER THERE AT CITY HALL JUST AS BAD AS WE GOT HERE AT T.C. PARK.

AND I THOUGHT ABOUT WHAT MY GRANDDADDY USED TO ALWAYS TELL ME YOU TAKE CARE OF HOME FIRST LONG BEFORE YOU REACH OUT TO TRY TO CLEAN UP SOMEBODY ELSE'S FRONT DOOR.

SO WITH THAT BEING SAID, HE'S RIGHT. HE'S JUST AS RIGHT AS HE CAN BE. WE GOT SOME ISSUES HERE. SO, AGAIN, I WANT TO EXTEND TO HIM I APPRECIATE HIM TALKING TO ME AND TAKING THE TIME OUT TO TALK TO ME AND EXPLAIN SOME THINGS TO ME. I JUST DO BELIEVE THAT THEY'RE GOING TO DO A LOT BETTER IN TERMS OF HIRING MORE MINORITIES AND ALLOWING PEOPLE THAT ARE FROM THE

[03:10:04]

NEIGHBORHOODS AND PEOPLE THAT ARE FROM HERE TO BE ABLE TO GET INVOLVED AND REPORT THE NEWS BECAUSE THEY HAVE A VESTED INTEREST. I DO BELIEVE THEY'RE GOING TO DO BETTER. THAT'S WHAT IT'S ALL ABOUT. I DON'T SIT HERE AND COMPLAIN Y'ALL TO JUST HEAR MYSELF TALK. I SIT HERE AND COMPLAIN BECAUSE I'M FEELING THE PAIN. AND THE PAIN THAT I FEEL IS FROM MY CONSTITUENTS. THE PEOPLE THAT LIVE I CAN'T JUST SAY IN THE DISTRICT AT LARGE CITY WIDE I GOT A WHOLE LOT OF FRIENDS IN DISTRICT AND DISTRICT 2 THAT'S JUST MY PERSONALITY. I DON'T SINGLE OUT ANYBODY.

I TAKE JUST AS MUCH INTEREST ON THAT BEACH AS WHAT I DO OVER HERE.

WHAT I WILL NOT TOLD THE RATE IS WHEN PEOPLE ARE BEING TAKEN ADVANTAGE OF UNDERPRIVILEGE. IF IT'S SOMETHING THAT I CAN I CAN BE RIGHT NOW IT IS DISTRICT 1 I'M GOING TO DO ALL I CAN TO MAKE IT HAPPEN. SO ANOTHER THING WHERE ARE

WE WITH THE WORKSHOP THAT WE HAD TALKED ABOUT? >> THE COMMUNITY CONVERSATION AS IT HAS BEEN CRAFTED I FORWARDED THAT INFORMATION TO YOU ALL, I BELIEVE LATE LAST WEEK. WE'RE LOOKING AT DECEMBER 17TH AS THE DATE OF THE COMMUNITY CONVERSATION. FROM THAT COMMUNITY CONVERSATION THEN WE WILL UTILIZE THAT INFORMATION TO BUILD INTO OUR STRATEGIC PLANNING COMMISSION FOR THE UPCOMING MONTH OF JANUARY. OKAY. SO THAT'S GOING TO BE AN OPPORTUNITY FOR EVERYBODY TO PARTICIPATE. THE PUBLIC.

OKAY. >> YES, SIR. HOWEVER, WE'RE GOING TO HAVE TO HAVE LIMITED CAPACITY NOW BECAUSE AS YOU KNOW WE'RE GOING TO HAVE SOCIAL DISTANCING SO WE'RE LOOKING AT A LARGE FACILITY. WE'RE LOOKING AT OUR RECREATION CENTER. WE'RE LOOKING AT POSSIBLY -- WE'RE LOOKING AT A LARGE FACILITY THAT WE CAN SCATTER THE DESIGN TABLES IN VARIOUS LOCATIONS AND THAT WAY WE CAN HAVE THE FACILITATORS ASK THOSE QUESTIONS AND GET THAT INPUT THAT YOU ALL, YOU

KNOW, DESIRE TO HAVE. >> OKAY. I'M LOOKING FORWARD TO THAT NAACP THEY WANT TO PARTICIPATE IN THAT TOO AS WELL SO KEEP THEM POSTED KEEP THEM INFORMED. I JUST LOOK FORWARD TO THAT. I THINK LYLE WILL BE THE BEST PERSON TO HANDLE THAT. I LIKE THE WAY THAT HE HAS HANDLED OUR PLANNING

WORKSHOPS. >> YES. >> HE'S VERY FAIR, HE'S VERY THOROUGH, HE'S VERY KNOWLEDGEABLE. AND I THINK THAT HE WOULD BE A GOOD PERSON TO BE ABLE TO SIT AT THE TABLE AND ADDRESS AND MEDIATE THESE ISSUES.

I FEEL ARE VERY IMPORTANT. I GUESS THAT'S ABOUT IT FOR ME.

THANK YOU. THANK YOU, MAYOR. >> COMMISSIONER JOHNSON.

>> THANK YOU, MAYOR. I WILL BE BRIEF. I GOT A MEMO WE ALL GOT A MEMO LAST WEEK FROM MR. MIMMS TALKING ABOUT BUILDING PERMITS FOR FISCAL YEAR'20. IF YOU WANT TO LOOK AT THE DATA IT IS AVAILABLE BUT THERE'S SOME INTERESTING NOTES HERE IF YOU COMBINE THE COMMERCIAL APPLICATIONS, ACTUALLY IF YOU COMBINE ALL APPLICATIONS IN THE CITY OF FORT PIERCE OVER 4200 PERMITS WERE ISSUED LAST YEAR ALONE. IN COMMERCIAL THE EVALUATION OF OUR PERMITS WAS $28 MILLION COMBINED WITH NEW AND RENOVATION.

A SIGNIFICANT AMOUNT OF MONEY. $53 MILLION OVER $53 MILLION WAS RESIDENTIAL AND SINGLE FAMILY DWELLING UNITS. IN LOOKING AT THOSE NUMBERS THAT'S VERY LARGE. THEN THE OTHER INTRIGUING NUMBER IS SITE WORK.

THOSE ALL GO HAND IN HAND. BUT THAT WAS ALMOST $8.5 MILLION.

WHEN YOU START LOOKING AT THOSE NUMBERS YOU KNOW, CITY WIDE THIS ISNY FOR US.

THAT DOESN'T EVEN INCLUDE WHAT THEY HAVE TO DO AS A PARTNER IN THAT.

IN NEW CAN CONNECTIONS AND WHAT THEY SIGN THE DOTTED LINE FOR YOU KNOW MAYBE IMPACT FEES AND POTENTIAL FIRE CONNECTIONS ALL THE THINGS THAT GO ALONG WITH THEIR SERVICES. IT'S VERY IMPORTANT THAT WE BRAG ABOUT THAT LITTLE BIT.

AT THE SAME TIME I FLOW ARE FOLKS WHO DON'T WANT TO BRAG TOO CLOUDLY BECAUSE WE DON'T WANT TO BE TOO ATTRACTIVE. BUT WE DO WANT TO BE ATTRACTIVE WE HAVE A GREAT CITY. WE'RE DOING SOME GREAT THINGS.

IT'S SOMETHING TO BE PROUD OF AS RESIDENTS AND AS A CITY GOVERNMENT.

I JUST WANTED TO TALK ABOUT THAT. THEN ASK ABOUT THE FPUA

SIDE. >> I WILL REMEMBER TO DO THAT TOMORROW.

>> OH, MIME SORRY. EXCUSE ME. -- I'M SORRY.

EXCUSE ME. HE BROUGHT THAT UP ABOUT THE FPUA THAT REMIND ME.

[03:15:03]

THERE'S GOING TO BE A MEETING TOMORROW FORT PIERCE UTILITIES AUTHORITY AT 4:00.

I KNOW IT'S COLDER SEASON ARE Y'ALL HAVING MEETINGS IN THE CHAMBER NOW IT'S LIMITED SEATING, HOWEVER IF YOU JUST SHOW UP BE VISIBLE I THINK THAT WILL PLAY APART AN IMPORTANT PART IN A ROLE FOR THESE BOARD MEMBERS TO SEE YOUR INTEREST.

JUST LIKE THOSE INDIVIDUALS CAME BEFORE HERE TONIGHT AND THEY ADDRESSED THE ISSUE IN THE NEIGHBORHOOD THAT THEY LOVE. IT'S AN ISSUE TOOL.

I TELL MY DISTRICT ALL THE TIME SHOW UP. VOICE YOUR OPINION YOU WILL GET RESULTS. BUT WHEN YOU SIT AT HOME AND DO NOTHING BUT COMPLAIN THEN GUESS WHAT. THINGS JUST GO. STATUS QUO AND YOU DON'T GET A RESULT. SO I'M SORT OF CAUGHT BETWEEN A ROCK AND A HARD PLACE TELLING PEOPLE TO COME OUT HERE. BUT THIS IS A SERIOUS MAT MATTER ,700 ARE ABOUT TO HAVE THEIR LIGHTS TURNED OUT AT A RATE OF 320 A WEEK LADIES AND GENTLEMEN IS A SERIOU PROBLEM. AND I DON'T CARE IF WE ARE THE ONLY ONE THAT'S HAVE NOT CUT OFF. I DON'T OPERATE LIKE THAT I DON'T CARE IF I'M DOING THE RIGHT THING. IT'S NOT RIGHT.

SO WHAT I WAS TOLD HERE TONIGHT IS NOT CONSOLATION TO ME.

AS A MATTER OF FACT, IT SHOULDN'T BE TO YOU. LET'S TAKE THIS SERIOUS.

LORD HAS BLESSED ME I CAN PAY MY LIGHT BILL. BUT THERE ARE SO MANY PEOPLE OUT THERE THAT CAN'T. THERE'S SO MANY PEOPLE OUT THERE THAT ARE SUFFERING AND YOU ALWAYS TRY TO LOOK OUT FOR THOSE THAT DON'T HAVE THE WHEREWITHAL WE SHOULD BE DOING THAT. SO I'M GOING TO BE WATCHING THIS MEETING.

I MAY SHOW UP MYSELF. I WILL BE WATCHING THIS MEETING.

I'M GOING TO CALL MY BOARD MEMBER. I CAN DO THAT RIGHT MR. CITY

ATTORNEY? >> ABSOLUTELY, SIR. >> I WILL BE CALLING HIM I NEED RESULTS. I NEED TO FIND OUT WHAT'S GOING ON WITH THAT MONEY WHY IS IT SITTING THERE WE NEED TO FIND OUT BECAUSE WE DON'T, IF WE CAN STOP IT ALLOW THIS TO HAPPEN. THIS IS NOT CORPORATE THIS IS SUPPOSED TO BE A CITY-OWNED COMMUNITY-OWNED UTILITIES AUTHORITY. IT'S JUST SOMETHING THAT SHOULD BE DONE WHEN IT'S CORPORATE VERSUS NOT. WE'RE NOT HANDLING IT THAT WAY. DON'T WORRY ABOUT THE CASH REGISTER LET'S GET THE HUMANITARIAN ASPECT IN PLACE AND TRY TO STOP THESE LIGHTS FROM GETTING CUT OFF.

THANK YOU. >> OKAY. I WILL BE AT THAT MEETING AND I WILL BE ADVOCATING FOR WHAT THE NUMBERS WE HEARD TONIGHT WERE NUMBERS THAT WERE NEW TO ME AND SO THE BOARD, THE FPUA BOARD HAS NOT HEARD THOSE NUMBERS.

WE'LL HEAR THOSE NUMBERS TOMORROW. SO I, I WILL BE ADVOCATING FOR NOT CONNECTS LIKE. THIS I HAVE BEEN ADVOCATING IT SINCE JUNE.

I HAVE BEEN PUSHING THEM BACK SAYING WE CAN'T DO THIS IN THE MIDDLE OF COVID.

I HAVE BEEN DOING IT AND SO, SOMETIMES I HAVE BEEN THE LONE VOICE.

SO I AGREE WITH COMMISSIONER SESSIONITS THAT WOULD BE A GREAT HELP FOR YOU TO COME AND HELP US MAKE A GOOD DECISION. I DID WANT TO SHARE WITH YOU THAT I JOINED WAS INVITED TO A COMMUNITY CONVERSATION THAT WAS PUT ON BY ALLEGHENY FRANCISCAN MINISTRIES AND IT WAS ABOUT RACE RELATIONS AND RACE IMPLICIT BIAS AND IT WAS VIRTUAL AND IT WAS CONDUCTED BY A RACIAL JUSTICE EXPERT AND IT WAS A REALLY, REALLY WORTHWHILE THREE HOURS. SHE PACKED A LOT IN THREE HOURS. SOME OF THE PEOPLE THAT WERE INCLUDED THAT WERE ON IT, AND STAYED THE WHOLE TIME WERE THE STATE ATTORNEY, THE NEW STATE ATTORNEY, AND A JUDGE, JUDGE MERMAN AND WAYNE GENT AND A NUMBER OF ST. LUCIE COUNTY LEADERS WERE PART OF THAT CAN CONVERSATION. TERESA BISHOP WITH THE ROUNDTABLE AND THERE WERE ABOUT, I THINK ABOUT 20 OR 25 OF US AND IT WAS A REALLY GOOD LEARNING EXPERIENCE. I LEARNED A LOT. I LISTENED A LOT AND I THINK THAT THERE WILL BE MORE OF THOSE KINDS OF OPPORTUNITIES TO COME AND I WILL TAKE

[03:20:01]

ADVANTAGE OF THEM. I ALSO WANTED TO SHARE WITH YOU THAT THE ST. LUCIE COUNTY UNEMPLOYMENT IS DROPPED TO 6.7. IT WAS FEBRUARY 20TH IT WAS 14.2. SO IT'S MOVING IN THE RIGHT DIRECTION.

WE'RE LOWER THAN THE U.S. WHICH IS 7.9 AND LOWER THAN FLORIDA 7.6.

THE HARDEST HIT INDUSTRY IS HOSPITALITY AND THERE ARE A COUPLE INDUSTRIES THAT ARE DOING WELL CONSTRUCTION AND MANUFACTURING. SO, I THINK THAT'S A GOOD NEWS FOR RIGHT NOW IT'S NOT AS GOOD AS IT COULD BE BECAUSE LAST YEAR WE WERE AT 3.SOMETHING UNEMPLOYMENT BUT IT'S MOVING IN THE RIGHT DIRECTION.

SO WITH THAT I WOULD LIKE TO SAY LET'S ADJOURN AND WHEN WE ADJOURN PLEASE MOVE OUT INTO THE FOYER. WE'LL BE TURNING OUT THE LIGHTS AND LET'S ADJOURN.
