[b. Conditional Use - Andrews Dwelling Rental - 1180 Carlton Court, Unit 102A]

PRESENTING FOR THE CONDITIONAL USE ANDREWS DWELLING RENTAL AT 1180 CARLTON COURT, UNIT WON 02A.

>>> GOOD EVENING PLANNING BOARD MEMBERS.

THIS IS A CONDITIONAL USE FOR THIS SUBJECT PROPERTY LOCATED AT 1180 CARLTON COURT UNIT WON ZERO TWO A.

THE PROPERTY OWNER IS SEEKING TO OFFER LODGING FOR LESS THAN TWO MONTHS WITH A MINIMUM STAY OF 31 DAYS.

THE SUBJECT PROPERTY IS LOCATED ON THE WEST CORNER OF CARLTON COURT. IT IS A TWO BEDROOM TWO BATH CONDOMINIUM. THE SUBJECT PROPERTY IS ZONED FOR HUTCHISON ISLAND RESIDENTIAL.

WITH FUTURE LAND USE OF HIR WHICH IS A HIGH DENSITY RESIDENTIAL. THE ANDREWS RENTAL IS IN CONSIDERATION FOR THE CONDITIONAL USED TO OFFER THE LODGING. SUBJECT TO SIX CONDITIONS.

A BRIEF SYNOPSIS OF OUR RECOMMENDATION ORDINANCE K -- 114 PASSED IN 2001. FLORIDA LEGISLATURE IN 2011 OPERATED FOR CONDITIONAL USES. A VALIDATED EVIDENCE CONSISTENT WITH THE CODE. NO CD OF FORT PIERCE CODE ENFORCEMENT OR FOR PIERCE POLICE DEPARTMENT VIOLATIONS AND CONDITIONS OF APPROVAL ARE BEING ADDED TO PROTECT THE NEIGHBORHOOD. POSSIBLE ACTIONS FROM THE PLANNING BOARD ARE RECOMMENDED APPROVAL OF THE CONDITIONS.

NO CHANGES RECOMMENDED PROPOSED WITH CHANGES.

DISAPPROVAL OF THE CONDITIONAL USE.

THIS WILL REQUIRE A CONCURRENT VOTE BY CITY COMMISSION.

[00:05:03]

STAFF SUBJECT TO THE SIX CONDITIONS.

THE PROPERTY MANAGER FOR THE DWELLING SHOULD BE AVAILABLE AT ALL TIMES TO HEAR COMPLAINTS OR VIOLATION OF CITY COLD SAID MENTOR SHOULD RESIDE IN THE COUNTY AND BE REGISTERED WITH THE CITY OF FORT PIERCE. NUMBER TWO GUIDEBOOK WAS AVAILABLE FOR CODE ENFORCEMENT SHOULD BE PROVIDED TO RENTERS REGARDING LOCAL RULES AND PUBLIC RESOURCES.

NUMBER THREE THE APPLICANT SHALL FILE FOR AND OBTAIN BUSINESS LICENSES WITHIN 30 DAYS OF CONDITIONAL USE OF APPROVAL.

NUMBER FOUR THERE SHOULD BE A LIMITATION OF NO MORE THAN TWO VEHICLES AT THE SITE. NUMBER FIVE THE CITY OF FORT PIERCE BUSINESS TAX LICENSE NUMBER SHOULD BE INCLUDED ON ALL ADVERTISING AND THE MAXIMUM OCCUPANCY OF THE HOME SHOULD BE IN COMPLIANCE WITH THE CITY CODE.

REQUIRED SPACE AND DWELLING UNITS BASED ON THE SIZE OF EACH UNIT. THANK YOU.

>>> THANK YOU. >> ANY QUESTIONS FOR MR. GILMORE

BY OUR BOARD? >> I JUST HAVE WON, TWO QUESTIONS ACTUALLY. IS MY UNDERSTANDING THAT CURRENTLY IN THIS CONDOMINIUM COMPLEX THERE IS A CONDITIONAL

USE PREVIOUSLY APPROVED. >> CORRECT.

>> SECOND QUESTION, AND THIS COULD JUST BE MY RECOMMENDATION BUT IN THIS PARTICULAR APPLICATION IN THE ANALYSIS, IT INDICATES THE SHORT TERM RENTAL 31 DAYS WITH A 31 DAY MINIMUM.

IT IS STILL IMPACTED BY THE CITY CODE SECTION RELATIVE TO PARKING. I JUST WANT TO MAKE SURE THAT IS CORRECT FROM THE PERSPECTIVE OF I KNOW WE ARE DEALING WITH THAT AND IN ESSENCE THAT IS THE HOTEL MOTEL PARKING REQUIREMENT.

IS THAT APPLICABLE EVEN IN THE 31 DAY OR A MINIMUM OF 31 DAY RENTAL SCENARIO. THE ONE FOR THAT PROVISION?

>> NO MORE THAN TWO VEHICLES? >> IT IS THE CITY CODE NOT THE TWO VEHICLE, IT INDICATES MOTELS AND HOTELS SHOULD PROVIDE ONE FOR SIX BASES FOR EACH SQUARE FOOT OF SPACE.

I THOUGHT THAT WAS ONLY APPLICABLE IN THE 31 DAY OR LESS TRANSIENT HOUSING FOR A BETTER DESCRIPTION NOT THE 31 DAY

MINIMUM SHORT-TERM RENTALS. >> WAS THAT ONE OF THE

CONDITIONS FOR THE DWELLING? >> IT IS IN THE PACKET THAT WE RECEIVED. IT COULD'VE JUST BEEN INCLUDED

IN THERE AS A REFERENCE. >> THE REASON, I CAN EXPLAIN THE REASON FOR THAT CONDITION. AFTER SEVERAL OF THESE DWELLING RENTALS AND VACATION RENTALS APPLICATIONS, THE PREVIOUS CITY ATTORNEY SPOKE WITH THE CITY COMMISSION AND THEY DECIDED WE NEEDED TO BE CONSISTENT WITH OUR RECOMMENDATIONS AND THE CITY COMMISSION AGREED THAT MAKING IT NO MORE THAN TWO VEHICLES ACROSS THE PLAYING FIELD WAS WHAT WE WERE GOING TO STICK TO.

SO EVERY APPLICATION THAT HAS COME FORTH SINCE THAT MEETING WHICH WE COULD RESEARCH, WE HAVE JUST BEEN CONSISTENT WITH NO

MORE THAN TWO VEHICLES. >> NO QUESTION THAT THE TWO VEHICLE STANDARD IS THE NORM. THAT IS WHY I WAS QUESTIONING IN THIS APPLICATION THAT THEY HAVE SEPARATE PARKING REQUIREMENTS DESCRIBED AS 1.6 VEHICLES FOR 500 SQUARE FEET OR MORE.

I THOUGHT IT WAS RELATED TO THE TRANSIENT HOUSING TYPE APPLICATION. SO IT IS ONE OF THE SAME.

>> I THINK WHAT TRIGGERED IT WAS THE RENTAL OFFICE.

SEVERAL PEOPLE WERE COMPLAINING THERE WERE VEHICLES PARKED ON THE STREET AND PEOPLE THROWING PARTIES.

THERE WAS A DECISION MADE IF WE COULD MINIMIZE IT OR MAXIMIZE IT TO KNOW MORE THAN TWO VEHICLES WE WOULDN'T HAVE TO WORRY ABOUT

THAT FOR MANY OF THE RENTALS. >> AS A SIDE NOTE.

NOT APPLICABLE TO THIS APPLICATION.

SE. I BELIEVE THE 1.6 VEHICLES OR 500 SQUARE FEET OR MORE IS DESIGNED FOR HOTEL ROOM TYPE OCCUPANCY. SO APPLYING THAT IN THESE LARGER STRUCTURES TRANSIENT RENTALS OR SHORT-TERM RENTALS, IS REALLY PROBLEMATIC. THE APPLICATION WE HAD RECENTLY IN FRONT OF US GOT 2800 SQUARE FEET OF PLACE WITH 1.6 CURRENT RATIO IT JUST SEEMS THAT WILL NEED TO BE LOOKED AT IN THE OVERALL SCHEME OF WORKING SHORT-TERM RENTAL SCENARIOS.

DOESN'T IMPACT THIS APPLICATION BUT I SAW IT AND I THOUGHT THAT IS PROBLEMATIC. IT WILL HAVE TO BE DEALT WITH IN

[00:10:03]

SOME CAPACITY. >> WE HAVE BEEN SPEAKING ABOUT THE PARKING REQUIREMENTS WITH OUR PREVIOUS APPLICATION THAT CAME FORWARD LAST MONTH. WE ALL WONDERED WHERE THE PROPERTY MANAGER WOULD PARK AND HOW THAT RELATES WITH EDA WHEN YOU ARE LOOKING AT UNDER 31 DAYS.

SO YES, WE HAVE ALL DETERMINED IT IS SOMETHING THAT WE NEED TO EXAMINE IN OUR CODE WITH REGARD TO PARKING.

>> IT MAY BE SOMETHING THAT COME BEFORE THE BOARD?

>> ABSOLUTELY. >> GREAT.

I THINK THAT IS A FABULOUS INITIATIVE.

THANK YOU. THAT ANSWERS MY QUESTION.

I KNOW I WAS DOVETAILING INTO THIS APPLICATION BUT THE INFORMATION'S UNIT PIQUED MY CURIOSITY.

THANK YOU. >> I DID A SITE VISIT TO THIS FACILITY AND IF I AM CORRECT, I THINK I NOTICED EVERY UNIT HAS ONE ASSIGNED SPACE NUMBERED AND ONE GUEST SPACE.

UNIT. >> CORRECT.

>> SO THEY HAVE THE SPACES. >> ANYONE ELSE?

>> SECTION NUMBER SIX. WHAT IS THE MAXIMUM OCCUPANCY OF THIS UNIT? HOW MANY PEOPLE CAN STAY THERE

AT ONE TIME? >> TO PEOPLE.

>> IT IS MORE OF A BUILDING. THAT IS A BUILDING DEPARTMENT SECTION. WE ARE MAKING SURE THEY ADHERE

TO THAT. >> I WAS JUST CURIOUS WHAT IT

WAS. >> ANY OTHER QUESTIONS ASKED.

>> THANK YOU. WE WILL MOVE TO THE OPEN MEETING THE PUBLIC MEETING. ANYONE SPEAKING IN FAVOR OR OPPOSE TO THIS PROJECT PLEASE STAMP FOR -- STEP FORWARD AND IF THE APPLICANT IS HERE I WOULD LIKE TO HEAR FROM THEM.

>> WOULD YOU PLEASE STATE YOUR NAME AND SIGN IN.

>> MY NAME IS DOUG ANDREWS. THIS WILL BE SHORT AND SWEET.

I JUST WANT TO THANK YOU FOR YOUR TIME AND DILIGENCE IN LOOKING INTO THIS PROPOSAL AND APPRECIATE THE WORK DONE.

>> THANK YOU. >> I LOOKED OVER YOUR FACILITY

AND IT IS WELL-MAINTAINED. >> YES.

>> I THINK THE ASSOCIATION HAS DONE A GOOD JOB THERE FOR YOU.

>> A GREAT PLACE TO BE. >> SIR, DO YOU KNOW WHEN YOUR ASSOCIATION WAS INCORPORATED? AND HAVE SOME TIME ON IT I KNOW

THAT. >>, YES, I HAVE THE HO A THING

IN HERE. >> THAT'S OKAY.

I READ YOUR DOCUMENTS RELATIVE TO THE LEASING OF UNITS.

THE LEASING OF UNITS IS ALMOST DESIGNED SPECIFICALLY TO ADDRESS SHORT-TERM RENTALS. IT IS REMARKABLE HOW IT REFLECTS THE STATE OF FLORIDA LANGUAGE. I'M GOING TO GUESS YOUR

DOCUMENTS ARE 20-YEARS-OLD. >> I WOULD GUESS THAT TOO.

>> SIR COULD YOU ANSWER MY QUESTION.

HOW MANY PEOPLE WILL YOU RENT TO A ONE-TIME?

>> I LOOKED AT THE CODES AND I FORGET, THE WORDING OF IT BUT IT IS TRUE FOR THE FIRST 500 SQUARE FEET AND MAYBE TWO MORE FOR THE -- WE'RE LOOKING FOR THREE PEOPLE.

IT IS A SMALL UNIT. 1195 SQUARE FEET.

SO IT IS PRETTY SMALL. I CAN'T IMAGINE ANYONE WOULD WANT TO BE THERE WITH MORE THAN THREE PEOPLE.

WE ARE LOOKING TO MINIMIZE IT AT THREE.

>> VERY GOOD. >> THANK YOU.

>> ANYONE ELSE SPEAKING OPPOSED OR IN FAVOR OF? NOT SEEN ANYONE WE WILL COME BACK TO THE BOARD.

ANY FURTHER COMMENTS OR QUESTIONS? NOT HEARING ANY. I WOULD ENTERTAIN A MOTION.

>> I MOVE APPROVAL WITH THE SIX CONDITIONS.

>> SECOND PERIOD. >> ME OF THE MOTION OF APPROVAL WITH THE SIX CONDITIONS FROM MISS JOHNSON SCOTT AND A SECOND

FROM THE GUARDIAN LEFT. >> THE GUIDE OF MY LOVE.

>> MR. BRODERICK. >> CALL THE ROLL POLICE.

>> MR. O'CONNELL. >> MS. JOHNSON SCOTT,

MR. BRODERICK, CHAIRMAN MILLER. >> YES.

[c. Conditional Use - Precious Lambs - 1504 Avenue F]

>> NEXT ITEM ON OUR AGENDA THE NEW ITEM DIDA ITEM DIDA -- MIKE D WILL BE CONDITIONAL USE OF PRECIOUS LAMBS AT 1504 AVENUE F.

AND HE IS PRESENTING THIS. >>> GOOD EVENING CHAIR AND MEMBERS OF THE BOARD. BEFORE YOU TODAY IS A

[00:15:03]

CONDITIONAL USE WITH NO NEW CONSTRUCTION FOR THE PRECIOUS LAMBS AT 1504 AVENUE F. THE FUTURE LAND IS MEDIUM DENSITY RESIDENTIAL WITH THE ZONING OF OUR FOUR MEDIUM RESIDENTIAL. THE REQUEST IS FOR CONDITIONAL USE WITH NO CONSTRUCTION FOR THE OPERATION OF A DAYCARE AT 1504 STAFF IS RECOMMENDING APPROVAL OF THE REQUEST AS IT IS CONSISTENT WITH THE CITY CODE AND PLAN.

GENERAL WELFARE OF THE PUBLIC AND THE CONDITIONAL USE FOR THIS PROPERTY WAS GRANTED IN 2012 FOR THE SAME REQUEST AND USE.

HOWEVER THE CONDITIONAL USE EXPIRED BEFORE WORK COULD BE COMPLETED AND THE BUILDING PERMITS WERE APPROVED.

THIS IS JUST A COPY OF THE SITE PLAN.

THIS WAS PRESENTED IN 2012. ALL WORK HAS BEEN COMPLETED AND ALL BIRD BUILDING PERMITS HAVE BEEN CLOSE OUT TO MY KNOWLEDGE.

STAFF IS RECOMMENDING APPROVAL SUBJECT TO ONE CONDITION.

THEY PROVIDE AN UPDATE TO THE PROPOSAL THAT WAS PROVIDED IN 2012 CONDITIONAL USE APPLICATION WILL PROVIDE VERIFICATION OF THAT WAS INSTALLED WITH THE BUILDING PERMIT IN ACCORDANCE WITH THE CITY CODE. THE SUBJECT VERIFICATION IS REQUIRED PRIOR TO THE ASSURANCE OF A BUSINESS TAX LICENSE FOR THE DAYCARE. POSSIBLE ACTION BY THE PLANNING BOARD RECOMMENDS APPROVAL WITH NO CHANGES AND ONE CONDITION YOU CAN RECOMMEND APPROVAL WITH CHANGE OR YOU CAN REMAND TRACK RECOMMEND DISAPPROVAL. THIS WOULD REQUIRE A FOUR FIFTHS VOTE. I'M AVAILABLE FOR ANY QUESTIONS.

TAKE YOU. >> BEFORE WE GO ANY FURTHER I WOULD LIKE TO NOTE THAT I DID A SITE VISIT TO THIS LOCATION TODAY AND HAD LENGTHY DISCUSSIONS WITH THE OWNER.

I BELIEVE THIS IS MORE OF THE HOUSEKEEPING.

>> THAT IS ACCURATE. >> I THINK THAT IS WHAT I UNDERSTAND IT TO BE FOR THE MOST PART.

I WILL MOVE BACK TO THE BOARD IF YOU HAVE ANY QUESTIONS OR

COMMENTS. >> JUST ONE QUESTION.

THE SITE PLAN WAS ORIGINALLY GENERATED IN 2012 AND THERE WAS NOT A NECESSITY TO UPDATE THE SITE PLAN AS IT IS 7-YEARS-OLD.

>> ACTUALLY I BELIEVE THE SITE PLAN SHOWS FOUR PARKING SPACES AND NOW THEY HAVE FIVE PARKING SPACES.

>> THEY ARE DONE WITH THE RENOVATIONS AND THEY'RE READY TO

GO. >> IT GOES FROM EAR TO THE CITY

COMMISSION THEN BUILDING COLD. >> THEY DO HAVE A TEMPORARY USE FOR OPERATIONS FOR FOUR MONTHS OF UNTIL FEBRUARY SO THEY CAN START THEIR OPERATIONS WHILE THEY RUN THROUGH THE PROCESS AS

WELL. >> ANY DELAY OF GETTING IN ON

THE CITY'S AGENDA WITH THAT? >> THEY WOULD ENTERTAIN AN

EXTENSION. >> THANK YOU.

>>> THEY HAVE PAR -- FIVE PARKING SPACES IN THE LOT RIGHT NOW. PLUS IT LOOKS LIKE THEY HAVE ROOM FOR 2-3 AUTOMOBILES IN THE DRIVEWAY.

I MAY ADD THEY DID A BEAUTIFUL JOB WITH CLEANING THIS AREA.

>> THEY ALSO OPERATE THE BUILDING TO THE SOUTH AS WELL.

THIS IS JUST AN EXTENSION OF THEIR CURRENT OPERATIONS.

>> ANY OTHER QUESTIONS OR COMMENTS.

>> NOT SEEN ANY, I WILL OPEN IT FOR PUBLIC MEETING.

ANYONE SPEAKING OPPOSED TO OR IN FAVOR OF THE PROJECT PLEASE STEP FORWARD. I WOULD LIKE TO HEAR FROM THE

APPLICANT IF I COULD. >> GOOD EVENING.

MY NAME IS MRS. OWENS. I AM THE NEW OWNER OF PRECIOUS -- PRECIOUS LAMBS INFANT COLLEGE.

THIS IS BEEN A TEN YEAR PROJECT FOR ME DUE TO THE FACT THAT MY PARENTS DECIDED TO ADOPT THE AREA OF 15TH STREET AND AVENUE F. THEY BOUGHT UP PRETTY MUCH ALL OF THE PROPERTY SO I WANTED TO OPEN AND INFANT FACILITY RIGHT ACROSS THE STREET FROM MY MOTHER'S FACILITY.

IT IS NOT AS BIG BUT I THINK IT IS VERY COZY AND IT IS HEALTHY, SAFE AND A LOVING AREA JUST FOR BABIES.

I ONLY TAKE INFANTS FROM SIX WEEKS TO 24 MONTHS OLD.

AND, ACTUALLY I'M JUST FOLLOWING IN THE FOOTSTEPS OF MY MOTHER.

I HAVE PROVIDED JOBS, I HAVE EIGHT TEACHERS, THE 21 CHILDREN IN THE FACILITY. I HAVE GIVEN OUT EIGHT JOBS FOR

[00:20:07]

TWO A DIFFERENT ADULTS BETWEEN THE AGES OF 18-YEARS-OLD TO 52-YEARS-OLD. THEY ALL CAN GO AND EXTEND THEIR EDUCATION IF THEY WANT TO. I CONTRIBUTE TO THAT BY GIVING THEM OR ASSISTING THEM IN HELPING PAY FOR THEIR AA DEGREE OR A S DEGREE IF THEY CHOOSE TO CONTINUE WITH THEIR EDUCATION.

I AM BASICALLY JUST OUT TO EDUCATE CHILDREN.

TO HELP MAKE LIFE EASIER FOR WORKING PARENTS.

THE SINGLE MOTHER, THE YOUNG GIRL THAT STILL WANTS TO GO TO SCHOOL. I PROVIDE A LOVING AND HEALTHY ENVIRONMENT FOR EVERYONE. MY GOAL IS NOT TO MAKE MONEY IT IS TO EDUCATE CHILDREN AND PROVIDE A SAFE AND HEALTHY ENVIRONMENT THAT PARENTS DON'T HAVE TO WORRY WHEN THEY GO TO

WORK. >> I COMMEND YOU FOR THE JOB THAT YOU AND YOUR FAMILY ARE DOING IN THE NEIGHBORHOOD.

AND FOR WHAT YOU ARE DOING IN THAT FACILITY IN PARTICULAR.

I WENT THERE TODAY. I WAS VERY IMPRESSED WITH

EVERYTHING. >> THANK YOU.

>> I DID NOT ASK YOU TO SIGN IN. WOULD YOU PLEASE SIGN IN.

IS THERE ANY QUESTIONS FOR THE APPLICANT FROM THE BOARD.

>> WITH ME I BROUGHT ONE OF MY TEACHERS.

I ASKED A PARENT ALSO TO COME. JUST SO THAT YOU CAN HEAR, SOME OF THE POSITIVE THAT COMES FROM PRECIOUS LAND.

I ASKED THEM TO COME IN SPEAK TONIGHT ON OUR BEHALF.

>> YOUR PARENTS HAVE BEEN IN BUSINESS THERE IN THAT AREA

SINCE 1994. >> YES.

>> MY FATHER'S NOW DECEASED BUT MY MOTHER IS STILL THERE.

SHE WAS SICK SHE HAS CANCER SHE GOT IT THREE OR FOUR YEARS AGO.

I RAN THE FACILITY FOR HER. SO IN THE TEN YEAR PROCESS OF WAITING TO OPEN MY OWN I LEARNED A LOT JUST FROM RUNNING OUR FACILITY AND I TELL YOU THIS, GOING FROM 104 KIDS 221 IS LIKE

A BLESSING. >> YOU KEEP LISTENING TO YOUR MOTHER BECAUSE SHE WILL TEACH YOU A LOT.

>> I WILL TRY. >> I WOULD DEBBIE -- FRANK I WOULD HAPPY TO HEAR FROM YOUR TWO FRIENDS HERE.

>> HELLO MY NAME IS SERENA JACKSON AND I CURRENTLY WORK FOR PRECIOUS LAMBS INFANT COLLEGE. I CAN HONESTLY SAY WORKING THERE HAS TAUGHT ME PATIENCE. EVERY DAY I GO TO WORK WITH THE MINDFRAME OF TREAT OTHERS HOW YOU WANT TO BE TREATED.

I THINK IF I WAS AN INFANT, HOW WOULD I WANT SOMEONE TO HANDLE ME. I TREAT THE BABIES AS EITHER THEY ARE MY FAMILY OR ANYONE CLOSE TO ME.

SHE HAS EMPLOYED MY LITTLE SISTER WITH A JOB TOO.

THEY LOVE HER AS WELL. IT IS A FULL-TIME JOB.

I WILL BE STARTING MY AA DEGREE. THAT IS JUST ONE OF THE MANY THINGS I'M DOING AND IT IS A LOVING FACILITY.

IT TEACHES THE KIDS THEIR ABCS, SHAPES, COLORS AND ALL OF THAT.

I ENJOY IT. >> VERY GOOD.

>> TEACHING WAS ONE OF MY MAIN GOALS BECAUSE EVERYONE HAS THAT WON FRAME OF MIND THAT BABIES CAN ONLY BE FED AND PUT TO SLEEP ALL DAY. WE ARE CHANGING THAT STATEMENT.

>> VERY GOOD. >> GOOD EVENING EVERYONE.

MY NAME IS CHARMAINE ELLIOTT. BOTH OF MY KIDS ATTEND PRECIOUS LAND. MY YOUNGEST WON IS TEN MONTHS OLD. I PERSONALLY EXPECT A LOT FROM THE PEOPLE WHO CARE FOR MY KIDS. MY 4-YEAR-OLD HAS BEEN GOING TO THEIR SCHOOL SINCE HE WAS SIX WEEKS OLD.

AS SOON & HAD MY SECOND ONE HE WENT THERE ALSO.

I LOVE THEM BECAUSE THEY ARE NOT JUST BABYSITTING.

WHEN I PLAY HIS ABCS HE GETS UP AND CLAPS BECAUSE HE KNOWS THEM.

HE CAN'T TALK IT BUT HE KNOWS THIS.

THEY LET ME COME TO VOLUNTEER ANY TIME.

I DON'T HAVE TO SCHEDULE IT. WHEN I WALK IN EVERYONE KNOWS I CAN WALK IN AT ANY MOMENT AND EVERYONE IS DOING EXACTLY WHAT THEY ARE SUPPOSED TO DO. THEY HAVE A SCHEDULE ON THE WALL. I CAN CLOCK WHEN THEY ARE GOING TO DO WHAT THEY ARE GOING TO DO. THEY ARE LEARNING VERY EASILY.

[00:25:04]

HAVE TO SAY I REALLY APPRECIATE THEM BECAUSE LIKE SHE SAID I AM A SINGLE MOTHER AND I HAVE TWO KIDS AND SHE IS THE REASON I GOT TO FINISH SCHOOL. THE REASON I GOT TO GO AND GET MY AA DEGREE. WHILE I CAN CONTINUE TO GO TO SCHOOL WHILE I WORK. THAT IS BECAUSE I HAVE MY KIDS WERE SOMEONE WHO CARES ABOUT THEM.

THEY ARE NOT JUST FOR THE MONEY. >> I WAS VERY IMPRESSED.

I AM NOT A CHILD PERSON. AND GENERALLY IF I GET AROUND TO MANY CHILDREN AND ONE TIME I BREAK OUT IN TIMES AND A COLD SWEAT. I WAS THERE JUST LONG ENOUGH SO IT WOULDN'T HAPPEN. I REALLY TAKE MY HAT OFF TO YOU GUYS WERE THERE ALL OF THE TIME AND DOING THE JOB.

TO SEE YOUR OPERATION IN THAT NEIGHBORHOOD IN WHAT YOU ARE DOING THERE I AM VERY PROUD OF WHAT YOU ARE DOING.

THIS CITY NEEDS IT. >> I WANT TO NOTE THAT.

>> CAN YOU PLEASE SPEAK INTO THE MICROPHONE.

>> MY LAST POINT. I TRIED TO MAKE LIFE EASIER FOR PARENTS. ALL THEY HAVE TO DO IS BRING THE DUST WRECKED THEIR BABY IN WITH A CAN OF MILK AND I PROVIDE EVERYTHING ELSE. BY MARCH I PLAN TO BE ABLE TO PROVIDE FORMAL AS WELL. THAT WAY YOU JUST HAVE TO WAKE UP AND BRING YOUR BABY IN AND I HAVE EVERYTHING.

>> THAT IS AMAZING. >> IS NOT FOR THE MONEY IT IS

FOR THE LOVE OF THE CHILDREN. >> KEEP DOING WHAT YOU ARE

DOING. >> THANK YOU.

>> ANYONE ELSE WISHING TO SPEAK? >> I WASN'T GOING TO SPEAK BUT I ALMOST CRIED WHEN SHE MADE HER SPEECH.

I AM THE OWNER OF PRECIOUS LAND LIKE SHE SAID.

MY HUSBAND WAS DECEASED 15 YEARS AGO.

WE STARTED THIS IN 1994. LIKE SHE SAID, DAYCARE, CHILDREN ARE OUR HEART. I WASN'T IT BEFORE 1994.

I WAS IN OTHER DAY CARES AND I TREATED IT EXACTLY HOW I TREAT MINE. I GET SENSITIVE WHEN I TALK ABOUT KIDS. THE HARDEST THING WE HAD TO DO WAS A COUPLE OF MONTHS AGO WHEN WE WEREN'T ABLE TO OPEN THE CENTER, WE HAD TO DECIDE WHICH 20 KIDS WE WOULD PUT OUT.

I NEVER THOUGHT IT WOULD BE SO HARD TO TELL PARENTS THAT THEY COULDN'T BRING THEIR KIDS. I LOST A LOT OF SLEEP OVER THAT.

MY DAUGHTER LOST A LOT OF SLEEP. HOW DO YOU TELL -- AND THEY WOULDN'T ALLOW US TO TELL THEM, THEY DID MAKE IT EASY.

I WANT TO THANK YOU ALL FOR GIVING THIS TO US BECAUSE WE WEREN'T SUPPOSED BE OPEN NOW. I WANT TO THANK YOU FOR LETTING US OPEN EARLY BECAUSE THOSE PARENTS WERE REALLY GIVING US A HARD TIME AND WE REALLY LEVEL WE DO.

WE REALLY DO. RIGHT NOW LIKE SHE SAID, WE HAVE THREE AND FOUR GENERATIONS. I HAVE HAD THE MOTHERS, NOW WE HAVE THE GRANDKIDS. THAT'S WHERE WE ARE RIGHT NOW.

THANK YOU. WE COULDN'T HAVE DONE IT WITHOUT

YOU ALL. >> WE THANK YOU.

>> ALSO I WANTED TO SAY MY LITTLE SISTER WHO ACTUALLY WORKS FOR PRECIOUS LAMB WAS THE ONE WHO WENT TO PRECIOUS LAMB WHO IS 19-YEARS-OLD. SHE FEELS AT HOME WORKING THERE.

THANK YOU. >> WAS A SUCCESS STORY.

THANK YOU VERY MUCH. I WILL COME BACK TO THE BOARD FOR ANY FURTHER QUESTIONS OF STAFF.

>> FIRST OFF I COMMEND THE APPLICANT FOR THEIR TENACITY AND TREMENDOUS SERVICE THEY ARE PROVIDING TO THE COMMUNITY.

I WOULD LIKE TO COMMEND THE STAFF FOR HAVING THE VISION TO GIVE THEM THEIR CONDITIONAL OPERATION CAPABILITY.

I THINK THAT WAS FORWARD THINKING.

I APPLAUD THE PLANNING DEPARTMENT FOR GETTING THAT DONE. OBVIOUSLY THERE IS A NEED IN THE COMMUNITY IN YOU ASSISTED IN GETTING THAT NEED ADDRESSED SO THAT IS APPRECIATED. I WISH WE HAD MANY MORE APPLICATS LIKE THIS. IT MAKES OUR TIME UP HERE THAT MUCH EASIER. THAT'S IT.

>> MR. CHAIR I WOULD LIKE TO COMPLEMENT MRS. OWENS AND THE

[00:30:04]

PRECIOUS LAMBS STAFF AS WELL. SHE SAID THEYOU GO INTO THAT ARU CAN SEE THAT THEY REALLY DO LOVE WHAT THEY DO THE WAY THEY HAVE ENHANCED THE AREA. AGAIN I COMMEND YOU AND

CONTINUED THE GOOD WORK. >> I WILL SAY WHEN YOU PULL INTO THAT BLOCK, YOU KNOW THERE IS SOMETHING SPECIAL GOING ON

THERE. >> I WILL ENTERTAIN A MOTION.

>> MOTION TO APPROVE. >> SECOND PERIOD.

>> WE HAVE A MOTION BY MR. BRODERICK.

>> MOTION SECOND FROM MISS JOHNSON SCOTT.

I WOULD ASSUME THAT MOTION IS TO INCLUDE THE WON CONDITION.

IT IS CALLED ROLE. >> MS. JOHNSON SCOTT MR. BRODERICK, MR. O'CONNELL, CHAIRMAN MILLER.

>> YES. >> OUR NEXT ITEM ON THE AGENDA

[a. Planned Development - Misty Creek Preserve - 1919 South 35th Street]

IS MISTY CREEK PRESERVE 1919 SOUTH 35TH STREET.

>> THIS IS FOR THE REZONING OF MISTY CREEK PRESERVE.

THE FUTURE LAND IS COMMERCIAL. AT THE LAST MEETING IS ON APPLICATION TO REVERT OR CHANGE THE FUTURE LAND USED TO RESIDENTIAL. THAT IS SCHEDULED FOR TOMORROW EVENING FOR A HEARING. THE ZONING ON THE PROPERTY IS COMMERCIAL IN THE APPLICANT IS REQUESTING A PLANNED DEVELOPMENT. SO THE REQUEST IS FOR DEVELOPMENT REVIEW AND DESIGN REVIEW FOR THE CONSTRUCTION AND OPERATION OF A MULTI FAMILY DEVELOPMENT WITH 144 UNITS.

JUST GENERALLY SPEAKING ABOUT THIS PROPERTY THERE WAS A REQUEST BACK IN THE MID TO THOUSANDS FOR A SIMILA PROPERTY OR SIMILAR DEVELOPMENT. IT WAS 136 UNITS.

THAT WAS ALSO APPROVED BY THE CITY COMMISSION.

IT IS SIMILAR IN SIZE AND SCOPE. SO STAFF IS RECOMMENDING APPROVAL AS IT IS COMPREHENSIVE INCLUDED WITH SECTION CODES THAT PROVIDE STANDARDS FOR THE REVIEW OF ZONING CHANGE REQUESTS.

IT DOES NOT ADVERSELY AFFECT THE PUBLIC HEALTH, SAFETY CONVENIENCE AND GENERAL WELFARE. IT IS WITHIN PROXIMITY TO KEY COMMERCIAL AND INSTITUTIONAL AMENITIES.

IT IS ACROSS THE STREET FROM INDIAN STATE COLLEGE.

>> SO HERE'S A COPY OF THE SITE PLAN TO SHOW YOU HOW IT WILL BE CONFIGURED. IT WILL BE SIX RESIDENTIAL BUILDINGS. THERE WILL BE ONE BUILDING THAT WILL HAVE A CLUBHOUSE AND A POOL.

THERE WILL BE INTERNAL SIDEWALKS AND EXTERNAL SIDEWALKS.

THEY WILL HAVE OVER 250 PARKING SPACES AND THEY'RE GOING TO HAVE A SURPLUS OF 46 PARKING SPACES SO THEY HAVE MORE THAN THEY NEED FOR THE SITE. THE LANDSCAPE, IS CONSISTENT WITH CITY CODE 22-131. AS I NOTED THE PARKING IS

CONSISTENT WITH CODE. >> THIS IS A COPY OF WHAT THE BUILDINGS WILL LOOK LIKE UPON FINAL COMPLETION.

AND STAFF IS RECOMMENDING APPROVAL WITH NINE CONDITIONS.

SO ONE A LIGHTING PLAN SHALL BE SUBMITTED AT THE TIME OF BUILDING PERMIT. NUMBER TWO PRIOR TO THE ASSURANCE OF A BUILDING PERMIT ALL 12 PARCEL SHALL BE COMBINED VIA A TITLE WITH THE CLERK OF COURTS AND THEY WILL NEED TO DO A PARCEL COMBINATION WITH THE PROPERTY APPRAISER'S OFFICE.

THIS SHALL BE SUBMITTED AT THE TIME A BUILDING PERMIT.

>> A RIGHT-OF-WAY PERMIT FOR ALL WORK WITHIN COUNTY RIGHT-OF-WAY IN MAY INCLUDE A ROADWAY AGREEMENT.

>> THE SIDEWALK SHALL BE CONSTRUCTED ALONG THE PROPERTY'S BOUNDARIES ON SOUTH 35TH STREET AND SOUTH 37TH STREET IN ACCORDANCE WITH CITY CODES OPTIONS MAY BE CONSIDERED AT THE TIME. THE APPLICANT SHALL ORDINATE WITH THE COUNTY REGARDING SIDEWALKS BECAUSE THEY ARE COUNTY OWNED. SOUTH 35TH STREET IS IDENTIFIED AS A FUTURE 80-FOOT RIGHT-OF-WAY.

DEDICATION ONE HALF OF THE REMAINING REQUIRED RIGHT-OF-WAY IS REQUESTING THE AMOUNT OF 5 FEET FROM THE PROPERTY.

THE APPLICANT SHOULD COORDINATE REGARDING THIS DEDICATION.

SOUTH 37TH STREET IS A LOCAL ROAD AND NOT ON THE COUNTY'S RIGHT-OF-WAY PROTECTION PLAN. THE MINIMUM RIGHT-OF-WAY FOR LOCAL ROAD TO 70 FEET. THE CURRENT WIDTH IS DEMONSTRATED AS 30 FEET. THE DEDICATION OF 20 FEET FROM

[00:35:03]

THE PROPERTY IS REQUIRED. THE APPLICANT SHALL COORDINATE WITH ST. LUCIA COUNTY REGARDING THIS RIGHT-OF-WAY DEDICATION.

>> THE WILL NEED TO SUBMIT THREE PLANS TO THE WATER AND WASTEWATER DIVISION FOR APPROVAL AT THE TIME OF APPROVAL.

THEY WILL NEED TO COORDINATE WITH THE AUTHORITIES REGARDING EASEMENTS AND THEY SHALL BE IN PLACE BEFORE THE FIRST CERTIFICATE OF OCCUPANCY. FINALLY LANDSCAPE ON SHALL BE REQUIRED BEFORE THE FINAL CERTIFICATE OF OCCUPANCY IS

APPROVED FOR THE SITE. >> POSSIBLE ACTIONS, IF YOU RECOMMEND APPROVAL, WITH NO CHANGES THE STAFF IS RECOMMENDING NINE CONDITIONS. YOU CAN RECOMMEND APPROVAL WITH CHANGES OR DISAPPROVAL. I AM AVAILABLE FOR ANY QUESTIONS

YOU MAY HAVE. >>> I AM OPEN TO QUESTIONS FROM

THE BOARD. >> CAN YOU GIVE US AN OVERVIEW OF THE ACCESS ISSUES RELATED TO THIS, PARTICULARLY NUMBER FIVE.

CAN YOU GIVE US SOME MORE LEHMANS DESCRIPTIONS OF WHAT ALL

THIS IS. >> BASICALLY BECAUSE THE COUNTY OWNS ALL OF THE RIGHT OF WAYS, THEY ARE REQUESTING PROPERTY DEDICATION FROM THE SITE. I BELIEVE THE COUNTY HAS BEEN IN CONTACT WITH THE DEVELOPER AND THE DEVELOPERS HERE TONIGHT.

>> SO THE COUNTY IS THE ONE THAT IS DESIGNATING IN ESSENCE, ALL VEHICULAR TRAFFIC BEING CONTROLLED BY THE COUNTY.

THE CITY DOESN'T HAVE ANY INPUT. >> YES.

ALL OF THESE CONDITIONS PERTAINING TO THE COUNTY CAME FROM AN E-MAIL THAT THE COUNTY ENGINEER SENT ME.

>> OKAY. >> HAS THAT ALL BEEN APPROVED BY THE COUNTY AT THIS TIME BORS IS STILL PENDING OR ARE THEY WAITING TO GET THROUGH THIS PROCESS?

>> I WILL FIELD THE QUESTION TO THE APPLICANT.

>> WE WILL HOLD FOR THAT THEN. >> ANY OTHER QUESTIONS OR

COMMENTS FROM THE BOARD? >> NOT HEARING ANY.

WOULD YOU BRING UP THE SITE PLAN AND LEAVE THAT UP FOR US.

I THINK THAT WILL BE HELPFUL AS WE MOVE INTO THE NEXT PHASE.

I WILL OPEN THE PUBLIC PORTION OF THE MEETING AND CERTAINLY I WOULD LIKE TO HEAR FROM THE APPLICANT.

I THINK WE SPOKE WITH YOU LAST MONTH.

>> THAT'S RIGHT. >> IT WAS ON LAND USE.

>> FOR THE RECORD I AM LEE DOBBINS.

I AM WITH THE OFFICE OF FORT PIERCE REPRESENTING THE APPLICANT. I ALSO HAVE WITH US BRIAN NOLAN OUR LAND PLANNER. THEY ARE HERE TO ANSWER ANY QUESTIONS YOU HAVE. IN RESPONSE TO THE QUESTION% RAISED BY MR. BRODERICK REGARDING THE COUNTY TRAFFIC COMMENT. WE JUST RECEIVED OUR TRAFFIC COMMENTS FROM THE COUNTY JUST BEFORE THE MEETING.

WE ARE PUSHING TO GET THOSE BACK.

THEY BASICALLY INDICATED AND ADDRESS FOR ALL OF OUR COMMENTS THAT THEY HAVE GIVEN US PREVIOUSLY.

WE HAVE ADDRESSED ALL OF THE COUNTY COMMENTS.

SO AS FAR AS TRAFFIC GOES WITH RESPECT TO THE COUNTY WE ARE

DONE. >> REGARDING TRAFFIC ON ORANGE AVENUE RIGHT, IT RUNS RIGHT UP THROUGH THEIR.

>> VIRGINIA AVENUE. >> VIRGINIA AVENUE'S ON THE SOUTH SIDE. ON THE NORTH SIDE IS OKEECHOBEE

ROAD. >> THAT HAS A MEDIUM STRIP IN FRONT OF IT THAT YOU ARE SHOWING GOING IN-AND-OUT OF YOUR

FACILITY. >> ON THE OKEECHOBEE SIDE?

>> YES. >> THAT IS ONLY GOING TO BE ENTERING FROM THE NORTH AND EXITING TO THE SOUTH, IS THAT

CORRECT? >> CORRECT.

RIGHT IN AND WRITE OUT. >> SO THE COUNTY, I GUESS THAT IS THE COUNTY RIGHT THERE, SO THE COUNTY WON'T ALLOW YOU TO

CARVE THROUGH THAT MEDIUM STRIP. >> WE CAN'T MAKE A CURB CUT

THERE. >>.

>> THE OTHER QUESTION I HAVE REGARDING THAT SAME AREA WAS, THERE IS AN OPERATING BUSINESS THAT IS ON YOUR PROPERTY.

IT IS LONG OKEECHOBEE AT THE CORNER OF 35TH AND OKEECHOBEE.

IT APPEARED TO ME AS THOUGH MANY OF THE U-HAUL VEHICLES THAT THEY RENT, ARE THEY PARKED IN YOUR PROPERTY PRESENTLY?

>> I DON'T KNOW. I DON'T KNOW IF THEY ARE OVER

THE PROPERTY LINE. >> I ONLY ASK THAT BECAUSE, I'M

[00:40:04]

JUST NOT REALLY CONCERN AS INTERESTED TO KNOW WHETHER OR NOT THERE'S BEEN ANY DISCUSSION WITH THE BUSINESS OWNER SHOULD THEY NEED TO MOVE ALL OF THAT STUFF.

IT LOOKS LIKE THEY ARE ANCHORED IN THE AIR.

>> NOT THAT I AM AWARE OF BUT WE WILL MENTION IT TO THE PROPERTY

OWNER. >> I THINK THERE MAY NEED TO BE SOME DISCUSSION IF INDEED, WHAT APPEARS TO BE IN OVERLAP OF THEIR USE IN YOUR PROPERTY. IT HAS BEEN SITTING THERE EMPTY FOR A LONG TIME. I WOULDN'T BE SURPRISED IF THEY

ARE NOT OVERLAPPING. >> IS VERY POSSIBLE.

IT PROBABLY ISN'T OBVIOUS WHERE THE PROPERTY LINE IS.

>> I WOULD KNOW WHERE IT IS. THAT IS WHY I AM GUESSING THEY ARE OVERLAPPING AND USING SOME OF THE PROPERTY.

THAT IS THE ONLY COMMENT I HAVE. DOES ANYONE ELSE HAVE ANY COMMENTS OR QUESTIONS FOR THE APPLICANT?

>> NOT HEARING ANY. THANK YOU VERY MUCH.

>> THANK YOU. ANYONE ELSE SPEAKING TONIGHT IN FAVOR OR OPPOSE? NOT SEEN ANYONE I WILL CLOSE THE PUBLIC MEETING AND, COME BACK TO THE BOARD FOR ANY FURTHER

COMMENTS OR QUOTES. >> MR. CHAIRMAN IF I MAY.

>> I WOULD LIKE TO ECHO YOUR SENTIMENTS.

I WENT OUT AND PUT THE SIGN OUT AND IT WAS HARD TO TELL WHERE THE PROPERTY LINE WAS WAS IN. IT IS POSSIBLE THERE ARE U-HAUL

TRUCKS PARKED THERE. >> IF I WERE RUNNING A BUSINESS ON THAT CORNER IN NOT ALL OF THAT REAL ESTATE AVAILABLE TO ME, I MAY USE IT TOO. SO, IT LOOKS LIKE IF INDEED THEY ARE USING IT. YOU MAY NEED TO HAVE SOME DISCUSSIONS TO HELP THEM FIGURE OUT WHAT THEY WILL DO WITH THAT STUFF. BECAUSE IT IS SPREAD OUT.

>> ARE YOU GOING INTO THE U-HAUL BUSINESS FRANK?

>> NOT INTERESTED. >> NOT INTERESTED IN ANY BUSINESS. I AM ALL DONE.

THE ONLY BUSINESS I WANT IS THIS BUSINESS.

>> ANY OTHER QUESTIONS OR COMMENTS?

>> NO. >> NOT SEEING OR HEARING ANY I

WILL OPEN IT UP FOR A MOTION. >> DO THE CHAIR MOVE WITH APPROVAL WITH THE NINE CONDITIONS.

>> SECOND PERIOD. >> WE HAVE A MOTION FROM MISS JOHNSON SCOTT WITH NINE CONDITIONS WITH APPROVAL AND A

SECOND FROM MR. O'CONNELL. >> I'M TERRIBLE.

KEEP ME STRAIGHT. >> NOT AS BAD AS THE MICROWAVE.

>> YEAH, YOU JUST CUT ME A BREAK.

>> CALLED THE ROLL PLEASE. >> MR. BRODERICK.

MR. O'CONNELL. MR. BURGE.

MS. JOHNSON SCOTT. CHAIRMAN CREYAYFMILLER.

>> THANK YOU FOR YOUR TIME. I THINK YOU JUST DID THAT TO

HELP ME OUT. >> OKAY NEXT ITEM ON OUR LIST IS

[d. Site Plan and Conditional Use - Independent Classical Charter School - 2900 South Jenkins Road]

ITEM D. SITE PLANNING CONDITIONAL USE.

IT IS FOR THE CLASSIC SCHOOL AND 2900 SOUTH JENKINS ROAD.

MS. JENKINS WILL PRESENT THAT AS WELL.

>> THIS WILL HELP YOU TOO. YOU GOT IN THE SCENE AND YOU ARE

COMFORTABLE. >> SOLD LAST BUT NOT LEAST TONIGHT. WE HAVE THE CONDITIONAL USE DEVELOPMENT REVIEW FOR CHARTER SCHOOL LOCATED AT TO ANY 900 SOUTH JENKINS ROAD. THE PROPERTY HAS A FUTURE LAND USE WITH MEDIUM DENSITY. IT IS A ZONING OF R-2 SINGLE-FAMILY INTERMDIATE DENSITY.

THE REQUEST IS FOR CONDITIONAL USE WITH NEW CONSTRUCTION DEVELOPMENT REVIEW AND DESIGN REVIEW FOR THE CONSTRUCTION AND OPERATION OF A CHARTER SCHOOL THAT WE HAVE NO MORE THAN 370 STUDENTS. STAFF RECOMMENDS APPROVAL OF THE REQUEST AS IT IS CONSISTENT WITH THE CITY CODE PLAN.

IT DOES NOT ADVERSELY AFFECT PUBLIC HEALTH, SAFETY OR GENERAL WELFARE. AND CONDITIONAL USE IS REQUIRED FOR ALL SCHOOLS WITHIN THE CITY LIMITS.

>> IT IS A SITE PLAN TO GIVE YOU AN IDEA OF THE CONFIGURATION.

THEY WILL HAVE 66 PARKING SPACES.

THEIR RETENTION POND IS LOCATED TO THE EAST OF THE SITE.

THERE WILL BE A WRAPAROUND DRIVEWAY THAT GOES AROUND THE SCHOOL FOR PARENT DROP-OFF AND PICKUP.

THERE WILL BE NO BUS SERVICE PROVIDED TO THE LOCATION.

THERE WILL BE GRADES KINDERGARTEN THROUGH 12.

THERE IS A BASKETBALL COURT THAT IS LOCATED ON THE SITE ALONG WITH AN OPEN FIELD FOR PLAY. THERE WILL BE AN OPEN COURTYARD AREA. NO FOOD WILL BE PREPARED ON SITE. EVERYTHING WILL BE CATERED.

[00:45:01]

THERE WILL BE APPROXIMATELY 40 STAFF MEMBERS.

BOTH THE LANDSCAPE PLAN AND THE LIGHTNING PLAN ARE CONSISTENT WITH CODE AND CITY CODE 22 -- 60 SUBSECTION J.

>> THIS IS A COPY OF WHAT THE BUILDING WILL LOOK LIKE.

IF YOU'VE BEEN OUT TO THE SITE IT MIMICS WHAT THE CHURCH CURRENTLY LOOKS LIKE ON THE SITE.

THERE'S A FEW DIFFERENT VARIATIONS BUT FOR THE MOST PART THE ARCHITECTURE LOOKS SIMILAR. STAFF IS RECOMMENDING APPROVAL SUBJECT TO THREE CONDITIONS. I WOULD LIKE TO KNOW CONDITIONS ONE INTO CAME DIRECTLY FROM THE ST. LUCIA COUNTY ENGINEER.

SO THE APPLICANT SHALL CONSTRUCT OFF-SITE IMPROVEMENTS INCLUDING BUT NOT LIMITED TO LEFT AND RIGHT HAND TURN LANES INTO THE SITE AND IMPROVEMENTS DEEMED NECESSARY BY THE TRAFFIC REVIEW.

ALL OFFSET IMPROVEMENTS WITHIN THE RIGHT OF WAY SHALL BE PERMITTED AND BONDED THROUGH ST. NUMBER TWO THE APPLICANT SHALL DEDICATE 7 FEET OF RIGHT-OF-WAY ALONG SOUTH JENKINS ROAD RIGHT-OF-WAY SHALL BE CONVEYED TO THE COUNTY WITHIN NINE DAYS OF THE SITE APPROVAL OR PRIOR TO THE ASSURANCE OF THE FIRST BUILDING PERMIT WHICHEVER COMES FIRST.

NUMBER THREE A LANDSCAPE BOND PURSUANT TO CODE SHALL BE REQUIRED BEFORE THE FINAL CERTIFICATE OF OCCUPANCY.

THE POSSIBLE ACTIONS BY THE PLANNING BOARD ARE TO RECOMMEND APPROVAL SUBJECT TO THREE CONDITIONS.

YOU CAN RECOMMEND APPROVAL WITH CHANGE OR YOU CAN RECOMMEND DISAPPROVAL. A RECOMMENDATION OF DISAPPROVAL SAYS THIS IS IS A CONDITIONAL USE WOULD REQUIRE FOUR FIFTHS VOTES. I AM OPEN FOR ANY QUESTIONS WE

HAVE. >> I WOULD LIKE TO MAKE NOTE DURING A SITE VISIT TODAY I SPOKE WITH THE YOUNG LADY IN ONE OF THE CHURCH OFFICES. I AM NOT SURE IF SHE WAS -- I WAS CONFUSED OF THE STORY WENT. I'M NOT SURE IF SHE WAS A DIRECT EMPLOYEE OR AN EMPLOYEE OF SOMEONE RENTING SPACE FROM THE CHURCH BUT NONETHELESS SHE WAS THERE AND I SPOKE WITH HER.

I WILL OPEN THIS UP TO QUESTIONS AND COMMENTS FROM THE BOARD.

>> I DO HAVE ONE QUESTION. SOMEWHERE IN THE VERBIAGE HERE, IT SEEMS THERE WAS A CHANGE IN THE STUDENT POPULATION FROM K-12

TO EIGHTH GRADE. >> SO THEY ORIGINALLY WERE PROPOSING 750 STUDENTS WHEN THEY WERE DOING THE COORDINATION WITH THE COUNTY FOR THE TRAFFIC REVIEW.

THE NUMBERS WOULD NOT WORK WITH THE SCHOOL FOR WHAT THEY WERE PROPOSING SO THEY HAD TO DROP THE NUMBER OF STUDENTS.

>> SO IT IS -- >> IT IS STILL K-12.

IT WILL BE NO MORE THAN 570. >> IS THAT DUE TO TRAFFIC?

>> YES. >> USE A 570 OR 370?

>> 570. >> CAN YOU GO BACK TO THE

CONDITIONS. >> CONDITION TWO WHAT IS THAT RELATIVE TO CALLED THE RIGHT AWAY.

>> THE RIGHT OF WAY, BASICALLY THEY NEED TO PROVIDE 7 FEET OF THEIR OWN WHILE THE CHURCH PROPERTY NEEDS TO PROVIDE 7 FEET FOR THE COUNTY TO EXTEND THE ROADWAY OR EXTEND THE SIDEWALKS.

THE COUNTY CAN USE IT FOR WHATEVER PUBLIC NEED THERE IS.

WITH EVERY PROJECT COMING ALONG SOUTH JENKINS ROAD THEY HAVE ASKED FOR THE RIGHT-OF-WAY THAT THEY NEED TO, I'M ASSUMING TO

EXPAND THE ROAD. >> THE GIST OF WHAT I WAS GETTING AT. THIS BOARD HAS DEALT WITH MULTIPLE PROJECTS ON THE ROAD, AND THEY HAVE A LOT OF TRAFFIC ON THAT ROAD. I WAS LOOKING OVER THE SITE PLANS AND THE TURNING LANES INTO THE PROPERTY, IS THAT WHAT THEY ARE GOING FOR HERE, I'M PROBABLY ASKING THE WRONG PERSON.

BUT RELATIVE TO THE FUTURE TRAFFIC GENERATION ON JENKINS ROAD, IS IT THE UNDERSTANDING THE COUNTY WILL EXPAND IT OR

WILL THEY REQUIRE TURNING LANES? >> FOR THIS SPECIFIC PROJECT FROM MY UNDERSTANDING THE COUNTY IS REQUIRING THEM TO CONSTRUCT OFF-SITE IMPROVEMENTS WHICH COULD INCLUDE BUT NOT LIMITED TO

TURN LANES. >> THAT IS NOT PART OF THE PLANNED APPROVAL FROM THE COUNTY OR IS IT?

>> IT WILL BE PART OF THE COUNTY'S APPROVAL.

NOT PART OF OUR APPROVAL. >> THE TURNING LANES ARE COMING.

MAYBE THE APPLICANT CAN ADDRESS THAT.

>> I DON'T KNOW IF IT IS PART OF THE COUNTY'S PLAN BUT IT SEEMS THEY ARE GOING TO COORDINATE TO HAVE THE APPLICANT DO IT OR THE COUNTY WILL DO IT. IT WILL BE A NEGOTIATING BETWEEN

THE APPLICANT AND THE COUNTY. >> THANK YOU.

>> MR. CHAIR. REGARDING SOUTH JENKINS, JUST TO

[00:50:01]

LET YOU KNOW I SENT ON THE TRANSPORTATION, THE SAME AS THE COUNTY HAS REQUESTED THE TRANSPORTATION PLANNING ORGANIZATION INCLUDE A STUDY FOR SOUTH JENKINS BETWEEN MIDWAY ROAD AND ORANGE AVENUE IN THE TRANSPORTATION PLAN.

THAT HAS BEEN BUMPED UP AND THEY ARE LOOKING AT DOING A CORD OR STUDY TO WHAT IMPROVEMENTS ARE NEEDED BECAUSE EVERYONE IS SEEING THE LEAVES AND EVERYTHING HAPPENING.

SOMETHING NEEDS TO BE DONE. THEY ARE TRYING TO DO A HOLISTIC LOOK AND AGAIN WORK WITH THE DOT TO GET SOME STATE FUNDING FOR THAT AS WELL. SO TYPICALLY WHAT HAPPENS IS THE COUNTY TRIES TO GET THE RIGHT AWAY WHEN NEW PROJECTS COME ALONG. THEN WHILE THE SITE PLAN APPROVAL IN THE CITY, THEY WILL HAVE TO GO TO THE COUNTY TO GET PERMISSION TO BUILD WITHIN A RIGHT-OF-WAY.

THAT IS WHEN THEY DECIDE WHETHER THEY NEED RIGHT TURN LINGS OR

LEFT TURN LANES. >> ANY IDEA WHEN THAT STUDY WILL

BE COMPLETED? >> I WOULD GUESS BEFORE WE SEE ANY REAL IMPROVEMENTS IT COULD BE 5-10 YEARS.

THE REALITY WITH THE STATE AND FEDERAL FUNDING, IT IS A SLOPE

PROCESS. >> NOT THE PROJECT JUST THE

STUDY. >> I DON'T REMEMBER WHEN THE STUDY WAS SCHEDULED. THEY ARE TRYING TO GET THAT MOVED UP AND FUNDED. I DON'T KNOW --

>> WOULD BE A SHORTER TIME. >> MAY BE WITHIN THE NEXT YEAR

THAT COULD MOVE FORWARD. >> A LOT OF ACTION OUT THERE.

>> MR. CHAIR IF I CAN ASKED MR. SANDERS A QUESTION.

DOES THIS STUDY INCLUDE THE EXTENSION OF JENKINS ROAD ALL

THE WAY DOWN THE MIDWAY CLIQUES. >> YES.

>> I WAS REMINISCING EARLIER, IN 1989 I WAS DOING ENGINEERING WORK FOR THE COUNTY AND I DID TWO PROJECTS.

ONE WAS THE EXTENSION OF JENKINS FROM EDWARDS TO MIDWAY AND ANOTHER WAS THE EXTENSION FROM JENKINS TO ORANGE AND ANKLE.

THOSE PROJECTS NEVER WERE COMPLETED IN THE COUNTY NEVER

HAD THE FUNDS FOR IT. >> SO IT HAS BEEN IN THE WORKS FOR A LONG TIME BUT NOW IT IS UNDER PRESSURE TO DO SOMETHING.

>> WITH PROJECTS LIKE THIS WE ARE SEEING MORE TAX MONEY SO

MAYBE WE CAN SPEED IT UP. >> IS THERE A SIDEWALK IN THIS QUICKSAND THERE IS AN EXISTING SIDEWALK ALL THE WAY DOWN TO

THIS LOCATION. >> IS IT LIKE A BIKE LANE TOO WITH THE SCHOOL? PEOPLE MAY WANT TO RIDE THEIR

BIKES TO SCHOOL. >> I DON'T THINK A BICYCLE LANE WAS INCLUDED BUT THAT MAY BE PART OF THE LONGER-TERM

IMPROVEMENTS TO JENKINS. >> RIGHT NOW THAT SECTION IS NOT MUCH MORE THAN A TWO LANE COUNTRY ROAD.

>> A BUNCH OF TREES FOR NOW. IT DOES NEED A LOT OF HELP.

ANY OTHER QUESTIONS BY THE BO BOARD? NOT SEEN ANY AND WILL MOVE TO THE PUBLIC PORTION OF THE MEETING. ANYONE SPEAKING IN FAVOR OR OPPOSE PLEASE SPEAK FORWARD AND I WOULD LIKE TO HEAR FROM THE APPLICANT. IT DOESN'T LOOK LIKE THERE'S ANYONE IN THE ORDINANCE BUT OUR OWN PEOPLE.

I GUESS WE ARE IT. >> I AM DAVID.

I AM INSURED FOR THE PROJECT. I WOULD LIKE TO MAKE A COUPLE OF CLARIFICATIONS. THE 570 IS CORRECT FOR THE NUMBER OF STUDENTS. K-8 GRADE IS WHAT THEY WILL BE.

>> THAT IS HOW THE REDUCTION WAS ACHIEVED.

>> MR. CHAIR, I'M JUST CURIOUS AS TO WHY THE NUMBER WAS REDUCED. WAS IT A DISCUSSION WITH THE

COUNTY BASED ON TRAFFIC? >> THE SCHOOL POPULATION.

THE SCHOOL ITSELF ONLY HAD THE NEED FOR K-8.

IT WAS REDUCED WITH THE TRAFFIC STUDY TOO.

THE NUMBERS WERE REDUCED AT THAT POINT AS WELL.

>> YOU CONTEMPLATE IN THE FUTURE?

>> THERE IS AN OPTION TO ADD UP TO 12 GRADES AT THIS LOCATION.

>> THIS WASN'T AN ISSUE BASED ON THE TRAFFIC COUNT AT THE COUNTY HAD PUSHED BACK BASED ON THE TRAFFIC IT HAD NOTHING TO DO WITH IT. IT WAS A MARKETING THING.

>> CORRECT. >> K.

[00:55:04]

>> PERHAPS YOU CAN CLARIFY SOME OF THE DISCUSSION CONCERNING TURN LANES. WE ARE CURRENTLY IN TALKS WITH THE COUNTY TO ADD TURN LANES FOR THIS PARTICULAR PROJECT.

>> THE RIGHT OF WAY, THE CHURCH HAS ALREADY GIVEN RIGHT-OF-WAY WHEN THEY CAME IN. MY UNDERSTANDING IS THE COUNTY WILL REQUIRE 160-FOOT RIGHT-OF-WAY TO WIDEN JENKINS ROAD. SO THAT IS THE REASON FOR THE COUNTY ASKING FOR SEVEN ADDITIONAL FEET TO MAKE THE 80-FOOT CENTER LANE TO OUR PROPERTY LINE RIGHT OF WAY MATCH THE OVERALL 160-FOOT RIGHT-OF-WAY.

>> YOU PURCHASE THE AREA EAST OF THE CHURCH AND THE EXTENDED

PARKING LOT. >> THAT IS CORRECT.

>> THE REQUEST FOR ADDITIONAL PROPERTIES ALONG JENKINS ROAD IS A QUESTION BETWEEN THE EXISTING CHURCH AND THE COUNTY.

>> THAT IS CORRECT. >> OBVIOUSLY YOU WILL PLAY A ROLE IN IT BEING THAT YOU ARE IMPOSING ON THE CHURCH WHERE

THEY NEED TO DO THAT. >> THE DEVELOPER OF THE SCHOOL IS IN NEGOTIATIONS WITH THE CHURCH AND WORKING TO PURCHASE THE PROPERTY AND THE CHURCH IS WORKING WITH THEM TO MAKE ANY CONDITIONS NEEDED TO MAKE THE PROPERTY WORK.

>> THE INTENTION IS TO USE THE EXISTING EGRESS IN-AND-OUT OF YOUR SCHOOL. I SAY YOUR SCHOOL, IS THE OWNER

HERE? >> NOW.

CHANGE SO THIS SAME EGRESS WILL BE USED?

>> THAT IS CORRECT. >> AND THE COUNTY IS REQUIRING A RIGHT TURN LANE INTO THE PROPERTY AND A LEFT TURN COMING FROM THE NORTH TO THE SOUTH ON JENKINS.

>> OKAY. >> WE ARE CURRENTLY WORKING WITH

THE COUNTY ON PLANS FOR THAT. >> ARE YOU FAMILIAR AT ALL WITH THE TURN LANE REQUIREMENTS FOR THE 808.

>> AOA? >> AOA CAMPGROUND.

WE WERE MADE AWARE OF THE CAMPGROUND TODAY.

>> I'M NOT AWARE OF THEIR TURN LANES FOR THEIR PROJECT.

I DID MAKE A REQUEST TO LOOK AT THEIR PLANS AND SEE WHAT THEY

ARE PROPOSING. >> THE CHURCH OWNS PROPERTY BETWEEN THAT CAMPGROUND IN THE EXISTING CHURCH PROPERTY BEING USED, DO THEY NOT? ISN'T IT THE CHURCH THAT OWNS

PART OF THE PROPERTY? >> I'M NOT FOLLOWING --

>> I KNOW THERE IS A CANAL THAT RUNS SOUTH OF THE CHURCH PROPERTY. MY UNDERSTANDING IS IT IS SOUTH

OF THAT. >> THERE IS ON THE SCREEN.

>> THE CHURCH PROPERTY DOESN'T GO FURTHER SOUTH THAN THE CANAL.

THIS IS THE PROPERTY JUST SOUTH OF THE CANAL.

I COULDN'T TELL EXACTLY WHERE EVERYTHING WAS WHEN HE WENT BY.

I'M PRETTY FAMILIAR WITH THAT AREA I VISIT IT A LOT.

OKAY. THE REASON I ASKED THE QUESTION IS BECAUSE AT TIMES I SEE THAT TURN LANES ARE DEVELOPED AND UNFORTUNATELY IN THIS AREA WE DO THIS A LOT.

WE'RE AT THIS FACILITY IS DEVELOPING A TURN LANE THIS FACILITY IS DEVELOPING A TURN LANE AND FOR WHATEVER REASON THEY ARE NOT CONNECTED. THAT IS WHY I'M ASKING THE

QUESTION. >> WE WILL TAKE A LOOK AT THAT.

I WOULD TURN LANES ARE NOT PLANNED TO GO OF THE CANAL.

I'M NOT SURE WHAT THEY'RE LEFT TURN LANE IS GOING TO ENTAIL.

BUT AS I SAID WE ARE REQUESTING TO MAKE ACCOMMODATIONS.

>> THAT WILL BE A BUSY AREA. >> IT WILL BE.

>> ANY OTHER QUESTIONS. >> COULD YOU GO BACK TO REVISIT THE NORTHERLY TURN LANE. HOW ARE THEY GOING TO CONFIGURE

THAT? >> MEAN FOR THE NORTH IT WILL BE A LANE WIDENING. IT WILL WIDEN TO THE WEST.

THAT LANE, THE THROUGH LANE WILL COME DOWN AND TAPER BACK IN JUST BEFORE THE CANAL. AND THE RIGHT TURN LANE WILL BE TO THE EAST. IT WILL BE A FULL 12-FOOT LANE TO THE EAST TO TURN RIGHT INTO THE PROPERTY.

>> I MIRRORED THE CHAIRMAN'S COMMENTS, I THINK YOU HAVE TO GET WITH THE OTHERS TO GET SOME SYNERGY GOING WITH ALL OF THE LANES OUT THERE. THERE COULD BE SOME BENEFIT TO

[01:00:01]

WORKING JOINTLY WITH THEM ON THAT.

OBVIOUSLY WITH THE AMOUNT OF TRAFFIC BEING GENERATED THERE.

>> THEY JUST DID A WIDENING EFFORT IN JUST BELONG -- BEYOND THE WALL OUT THERE. THERE IS A PROPERTY BETWEEN JAN AND A DEVELOPMENT THAT WILL GO IN JUST SOUTH OF THE WALL.

I WILL GUESS THEY WILL CONTINUE TO GET THIS DOWN TO EDWARDS.

YOU HAVE TO CREATE A CENTER LANE SOMEHOW.

>> THE CURRICULUM FOR THE SCHOOL.

I KNOW WHEN SUBMITTED IT INDICATED WILL BE AND AGRICULTURAL CURRICULUM, DO YOU KNOW IF THAT IS STILL THE CASE?

>> I DON'T KNOW THAT TO BE THE CASE.

>> I DON'T KNOW. >> I AM NOT SURE FOR THE ROOM FOR THAT CURRICULUM. I GUESS THAT IS A SEPARATE ISSUE. ALL RIGHT, THANK YOU.

ARE YOU SUGGESTING THEY ADD TRAFFIC ENGINEERING TO THEIR

CURRICULUM. >> THEY HAD PROPOSED A SITE OUTSIDE OF THE URBAN SERVICE AREA AND OUT AN 11-MILE ROAD IN OKEECHOBEE. THEY CAME BACK TO THE SCHOOL DISTRICT AND SAID THIS WILL BE AN AGRICULTURAL SCHOOL.

I KNOW THEIR CHARTER IS NOT APPROVED.

IT HAS BEEN ON HOLD. I GUESS THIS WILL HAVE TO BE

WORKED OUT. >> THIS IS ACTUALLY MUCH BETTER LOCATION THAN THE SITE OUTSIDE OF THE URBAN SERVICE AREA.

I AM HAPPY TO SEE IT. >> YOU DIDN'T THINK YOU WERE READY TO ENTER INTO THE DISCUSSION.

OKAY ANY OTHER COMMENTS OR QUESTIONS FOR THE APPLICANT CORRECTS NOT SEEN ANY I WILL COME BACK.

THANK YOU VERY MUCH. I APPRECIATE YOUR EFFORTS.

>> I HAVE A COMMENT CONCERNING OUR REPORT.

IF YOU LOOK UNDER SITE LOCATION ON THE FRONT PAGE.

IT SAYS 2009 SOUTH JENKINS ROAD. I THINK A NUMBER GOT MOVED AROUND A LITTLE BIT. MAYBE WE WANT TO FIX THAT PRIOR

TO GOING TO THE COMMISSION. >>, YES, I MADE THE CORRECTION.

>> I KNEW WHERE THE CHURCH WAS. I KNEW WHERE 2900 WAS.

BUT WHEN I SAW THAT I WENT UP TO 2009 AND I FOUND IT AND GRANT IN JENKINS ROAD AND IT HAPPENS TO BE A BAPTIST OR SOMETHING OR OTHER. IT WAS RIGHT THERE WHERE CAMP WORLD IS GOING. I THOUGHT THIS CAN'T BE THE RIGHT PLACE. IT HAS TO BE FOUND THE CHURCH.

SO THAT IS HOW I GOT BACK THERE. I WOULDN'T WANT TO SEE OUR COMMISSIONERS WHEN THEY GO OUT TO DO SITE VISITS, DO THE SAME THING I DID. VERY GOOD.

ANY OTHER QUESTIONS OR COMMENTS CRACKS.

>> NOT HEARING ANY I WILL MOVE FORWARD TO ENTERTAIN A MOTION.

>> MR. CHAIR I MOTION TO APPROVE WITH CONDITIONS.

>> SECOND PERIOD. >> WE HAVE A MOTION BY MR. BRODERICK AND A SECOND BY MS. JOHNSON SCOTT.

CALL THE ROLL PLEASE. >> MS. JOHNSON SCOTT, MR. BRODERICK, MR. O'CONNELL, MR. BURGE, CHAIRMAN

CREYAYFMILLER. >> YES.

>> THANK YOU FOR YOUR PATIENCE WITH US.

I DID NOT MEAN FOR THE PRESCHOOL TO GO AS LONG AS IT DID.

BUT IT IS A VERY SPECIAL PROJECT.

I COULDN'T LET THEM NOT TALK ABOUT IT.

PARTICULARLY, I DON'T KNOW IF YOU KNOW FORT PIERCE WORLD BUT PARTICULARLY IN THAT NEIGHBORHOOD FOR THAT KIND OF THING TO GO ON, IT IS JUST AMAZING AND VERY IMPRESSIVE TO ME. I AM NOT EASILY IMPRESSED.

[7. COMMENTS FROM THE PUBLIC Any person who wishes to comment on any subject may be heard at this time. Please limit your comments to three (3) minutes or less, as directed by the Chair, as this section of the Agenda is limited to thirty minutes. The Planning Board will not be able to take any official actions under Comments from the Public. Speakers will address the Board and the Public with respect. Inappropriate language will not be tolerated.]

BUT THAT IS PHENOMENAL. OKAY.

NEXT ITEM IS COMMENTS FROM THE PUBLIC.

AND IT LOOKS LIKE I HAVE COMMENTS.

WHEN DID YOU COME IN? I DIDN'T SEE YOU BACK THERE

EARLIER. >> YOU KNOW TO SIGN IN AND STATE

YOUR NAME. >> NOW WE HAVE A THREE MINUTE

RULE. >> IT WON'T TAKE THAT LONG.

[01:05:03]

>> I AM JUST MAKING PUBLIC COMMENT AND MAKING EVERYONE AWARE INCLUDING JENNIFER THAT I WILL BE PRESENT FOR THE CITY MANAGEMENT MEETING THIS COMING MONTH IN REGARDS TO THE PERMIT PROCESS WHICH YOU GUYS ARE AWARE OF MY PERMIT.

EXCUSE ME. >> CAN YOU PLEASE STATE YOUR

NAME AND ADDRESS. >> MICHEL.

>> 715 SOUTH OCEAN DRIVE. >> SORRY ABOUT THAT.

>> I AM SORRY TOO. >> ANYWAY, WITH THAT BEING SAID AS YOU GUYS ARE AWARE DESPITE THE FACT THE PLANNING BOARD DID NOT HOLD MY QUASI JUDICIAL DID NOT APPROVE ME WE WERE APPROVED FOR FIFTH IN OUR PERMIT AND IT HAS COME TO MY ATTENTION AND TO OTHERS ATTENTION AS WELL THAT THERE HAS BEEN MULTIPLE PEOPLE THAT HAVE BEEN DENIED THROUGH THE PROCESS THROUGH DUE PROCESS.

THEY HAVE NOT GOTTEN THE PROPER SITUATION WHERE THEY ARE ABLE TO BE HEARD AND IN OUR CASE WE HAVE MULTIPLE TIMES ASKED THE PLANNING BOARD AND ALSO IN CONJUNCTION WITH THE COMMISSIONERS AND MAYOR TO REMAIN AND REVISIT WITH THE EIGHT CONDITIONS. YOU GUYS ARE AWARE OF THE EIGHT CONDITIONS. BECAUSE, IT APPEARS THAT THE CITY COMMISSIONERS AND THE MAYOR REFUSED TO MEET WITH US WHICH IS NOT LEGAL FOR RESIDENTS. IN THE END I AM PUTTING IT ON THE RECORD THAT I WILL BE PRESENT, I WILL BE SPEAKING.

I EXPECT MY CASE TO COME BACK IN FROM THE BOARD WITH REGARDS TO DEADLINES AND EXTENSIONS. I ASKED FOR SOMETHING VERY SIMPLE AND IT APPEARS THE PLANNING BOARD CANNOT COMPLY WITH IT. I HAVE TALKED TO OTHERS IN I WILL CONTINUE TO GO IN A PUBLIC FORUM BECAUSE I WANT TO GET THIS ON THE RECORD I HAVE SPOKEN TO EIGHT OR NINE RESIDENTS TODAY THAT IT HAD THE SAME ISSUES AND PROBLEMS. FOR SOME REASON YOU ALLOW CERTAIN PEOPLE TO GO THROUGH LIKE OCEAN, THEY ARE SELF REGULATED ACCORDING TO LINDA COX. THEN YOUR PEOPLE LIKE US WHERE WE ARE RESIDENTS AND YOU KNOW MY CAUSE.

I HAVE SPOKEN ABOUT IT A MILLION TIMES.

EVERYONE KNOWS WHAT I AM DOING. AND I CAN'T GET ANYTHING FORWARD. IT IS LIKE A HURDLE AFTER HURDLE. MR. BRODERICK JUST FOR YOU PERSONALLY WE HAVE SPOKEN WITH TALLAHASSEE AND I KNOW YOU WERE CONCERNED ABOUT THE FIRE SPRINKLERS IN REGARDS TO RESIDENTIAL'S WITH EXISTING BUILDINGS.

I'M PUTTING ON THE RECORD IS CHAPTER TEN.

THIS HAS COME FROM TALLAHASSEE IN IT IS NOT APPLICABLE TO RESIDENCES. JUST FYI.

WE ARE GOING TO HAVE AN OPEN LINE AND I WILL SHARE IT WITH EVERYONE AT THE PLANNING BOARD AND THE CITY COMMISSIONERS AND THE MAYOR. THANK YOU.

>> THANK YOU. >> THERE ARE NO OTHER PUBLIC SO

[8. DIRECTOR'S REPORT]

I WILL MOVE ON TO A NEW ITEM ON OUR AGENDA.

THE DIRECTORS REPORT. >> GOOD EVENING.

I JUST WANTED TO LET YOU KNOW THAT FROM HERE GOING FORWARD AT THE MEETINGS WILL BE INCLUDING A DIRECTORS REPORT SO THAT BOTH MYSELF AND STAFF CAN KEEP YOU ABREAST OF PLANNING ACTIVITIES THAT WE ARE UNDERGOING. THIS WEEK I HANDED EVERYONE A FLYER. WE ARE HAVING OUR COMMUNITY MEETING AND EVERYONE IS WELCOME TO ATTEND.

SO THAT WILL BE THIS THURSDAY FROM 6:00 P.M. TO 8:00 P.M. AT THE RIVERWALK. THAT WILL BE AN INFORMAL MEETING JUST TO GET INPUT AND INTRODUCE MYSELF AND STAFF AND SEE WHAT SOME OF THE ISSUES ARE WITH THE AREA, THAT HISTORIC DISTRICT AND TALK ABOUT SOME OF THE CURRENT REGULATIONS IN PLACE.

THE ACTUAL BOUNDARY AND HOW IT MATCHES UP WITH THE LAND DEVELOPMENT REGULATIONS. AND INTRODUCE SOME PUBLIC ELEMENTS TO THE TOWN THAT CREATES A SENSE OF PLACE FOR THE DISTRICT. WE WELCOME ATTENDANCE AND WE WILL HAVE REFRESHMENTS ALSO. SO WE ARE LOOKING FORWARD TO

THAT. >> LAST MONTH, I THINK THAT IS GREAT. MAYBE YOU HAVE SOMETHING YOU

WANT TO SAY -- >> NOTE, IS THE MEETING GOING TO

BE ABOUT WOULD BE MY QUESTION. >> SO, WE WERE ASKED, THE PLANNING STAFF WAS ASKED BY A RESIDENT IN THE COMMUNITY BECAUSE THERE WERE SOME ISSUES AT THAT POINT.

THERE WERE SOME COLD AND BUILDING CODE AND BUILDING VIOLATIONS. JUST OVERALL MAINTENANCE OF SOME OF THE PROPERTIES THEY DID NOT HAVE CONTROL OVER AND WANTED TO HAVE A FORUM FOR DISCUSSION. IT IS A VERY COMMON PRACTICE IN

[01:10:01]

PLANNING TO DO THESE DESIGNS TO WHERE THE CONVERSATION ISN'T ALL ABOUT NEGATIVE THINGS BUT ACTUALLY SOLUTIONS.

SO IN ORDER TO DO THAT, IT IS AN INTERACTIVE FORUM.

THAT IS WHAT WE ARE PLANNING ON DOING.

WE WILL HAVE BOARDS, WE WILL HAVE ITEMS WITH OUR THINGS THAT ARE CURRENTLY GOING ON IN THE REGULATIONS ARE THEY HELPFUL, DO THEY NEED TO BE REVISITED, THE CITY IS UNDERGOING SOME STREET SIGNS THROUGHOUT DIFFERENT DISTRICTS.

WE WANTED TO INTRODUCE WHAT WE ARE PROPOSING.

WE WANT TO TALK ABOUT POTENTIAL LOGOS FOR THE AREA.

LINKIN PARK HAS THEIR SPEAR WHAT DOES THIS SOUND WANT TO SEE.

AND TO GET A LIST OF SOME ISSUES AND HOW WE CAN ADDRESS THEM.

THE COMMUNITY IS SEPARATED BY SEAWAY.

HOW CAN WE CREATE A DISTINCT AREA.

THERE ARE SOME VACANT PROPERTIES.

WE WOULD LIKE TO SEE THAT AND BLAMED THE COMMUNITY WITH WHAT WILL BE HAPPENING WITH KINGS LANDING AND DOWNTOWN.

WE WILL TALK ABOUT THE STREETS, MAYBE SOME LANDSCAPING OPPORTUNITIES. REALLY ENHANCING OUR PUBLIC SPACES. EXAMPLES BUT WITH OTHER COMMUNITIES HAVE DONE THAT ARE SIMILAR IN NATURE.

JUST GET SOME THOUGHT PROVOKING IDEAS.

IT WON'T BE THE LAST. WE HAVE A SURVEY ONLINE WHERE YOU CAN GO IN AND OFFER SOME IDEAS.

WE WILL HAVE A SUBSEQUENT WON BASED ON THE INFORMATION WE GET FROM THE COMMUNITY. AND WITH LINKIN PARK WE DID A SIMILAR EXERCISE. IT WAS BEFORE MY TIME.

BUT ALL OF THE INFORMATION GATHERED BY STAFF, IT WAS HELD BACK IN APRIL, HAS NOW BEEN PUT ON PAPER AND WE ARE CREATING A CONCENTRATED AREA WHERE WE ARE TAKING A LOOK AT POTENTIAL MASTER PLANNING FOR THE AREA. WE WILL DO SOMETHING SIMILAR.

BUT OF COURSE IT WILL BE SMALLER.

>> OKAY. >> MR. CHAIR, JUST A QUICK QUESTION RELATIVE, I THINK WE ARE MISSING A LINE ITEM.

ISN'T THERE USUALLY BOARD COMMENTS.

>> IT IS ON THE BACK. >> WE DON'T HAVE A BACK.

>> YOU DIDN'T PRINT IT. >> I'VE BEEN FLIPPING THIS OVER

AND OVER. >> YOU DON'T GET TO MAKE

COMMENTS. >> ONE OTHER THING I WANT TO MENTION. OUR CONSULTANTS, OUR PLANNING CONSULTANTS ARE COMING TOMORROW FOR A LUNCH MEETING TO TALK ABOUT THE HOURS COMING UP THAT ARE BASED ON THE APPRAISER REPORT. AND ALSO THE MASTER PLAN FOR

DOWNTOWN. >> DO WE GET AN UPDATE THAT THE

NEXT PLANNING BOARD MEETING. >> I WILL BE HARD FOR FOR NEXT

MONTH. >> VERY GOOD.

>> LAST MONTH I REQUESTED AN UPDATE REGARDING THE ALCOHOL BEVERAGE ORDINANCE. I HAD A QUESTION TODAY BY A POTENTIAL BUSINESS OWNER SOMEONE INTERESTED IN OPENING UP A BEVERAGE FACILITY. SO I WENT BACK TO THE ORDINANCES AND IT REMINDED ME WHEN I DID THAT OF A SITUATION WE HAD IN FRONT OF THE PLANNING BOARD WITHIN THE LAST COUPLE OF YEARS.

WHERE A, NURSERY SCHOOL, WANTED TO OPEN NEXT DOOR TO A FACILITY THAT WAS ALREADY SELLING ALCOHOLIC BEVERAGES.

WHEN I POSED THE QUESTION TO THE PLANNING DIRECTOR, AS TO WHY WE WOULD BE IN A SITUATION WHERE WE COULD APPROVE THIS CHRISTIAN NURSERY SCHOOL TO OPERATE NEXT DOOR TO A BEVERAGE FACILITY, BUT WE COULD NOT DO THE REVERSE. THE ANSWER WAS NOTHING IS IN THE ALCOHOL BEVERAGE ORDINANCE THAT SAYS YOU CAN'T.

AND SHE WAS RIGHT. AND I QUESTIONED THE WISDOM IN

THAT. >> ARE YOU SPEAKING OF JUST

SELLING OR A RESTAURANT? >> WHETHER IT IS A RESTAURANT OR OTHERWISE. IF I -- IF THERE IS A CHURCH

[01:15:03]

ESTABLISHED HERE AND I WANT TO TAKE THIS, WHETHER IT IS A RESTAURANT OR CONVENIENCE STORE SELLING ALCOHOLIC BEVERAGES, I HAVE TO GET A CONDITIONAL USE IF I AM WITHIN 1500 FEET.

>> IT IS DIFFERENT FOR LIQUOR STORES OR RESTAURANTS.

>> BUT IF I AM A CHURCH OR A NURSERY SCHOOL, I CAN OPEN RIGHT NEXT DOOR TO A PLACE ALREADY SELLING ALCOHOLIC BEVERAGES WITH NO QUESTIONS. I AM QUESTIONING THE WISDOM IN THAT. AS WE GO INTO THIS REVIEW OF THE ORDINANCE THAT PERHAPS WE SHOULD BE REVIEWING THE WISDOM IN THAT ORDINANCE IN TERMS OF A FLIP-FLOP ARRANGEMENT FROM SCHOOLS, CHURCHES NURSERY SCHOOLS, I GUESS IT ALL FALLS

UNDER SCHOOLS. >> IF I MAY.

WE ACTUALLY DID HAVE A WAIVER OF DISTANCE ON THE AGENDA FOR THE COMMISSION MEETING THIS WEEK. AND WE HAVE BEEN CHARGED, WE DID OUR PRELIMINARY REVIEW, A NUMBER OF CITIES AND COUNTIES AND EVERYONE HAS REGULATIONS OF SOME KIND.

THERE ARE MANY THAT HAVE EXCEPTIONS TO THE RULE.

THE FLIP-FLOPPING THAT YOU JUST SPOKE OF WAS NOT IDENTIFIED BUT WE WILL DEFINITELY TAKE A LOOK. WE WERE ASKED TO DO A MORE THOROUGH ANALYSIS AND COME BACK WITH WHAT WE ARE RECOMMENDING.

>> YOU ARE LOOKING AT THE STATE ORDINANCES QUICK STANCH THE STATE DOES NOT REGULATE FOR THE LAND USE.

THE STATE JUST REGULATES THE LICENSING.

>> OKAY. >> I AM JUST INTERESTED TO SEE IF THERE WAS SOME WAY WE COULD LOOK AT THIS AND IF YOU CAN'T DO WON WHAT CAN YOU DO THE OTHER. I GUESS THAT IS WHERE I AM COMING FROM. TO ME THE WISDOM JUST ISN'T

THERE TO SUPPORT IT. >> A DEVIOUS PERSON, COULD OPEN A RESTAURANT AND THEN OPEN A CHURCH IN THE SAME BUILDING TO MOVE OUT FUTURE COMPETITION. IT'S ALMOST THE CREATION OF OPENING A CHURCH IN THESE AREAS TO PREVENT OTHER ALCOHOL FOR

BUSINESSES COMING IN. >> I GUESS THAT IS THE REASON FOR THE REWRITE. IT IS NO LONGER THE TRADITIONAL

HALF OF THE BLOCK. >> CERTAINLY --

>> IS LIKE COMING INTO SHOPPING CENTERS.

>> I THINK COMMISSIONER ALEXANDER SAID IT BEST WITH ALL OF THE CHURCHES WE HAVE IN FORT PIERCE, EVERYBODY OUGHT TO BE ANGELS. I HAVE TO BE CAREFUL HOW I --

[9. BOARD COMMENTS]

TANGIER. >> I HAVE ONE ISSUE THAT I WOULD

LIKE TO BRIEFLY TOUCH ON. >> SO YOU WANT TO GO INTO BOARD

COMMENTS. >> WERE ALREADY ON BOARD

COMMENTS. >> CHAIRMAN COMMENTS.

>> RECENTLY THE HISTORICAL PRESENTATION BOARD WAS DEALING WITH A CHALLENGING ISSUE RELATIVE TO THE BOSTON HOUSE IN TOWN. THEY HAD COME BEFORE THE BOARD ON SEVERAL OCCASIONS TO DO SOME EXTERIOR MODIFICATIONS AND IT WAS CONTINUOUSLY EITHER DEFERRED OR VOTED DOWN.

SUBSEQUENTLY I MUST RECOGNIZE THE PLANNING DEPARTMENT FOR COMING UP WITH THE IDEA OF HAVING AN ON-SITE VISIT TO THE PROPERTY WHICH WAS NOTICED AND STAFF LEAD THE DISCUSSION WITH THE OWNERS OF THE PROPERTY AND MULTIPLE PEOPLE ON THE BOARD.

WE WERE ABLE TO VISUALIZE THE ISSUES THAT THEY WERE CONFRONTED WITH AND DIGEST THE INFORMATION AND COME UP WITH A WORKING PLAN THAT WAS VERY EFFECTIVE IN MAINTAINING THE HISTORICAL NATION -- NATURE OF THE PROPERTY RELATIVE TO COMPLIANCE.

MY COMMENT TO THIS IS SIMPLY, I FOUND THAT IT WAS A VERY WORTHWHILE EXPEDITION TO AN ON-SITE PROJECT.

I WOULD JUST SUGGEST IN THE FUTURE THAT THIS MAY BE A MECHANISM THAT THE PLANNING BOARD MAY BE ABLE TO EMPLOY AS WELL FROM COMPLICATED ISSUES THAT REALLY WITH EYES ON CERTAINLY WOULD BE BENEFICIAL. I GUESS I AM SAYING IT WAS A GREAT CONCEPT AND EXECUTION. IT WAS ONE 100% SUCCESSFUL FOR THE CITY, FOR THE DEVELOPERS. IT WAS A WIND WIN ALL OF THE.

I AM HOPEFUL THAT WITH THE LARGE PROJECTS WHERE YOU NEED MORE

[01:20:05]

THAN PAPERWORK, THAT THIS IS A MECHANISM WE CAN DEPLOY FOR THE PLANNING BOARD AS WELL. I THOUGHT IT WAS GREAT.

IT WAS VERY EFFECTIVE. >> I THINK THE HANDS-ON, WE WILL BE ABLE TO SEE IT AND FEEL IT AND TAKE A LOOK AROUND.

WHAT ARE THE USES AROUND THE SITE AND HOW DOES IT FIT IN.

IT IS A FIRST STEP FOR US AS PLANNERS.

WE LOOK AT THE SITE. WE VISUALIZE IT.

IT REALLY HELPED WITH THAT. >> I THINK IN MORE COMPLICATED CASES, I KNOW THE MEMBERS ARE OUT AND VISIT EVERY PROJECT.

BUT ON THESE MORE -- >> THEY ARE PUBLICLY NOTICE

PERIOD THE PUBLIC AND BE THERE. >> WE INTERACT WITH THE DEVELOPMENT PEOPLE. I KNOW THE CITY ATTORNEY IS GIVEN IT THEIR BLESSING. I'M NOT SAYING EVERY ISSUE --

MIKE. >> AND WITH HISTORIC PRESERVATION THE REASON WHY WE COULDN'T DO IT WITH THE SECOND IS THAT THE APPLICANT HAD ISSUES TOO.

BUT WITH UNDEVELOPED LAND AND GIVEN THE AUTHORIZATION --

TRACK. >> I SAW A LOT OF BENEFIT TO IT.

I'M JUST LETTING YOU KNOW I THOUGHT IT WAS A GREAT IDEA.

>> I THINK IT WOULD BE A GREAT CONCEPT AND PARTICULARLY WITH THE UPCOMING SITE, THAT WILL BE A MASSIVE PROJECT COMING UP.

YOU WILL BE IMPORTANT TO THE CITY.

THIS BOARD WILL SEE IT. I DON'T THINK IT IS SOMETHING WE

SHOULD TAKE LIGHTLY. >> GREAT JOB.

THAT WAS REALLY PHENOMENAL. >> ANY OTHER COMMENTS.

>> I NOTICE WE HAVE A NEW ATTORNEY.

>> WOULD YOU INTRODUCE YOURSELF. >> I HAVE TO APOLOGIZE.

I WAS GOING TO INTRODUCE THIS LOVELY LADY AT THE BEGINNING OF THE MEETING AND I FAILED TO DO THAT.

EVEN AFTER I GOT THE CORRECT SPELLING OF YOUR NAME.

I DIDN'T DO ANYTHING FOR YOU AND I APOLOGIZE.

BUT WE HAVE YOU HERE. WHY DON'T YOU GO AHEAD AND

INTRODUCE YOURSELF. >> VERY WELL.

MY NAME IS TONYA. I AM AN ATTORNEY.

>> WELCOME. >> GLAD TO BE HERE.

>> TONYA HAS BEEN HERE WITH US GETTING CLOSE TO ONE YEAR I

THINK. >> ABOUT SIX MONTHS.

>> I THOUGHT IT WAS LONGER THAN THAT.

>> NO, SIR. >> TIME JUST GOES BY FOR ME.

YESTERDAY WAS JANUARY 1, 2019. THAT GIVES YOU AN IDEA.

>> ARE WE GOING TO RETAIN HER AS OUR ATTORNEY?

>> NO, I THINK IT DEPENDS ON WORK LOAD AND PERSONALLY WHAT IS

GOING ON BETWEEN YOUR LIFE. >> I SPOKE WITH HER EARLIER.

>> TONYA DOES A PHENOMENAL JOB. I HAD AN OCCASION TO SIT AND TALK TO HER. VERY IMPRESSIVE YOUNG LADY.

I SPOKE WITH PETE AND HE THINKS THAT HE DIDN'T MAKE THE RIGHT HIRES IS WHAT HE TOLD ME. THAT SOUNDS GOOD DOESN'T IT.

>> THANK YOU MR. BURGE. >> ANY OTHER COMMENTS OR

DISCUSSIONS? >>
